The Elgin Board of Health regular meeting was held on
Monday, January 12 , 1998 in the lower level conference room
at City Hall . The meeting was called to order by Chairman
Hirsch at 7 : 33 p.m.
Gus Stuart made a motion to accept the Minutes from the
July 14, 1997 meeting (there was no meeting in October) .
Seconded: Harriet Ward. Motion carried.
REVIEW 3RD AND 4TH QUARTER INSPECTION REPORTS
Paul Slaby gave a detailed report of the 3rd and 4th
quarter inspections . New food service establishments
include Baskin Robbins on Summit Street, La Rosita
Groceries on Villa Street, San Marcos Restaurant on Villa
Street, Schlotzsky' s Deli, A Private Affair, The Mission
(nightclub) on Chicago Street, Pasta for You By Sue on
North State Street, Cuisine America on Bluff City Blvd,
Amoco McDonalds on St . Charles Street and Ararak (bagel &
coffee cart) Big Timber Road office building.
Food service establishment closings include Everything' s
Pecan and St Charles Street Amoco (which was demolished and
rebuilt) .
Plans were reviewed for a Citgo/7-11 on East Chicago Street
and Ameritech Cafeteria.

January 12 , 1998
Gus Stuart asked what kind of smoking complaints had been
received by the department. Paul Slaby related events
leading to a complaint about smoking at one of the local
private schools . Paul stated that the problem should be
resolved next week, when smoking in the building will be
prohibited.
The weed cutting program and swimming pool inspections were
discussed.
REVIEW MOSQUITO ABATEMENT CONTRACT
Mr. Slaby explained the mosquito abatement program and the
upcoming contract renewal with Clarke Environmental
Mosquito Management, Inc. A copy of the proposed Agreement
was distributed for further discussion.
After some discussion, Gus Stuart made a motion the Board
recommend approval of the proposed Agreement with Clarke
Environmental Mosquito Management, Inc. , for 1998 and 1999 .
Harriet Ward seconded. Yeas : 5 Nays : 0 Motion was
carried.
There being no further business to discuss, the meeting was
adjourned at 8 : 14 p.m.

The Elgin Board of Health regular meeting was held on
Monday, April 13, 1998 in the lower level conference room
at City Hall . The meeting was called to order by Chairman
Hirsch at 7 : 34 p.m.
Mr. Stuart made a motion to accept the Minutes from the
January 12 , 1998 meeting. Seconded: Ms . Demuth. Motion
carried.
PROPOSE AMENDING MASSAGE ORDINANCE TO ELIMINATE
BATHING FACILITY REQUIREMENT
Mr. Slaby gave members of the board background information
on massage facilities and the proposal to eliminate bathing
requirements .

Warreen Phillips gave an explanation of the different types
of massages and stated that showering/bathing facilities
are not necessary. She further stated that her building is
on a slab and it would not be financially feasible to
provide showers . Ms . Phillips also questioned the "Out
Call" requirements in the ordinance that would make the
practice illegal for most people. She has provided
services as an Aromatherapist and Herbalist for five years .
Michelle Matlock stated that their clients would not want
to shower after their massage. Clients are allowed to
change in the treatment rooms and their belongings stay
with them, eliminating the need for dressing rooms and
lockers .
After some discussion Dr. Hirsch stated that he would have
no problem modifying the ordinance to exclude bathing
rft. facilities, dressing rooms and lockers .
Mr. Hirsch made a motion to delete section 6 . 31 . 110 under
Facilities Necessary, paragraphs 1, 2 and three from the
massage ordinance. Dr. Stockman seconded. Motion was
carried.
Further discussion centered around the "out call" section
of the ordinances . Dr. Hirsch asked Mr. Slaby to discuss
the matter with the City' s Zoning Officer to find out if
this type of operation can be conducted from a residence,
prior to taking any action to change the ordinance.
Mr. Slaby will also notify those present when this matter
comes before the Committee of the Whole for consideration.
REVIEW DRAFT NOISE ORDINANCE
After reviewing the proposed noise ordinance, some members
questioned the wording in paragraph B on page three,
specifically "the next 7 : 00 p.m. " Dr. Hirsch asked Paul to
get some clarification on this wording.
Clarification is need under Section 5 paragraph A on page
three and continuing to page four. The language is very
confusing.

Also, it was suggested that Section 9 on page six be
eliminated, because it would be impossible to enforce.
Mr. Slaby will check on these matters and report back at
the next meeting.
REVIEW DRAFT LIGHTING ORDINANCE
The lighting ordinance was briefly discussed. Dr. Hirsch
stated that there is a need for limits, but you also need
to be able to enforce whatever code. He further stated
that paragraph A on page 5 (under 2 . 6 Prohibitions) should
be eliminated. No decisions were made.
MISCELLANEOUS
Responding to a letter received by his office from Mr. &
Mrs . McGowan, Mr. Slaby requested input from the Board as
to whether the current smoking ordinance needs to be
rok revised to make it a little stronger.
Ms . Demuth wanted to know how any changes in the ordinance
would be enforced. Mr. Slaby responded that any changes
would target the establishment owner. After some
discussion, the consensus was that the current ordinance is
adequate. Dr. Hirsch will draft a letter to the McGowans .
There being no further business to discuss, the meeting was
adjourned at 8 :45 p.m.

The Elgin Board of Health regular meeting was held on
Monday, July 13, 1998 in the lower level conference room at
City Hall . The meeting was called to order by Chairman
Hirsch at 7 : 31 p.m.
Dr. Hirsch made a correction to the Minutes from the April
rik 13th meeting, changing the term "call out" to "out call . "
Mr. Stuart made a motion to accept the Minutes from the
April meeting as corrected. Seconded: Mr. Whitcomb.
Motion carried.
NOISE/LIGHTING ORDINANCES
Mr. Slaby stated that he was working with the Parks,
Engineering and Planning Departments to develop a draft to
submit to the Corporation Counsel . He hopes to have
something by the October meeting.
OTHER BUSINESS
The massage ordinance is on the Committee of the Whole
Agenda for Wednesday, July 15th.
Mr. Stuart submitted a complaint about a house on the
southwest corner of West Chicago and Monroe that is half
burned and has a tarp over a portion of the roof . Also, an
unlicensed vehicle on the northeast corner of Van and
Moseley Streets .

Ms . Ward questions the hand washing facilities at the
upcoming Elgin Fest. Mr. Slaby stated that he would make
sure that there are adequate hand washing facilities .
There was some discussion regarding a complaint about
pigeons . Mr. Slaby reported that the problem will be
resolved when the owners move in November.
There being no further business to discuss, the meeting was
adjourned at 8 : 12 p.m.

The Elgin Board of Health regular meeting was held on October
19 , 1998 in the lower level conference room at City Hall . The
rft meeting was called to order by Chairman Hirsch at 7 : 33 p.m.
Dr. Hirsch made a correction to the Minutes from the July 13th
meeting, deleting the term "something" regarding the
noise/lighting ordinances . Mr. Stuart made a motion to accept
the Minutes from the July meeting as corrected. Ms . Demuth
seconded the motion. Motion carried.
THIRD QUARTER REPORTS
Mr. Slaby gave a detailed report of the third quarter
inspections . Newly opened food service establishments and
retail food stores during this quarter were the Asia Inn,
Speedway on Dundee Avenue, The Coffee Shoppe and 7-11/Citgo on
Chicago Street . Food service and retail food businesses that
closed were Kimball 66, Dos Rios , 7-11 on Chicago Street,
Butternut Bread and Carniceria Guerrero. El Parasio and Al ' s
Cafe were closed for 24 hours . Paul reviewed four plans and 99
properties were sent to the cutters .
NOISE ORDINANCE-, -
The second revised noise- ordinance which incorporates
provisions of the Illinois Pollution Control Regulations was
presented to the board. After some discussion, Dr. Hirsch
motioned to approve the Noise Ordinance as written exclusive of
typographical errors upon approval by the Illinois
Environmental Protection Agency. Ms . Demuth seconded the
motion. Yeas : 5 Nays : 0 The motion carried.

OTHER BUSINESS
Mr. Bohner discussed the weed cutting program for 1998 . He
stated 1, 011 complaints were received by the health department
regarding tall weeds and grass to date. This is an increase of
20% from 1997 . Of these complaints, 396 ( 39% ) were invalid.
The health department has forwarded 238 properties to the
cutters for compliance which has cost the City $23, 137 . 95 . Of
that amount, $6, 243 is not reimbursable since these are either
City owned properties or properties ordered cut by the Director
without proper notification to the property owner.
With no further business to discuss, the meeting was adjourned
at 8 : 11 p.m.
