June Wooten Cmmr.Alvaro Fernendez Staff: Tim Bennett Guest: Christopher Hughes The meeting was called to order at 5:0o p.m.by Chair Aagesen Approval of the Minutes Chief Lalley made a motion to approve October 18,2018,and December 20, 2018 minutes. It was seconded by Chief Schmidt. Motion carried 3-0. Discussion on Police testing process Staff Liaison gave an update on the police hiring process. Notified that the police application process will open on March 1, 2019. We had discussed that Police Chief Lalley and the police department is going to go before the City Council on February 13, 2019 to make changes to the Police ordinance for new hires. The department is recommending the following changes/additions: • Change the requirement for hire from needing 60 credit hours of college and being a CSO with 3 years of employment to 60 credit hours of college and being a city employee with 3 years of employment. The Chief also discussed the police Open House event that the department was hosting on February 16, 2019 from 10 am to 12 pm. They were hoping to gain more exposure for police recruitment and help with the new recruitment that is coming up. Tim announced that the police test would begin March 1, 2019 and be open until April 26, 2019. Executive Session At 5:17 p.m. Chair Aagesen made the motion,seconded by Fire Chief Schmidt to adjourn to executive session to discuss a police officer candidate currently on the eligibility list. Motion carried 3-0. Returned to open session at 5:57 p.m. Chief Lalley made the motion, seconded Chief Schmidt to postpone making an offer to the police candidate until we can get further information about his background and make a determination at the next Fire and Police Board meeting. Motion carried 3-0. Adjournment Chief Lalley made the motion, seconded by Chief Schmidt to adjourn the meeting at 5:58 p.m. Motion carried 3-0. Tim Bennett Staff Liaison Approved: 2/21/19 Board of Fire&Police Commissioners 2nd Floor Conference Room/South Tower January 17, 2019 5:00 p.m. Executive Session Present: Chair Aagesen David Schmidt, Fire Chief Ana Lalley, Chief of Police Staff: Tim Bennett Guest: Christopher Hughes Chief Lalley discussed the background investigation on police candidate Matthew Szoke. As part of the investigation an integrity interview is conducted. Detective Christopher Hughes was the one assigned to Matthew Szoke. Chief Lalley stated that the department was waiting to receive a waiver from our legal department to contact Carpentersville and get Matthew's background investigation from them. We were able to get a release from Matthew and Carpentersville was able to share his background. Det. Hughes discussed that he discovered Matthew participated in marijuana usage between 2013 &2014. He was also participating in Adderail usage without a prescription during 2013. He admitted to purchasing and using marijuana in recent past as well. He did not disclose this information during his initial integrity interview. We received a report from Hampshire that was in the Carpentersville report. Matthew had only requested Hampshire reports pertaining to speeding, but additional reports from Hampshire showed that there additional contacts with the police department there. In the report it revealed that he was with people during the time that they were stealing items. He did not participate in the stealing,but never disclosed to Elgin that he was present during this activity when our integrity interview asks questions relating to this type of behavior. An additional report was obtained from Algonquin Police Department. It showed that Matthew was part of a YouTube prank at a Target where a group was touching the backs of customer's heads with their phones and the phones made the sound of a razor cutting hair. The individuals filmed the encounters while laughing and joking about the prank. This happened on 4/4/14 and was never disclosed to the detective during the integrity interview. A recommendation was given by Chief Lalley to remove Matthew Szoke from the list based on the activities he has done and for not disclosing it during the integrity interview when he was asked about such behavior. Chair Aagesen ask what questions on the integrity interview would be asked where Matthew would not have answered. He has made it through the psychological portion of the process,but we had received information with regard to his background investigation and need to get information before we could continue with the hiring process. The Chief stated that our detective had heard from another detective from Carpentersville that Matt Szoke had been removed from r their list due to reasons that he did not have in our background investigation. The original background investigation was done on July 25, 2018. Our updated investigation was conducted in December once we anticipated we had an opening. During the updated investigation the detective asked Matt Szoke about any additional information that his original background may not have had in it and to disclose any information now. The detective had obtained information from Matt's release from Kane County Juvenile Detention Center position. 'His employer that he was released for over sharing. They stated the he: • . Talk to detainees about wine under his breath • He stated he was :Jazzed" about seeing fight videos of the detainees • Had a number of safety issues • Stated that Matt told them he would lay down the hammer if necessary • Matt had an aggressive demeanor • He was let go because he was too immature for the position The detective also stated that Matt admitted to using drugs throughout his time in college and used Adderall un-prescribed for a time as well. He did not admit this on the first background check because he did not understand the question at that time. The department has tried to get Matt Szoke's background file from Carpentersville,but they will not release it without a subpoena: Out legal department has been trying to get a hold of their legal department,but no calls have returned. Tim shared his call that he received from Matt. Tim stated.that Matt had called asking if we had gotten any further in getting his records from Carpentersville and if we had made a decision yet. Tim told Matt that he should try to get the records for our department and that we had not ma decision yet. Matt told Tim that he knew he should have said something about the drug use and reason for not being hired by Carpentersville, but misunderstood the question when first asked about it during the intial background investigation. Matt told Tim that he would try and get the file from Carpentersville or sign a release for us to get the records. The Chief asked the Board to pass Matt Szoke until we had more information to make an informed decision. We have openings that need to be filled. The Board agreed and decided to go back into regular session. Chief Lalley made the motion to return to open session at 5:57 p.m. The motion was seconded by Chief Schmidt. Approval of the Minutes Chief Lalley made a motion to approve January 17, 2019 minutes. It was seconded by Chief Schmidt. Motion carried 3-0. Discussion on Police testing process Staff Liaison gave an update on the police hiring process. Notified that the police application process will open March 1, 2019. We had changed the requirements for the position in hopes of attracting additional candidates. Will report how process is going at future meetings. . Executive Session At 5:18 p.m. Chief Lalley made the motion,seconded by Chief Schmidt to adjourn to executive session to discuss a police officer candidate currently on the eligibility list. Motion carried 3-0. Returned to open session at 5:26 p.m. Chief Lalley made•the motion, seconded Chief Schmidt to remove Police Officer candidate Matthew Szoke from the eligibility list based on the background information received from other agencies and the follow up integrity interview. The other question that is asked is if they have taken any illegal drugs or prescription drugs without a prescription in the past. Matthew did not disclose his use of marijuana usage during the initial integrity interview. Matthew only disclosed the drug usage and police contact after we received the reports and he was asked directly. Chief Schmidt made the motion to return to regular session at 5:26 p.m. The motion was seconded by Chief Lalley. Motion passed 3-0. Approval of the Minutes Commissioner Wooten made a motion to approve February 21, 2019 minutes. It was seconded by Assistant Chief Carter. Motion carried 4-0. Discussion on Police testing process Staff Liaison gave an update on the police hiring process. Notified that the police application process had 322 applications to date. The diversity numbers were approximately 48% of applicants claim a status other than white. Discussion was done on the written test process and how the testing was proceeding. Chair Aagesen asked how the Police Explorer program impacted the totals and whether we had numbers on where applicants had heard about the testing process. Staff Liaison told the Board he would follow up once the testing process was complete to give an overview of the process with relation to diversity, advertising and participation results. Discussion on Updating Rules and Regulations Chair Aagesen asked about the wording for the Fire and Police rules in relation to adding the background investigation process for firefighter candidates. Staff Liaison handed out suggested language on what the Board had requested in previous meetings. The wording was to change Rule V, EXAMINTATION FOR ORIGINAL APOINTMENT, Section 6. Oral EXAMINATION: Prior to the oral,examination background investigations for both police and fire candidates shall be conducted by the Elgin Police Department or a designee contracted by the City of Elgin, with the approval of the Fire and Police Board, to perform such backgrounds. After discussion the motion was made by Deputy Chief Young and seconded by Commissioner Wooten to amend the Rules and Regulations as outlined above. Motion carried 4-0. Discussion on Police Testing Process There will be a potential 64 candidates to be interviewed. Background checks on the candidates were completed and dates need to be scheduled. We had 15 candidates that the department would like to remove. Discussion on those candidates will be done in executive session. Dates were discussed for police officer interviews. Tentative dates are set at July 23rd, August 2,4, 5, 12, 13 & 15th. Tim advised that that he would follow up with absent commissioners and send out interview list with dates and time by Friday,July 19, 2019. He detailed the files that came back as flagged due to concerns the background investigations detectives had after conducting the background investigations. - After discussion on all the flagged candidates 15 candidates that were flagged for review were recommended to be removed from,the process. June Wooten Cmmr.Anthony Ortiz David Schmidt, Fire Chief Ana Lalley, Chief of Police Absent: Chair Thomas Aagesen Staff: Tim Bennett The meeting was called to order at 5:03 p.m. by Cmmr.Wooten. Approval of the Minutes Chief Schmidt made a motion to approve July 18, 2019 minutes. It was seconded by Chief Lalley. Motion carried 4-0. Discussion on Police testing process Chief Lalley wanted to discuss the possibility of changing some of the requirements for Police Officer. She stated that we will be hiring very soon and the changes she is proposing will not take effect for this next testing cycle,but would like to implement changes for the testing processes once this testing process is complete. Chief Lalley's proposal is to change the education requirement to a high school diploma and then implement preference points for education beyond the high school diploma. Preference points would be given for a bachelor's degree,Associates,Masters degrees. Additional points toward preference would be given for Elgin residency and military service. -. Cmmr.Wooten asked questions to the Chief as to whether the change in the education requirement would affect the promotional process. Chief Lalley stated that the education requirement would stay the same. Chief Schmidt explained that the change to the educational requirement from requiring college,to only requiring a high school diploma for firefighters has increased the number of applicants,but is too soon to tell how effective it has been with the candidates that have recently been hired. They have not had any issues and the candidates seem to be working out well. Chief Lalley discussed the thoughts of including a'lateral process for the recruitment process. Staff Liaison Bennett will contact other departments to see how they administer the lateral process and how many other municipalities actually have that process. Executive Session At 5:23 p.m. Chief Lalley made the motion, seconded by Chief Schmidt to adjourn to executive session to discuss a police officer candidate currently on the eligibility list. Motion carried 4-0. Returned to open session at 5:35 p.m. Chief Lalley made the motion, seconded Chief Schmidt Cagann to postpone making an offer to the police candidate until we can get further information about his background and make a determination at the next Fire and Police Board meeting. June Wooten Cmmr..Anthony Ortiz David Schmidt, Fire Chief Ana Lalley, Chief of Police Staff: Tim Bennett Chief Lalley discussed the background investigation on police candidate Damon Davies. As part of the hiring process a psychological examination is conducted. The report came back as incomplete due to a question with regards to the candidate's use of marijuana in the past. The candidate admitted to using marijuana in the past and that caused the test to be classified as ineligible. The psychiatrist stated that outside of the admission of use of marijuana in the past he interviewed well and the test would be changing to take marijuana usage into account starting in January of 2020 because of the legal status. After review of the background investigation by the police department it was determined that the question about drug usage in the past was not asked of this candidate. The recommendation by the department was to pass on Damon Davies at this time and follow up with him about his usage of drugs by a detective. Once we get the findings back from the detective we can have Damon Davies re-take the psychological test again in January if he admits to the usage and is forthcoming with information on his usage. If he is truthful he can then retake the psychological test and be considered for potential openings in March if the results come back as passing. The commissioners discussed with Chief Lalley about how the department would bring Damon in and what questions would asked. The Chief explained the process and said that the department and psychologist both felt that if Damon explained himself well and retook the psychological examination again he would most likely pass and can be considered for the position.
