June Wooten Bryan McMahan,Assistant Fire Chief Bill Wolf, Police Deputy Chief Absent: Jeff Swoboda, Chief of Police Staff: Tim Bennett The meeting was called to order at 5:09 p.m.by Chair Aagesen. Approval of the Minutes Assistant Fire Chief McMahan made the motion,seconded by Commissioner Fernandez to approve the December 9, 2015 minutes as presented. Motion carried. 4-0 Discussion on Ordinance for Firefighter testing Tim addressed the Board to let them know what changes were going to be put in place for the upcoming Firefighter test. Discussion was made by the Board members with regard to the current process for background checks on Firefighters. Tim expressed that the Police Department and City Manager's Office had expressed concern of having the Police Department conduct 50-60 background checks on firefighter applicants and the time and money that would be needed. Chair Aagesen expressed concern that background checks should be more in depth than what we currently are doing. He suggested that the Board contact the City Manager's Office directly about their concerns. Tim suggested that a letter to the City Manager can be drafted by the Board and once drafted could be given to the City Manager. Have further discussion Chair Aagesen said that he would draft a letter that the rest of the Board could sign to be given to the City Manager expressing the Boards desire to have more extensive backgrounds conducted on firefighter applicants. A motion was presented to authorize the testing process for fighters. Motion: " The Board authorizes Human Resources to start the process for Firefighter testing with the new requirements that the City Council approved,but prior to the interview the Board requests a definitive answer on the background process for Firefighters." Commissioner Wooten made the motion and was seconded by Assistant Chief McMahan. Motion carried 5-0 Review Rules and Regulations The Board went through the Rules and Regulations and made suggestions and updates to the current rules to included changes made by the City Council and updating of outdated rules that no longer apply. After review of the rules and requesting changes a motion was made by Commissioner Wooten and Seconded by Commissioner Fernandez to approve the rules as discussed. Motion carried 5-0 Executive Session A motion was made by Commissioner Wooten and seconded by Commissioner Ferandez to move into Executive Session at 6:25 p.m. Motion carried 5-0. After returning from Executive Session at 7:18 p.m.a motion was made by Commissioner Wooten and seconded by Assistant Chief McMahon to remove Carl Meyers from the eligibility list for the position of Police Officer. Motion carried 5-0. Adjournment Commissioner Wooten made the motion,seconded by Commissioner Fernandez to adjourn the meeting at 7:227 p.m. Motion carried 5-0 Respectfully Submitted, Tim Bennett Staff Liaison Board of Fire & Police Commissioners 2nd Floor Conference Room/South Tower February 18, 2016 Executive Session Minutes Present: Commissioner Thomas Aagesen Commissioner Alvaro Fernandez Commissioner June Wooten Bryon McMahan, Assistant Fire Chief Bill Wolf, Deputy Chief Staff: Tim Bennett Deputy Chief Wolf discussed the candidate Carl Meyer who is currently on the Police Officer eligibility list. Carl Meyers is the next candidate on the Police Eligibility list for police officer and is having an updated interview conducted. Deputy Chief Wolf expressed concerns that Carl Meyers was not being truthful with the City during a follow-up interview about past terminations from previous positions. After discussion of the different inconsistencies that Carl Meyers had and why it was a concern to hire him for the position of police officer Deputy Chief Wolf requested that he show the Board the video of the interview. After watching the video there was discussion on how Carl Meyers was terminated from 2 previous positions and the inconsistencies in his answers to the reasons why. The Board asked the history of removing candidates from previous eligibility lists. Tim informed the Board that it has been done before and the Board has the authority to review candidates for reasons that show concerns for the character of individuals on the list. Discussion was made about the current list and how we have had a few voluntary terminations from individuals already and 1 termination of an officer during their probationary periods. Commissioner Fernandez expressed his concern for the truthfulness of Carl Meyers and how he believed it went toward his character and how that would reflect on the Elgin Police Department. Chief Swoboda made the motion, seconded by Commissioner Fernandez to adjourn to executive session at 5:10 to discuss personnel. Motion carried 4-0 Returned to open session at 5:13 p.m. Chief Swoboda made the motion,seconded by Commissioner Fernandez to accept the letter of voluntary demotion of Lieutenant Amanda Bruce to the position of Firefighter as agreed and signed by Amanda Bruce, Chief John Fahy and City Manager Sean Stegall. June Wooten Staff: Tim Bennett Chief Fahy brought a request before the Board to accept the voluntary from Lt.Amanda Bruce to be demoted to the position of Firefighter. In the agreement,all participants agreed to a demotion to keep their jobs. All were either demoted or re-assigned to a position of non-authority. The purpose of this meeting is to accept Lt. Bruce's request as signed by herself, Chief Fahy and City Manager Sean Stegall back to the rank of Firefighter. Chair Aagesen questioned whether all procedures had been followed so that there would be no backlash. Chief Fahy indicated that all procedures were followed to the best of their abilities. Tim brought out that one reason for this process was because the rules do no specifically state about voluntary demotions. The Board's responsibility is to approve in-voluntary demotions. This process is just a formality. Approval of the Minutes Commissioner Fernandez made the motion,seconded by Commissioner Wooten to approve the February 18, 2016 minutes as written. Motion carried Chief Swoboda made the motion, seconded by Commissioner Fernandez to approve the April 4, 2016 minutes as written. Motion carried. Update on Firefighter Process Tim provided the ethnicity breakdown on the 267 candidates that took the firefighter examination. Tim will provide the Commission with a report that lists the number of Elgin residents that took the exam. The top 50 candidates will be chosen from the list to proceed to the next step. Discuss Background Check for Firefighters Tim informed the Commission that the company called`Backgrounds online will perform comprehensive background checks on the firefighter candidates. The Police Department will continue to run background checks on police officer candidates. The Police Department will add credit checks to their background checks on potential candidates. The Board indicated that they would like to have a special meeting with the City Manager to discuss the possibility of outsourcing background checks to a private investigator. Commissioner Fernandez made the motion,seconded by Chief Swoboda to table discussion of background checks for firefighters until discussion with the City Manager and Fire Chief. Motion carried. Review Rules and Regulations An approved copy of the rules and regulation was provided to the Board. Discussion ensued around the proposed changes that the Police Department would like to make do the rules and regulations. All but one of the requested changes require an ordinance change. Proposed changes: • Extend probation period on new recruits • Extend probation period due to military leave or sickness • State law rule of three to apply to appointees and promotion • Allow Board the ability to permanently remove a candidate from list due to discipline • Extend probation on promotions • Revert back to state law for maximum age-keep age at 35 without prior experience Deputy Chief Wolf will send the proposed requested changes to Corporation Counsel for review. June Wooten Staff: Tim Bennett The meeting was called to order at 5:45 p.m.by Chair Aagesen. Tim advised that the police testing process was currently taking place and the top 63 candidates needed to be setup for interviews. The background investigations were being conducted and would be completed by the end of the month. Dates were discussed and the following dates were confirmed: September 10, 2016 1:00 p.m.to 5:00 p.m. September 16, 2016 5:00 p.m.to 9:00 p.m. September 21, 2016 5:00 p.m.to 9:00 p.m. September 22, 2106 5:00 p.m.to 9:00 p.m. Once the dates were confirmed, Commissioner Fernandez made the motion,seconded by Commissioner Assistant Chief McMahan to adjourn to executive session at 5:58 p.m.to discuss the Firefighter interview process. All scores were tallied and Tim stated that the scores will be added to the points from the test. Additional points would be added for military and other preference points. Once all the points were tallied Tim would release the list. Interview Training Training was presented to the Commission by the City's law firm, Robert J. Smith,Attorney at Law. Mr. Smith indicated that it was necessary for the City to have up to date job descriptions for each job position and that questions asked during an interview should be presented to each candidate. No medical questions/inquiries may be considered until a conditional offer of employment has been made. The Commission thanked Mr. Smith for providing information necessary and important for the interview process of candidates. Commissioner Fernandez made the motion,seconded by Chair Aagesen to adjourn to executive session to discuss personnel. Motion carried Commissioner Fernandez made the motion, seconded by Assistant Chief McMahan to return to open session at 7:02 p.m. Motion carried. Open Session Deputy Chief Wolf made the motion,seconded by Assistant Chief McMahan to remove candidates)through 6 from the interview process due to negative background information. Motion carried. There was a discussion of interview questions to be used for Police candidates. Tim indicated that he would email the questions for the Police interview process to the Board. After an extensive background check on Mr. Bello, it came to light that he was not truthful in the information that was provided on his application for Police Officer. There was much discussion regarding the failure to disclose pertinent information. Due to the lack of honesty and consistency in the information provided on his application as an Elgin Police Officer,the Board of Fire and Police Commissioners agreed to remove Mr. Bello from the current eligibility list. Deputy Chief Wolf made the motion,seconded by Commissioner Wooten to return to open session at 5:34 p.m. Motion carried. Approval of the Minutes Commissioner Fernandez made the motion, seconded by Assistant Chief McMahan to approve the October 20, 2016 minutes as written. Motion carried Police Lieutenant Requirements There was much discussion of the rules and regulation for the Police Lieutenant promotional process. The Police Department was requesting that the requirement for a Bachelor's degree for Lieutenants be removed as the Sargent's promotion does not require a Bachelor's degree. The Police Department requested that the verbiage be changed to read "can take test without Bachelor's degree,however,to be promoted the individual must have a Bachelor's degree. If no degree,the individual will be skipped and kept placed on the list." The Commission was informed that in order to make a rule change, the information would have to be publicized for one week prior to the change going into effect. In order to take the Lieutenant's exam, an individual must pass the probationary Sargent rk position. Deputy Chief Wolf made the motion, seconded by Commissioner Fernandez to adopt the language as proposed by the Legal Department to require a Bachelor's degree for promotion to the position of Lieutenant. Motion carried.
