Approval of the Minutes
Cmmr. Marshall made the motion, seconded by Cmmr. Shannon to approve the
November 9, 2006 with the following corrections.
Page 2, paragraph 4 should read Chair Camacho inquired if

Educational Requirements for Police Promotional Process
Chief Womack explained to the Board her reasoning for bringing this request to the
Board for discussion. Chief Womack recommended that a Bachelor's degree be
required for the promotional process. She indicated that the January promotional
candidates were considered from among those that do not possess a Bachelor's
degree.
Chief Womack indicated that she supports that new hires and promotional candidates
possess a Bachelor's degree.

Chief Womack suggested that those Officers prior to August 2001 be grandfathered so
as not to be required to possess a Bachelor's degree. She suggested that preference
points are awarded to those candidates who have a Bachelor's degree for Sergeants
and Lieutenants.
Cmmr. Shannon inquired if the Union was in agreement with this recommendation.
Chief Womack indicated that they did not have a contractual agreement.
Chief Womack asked the Board to take action as to whether an Associates degree will
be required or not. She would support and recommend that candidates with
employment prior to 2001 be grandfathered in, 30 credit hours for Sergeants and 60
credit hours for Lieutenants.
Officer Genz indicated that he agreed with the Chief's recommendation. He currently
has 30 credit hours.
Officer Bennet indicated that he has 30 credit hours, but was not sure if he would
proceed with the 60 credit hours to test for the next rank.
The next Sergeants test will be held in April. Study material has already been
submitted. The current promotional testing process consists of:
Written test
Assessment center
Chief's points
Seniority points
Military points
Tim suggested that the Board should make the final determination on the number of
credit hours or if a Bachelor's degree is necessary for the promotional process.
Tim explained that the previous Commission thought that the Bachelor's degree was
required. They allowed candidates to test without a degree, but the candidate must
achieve the Bachelor's degree prior to appointment to be promoted.
Cmmr. Marshall made the motion, seconded by Cmmr. Shannon that a decision on this
issue be tabled until the February 8th meeting, with an anticipated definitive answer at
that time. Motion carried 3-0.
Chair Camacho asked Tim to gather information showing the number of credit hours
that each individual being considered for taking the testing process possesses.
Cmmr. Shannon requested prior minutes dealing with discussion on the testing process.

Police Test Process
The current Police officer list is out of candidates. Applications are now being
advertised for Police officer. The written test will take place on February 24th; the
interview process is set to begin in April.
Adjournment
There being no further business to discuss, Chair Camacho called for a motion to
adjourn.
Cmmr. Shannon made the motion, seconded by Cmmr. Marshall to adjourn the meeting
at 6:36 p.m.

The meeting was called to order at 5:40 p.m. by Cmmr. Shannon.
Approval of the Minutes
Cmmr. Marshall made the motion, seconded by Cmmr. Kethdy to approve the January
11, 2007 minutes as written.
Motion carried 4-0.
Educational Requirements for Police Promotional Process
Chief Womack gave a summary of her request to have the educational process
changed to 30 credit hours or 60 credit hours. She was asking to have the
requirements be the same as or slightly changed from the requirements that were in
place before the Board changed the educational requirement back in 2001. She
explained that she believes that both sides on the argument to change or leave the
requirements the same have valid points. Her recommendation was to grandfather
everyone who was hired prior to 2001, so that they would be required to meet the old
requirements and those going forward, would have to meet the bachelors requirement.
Everyone hired after 2001 has a bachelors degree, because it is part of the current new
hire process.
Chair Camacho stated that the Board wants to be fair to all parties involved. She read
the minutes from 1-13-03 and feels that the action taken by the Board at that time was
appropriate.

Cmmr. Shannon voiced his opinion on the topic. He had concerns that officers were not
making the effort needed to gain a degree. He proposed that officers that were hired
prior to 2001 to have until 2010 to obtain a degree and the testing processes would be
adjusted to allow them to take the test under the old standards.
Discussion ensued about this option and Cmmr. Shannon asked the Commissioners to
voice their opinion on whether to change the rule as leave it as it currently is in the
rules.
Cmmr. Marshall —wants to keep the rule the same.
Cmmr. Kethdy— wants to keep the rule the same.
Chair Camacho —wants to keep the rule the same.
A motion was made to keep the rule that is currently in the Rules and Regulations
stating that a bachelors degree is required to test for the position of Sergeant, remain
the same and not to make any changes at this time. Motion approved 4-0.
Motion was made by Cmmr. Marshall and seconded by Chair Camacho to go into
Executive session at 6:00 p.m. to discuss personnel matters.
Returned to open session at 6:20 p.m.
A special meeting was scheduled for February 16, 2007, at 5:30 p.m to further discuss
pending personnel matters.
Tim Bennett gave an update of the Police new hire testing process that is currently
being conducted.

Rick Kozal gave an update on the pending litigation on the Henry Smith Case. Rick
explained that Greg Welter had won his case with the appellate court and that they
awarded him his position as Lieutenant. Rick explained that Henry Smith did take his
appeal to the Supreme Court to get the decision overturned. The Supreme Court
decided not to take the case, which in effect means that Henry Smith has exhausted
nearly all his options of retaining his position as a Lieutenant. Rick explained that Henry
Smith has 21 days to make one final request to the court, but do not anticipate that
going through. He is requesting that the Board meet again in one week to meet to
make the recommendation to move Greg Welter into the position of Lieutenant and
terminate the employment of Henry Smith.
Cmmr. Shannon asked what this means for Henry Smith in regards to his status with
the City of Elgin.
Rick explained that as of right now Henry Smith has lost his appeal to the Supreme
Court and the Appellate Court. the Court has determined that Welter is entitled to the
position and the City only has a court order to put him in that position. Because of the
court order we have to put Welter in the Lieutenant position. By doing this we must
removed Henry Smith from his position. The City does not have an open position in the
Lieutenant rank or Sergeant rank, thereby forcing Henry Smith to come back as a Patrol
Officer, if he chooses to come back. He currently is out on a disability and that may
result in a claim for a disability pension claim. Currently at this time we are not sure
what Henry Smith will do. He is eligible for a full pension, but will not be eligible to draw
his pension until November.

Discussion ensued about his current status and what Henry may do if he where to be let
go.
Chief Womack gave her prospective from the Police Department and how it is being
handled and what the Department is doing from this point on.
The Board agreed to meet on February 16, 2007, to make the formal vote that is need
to release Henry Smith and promote Greg Welter.

Cmmr. Shannon made the motion and was seconded by Cmmr. Kethdy to go into
executive session at 5:35 p.m.
Returned to open session at 6:57 p.m.
Personnel Matters
Cmmr. Shannon made the motion seconded by Cmmr. Marshall — "I hereby move that
the previous reinstatement of Lt. Henry Smith as a lieutenant with the Elgin Police
Depatement approved by the Board of Fire and Police Commisioners on or about April
16, 2004, and implemented by the City of Elgin on or about April 20, 2004, to the then
open lieutenant position created by the retirement of Lt. Paul McCurtain be vacated and
that Henry Smith's employment with the Elgin Police Department be terminated
effective February 16, 2007 and that Sgt. Greg Welter be promoted to the lieutenant
position created by the retirement of Lt. McCurtain, with such promotion of Greg Welter
to such lieutenant position being effective April 20, 2004, all as set forth in the proposed
Findings and Order before the Board of Fire and Police Commissioners, and that the
proposed Findings and Order be approved, executed and entered by the Board of Fire
and Police Commissioners."

William Cogley discussed the history on Henry Smith's appointment to Lieutenant and
have he was appointed after he cam back from a disability pension. Cogley discussed
Sgt. Greg Welter's suit against the City of Elgin and how he felt he should have been
the next person promoted on the list. The appellant court ordered the promotion of Sgt.
Welter to the position of Lieutenant. William Cogley stated that the Board must make
the recommendation to terminate Henry Smith and promote Sgt. Greg Welter based on
the Courts order. Based on moving Sgt. Welter to the position of Lieutenant, the next
person on the list for Sergeant should be promoted.
Discuss ensued about when to make the promotion of Sgt. Greg Welter effective.
Cogley stated that it would need to be when Lt. Smith was given the reinstatement on
April 20, 2004.
Board members asked whether Welter could be promoted as well as keeping Smith in
his role. Cogley explained that the City has a set number of positions set by ordinance.
By allowing Lt. Smith to move to another slot would open the door for another lawsuit by
the next candidate on the Lieutenants list, with the same reasons that Sgt. Welter used.
Cogley explained that by letting Lt. Smith go, he would not be left without income
completely. Lt. Smith is currently being treated for a work related injury and the City
would continue to pay him until that injury has healed or turns into a long term disability
that causes him to receive a disability pension. He would also be allow to retire in
November with full pension, as he would meet the requirements for that at that time.
Chair Camacho asked if there was any past precedent for this situation. Cogley's
response was that there was not.

Cmmr. Marshall asked why Sgt Welter was not promoted previously and Cogley
reiterated that there was not a time when he could have been prior to the list he was on
expiring.
With no further discussion a motion was made by Cmmr Shannon and seconded by
Cmmr. Kethdy to return to open session at 6:57 p.m.

Election of Chairperson
An election was held for the position of Chairperson. The tally of the ballots were 2 for
Chair Camacho and 2 for Cmmr. Shannon.
After discussion of options for deciding tied ballot, the discussion was to redo the
election at the next meeting.
Cmmr. Shannon made the motion, seconded by Cmmr. Marshall to redo the election at
the next scheduled Board meeting.
Motion carried 4-0.
Other Business
Discussion was brought up in reference to the newly established Citizen Advisory
Committee. Discussion ensued on how the Committee was created and who was

appointed to the Committee. The Board asked that Chief Womack come to the next
Board meeting to discuss the background and purpose of the Citizens Advisory
Committee. Tim said that he would invite the Chief to the next meeting.

The meeting was called to order at 5:35 p.m. by Chair Shannon.
Approval of the Minutes
Cmmr. Kethdy made the motion, seconded by Cmmr. Camacho to approve the July 12,
2007 minutes. The motion carried 3-0.
Discussion of Interview Dates
Tim informed the Commission that there would be 78 candidates to interviewed. The
CPAT test is scheduled for Saturday, October 6th. There are 14 candidates that already
posess their CPAT cards and will not need to go through the process.
The Commission requested to use the conference room at Fire Station 1 for the nine
nights of the interview process.
Interview dates will be: October 22nd, 23rd,
29th and 30th
November 1st5th, 6th 7th and 8th
The October and November meetings will be cancelled due to the scheduled interviews.
The Commissioners were invited to attend the Illinois Fire and Police seminar schedule
for November 2nd through 4th at Indian Lakes Resorts in Bloomingdale, Illinois.
Commissioners are to let Tim know if they are interested in attending.
Executive Session
Cmmr. Camacho made the motion, seconded by Cmmr. Kethdy to adjourn to executive
session at 5:58 p.m. to discuss personnel. The motion carried 3-0.

elk of days of the probationary period for Firefighter Vogel based on the amount of days he
is on leave. The days will be determined upon his return according to the rules and
regulations. The motion carried 3-0.
Adjournment
There being no further business to discuss, Chair Camacho called for a motion to
adjourn.
Cmmr. Kethdy made the motion, seconded by Cmmr. Camacho to adjourn the meeting

Tim brought before the Commission a request from the Fire Department to extend the
probationary period for Firefighter Mike Vogel who was injured on the job. After much
discussion, the Commission agreed to extend the probationary period.

session at 6:04 p.m.

The Board asked that this be discussed in Executive session.

Tim asked that the Board review the rules and regulations that were handed out to
discuss the changes at the next meeting in January.

Board moved to Executive session at 5:33 p.m.
Tim explained the new list that was established for Firefighter. The list had changed
from the one that the Board last seen, as it included Firefighter preferential points.
Tim discussed that points were given to firefighter candidates based on their years of
experience as a full-time firefighter and what certifications they have received. A
candidate was given .5 points for every year that they were a full-time firefighter and
had Firefighter 2 certification and/or paramedic status, up to a maximum of 5 points.
They candidates also received 1 point for every year they were a full-time firefighter and
had a firefighter 3 certification, up to a maximum of 5 points. A candidate could get
points for both scenerios with a total point possibility of 10 for firefighter preference and
a possible 5 additional points for military preference. Tim further explained that when
assigning these points, a candidate can not utilize these points if it would bring them
above a candidate that was utilizing military points.
The Board members asked why this information was not given to them prior to the
interview p[rocess. Tim responded to the Board by saying that the City was not aware
that the points should have been given until after the interviews were completed.
Discussion took place in regard to the process of the distribution of points and how the
points made some candidates rise higher on the list than the Board had hoped that they
would. Discussion continued to address issues of how this process could be improved
in the future and the Board was satisfied with the explaination of the events and
distribution of points.
Cmmr. Kethdy made the motion, seconded by Cmmr. Fulton to return to open session.
Motion passed 3-0 at 6:08 p.m.
