AUTHORIZING EXECUTION OF A FACADE IMPROVEMENT
PROGRAM AGREEMENT WITH JAMES WICKER
(79 S. Grove Avenue)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that
Sean R. Stegall, City Manager, and Diane Robertson, City Clerk,be and are hereby authorized and
directed to execute a facade improvement program agreement on behalf of the City of Elgin with
James Wicker,owner of the property commonly known as 79 S. Grove Avenue, a copy of which is
attached hereto and made a part hereof by reference.

FACADE IMPROVEMENT PROGRAM AGREEMENT
79 South Grove Avenue
THIS AGREEMENT is made and entered into this 17th day of November 12010,
by and between the City of Elgin, Illinois, a municipal corporation (hereinafter referred to as
"City"),and James Wicker,the owner of the property commonly known as 79 South Grove Avenue,
Elgin, Illinois, (hereinafter referred to as "Owner").
WHEREAS,City has established a facade improvement program(hereinafter referred to as
"Program")for application within certain areas of the corporate limits of City designated by City as
appropriate for such application (hereinafter referred to as "Rehabilitation Areas"); and
WHEREAS, Program is administered and funded solely by City for purposes of the control
and prevention of blight, dilapidation and deterioration of Rehabilitation Areas; and
WHEREAS, pursuant to Program, City has undertaken to share the cost of facade
improvements to certain structures within Rehabilitation Area, pursuant to the criteria set forth
herein; and
WHEREAS,Owner owns at least 50%of subject commercial building(s),or is the tenant of
commercial building(s)located within Rehabilitation Area,with owner having provided the owner's
consent and authority to participate in Program pursuant to the terms and provisions of this
Agreement.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein,the sufficiency of which is hereby mutually acknowledged,the parties hereto hereby agree as
follows:
Section 1. The above recitals are incorporated into and made a part of this agreement. The
total approved project costs for the facade improvements for the structure referred to at Section 16
herein shall be $73,420.00, as set forth in Attachment A attached hereto made a part hereof(such
total approved project costs for facade improvements are hereinafter referred to as"Eligible Costs"
and such structure is hereinafter referred to as the"Structure"). The City shall pay the Owner a sum
not to exceed $25,697.00, being 35% of the total Eligible Costs, for facade improvements to the
structure approved pursuant to the provisions of this Agreement. The project shall be confined to
approved improvements made to that part of the Structure visible from any public right-of-way. All
parties hereto agree that all payments from the City provided for herein shall be made to James
Wicker, who shall provide the City with a full release upon receipt.
Section 2. Eligible Costs shall include labor,material and equipment costs, and such other
costs as may be reasonably necessary for the execution and completion of the facade improvement
hereby provided for(hereinafter referred to as the"Work"),as designated from the design drawings,

specifications, and/or scope of work as set forth in Attachment B attached hereto made a part
hereof,and approved by the Project Review Team pursuant to the provisions of Section 3 herein and
prepared by Consultant (hereinafter referred to as "Plans").
Section 3. No Work shall be undertaken or shall be considered to constitute the basis for an
Eligible Cost until the design for such Work has been submitted to and approved in writing by the
City's Project Review Team (hereinafter referred to as "Project Review Team") consisting of the
City's Historic Preservation Planner and City's Senior Planner,and any other member designated on
the Project Review Team. Such design shall include,but not be limited to, a date certain by which
the Work shall be completed. In no event shall such Work be completed more than one hundred
eighty(180)days from the date of this Agreement,without the written consent of the Project Review
Team.
Section 4. The Project Review Team shall be permitted access to Structure to periodically
review the progress of the Work. Such review shall not be in lieu of any other inspections that may
otherwise be required by law or by City. Any and all portions of the Work which do not,in the sole
discretion of the Project Review Team, conform to the Plans or other applicable terms of this
Agreement, shall be made to conform to the Plans and other applicable Terms of this Agreement
upon written notice of the existence of such non-conforming portions.
Section 5. Upon completion of the Work,and upon final inspection and written approval by
the Project Review Team and such other final inspections and approvals as may be required by law,
Owner shall submit to City: (1) an executed,notarized itemized contractor statement reflecting the
total cost of the Work and each portion thereof, including, but not limited to, the cost of labor
(whether provided by any contractor or subcontractor), materials and equipment; (2) copies of all
bids, contracts and invoices submitted, executed or incurred pursuant to the Work; and (3)
reasonable proof of payment of all costs incurred pursuant to the Work.
Section 6. City shall pay to Owner the sum provided for at Section 1 herein within thirty
(30) days of owner's compliance with the provisions of Section 5 herein. In no event shall the
amount paid to Owner exceed the amount specified in this Agreement or in the contractor statement.
Section 7. In the event Owner fails to complete the Work in accordance with the terms of
this Agreement, or otherwise breaches the terms of this Agreement, City may terminate this
Agreement upon written notice of breach and termination to Owner, and any and all financial or
other obligations on the part of City shall cease and become null and void.Additionally,Owner shall
refund to City all money paid to Owner by City pursuant to this agreement upon thirty (30) days
written demand. This provision shall not constitute a restriction on City to pursue any and all other
rights to which it may be entitled by law.
Section 8. Upon completion of the Work,and for a period of five(5)years thereafter,Owner
shall properly maintain the Work in its finished form,without alteration or change thereto,and shall
not enter into any agreement, or take any other steps to alter, change or remove such Work, or to
create or undertake any other Work which may constitute a deviation from the Plans,without prior

written approval from the Project Review Team in its sole discretion.
Section 9. Nothing herein is intended to limit, restrict or prohibit the Owner from
undertaking any other Work in or about the subject premises that is unrelated to the facade
improvement provided for in this Agreement.
Section 10. This Agreement shall be binding upon City and its successors,and upon Owner,
Owner's successors and assigns for a period of five(5)years from and after the date of completion
and approval of the Work. Owner shall provide subsequent Owner(s) of Structure with a copy of
this Agreement. This Agreement shall run with the land underlying Structure.Notwithstanding the
aforementioned five (5) year period, the provisions of Sections 7 and 12 herein shall survive the
termination of this agreement.
Section 11. If Owner does not own the underlying property for which Work is being done,
Owner warrants and represents to City that Owner has a lease at the location for which the Work is
proposed for a term of at least six (6) years. Owner further warrants and represents that he has
received authorization from all owners of the property for which Work is to be done to accept funds
under this program and to undertake the Work. Further, such owner(s) of the property for which
Work is to be done hereby acknowledges that he is aware of this Agreement and authorized the
Work that is to be made to the Structure. Said owner(s)of the property for which improvements are
to be made further acknowledge that,as owner of the property,he is a party to this Agreement and is
bound by the provisions of this Agreement specifically,but not limited to,the provisions of Section
8 of this Agreement. Each"Owner" signature hereto hereby warrants and represents that there are
no other entities having an ownership interest in the Structure, which have not executed this
Agreement.
Section 12. Owner hereby holds harmless and indemnifies City from and against any and all
causes of action,suits,claims for damages,and any and all other liability,which may arise out of or
in connection with Owner's or Owner's agents',employees' and assigns' negligent performance of
any of the terms of this Agreement. In the event the indemnification provisions of this Agreement
are invoked so as to require legal defense of City, counsel for such defense shall be of City's
choosing. The provisions of this section shall survive any termination and/or expiration of this
agreement.
Section 13. This Agreement shall not be construed to create a partnership,joint venture or
employment relationship between the parties hereto.
Section 14. This Agreement shall be subject to and governed by the laws of the State of
Illinois. The parties hereto hereby agree that venue for any and all actions that may be brought by
each and either of them to enforce the provisions of this Agreement shall be in the Circuit Court of
Kane County, Illinois.
Section 15. The terms of this Agreement shall be severable. In the event that any of the
terms or provisions of this Agreement are deemed to be void or otherwise unenforceable for any

reason, the remainder of this Agreement shall remain in full force and effect.

Section 17. Notwithstanding any other provision of this Agreement it is expressly
agreed and understood that in connection with the performance of this Agreement that the
Owner shall comply with all applicable Federal, State, City and other requirements of law,
including, but not limited to, any applicable requirements regarding prevailing wages,
minimum wage, workplace safety and legal status of employees. Without limiting the
foregoing, Owner hereby certifies, represents and warrants to the City that all Owner's
employees and/or agents who will be providing products and/or services with respect to this
Agreement shall be legal residents of the United States. Owner shall also at its expense
secure all permits and licenses, pay all charges and fees and give all notices necessary and
incident to the due and lawful prosecution of the work,and/or the products and/or services to
be provided for in this Agreement. The City shall have the right to audit any records in the
possession or control of the Owner to determine.Owner's compliance with the provisions of
this section. In the event the City proceeds with such an audit the Owner shall make
available to the City the Owner's relevant records at no cost to the City.Owner shall pay any
and all costs of such audit.
Section 18. Time is of the essence of this Agreement.

INITIATIVE E: Facade Improvement Project at 79 South Grove Avenue
COMMUNITY GOAL
■ Alive Downtown. Create a downtown area that is alive and vibrant, and has
made the revitalization of its entire downtown area a top priority
OBJECTIVE
■ Award grants to businesses in downtown Elgin to allow for the redevelopment
of exterior facades including storefront renovation, masonry cleaning and
repointing, window replacement, and restoration of decorative elements
PURPOSE
■ Support local initiatives to encourage private investment in commercial
buildings of downtown through a grant program that offers financial incentives
to businesses to improve the exterior appearance and quality of their buildings
RECOMMENDATION
■ Approve a facade improvement grant to the property at 79 South Grove Avenue
for the restoration of the exterior building facades
BACKGROUND
The Elgin Facade Improvement Program is designed to promote improvements to storefronts in
the city's center core area. Under the Facade Improvement Program, property owners or
business owners within the target area are eligible to apply for grants for work to improve
facades of commercial buildings that are visible from a public right-or-way. These grants are
provided in recognition of the positive impact that individual facade renovations can have on
the overall appearance and quality of their storefronts. Established in 1991, the program has
been instrumental in providing funds for the improvement of over 50 buildings in downtown
Elgin. The program has also been used as a guide by many communities in the region such as
Libertyville and Geneva, Illinois that are in the process of promoting the revitalization of their
downtown areas.
The proposed facade improvement grant application for 79 South Grove Avenue is another
example of how the city's economic development incentives can encourage additional private
investment in downtown Elgin.
The subject property had been vacant and neglected for many years prior to its sale in mid-
September to current owner, Mr. James Wicker. The building, commonly known as Whiskey
Point, dates back to the 1880s, and is located on a prominent corner of downtown where South
Grove Avenue, Spring and Fulton Streets meet. The property essentially has three facades as it
is shaped like a triangle—one on Spring Street, facing east; one on South Grove Avenue, facing
west; and one on Fulton Street, facing south.
In the 1970s, the primary facade facing South Grove Avenue was irreversibly altered. The first
floor level was covered with a layer of dark brown brick and brown cedar paneling, and the
second story windows replaced with ill-fitting windows and later completely boarded up. The
main entrance to the street-level space was closed off and its decorative steel column
concealed under a brick panel containing a front door. Over the past three decades, there have
been a number of short-lived retail and office uses on the first floor and basement levels, and a
residence on the second level. The property has been completely vacant in recent years.
The Downtown Neighborhood Association (DNA) first approached the current property owner,
Mr. James Wicker, with ideas to renovate the building. According to the DNA, an affordable
asking price attracted Mr. Wicker to purchase the property in order to move his engineering
firm to the first level and renovate the second level to a loft-style residence. Upon meeting with
the DNA to learn about the city's downtown grant programs, Mr. Wicker's original renovation
plans were able to expand into a complete interior and exterior rehabilitation project with a
focus on energy efficiency while restoring some of the building's original architectural integrity.
Mr. Wicker's investment in the property is multiplied with the assistance of the Center City
Commercial Retrofit Grant and the Facade Improvement Grant to a total investment of more
than $130,000. Once completed, the property will house Mr. Wicker's company, NW Consulting
Engineers, with 5-7 full-time employees on the first floor and a single loft-style residence on the
second floor.
The complete interior and exterior renovation of this property will not only increase its value
and use, but due to its prominent location, will enhance the perception of downtown in an area
that currently has the greatest potential for improvement and reinvestment.
OPERATIONAL ANALYSIS
Under the requirements of the Facade Improvement Program, a property owner is eligible to
receive 35 percent of the cost of eligible improvements, up to a maximum of$100,000, with an
additional $50,000 provided to high-impact projects. The minimum project cost to participate in
the program is $5,000. Improvements are recommended to be approved in advance, and each
eligible improvement will be funded only once. Architectural services are an eligible cost
funded by the program.
The applicant proposes to make approximately $74,000 in facade improvements to the
property, which includes:

Attachment A contains the details on the proposed scope of work and cost estimates.
INTERESTED PERSONS CONTACTED
DNA has negotiated the proposed facade improvement project with Mr. Wicker on the city's
behalf in accordance with DNA's expanded responsibilities under its 2010 purchase of services
agreement with the city.
The DNA Design Committee reviewed the proposal and submitted a recommendation for
approval of the project (reference Attachment B). The DNA Design Committee is a seven
member committee chaired by Tom Armstrong, former principal planner for the city, and is
comprised of three architects, a graphic designer and one representative each from the Elgin
Heritage Commission and the Green Building Technology and Energy Efficiency Committee of
Elgin's Sustainable Master Plan. The application and submitted documentation was also
reviewed by staff of the city comprising the senior planner and plans examiner. The city's
engineering department have reviewed the applicant's request for a License Agreement to
work within the public right-of-way along Grove Avenue and Spring Street. A site visit to the
property by city staff and the DNA Design Committee Chair was conducted to assess the
existing condition and configuration of the building.
FINANCIAL ANALYSIS
The applicant has obtained two competitive bids for each item within the proposed scope of
work (reference Attachment C). The eligible cost for the project, based on the low bids, totals
$73,420. At a funding rate of 35%, the City's participation would be $25,697 (reference
Attachment D).

NEXT STEPS
1. Staff will have the grant recipient sign a legal agreement before starting work.
2. The property owner will need to obtain the necessary building permits for the facade
work. All permits will need to be obtained prior to starting construction on the project.
3. Through the duration of the project, staff, with the help of DNA, will monitor the project
and work with the property owner to resolve any issues that arise during construction.
Major changes or elimination of certain items in the approved design plan must be
approved by the city with a recommendation from DNA.
4. Upon completion of the project, copies of all bids, contracts, and invoices will need to be
submitted to the city along with contactors waivers of lien (or partial waivers of lien for
individual discrete components of work). The property owner will need to request a final
inspection on the project.
5. City staff will inspect the work for compliance with city codes and conformance with the
design plans approved for the project. A final payout of the grant amount will only be
made on completion of the final inspection and review of all out of pocket expenses.

The subject project is located on a predominant corner(Grove and Spring)in the
downtown center city district. It has three exterior exposed sides all clearly visible to the
public's view. The building is zoned for mixed use office/residential.

IMPROVEMENT DESCRIPTIONS
Brick Cleaning and Tuck Pointing:
This will be one of the last steps to the restoration of the exterior fagade. After all exterior
work has been prepped and before the awning is installed,all three exterior sides will be
cleaned and tuck pointed by a professional brick contractor.
Painting:
This step will include hand stripping(no sand blasting)any paint on bricks, sanding the
decorative top crown and painting per the approved rendering scheme.The top crown,
window and door trim will be painted. This includes rental of a boom lift to reach the
peaks, temporarily taping off the sidewalk from pedestrian traffic, placing drip mats on
the decorative paved sidewalks and working with the City of Elgin to temporarily block
off the parking spots in the working area.
Restoration of architectural,features:
In this scope of work the removal of the 1970's second layer of face brick and brown
painted cedar will be removed. New complimentary brick will be rebuilt from sidewalk
elevation to first limestone band. Provide decorative beck under west first floor windows
with design features to mimic the original second floor decorative brick panel,
Lighting:
We will be providing minimal lighting at three entries as required by code and a sign
light. Refer electrical quote.

To provide a Iook consistent with the era of this building and the look of downtown
Elgin, we will install a continuous"candy store" looking awning wrapping the perimeter

of the three exterior sides. This will be a fixed canopy. Refer to the renderings and
quotes.
Architectural Design work.
We will retain the services of a registered architect to provide us and the City of Elgin
with architectural elevations and color renderings of all three exterior facades.

We are moving the main entry door to the corner(short side)side. We are proposing two
arched steps from the City's paved side walk to the entry door elevation capped with
pavers to match the City's sidewalk. We'd prefer to use the City's original contractor for

PuEpose
To forward the comments and recommendation of the DNA Design Committee regarding a Fagade
Improvement Grant Application for 79 South Grove Avenue.
Background
A FaSade Improvement Grant Application has been submitted for the property located at 79 South
Grove Avenue. The application materials were distributed to the members of the DNA Design
Committee for review and comment.
The applicant proposes to make approximately $75,000 in facade improvements to the property,
which include:
• Restoration of architectural features - removing 1970s facade and replacing with a brick
facade that compliments the original second story brick and a limestone cap (it has been
determined that restoration of original brick on first level is not possible); mimicking
original architectural details where possible
• Cleaning and tuckpointing of existing brick
• Painting crown,window/door trim in a historic blue color scheme
• Installing"candy-stripe"awning that wraps around all three facades
• Reorienting main entry door to south facing facade;building paved stoop at entrance
Recommendation
The Design Committee recommends the approval of the Facade Improvement Grant Application for
the property located at 79 South Grove Avenue,subject to the following:
■ New brick on first floor south and west elevations to match second story brick color and
finish/texture as best possible. Mortar joints and color to match mortar joint technique
used on second floor. The vertical plane of the new brick walls should align with the face of
the second floor brick.
• Cleaning and tuckpointing of existing brick shall use gentle means recommended and
approved by Elgin city staff.
• Paint colors for cornice line of the building,window and door trims shall be as approved by
the DNA Design Committee.
• Awning colors and patterns shall be as approved by the DNA Design Committee.
• Reorienting the entry door to the south facing fagade and constructing a new entry stoop
will return an original design feature of the building. The location and design of the new
entry door should be guided by the ghost lines of the original entry,which are visible on the
floor of the street level tenant space.

Dear Jim:
Anthem Architects is pleased to submit this letter which will serve as our Proposal and, when
signed by you on the Agreement Acceptance line below and returned to our office, shall also
represent the Agreement between the parties. The parties to this Agreement are Jim Wicker
hereinafter called the "Owner", and Anthem Architects hereinafter called the "Architect", for
the architectural services stipulated below.
The Owner will provide the Architect full information regarding the project scope and program
which will set forth the Owner's design objectives, constraints, criteria and budget.
It is the intent of this letter to describe the Professional services to be rendered by our firm and
the corresponding remuneration.
SCOPE OF SERVICES:
The Architect will provide the architectural services described below for the design and
renovation of the building fagade at 79 Grove Avenue in Elgin Illinois. The new elevation
design should be in context with the neighborhood and be sensitive to historic means and
methods, colors, etc.
THE ARCHITECT'S BASIC SERVICES
A. Concept Design Phase
1. Consult with the Owner to determine the program specifics, goals, schedule and related
budget.

2. Prepare preliminary building and zoning code requirements to evaluate their impact on
the project.
3. Prepare sketches and diagrams to study strategic alternatives for the project.
B. Schematic Design Phase
1. Develop Schematic Designs responding to the Concept Design alternatives. The
Architect shall present the Owner with a maximum of three alternative Schematic
Designs from which a final Schematic Design can be prepared.
2. Provide final revisions within the original Scope of Services to the Schematic Design
Drawings reflecting the Owner's review for approval.
3. The Architect shall prepare Schematic Design Pricing Documents from which an
estimate of the cost of construction shall be prepared with the assistance of the
contractor(s). This estimate may vary as the project progresses due to changes in the
Scope or Quality of Construction and/or changes in the Time of Construction. The
Architect shall endeavor to advise the Owner of such variations but shall not be required
to quantify the changes. The estimate is considered neither a fixed limit of construction
cost nor a guarantee of such costs. Nor is it a detailed construction cost estimate or
quantity survey.
C. Design Development Phase
1. Based on the Schematic Design Documents approved by the Owner and any adjustments
authorized by the Owner in the program, schedule or construction budget, the Architect
will prepare for approval by the Owner, Design Development Documents consisting of
drawings and other documents to fix and describe the size and character of the Project as
to architectural structural, mechanical and electrical systems, materials and such other
elements as may be appropriate.
2. The Architect shall advise the Owner of any adjustments to the preliminary estimates of
Construction Cost with the assistance of the contractor(s).
D. Contract Document Phase
1. Based on the approved Design Development Documents any further adjustments in the
scope or quality of the Project or in the construction budget authorized by the Owner,the
Architect shall prepare for approval by the Owner Contract Documents consisting of
Drawings and Specifications setting forth in detail the requirement for the construction of
the Project.
2. The Architect shall assist the Owner in the preparation of the necessary bidding
information, bidding forms, the Conditions of the Contract and the form of Agreement
between the Owner and the Contractor.
3. The Architect shall advise the Owner of any adjustments to previous preliminary
estimates of Construction Cost indicated by changes in requirement or general market
conditions with the assistance of the contractor(s).

4. The Architect shall assist the Owner in connection with the Owner's responsibility for
filing documents required for the approval of governmental authorities having
jurisdiction over the Project.
5. In the event that outside consultants (Civil, Structural, Mechanical, and/or Electrical
Engineers) are required for specific design conditions, the consultants would be hired by
the Architect and expenses relating to such services shall be passed on to the Owner. The
Architect shall coordinate the work of the consultants and include any required drawings
and specifications within the Architects Contract Documents.
E. Construction Administration Phase
1. The Architect will provide consultation services for the Owner in selecting a General
Contractor. Periodic site observations will be provided to review the progress of the
Work and its compliance with the Contract Documents.
2. Architect shall visit the site at intervals appropriate to the stage of the Contractor's
operations and keep the Owner informed about the progress and quality of the portion of
the Work completed. The Architect shall report to the Owner any known deviations from
the Contract Documents and from the most recent construction schedule submitted by the
Contractor.
3. The Architect shall review and certify the amounts due to the Contractor and shall issue
certificates in sum amounts.
4. The Architect shall collect lien waivers prior to each payout.
5. The Architect shall review and approve Contractor submittals such as Shop Drawings,
Product Data and Samples.
6. The Architect shall prepare Change Orders and Construction Change Directives for the
Owner's approval and execution.
7. The Architect shall conduct inspections to determine the date or dates of Substantial
completion and the date of final completion, shall receive from the Contractor and
forward to the Owner, for the Owner's review and records, written warranties and related
documents and shall issue a final Certificate for Payment based upon a final inspection
indicating the Work complies with the requirements of the Contract Documents.
8. If the Owner requests, the Architect will execute any reasonable certifications regarding
the project.
F. Basis of Compensation
1. Compensation for the Architect's Concept Design and Schematic Design Phases will be
based the hourly rate of$100.00 per hour.
2. Compensation for the Architect's Design renderings will be based on a stipulated sum of
$7,600.00 or 76 hours of the architectural design and rendering time. The stipulated sum
is based on the scope and detail of the work to be prepared by the Architect.
1. Compensation for Additional Services will be performed at the same rate as indicated in
Paragraph F-l.

2. Reimbursable expenses shall be actual out—of—pocket expenses incurred by the Architect,
including but not limited to long distance communication, project related travel, postage
or messenger service, expense of reproduction of drawings, specifications and other
documents for Owner's use, Owner requested reproduction, photographic reproduction
and expense of renderings and models. For Reimbursable Expenses as described above,
a multiple of one point two (1.2) times the expenses incurred by the Architect, the
Architect's employees and consultants in the interest of the Project shall be applied.
G. Additional Services
1. Additional Services include but are not limited to the following:
a. Making revisions in Drawings, Specifications or other documents when such
revisions are:
i. inconsistent with approvals or instructions previously given by the Owner,
including revisions made necessary by adjustments in the Owner's program or
Project budget;
ii. required by the enactment or revision of codes, laws or regulations subsequent
to the preparation of such documents;
iii. due to changes required as a result of the Owner's failure to render decisions
in a timely manner;
b. Providing services made necessary by the default of the Contractor, by major
deficiencies in the work of the Contractor or by failure of performance of either
the Owner or Contractor under the Contract for Construction.
c. Providing services in connection with a public hearing, arbitration proceeding or
legal proceeding except where the Architect is party thereto.
CONTRACTUAL TERMS
1. Invoicing will be according to the attached schedule. Invoices are due upon receipt.
Retainer : a retainer of 1,500.00 shall be due for the architect to begin work on
the project.
Schematic Design : a payment of 1,500.00 shall be due upon completion of a design the
client considers acceptable as evidenced by a signature on the
schematic design acceptance drawing.
Rendering : upon completion of the final renderings, a final payment of$4,900.00
shall be due.
2. The Owner may terminate this Agreement at any Phase upon at least seven (7)days written
notice to the Architect. In the event of termination,the Architect shall be compensated for all
services performed to termination date, together with reimbursable expenses incurred to date.
3. A retainer fee $1,500.00 shall be required. This amount shall be credited to the final invoice.
4. If this Agreement meets with your approval, please sign a copy and return it to our office.

The undersigned proposes to furnish all labor, material and equipment necessary to complete the following.
1. $ 9.500.00 Provide a cost to clean all exposed brick,tuck point, caulk and recondition mortar joints.This
does not include brick replacement or restoration. Those costs will be included in the restoration costs.
2. $ 16,800.00 Provide a cost to remove all cedar from the exterior. This should include the haul away costs.
Cap the adjacent neighbor's cedar where this property line ends. Provide a lime stone edge cap on top of the
lower newer brick. This cost does not include repair to any brick exposed under the cedar soffit.Include new
rick walls under five window openings on the west exterior recessed to look similar to second floor design and
five new limestone window sills.
3. $ 35,200.00 Provide a cost to remove all first floor 1970's brick down to sidewalk and provide new brick
back up to first existing limestone band under second floor windows and cap off with another limestone band.
4.200.00 Restoration: a.Replace up to 50 of the worse bricks b. Replace two brick window sills under
basement bathroom windows with limestone. c. Rebuild one bathroom brick window opening that is falling
apart. d. Fill backsides of existing limestone sills with mortar
5. $ 7,400.00 Paint 45 linear feet of the top corneous three colors and the rear gutter and downspout one color.
