HomeMy WebLinkAbout1994 Bd of Fire & Police Agendas & Minutes MINUTES Board of Fire and Police Commission Special Session January 27, 1994 A special meeting of the Board of Fire and Police Commissioners of the City of Elgin, Illinois was held on January 27, 1994 at 5 :00 p.m. at Elgin City Hall, 150 Dexter Court, Elgin, Illinois 60120. Members Present: Chairman Ronald O'Neal, Commissioners Kay Diamond, Bruce Trego and Eugene Ericson. Member Absent: Commissioner Mary Camacho. Attorney Richard Reimer stated that he had submitted a motion to reopen the Administrative .Hearing regarding Michael Whitty. He further stated that he felt it would be in- appropriate to render a decision at this time without hearing the additional testimony. He requested a Stay in rendering a decision, before ruling on the motion. Attorney Michael Gehrman stated that the motion should be stricken for lack of foundation. To delay a decision is pointless. A motion was made by Commissioner Ericson, seconded by Commissioner Diamond to go into closed session to continue deliberation of the Michael Whitty case and to discuss the motion to reopen the Administrative Hearing. Yeas: O'Neal, Diamond and Ericson. Nays: None. A motion was made by Commissioner Trego, seconded by Commissioner Diamond to return to regular session. Yeas: O'Neal, Diamond, Ericson and Trego. Nays : None. Attorney Robert Smith stated that both Attorney's Michael Gehrman and Richard Reimer had agreed to have minutes taken at this meeting instead of using a court reporter. Both Attorneys concurred. A motion was made by Commissioner Trego, seconded by Commissioner Ericson to reopen the. Administrative Hearing into the Michael Whitty case. He also stated that the hearing would be open to the public. Yeas: O'Neal, Diamond, Ericson and Trego. Nays: None. - 4 The Board announced that the Administrative Hearing for Michael Whitty would reconvene on Saturday, January 29, 1994 at 12 :30 p.m. in the City Court Room, 150 Dexter Court, Elgin, Illinois. A motion was made by Commissioner Trego and seconded by Commissioner Diamond to adjourn the meeting at 6 : 15 p.m. Yeas: O'Neal, Diamond, Ericson and Trego. Nays: None. Respectfully submitted: Virg' is Schuring Recording Secreta r r 3 BOARD OF FIRE AND POLICE COMMISSION July 14, 1994 The regular session of the Board of Fire and Police Commission of the City of Elgin, Illinois, was held July 14, 1994 , at 7 : 15 p.m. in the Council Conference Room. Members Present: Commissioner Mary Camacho, Commissioner Eugene Ericson, Chairman Ronald O 'Neal, Commissioner Chuck Reed Member Absent: Commissioner Kay Diamond A motion was made by Commissioner Reed, seconded by Commissioner Ericson, to accept the June 9 , 1994, minutes . Motion carried. Approval of the July 7 , 1994, and July 9 , 1994, minutes will be placed on the agenda of the next meeting. A response will be sent to police candidate Enrique Santiago stating that although he is no longer a candidate on the June 8, 1993, eligibility list, he is encouraged to reapply. The request for minutes from the July 7, 1994, and July 9, 1994, meetings will be placed on the agenda for the next meeting after the minutes have been approved. A motion was made by Commissioner Ericson, seconded by Commis- sioner Reed, to appoint the next police officer from the June 8, 1993, Police Officer list to be effective as soon as possible. Motion carried. A motion was made by Commissioner Camacho, seconded by Commis- sioner Reed, to appoint the next police lieutenant from the May 13, 1992 , Police Lieutenant list . Yes 3; No 0 . Commissioner Ericson voted Present . Motion carried. Business cards will be provided for any Commissioner that would like them. Promotional points will remain as revised on 10/24/93 . The Rules and Regulations of the Fire and Police Commission were distributed so members could review them before the next meet- ing. Both Chiefs will be asked to review them also. A motion was made by Commissioner Camacho, seconded by Commis- sioner Reed, to have staff prepare for the next police sergeant examination process . Motion carried. r Fire and Police Commision Minutes of July 14, 1994 Page 2 The police officer written test will be held at 8 : 30 a.m. on July 30, 1994, at the Hemmens . Members are encouraged to stop in during the testing process . Applicants receiving the top 50 scores will take the physical agility exam on August 20, 1994, at Elgin High School . A motion was made by Commissioner Ericson, seconded by Commis- sioner Reed to adjourn to executive session. Motion carried. A motion was made by Commissioner Reed, seconded by Commissioner Camacho, to adjourn at 8 :02 p.m. Motion carried. Members Present: Commissioner Mary Camacho, Commissioner Eugene Ericson, Chairman Ronald O'Neal, Commissioner Chuck Reed Member Absent: Commissioner Kay Diamond A motion was made by Commissioner Camacho, seconded by Commis- sioner Ericson, to table voting on the July 7 , 1994, minutes until the three commissioners that were in attendance at the July 7 meeting are present. Motion carried. A motion was made by Commissioner Camacho, seconded by Commis- sioner Reed, to accept the July 9, 1994, minutes . Yes 3; No 0 . Commissioner Ericson abstained. Motion carried. A motion was made by Commissioner Camacho, seconded by Commis- sioner Reed, to accept the July 14, 1994, minutes . Motion car- ried. In response to Police Sergeant Duffy' s request for copies of the minutes from the July 7 and 9, 1994, meetings, a motion was made by Commissioner Ericson, seconded by Commissioner Reed, to table the request until the July 7 , 1994, minutes are approved. Mo- tion carried. Mr. Folarin said that Statute states minutes from executive sessions are exempt under the Freedom of Information Act unless the Board decides to release them. A motion was made by Commissioner Reed, seconded by Commissioner Camacho, to direct staff to notify Police Sergeant Duffy that there are no appeal rights for the action taken by the Board at its July 9, 1994, meeting. Motion carried. Proposed changes to the current Fire and Police Board Rules and Regulations were given to staff for compilation. Proposed chang- es will be reviewed at the next meeting. A motion was made by Commissioner Camacho, seconded by Commis- sioner Reed, to adjourn at 7 : 40 p.m. Motion carried. Members Present: Commissioner Mary Camacho, Commissioner Eugene Ericson, Chairman Ronald O'Neal, Commissioner Chuck Reed Member Absent: Commissioner Kay Diamond A motion was made by Commissioner Reed, seconded by Commissioner Ericson, to adjourn to executive session. Motion carried. Commission returned to special session. A motion was made by Commissioner Reed, seconded by Commissioner Ericson, to concur with Chief Henrici ' s recommendation to termi- nate Probationary Firefighter James Schnering, unless he volun- tarily submits his resignation within the next 24 hours . Motion carried. A motion was made by Commissioner Camacho, seconded by Commis- sioner Ericson, to adjourn at 8 : 34 p.m. Motion carried. Members Present: Commissioner Mary Camacho, Commissioner Kay Diamond, Commissioner Eugene Ericson, Chairman Ronald O'Neal, Commissioner Chuck Reed A motion was made by Commissioner Camacho, seconded by Commis- sioner Diamond, to accept the minutes from the July 7 , 1994, meeting. Motion carried. Ericson and Reed abstained. A motion was made by Commissioner Reed, seconded by Commissioner Ericson, to accept the minutes from the August 11, 1994, and August 18, 1994, meeting. The motion was amended by Commissioner Ericson, seconded by Commissioner Diamond, to accept only the minutes from the August 11, 1994, meeting. Commissioner Diamond withdrew her second to the motion due to her absence at the August 11, 1994, meeting. A motion was made by Commissioner Camacho, seconded by Commis- sioner Reed, to accept the August 11, 1994, meeting. Motion carried. Diamond abstained. A motion was made by Commissioner Reed, seconded by Commissioner Ericson, to accept the minutes from the August 18, 1994, meeting. Motion carried. Diamond abstained. A motion was made by Commissioner Camacho, seconded by Commis- sioner Diamond, not to release all executive session minutes . Motion defeated. A motion was made by Commissioner Ericson, seconded by Commis- sioner Reed, to make the decision to release executive session minutes on a case by case basis. Motion carried. Fire and Police Commission September 8, 1994 Page 2 A motion was made by Commissioner Diamond, seconded by Commis- sioner Camacho, not to release the July 7 , 1994, executive ses- sion minutes . Motion carried. Ericson and Reed abstained. A motion was made by Commissioner Ericson, seconded by Commis- sioner Diamond, to send the top 12 promotional candidates with a combined (written/department/seniority) score of 72 to the as- sessment center. If the 12th score is tied, both or all will be included. The motion was amended by Commissioner Ericson, seconded by Commissioner Reed, to send the top 12 police sergeant promotion- al candidates with a combined (written/department/seniority) score of 72 to the assessment center. If the 12th score is tied, both or all will be included. Motion carried. Police officer oral interview dates were set for 44 candidates . November 10 6 : 00-9 : 30 11 6 : 00-9 : 30 12 10: 30-12 : 00, 12: 30-2: 30 13 6 : 00-9 : 30 17 6 : 00-9 : 30 18 6 : 00-9 : 30 21 6 : 00-9 : 30 at Fire Station 1 All suggested changes have been incorporated into the Police and Fire Commission Rules and will now be sent to Legal for review. In response to the Commission' s request to improve backgrounds, Chief Gruber explained his proposal to enhance the background investigation process . A memorandum was distributed from S/P Henry Smith outlining the results of his research. Director McCollum stated that specific details could be discussed in executive session. A motion was made by Commissioner Camacho, seconded by Commis- sioner Diamond, to move to executive session at 8 : 19 p.m. Motion carried. Fire and Police Commission September 8, 1994 Page 3 Based on the information discussed during executive session, a motion was made by Commissioner Ericson, seconded by Commission- er Camacho, to inform police applicant Robert L. Carpenter that he has been eliminated from the process . Motion carried. A motion was made by Commissioner Reed, seconded by Commissioner Camacho, to adjourn the meeting at 8 : 54 p.m. Motion carried. Members Present: Commissioner Mary Camacho, Commissioner Kay Diamond, Commissioner Eugene Ericson, Chairman Ronald O'Neal, Commissioner Chuck Reed The September 8, 1994, minutes were corrected to read, "A motion was made by Commissioner Camacho, seconded by Commissioner Reed, to accept the August 11, 1994, minutes . A motion was made by Commissioner Camacho, seconded by Commis- sioner Diamond, to accept the minutes as corrected. Motion carried. A letter was received from Robert Carpenter asking the exact reason for his disqualification from further consideration for the position of police officer. The secretary will send him a response without disclosing specifics . A motion was made by Commissioner Camacho, seconded by Commis- sioner Diamond, to adjourn to Executive Session. Motion carried. Upon the return to Special Session, item Fl "Appointment of six new Police Officers from the soon to be established eligibility list, " was tabled. A motion was made by Commissioner Reed, seconded by Commissioner Ericson, to adjourn the meeting at 9 p.m. Motion carried. Respectfully submitted: Marlene Friedland Recording Secretary r r MINUTES BOARD OF FIRE AND POLICE COMMISSION November 17 , 1994 A Special Session of the Board of Fire and Police Commission of the City of Elgin, Illinois, was held November 17 , 1994, at 5: 49 p.m. in the Council Conference Room. Members Present: Commissioner Mary Camacho, Commissioner Kay Diamond, Commissioner Eugene Ericson, Chairman Ronald O'Neal, Commissioner Chuck Reed The scoring of the Police Sergeant promotional process were discussed. In the past the written score of 72% was used to eliminate applicants from continuing in the process . Following the Peoria court case decision, the Commission voted on Septem- ber 8, 1994, to combine the written, department, and seniority scores with the top 12 candidates with a combined score of 72% or better advancing to the Assessment Center. Mr. Folarin advised that the scoring is broken down: written 100, department 20, seniority 10 which totals 130 . Percentile score .= x/130 x 100 . If the points are left exact, ten people will qualify. If rounded off to even numbers, twelve people will qualify. He asked how the Commission wanted to handle it. He also stated that Legal reviewed the Peoria case and said it did not change anything in the current rules - interpretation is the problem. The rules say to use merit. Chief Gruber said the September 8 minutes state the top 12 candi- dates with a combined score of 72% will advance to the assess- ment center. The current board rule says written 10, seniority 10, and department 20 . Attached is a handout emphasizing the weighting of the written, seniority, and merit/efficiency points . If the written is given 100 points, the department and seniority become devalued by only receiving 20 points and 10 points respectively. Since careers are at stake, Commissioner Reed made a motion to postpone the assessment center process until the scoring problem is resolved. Commissioner Camacho seconded the motion. Motion carried. Chief Gruber asked that the rules be published. Mr. Folarin stated that the rules have been published. Special Session Board of Fire and Police Commission November 17 , 1994 A motion was made by Commissioner Reed, seconded by Commissioner Diamond, to adjourn the meeting to executive session in order to conduct police officer interviews at 6 :20 p.m. Motion carried. Respectfully submitted: Marlene Friedland Recording Secretary r r MINUTES BOARD OF FIRE AND POLICE COMMISSION December 8, 1994 The Regular Session of the Board of Fire and Police Commission of the City of Elgin, Illinois, was held December 8, 1994, at 7 : 08 p.m. in the Council Conference Room. Members Present: Commissioner Mary Camacho, Commissioner Kay Diamond, Commissioner Eugene Ericson, Chairman Ronald O'Neal, Commissioner Chuck Reed Commissioner Camacho requested that page one, paragraph four, of the November 17 , 1994, Special Session minutes be amended to read " . . .a minimum combined score of 72%. " A motion was made by Commissioner Camacho, seconded by Commis- sion Reed, to accept the November 17 , 1994, minutes as amended. Motion carried. A motion was made by Commissioner Camacho, seconded by Commis- sioner Diamond to appoint seven officers from the November 21, 1994, Police Officer Eligibility List, effective January 3, 1995 . Motion carried. A motion was made by Commissioner Diamond, seconded by Commis- sioner Camacho, to promote David Buck to lieutenant from the May 13, 1992, Police Lieutenant Eligibility List. Motion carried. A motion was made by Commissioner Diamond, seconded by Commis- sioner Reed, to promote an officer to sergeant when the Police Sergeant Eligibility List is established. Motion carried. A motion was made by Commissioner Camacho, seconded by Commis- sioner Diamond, to appoint a firefighter from the January 25, 1993, Firefighter Eligibility List, effective October 17 , 1994 . Motion carried. When the Firefighter Eligibility List expires on January 25, 1995, a letter will be sent to those remaining on the list. r Fire and Police Commission December 8, 1994 Page 2 emk Mr. Folarin explained the delay in the Police Sergeant promotion- al process . Previously, applicants needed a 72% on the written examination in order to proceed to the next step in the pro- cess. Since then as a result of a Peoria court case, the writ- ten, merit/efficiency, and seniority points must be combined before applicants can proceed to the next step in the process . The Commission decided to score the points as follows : written 100, seniority 10, department 20 . Since the Commission did not discuss how to weight the scores, there were three possible ways to calculate them. A. 100(w) + 10(s) + 20(d) = 10 people will score 72% or above. B. 10(w) + 10(s) + 20(d) = 11 people will score 72% or above. C. 100(w) + 100(s) + 100(d) = 9 people will score 72% or above. (Note: Those names in C would also be included under A and B) Mr. Folarin recommended that all of the candidates in each of the categories that received a combined score of 72% or above proceed to the assessment center. Although the Commission had previously decided to send 12 candidates to the assessment cen- ter, this method would send 14 . A motion was made by Commissioner Reed, seconded by Commissioner Ericson, to send those applicants with a combined minimum score of 72% based on A and B calculations to the assessment center. Motion carried. A motion was made by Commissioner Ericson, seconded by Commis- sioner Camacho, to send out a maximum of 350 applications for firefighter. Motion carried. A motion was made by Commissioner Camacho, seconded by Commis- sioner Reed, to have the firefighter applicants with the top 40 written scores proceed to the next step in the process . Motion carried. A motion was made by Commissioner Ericson, seconded by Commis- sioner Diamond, to add a drivers license check and criminal history check to the firefighter application process. Motion carried. Mr. Folarin reported that the Rules and Regulations are being reviewed by legal and will be ready in January for the board. r Fire and Police Commission December 8, 1994 Page 2 rft The May 13, 1992, Police Lieutenant Eligibility List has been depleted. A motion was made by Commissioner Camacho, seconded by Commissioner Diamond to score the lieutenant applicants as follows: written = 10 point value, department = 20 point value, seniority = 10 point value. Those with a combined score of 72% or above will proceed to the assessment center. Motion carried.
