AUTHORIZING EXECUTION OF AMENDMENT AGREEMENT NO. 1 WITH
CHRISTOPHER B. BURKE ENGINEERING, LTD.
(2010 Neighborhood Street Rehabilitation-Spring Street)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,that
Sean R. Stegall, City Manager, and Diane Robertson, City Clerk, be and are hereby authorized and
directed to execute amendment agreement no. 1 on behalf of the City of Elgin with Christopher B.
Burke Engineering, Ltd. for the 2010 Neighborhood Street Rehabilitation-Spring Street, a copy of
which is attached hereto and made a part hereof by reference.

AMENDMENT AGREEMENT No. 1
THIS AMENDMENT AGREEMENT No. 1 is hereby made and entered into this 26th day of
May , 2010, by and between the City of Elgin, Illinois, a municipal corporation
(hereinafter referred to as the "CITY"), and Christopher B. Burke Engineering, Ltd., an Illinois
professional service corporation(hereinafter referred to as"ENGINEER").
WHEREAS, the CITY and ENGINEER hereto have previously entered into an agreement dated
January 27, 2010 wherein the CITY engaged the ENGINEER to furnish certain professional
services in connection with the 2010 Neighborhood Street Rehabilitation — Spring Street
(hereinafter referred to as "ORIGINAL AGREEMENT"and the"PROJECT"); and
WHEREAS, the parties hereto have each determined to be in their best interests to amend
ORIGINAL AGREEMENT; and
WHEREAS, the CITY has determined that the proposed scope of the PROJECT should be
modified to include Construction Engineering Activities—Phase III Engineering Services; and
WHEREAS, the CITY has determined that the proposed schedule of the PROJECT should be
modified to continue in May of 2010 with a contract completion date of November 2010
requiring additional professional engineering services; and
WHEREAS, the ORIGINAL AGREEMENT provided for a total payment to ENGINEER in the
amount of$82,390 which amount will be amended by this Amendment Agreement No. 1 to the
amount of$94,896, which is an increase over the original contract price of 115%; and
WHEREAS, the circumstances necessitating the change in performance contemplated by this
amendment were not reasonably foreseeable at the time ORIGINAL AGREEMENT was signed;
the change contemplated by this First Amendment Agreement is germane to the ORIGINAL
AGREEMENT as signed; and this Amendment Agreement No. 1 is in the best interests of CITY
and is authorized by law.
NOW, THEREFORE, for and in consideration of the mutual undertakings as set forth in the
ORIGINAL AGREEMENT, and other good and valuable consideration, the sufficiency of which
is hereby mutually acknowledged, the parties hereto agree as follows:
1. The above recitals are incorporated into and made a part of this agreement as if fully
recited hereby.
2. That Section 1 of the ORIGINAL AGREEMENT is hereby amended by adding a
subparagraph D to read as follows:
"D. ENGINEER shall also provide the services for the PROJECT as outlines in
ENGINEER's Scope of Services document entitled "Construction Engineering
Activities, Attachment A — Phase III Engineering Scope of Services", for 2010
Neighborhood Street Rehabilitation — Spring Street, Elgin, Illinois, proposal,
dated April 26, 2010, consisting of seven (7) pages, a copy of which is attached
hereto and made a part hereof as Attachment A. In the event of any conflict
between the terms of this Amendment Agreement No. 1 shall control."
3. That Section 2 of the ORIGINAL AGREEMENT is hereby amended by adding a
subparagraph C thereof to read as follows:
"C. The ENGINEER shall commence with the services for Phase III Construction
Engineering Activities of the PROJECT on or before June 1, 2010, and shall
complete same no later than November 2010 thereafter, unless such other
schedule is mutually agreed to by the CITY and ENGINEER."
4. Section 4A. of the ORIGINAL AGREEMENT is hereby amended to read as follows:
"For services provided by the ENGINEER, as described in Section 1 of the ORIGINAL
AGREEMENT, and as amended by this Amendment Agreement No. 1,ENGINEER shall
be paid at the direct hourly rate of personnel employed on the PROJECT and including
all in-house direct cost and services by other cost as set forth in Attachment A to this
Amendment Agreement No. 1, at a dollar amount of$94,896 with the total fee not to
exceed $177,286 regardless of the actual time expended or actual costs incurred by the
ENGINEER unless substantial modifications to the Scope of Work are authorized in
writing by the CITY ENGINEER.
5. The changes provided to the ORIGINAL AGREEMENT as provided in this Amendment
Agreement No. 1 are germane to the original contract as signed and this Amendment
Agreement No. 1 is in the best interests of the City of Elgin and is authorized by law.
6. That except as amended in this Amendment Agreement No. 1 the ORIGINAL
AGREEMENT shall remain in full force and effect.
7. That in the event of any conflict between the terms of the ORIGINAL AGREEMENT,
and the provisions in this Amendment Agreement No. 1, the provisions of this
Amendment Agreement No. 1 shall control.

I. CONSTRUCTION PHASE SERVICES
Task 1.1 —Pre-Construction Services:
1. Attend a pre-construction conference with the contractor, City, and other parties to
discuss goals, objectives, and issues of the project. CBBEL shall prepare a project
contact list, including 24-hour emergency numbers, for distribution with the meeting
minutes.
2. Conduct utility coordination meetings, as required, to monitor and verify the
progress of utility relocations being completed by others.
3. Obtain and distribute all permits issued for the construction of the project.
4. Obtain from the contractor a list of proposed suppliers and subcontractors. Make
recommendations to the City regarding the suitability of the subcontractors for the
proposed work.
5. Review the construction schedule submitted by the contractor for compliance with
the contract. CBBEL will review it in relation to the notes found on the Construction
Staging and Sequencing Plan sheets in the plan set. If the Contractor chooses an
alternate staging and sequencing (as allowed), CBBEL will review the
constructability of their plan to insure that the work is being completed in a logical
sequence.
6. CBBEL shall document all existing conditions with digital photographs and
videotapes to insure that all disrupted areas have been restored per the plan or
existing conditions.
7. Review the plans and specifications for potential conflicts or problems, so that
solutions can be developed prior to construction.
8. Review the Inspector's Checklists provided through IDOT for contract line items.
9. Provide information to the City for use in updating project website with construction
updates.
10. Prepare project files, Quantity and IDR books.
Task 1.2 —Shop Drawing Review:
1. Review submittals made by the contractor for compliance with the contract
documents.
2. Shop Drawings and Contractor Submittals:
a. Record data received, maintain a file of drawings and submissions, and
check construction for compliance with them.
b. Review Contractor's submittals for compliance with contract documents.
Notify the City of any deviations or substitutions. With the notification, provide
the City with a recommendation for acceptance or denial, and request
direction from the City regarding the deviation or substitution.

Task 1.3—Construction Observation, Weekly Report and Material Testing:
Layout Verification and/or Construction Layout
1. Verify initial geometric controls.
2. If the contractor is responsible for construction staking, perform periodic
measurements to assure the contractor's construction staking and construction
layout is accurate per plans.
Construction Observation
1. Observe the progress and quality of the executed work. Determine if the work is
proceeding in accordance with the Contract Documents. CBBEL shall keep the
City informed of the progress of the work, guard the City against defects and
deficiencies in the work, advise the City of all observed deficiencies of the work
and reject all work failing to conform to the Contract Documents.
2. Provide on-site observations of the work in progress and field checks of materials
and equipment through a Resident Engineer and Inspector (if necessary), who
shall:
• Serve as the City's liaison with the contractor working principally through the
contractor's field superintendent.
• Be present whenever the contractor is performing work on-site.
• Cooperate with the contractor in dealing with the various local agencies and
utility companies having jurisdiction over the project to facilitate completion of
service connections to public utilities and facilities.
• Record names, addresses and telephone numbers of all contractors,
subcontractors, and major material suppliers.
• Attend all construction conferences. Arrange a schedule of weekly progress
meetings and other job conferences as required. Maintain and circulate
copies of records of the meetings.
• Review contractor's progress on a weekly basis and update the progress
schedule. Compare actual progress to the contractor's approved schedule. If
the project falls 14 calendar days behind schedule, work with the contractor to
determine the appropriate course of action to get back on schedule. The
contractor is required to submit a revised schedule for approval prior to
further payments being made.
• Maintain orderly files of correspondence, reports of job meetings, shop
drawings and other submissions, RFI responses, original contract documents
including all addenda, change orders and additional drawings issued
subsequent to the award of the contract.
• Prepare any RFC's needed as construction proceeds. Once the contractor
submits a proposal, assist the City in their review and provide a
recommendation.

3. Determine if the project has been completed in accordance with the contract
documents and if the contractor has fulfilled all obligations.
4. Except upon written instruction of the City, the Resident Engineer or Inspector shall
not authorize any deviation from the Contract Documents.
5. Alert the Contractor's field superintendent when materials or equipment are being
installed before approval of shop drawings or samples, where such are required,
and advise the City when it is necessary to disapprove work as failing to conform
to the Contract Documents.
6. Discuss the truck routes with the Contractor and monitor that the identified routes
are being used.
7. All CBBEL personnel and their sub-consultants will comply with the City's current
safety guidelines.
8. Utilize Testing Service Corp. to periodically test concrete and asphalt.
Construction Documentation
1. Keep an inspector's daily report book and project diary in the City's format,
recording hours on the job site, weather conditions, general and specific
observations, daily activities, quantities placed, inspections, decisions, and list of
visiting officials, as outlined in IDOT's Construction Manual. Additionally, prepare
photo documentation of construction to be submitted in both hard and digital
formatting.
2. Prepare payment requisitions and change orders. Review applications for payment
with the Contractor for compliance with established submission procedure and
forward them with recommendations to the City. Maintain a Change Management
Plan logging all decisions and approved changes of scope and budget.
3. Schedule any material testing through the City's Consultant at the frequency
required by IDOT's QC/QA provisions. Also obtain and document all material
inspection received from the Contractor as outlined in the Project Procedures
Guide of IDOT's Construction Manual.
4. Prepare a monthly written update to the City summarizing the Project status, costs
and schedule.
5. Review and coordinate response to any RFI from the Contractor in a timely
manner and maintain a separate file for each request.
Task 1.4 — Area Resident and Business Concerns Coordination: The Resident
Engineer will be responsible for keeping the public aware of the construction activities, as
required. This will include, but not be limited to, advance notification of construction start,
detours and/or road closures, access limitations, and disruption of water, sewer, and gas
service. The RE will also be available throughout the construction project to address any
questions or concerns area residents and/or businesses may have. Our policy is to
respond to all questions or concerns within one business day.

Task 1.5 — Erosion Control Inspection: As required by the provisions of the NPDES
Permit Number ILR10, CBBEL's Resident Engineer will designate an environmental
specialist to inspect all erosion control measures installed during construction to insure they
are in accordance with the Storm Water Pollution Prevention Plan (SWPPP). They will
perform this inspection weekly and generate a report detailing any deficiencies that need to
be addressed.This report will be given to the Contractor, as well as the City.
Task 1.6 — Traffic Control Inspection: Perform barricade checks as outlined in Section
700: Work Zone Traffic Control of IDOT's Construction Manual. At a minimum, CBBEL
shall perform the following:
• One detailed daytime inspection per week and two detailed nighttime inspections
per month. These inspections shall be recorded on a format in accordance with
City policy or Form BC 726, Traffic Control Inspection Report.
■ In addition, the Resident Engineer will drive through the jobsite daily and
document the drive through in the project diary.
• If traffic control is in place during the proposed winter shutdown, two drive-
throughs per week will be performed.
If major deficiencies are observed, the Resident Engineer will notify the contractor
immediately and insure that the contractor takes the appropriate actions as outlined in the
contract documents.
Task 1.7—Post-Construction:
1. Prior to final inspection, submit to the Contractor a list of observed items requiring
correction and verify that each correction has been made.
2. Conduct final inspection with the City and prepare a final list of items to be
corrected.
3. Verify that all items on the final list have been corrected and make
recommendations to the City concerning acceptance.
4. Prepare final pay estimate and change order for the City's approval.
5. Verify all necessary material inspection information has been received and
documented.
6. Submit the job box to the City with all pertinent project information, including
Record Drawings as indicated in the RFQ (see Task 3.8).
Task 1.8 — Record Drawings: CBBEL will maintain a set of working drawings showing
changes in the work during construction. This will expedite the submittal of the record
drawings to the City. Approved record drawings will be submitted to the City in mylar and
AutoCAD 2007 format no later than four weeks after the completion of construction.

SUBJECT: Amendment No. 1 for Construction Engineering Services for 2010 Neighborhood
Street Rehabilitation Project—Spring Street
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider Amendment No. 1 to an agreement with Christopher B. Burke
Engineering Ltd. (CBBEL) for construction services for the 2010 Neighborhood Street
Rehabilitation Project— Spring Street.

It is recommended that City Council authorize Amendment No. 1 with CBBEL in the amount of
$94,926 and authorize staff to execute the necessary documents.
BACKGROUND
The original agreement for the 2010 Neighborhood Street Rehabilitation Project — Spring Street
included the design engineering services. The original engineering services agreement for the
subject project ($82,390) was authorized by City Council on January 27, 2010. The design
included for the street reconstruction and water main upgrades along Park, Addison and Gifford
Streets and various streets adjacent to same. A map showing proposed locations for the street
rehabilitation work is attached as Exhibit A.
The construction project will improve approximately 1.0 mile of City streets and upgrade
approximately 4,400 lineal feet of watermain. The award of the construction contract is part of
the Council Agenda as Bid 10-024. The attached amendment agreement will provide for
construction engineering services for this improvement project. The services will include
observation of construction procedures, quality control, quantity documentation and contractor
payment processing.
A copy of the Amendment No. 1 to the agreement is attached as Exhibit B.

Amendment No. 1 with CBBEL will total $94,926. Of this total, $40,255 is attributable to
roadway work and is budgeted ($900,000) and available ($878,474) in the Riverboat Fund,
account number 275-0000-791.93-80, "Major Repairs-Public Ways", project number 59911A,
"Spring St./Ann 2010".
Of the subject total, $54,671 is attributable to water main work. The Annual Water Distribution
System Upgrading budget is $2,100,000 for 2010. Funding for the water main work for this
project is budgeted ($665,000) and available ($594,917) in the water portion of 2008 General
Obligation (G.O.) Bond Fund, account number 368-4000-795.93-41, "Major Repairs-
Distribution System,"project number 59911A. I

installed before approval of shop drawings or samples, where such are required,
and advise the City when it is necessary to disapprove work as failing to conform
to the Contract Documents.

specialist to inspect all erosion control measures installed during construction to insure they
are in accordance with the Storm Water Pollution Prevention Plan (SWPPP). They will
perform this inspection weekly and generate a report detailing any deficiencies that need to
be addressed. This report will be given to the Contractor, as well as the City.
