RESOLUTION
APPROVING CHANGE
FOR THE LANDMARK CONTRACTOR HE FRAZIER AVENUE LOWERING PROJECT
WHEREAS, the City of Elgin has heretofore entered into a contract with Landmark
Contractors for the Frazier Avenue Lowering Project; and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Sean R, Stegall,City Manager,be and is hereby authorized and directed to
execute Change Order No. 1,a copy of which is attached hereto and made a part hereof by reference.

CHANGE ORDER No. I AND FINAL
CONTRACT: Frazier Avenue Lowering Project(Bid No. 09-032)
SCOPE: This change order will provide for the funding to properly dispose of contaminated soil and
miscellaneous debris, redesign and build the storm sewer due to a conflict with ComEd facilities, addi-
tional grading and stabilization with retaining wall and additional pavement patching to complete the
construction of Frazier Avenue under Metra's bridge. The additional contaminated material, conflict
with ComEd, grading issues and pavement patching were unforeseen at the time the contract was origi-
nally awarded.
This change order affects a contract between the City and Landmark Contractors, Inc. dated June 9,
2009 for the Frazier Avenue Lowering Project.
REASONS FOR CHANGE: Change Order oreseen at the time interest
law. The necessity for the change the contract was originally executed. The
changes contemplated in Change Order No. 1 are germane to the original agreement.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as
to scope and costs to include disposal of additional contaminated soil and miscellaneous debris, the re-
design and construction of storm sewer, additional grading, stabilization and retaining wall, and addi-
tional pavement patching.

The original amount of the contract with Landmark Contractors, Inc. is $477,733.57. Change Order No.
I will increase the original contract amount by a total of $83,633.75, that sum representing seventeen
and five tenths percent (17.5%) of the original contract amount. The new contract amount, inclusive of
all change orders is $561,367.32.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.

SUBJECT: Change Order No. 1 and Final with Landmark Contractors for the Frazier Avenue
Lowering Project
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider Change Order No. 1 and Final with Landmark Contractors for the
Frazier Avenue Lowering Project.
RECOMMENDATION
It is recommended that the City Council approve Change Order No. 1 and Final with Landmark
Contractors for the Frazier Avenue Lowering Project at a cost of $83,633.75, with a final
contract value of $561,367.32. This increase represents a 17.5% increase in the total contract
amount from the original awarded amount.
BACKGROUND
On June 4, 2009, the City Council awarded the subject project to Landmark Contractors. Said
project included removal of contaminated soil to lower and reconstruct Frazier Avenue under a
Metra bridge to provide clearance for trucks and emergency equipment. The project also
included the construction of storm sewer, curb and gutter, pavement and sidewalk. This change
order is necessitated by added quantities of existing pay items including disposal of
contaminated soil, additional grading and stabilization with retaining wall and additional
pavement patching and added pay items including further evaluation of contaminated material,
disposal of miscellaneous debris and redesign and construction of the storm sewer due to a
conflict with ComEd facilities.

FINANCIAL IMPACT
The current contract and Change Order No. 1 and Final with Landmark Contractors are
$477,733.57 and$83,633.75 respectively, resulting in a total contract amount of$561,367.32.
Funding for this change order is available in the Riverboat Fund, account number 275-0000-
791.93-80, "Major Repairs-Public Ways," project number 339673, "Frazier Avenue Lowering,"
with$329,239 budgeted and$127,574 available.
