. , Resolution No. 09-23 RESOLUTION APPROVING CHANGE ORDER NO. 4 AND FINAL IN THE CONTRACT WITH NORTHWEST CONTRACTORS, INC. FOR CONSTRUCTION OF THE HIGHLANDS OF ELGIN CLUBHOUSE WHEREAS, the City of Elgin has heretofore entered into a contract with Northwest Contractors, Inc. for construction of The Highlands of Elgin Clubhouse; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 4 and Final, attached hereto. R'S AA January 22, 2009 TO Mayor and Members of the City Council _ FROM: Olufemi Folarin, City Manager Randy Reopelle, Parks and Recreation Director SUBJECT: Change Order No. 4 and Final for the Construction of the Highlands of Elgin Clubhouse PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider authorization of Change Order No. 4 and Final Change Order with Northwest Contractors Incorporated for the construction of The Highlands of Elgin Clubhouse. RECOMMENDATION It is recommended that the City Council approve the execution of Change Order No. 4 and Final Change Order with Northwest Contractors Incorporated for The Highlands of Elgin Clubhouse in the amount of$48,961.62. BACKGROUND On September 27, 2006, the City Council awarded a bid to Northwest Contractors, Incorporated in the amount of$4,430,000 to construct the Highlands of Elgin Clubhouse at 875 Sports Way. The construction of the clubhouse began in the fall of 2006 and occupancy was gained to the building on February 27, 2008. Change Order No. 1 in the amount of$56,079 was approved for structural enhancements including foundation and masonry adjustments to site conditions. Change Order No. 2 in the amount of $282,825 was for the landscape, site hardscape, site earthwork and entry gate features. Change Order No. 3 was for miscellaneous modifications to the kitchen to provide for full scale banquet services. Change Order No. 4 provides for necessary kitchen adjustments and enhancements to the building electrical plan. The enhancements to the kitchen created the capacity to handle both banquets and a la carte service at the same time. Staff reviewed the original plan with the selected food operator and made adjustments to accommodate the more efficient kitchen plan. A number of code and fire related adjustments to the electrical and HVAC system were made to be in compliance with local codes that were not specified in the original plan. Change Order No. 4 was reviewed and recommended for approval by the Golf Leadership Team at their meeting of December 3, 2008. Change Order No. 4 and Final for the Construction of the Highlands of Elgin Clubhouse January 22, 2009 Page 2 By reason of Change Order No. 4, the contract for the Highlands Clubhouse project will increase in the amount of $48,961.62 or approximately 1% of the original contract amount. The new contract amount, inclusive of all Change Orders, is $4,885,061.37 that sum representing a 10.2% increase over the original contract. A copy of Change Order No. 4, provided by project architect Larson and Kramer Associates, is attached. The project budget is $5,541,209 with expenses-to-date totaling $5,477,695 leaving an available balance of$63,514. There are sufficient funds budgeted ($1,160,052) and available ($52,764) in the Riverboat Lease Fund, account number 276-0000-791.92-36, project number 509737,to fund this change order. In addition, the entire project included Building Architectural by Larson Kramer, Ltd., Landscape Architectural and engineering fees which totaled $285,265. The remainder of the project was miscellaneous furniture, fixtures and start up costs for the operations which totaled $370,883. LEGAL IMPACT None ALTERNATIVES 1. The City Council may choose to approve Change Order No. 4 and Final in the amount of $48,961.62 as recommended. 2.
