RESOLUTION
APPROVING CHANGE ORDER NO. 2 IN THE CONTRACT WITH
JOEL KENNEDY CONSTRUCTION
FOR PHASE II OF THE JOINT DISPOSAL FORCE MAIN PROJECT
WHEREAS, the City of Elgin has heretofore entered into a contract with Joel Kennedy
Construction for Phase II of the Joint Disposal Force Main Project; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 2, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Sean R. Stegall, City Manager,be and is hereby authorized and directed to
execute Change Order No.2,a copy of which is attached hereto and made a part hereof by reference.

CHANGE ORDER NO. 2 AND FINAL
CONTRACT: Joint Waste Disposal Force Main—Phase II (Bid No. 08-029)
Joel Kennedy Constructing Corp. (Contractor)
SCOPE: The following items adjust the contract price to account for additions and modifications as in-
dicated below:
CO2-1. Jack and Bore at U.S. Route 20 Hand Mining. The Contract called for the installation of 183
linear feet of 30-inch steel casing pipe beneath U.S. Route 20 via jacking and boring. The
Contractor was able to install 100 linear feet using the specified method. However, at the
100 foot mark the auger began to encounter very large cobbles and boulders that could not be
passed back through the casing pipe. As a result, the Contractor was unable to control the
pitch of the auger and it began to rise in elevation too rapidly. The only way to counter this
rise was to remove the augers and begin hand mining until the casing pipe could be returned
to the correct elevation on a level plane. The total distar e of the hand mining was 35 linear
feet. This work was done on a time and material basis. I'his will result in an addition of
$51,503.08 to the original contract price.
CO2-2. 16 Inch Diameter Steel Casing Pipe. The Contractor submitted a proposal for installing the
8-inch and 14-inch diameter force mains inside a single 30-inch casing pipe for the jack and
bore under U.S. Route 20, Union Pacific Railroad, Illinois Route 31 (State Street), and Metra
Railroad. Change Order No. 1 covered the crossings at U.S. Route 20 and Illinois Route 31.
This change results in the elimination of 231 linear feet of 16-inch diameter steel casing pipe.
This will result in a deduction of$10,395.00 from the original contract price.
CO2-3. 20 Inch Diameter Steel Casing Pipe The Contractor submitted a proposal for installing the
8-inch and 14-inch diameter force mains inside a single 30-inch casing pipe for the jack and
bore under U.S. Route 20, Union Pacific Railroad, Illinois Route 31 (State Street), and Metra
Railroad. Change Order No. 1 covered the crossings at U.S. Route 20 and Illinois Route 31.
This change results in the elimination of 231 feet of 20 inch diameter steel casing pipe. This
will result in a deduction of$11,550.00 from the original contract price.
CO2-4. 30 Inch Diameter Steel Casing Pine The Contractor submitted a proposal for installing the 8
inch diameter force main and the 14 inch diameter force main inside a single 30 inch steel
casing pipe as opposed to 2 separate steel casing pipes for the jack and bore under U.S. Route
20, Union Pacific Railroad, Illinois Route 31 (State Street), and Metra Railroad. Change Or-
der No. 1 covered the crossings at U.S. Route 20 and Illinois Route 31. The Contractor will
not be installing a new casing pipe under the Metra Railroad as the existing 30-inch steel cas-
ing pipe previously installed by Fox River Water Reclamation District is going to be re-used
for this project. The original contract price for casing pipe was $45.00 per linear foot for the
16-inch casing pipe and $50.00 per linear foot for the 20-inch casing pipe. The Contractor
agreed to provide a credit to the contract of$92.00 per linear foot of casing pipe. In addition,
the Contractor chose to provide the entire credit on the casing pipe. The total cost of the cas-
ing pipes under the original contract was $95.00 per linear foot. The credit from the Contrac-
tor results in the 30-inch casing pipe being installed at$3.00 per linear foot. This change re-
sults in the addition of 130 feet of 30 inch diameter steel casing pipe for the crossing of the
Union Pacific Railroad. This will result in an addition of$390.00 to the original contract
price.
CO2-5. 14 Inch Diameter HDPE Force Main by Jack and Bore at Metra Railroad Fox River Water
Reclamation District previously installed a 30-inch diameter steel casing pipe under the
Metra Railroad in the same location as the proposed crossing. Metra has agreed to let the ex-
isting casing pipe be re-used. This will result in an $86.00 per linear foot reduction in the
unit price for 121 linear feet of 14-inch diameter HDPE force main by jack and bore. This
will result in an addition of$31,944.00 to the original contract price.
CO2-6. 8 Inch Diameter HDPE Force Main by Jack and Bore at Metra Railroad Fox River Water
Reclamation District previously installed a 30-inch diameter steel casing pipe under the
Metra Railroad in the same location as the proposed crossing. Metra has agreed to let the ex-
isting casing pipe be re-used. This will result in an $86.00 per linear foot reduction in the
unit price for 121 linear feet of 8-inch diameter HDPE force main by jack and bore. This
will result in an addition of$31,944.00 to the original contract price.
CO2-7. 14 Inch Diameter HDPE Force Main by Jack and Bore Fox River Water Reclamation Dis-
trict previously installed a 30-inch diameter steel casing pipe under the Metra Railroad in the
same location as the proposed crossing. Metra has agreed to let the existing casing pipe be
re-used. As the casing pipe is already in place, there will be a cost savings on the installation
of the 8-inch and 14-inch diameter force main. This will result in the elimination of 121 lin-
ear feet of 14-inch diameter HDPE force main by jack and bore. This will result in a deduc-
tion of$42,350.00 from the original contract price.
CO2-8. 8 Inch Diameter HDPE Force Main by Jack and Bore Fox River Water Reclamation District
previously installed a 30-inch diameter steel casing pipe under the Metra Railroad in the
same location as the proposed crossing. Metra has agreed to let the existing casing pipe be
re-used. As the casing pipe is already in place, there will be a cost savings on the installation

CO2-9. Correction to Chantze Order No 1 There was a mathematical error in the calculation of the
total deduction on Change Order No. 1. The correct figure was $17,756.00. This will result
in an addition of$360.00 to the original contract price. However, as the approved figure for
Change Order No. 1 was $18,116.00 and cannot be changed, it is necessary to make the addi-
tion $720.00 to make the numbers balance at the bottom of this change order.
CO2-10. 8 Inch Diameter HDPE Force Main by Horizontal Directional Drilling. original design
in the plans called for the 8-inch HDPE pipe to be installed under the Metra Railroad, then
run north along the western side of the Fox River Water Reclamation District North Plant
and then east along the north side from Station 147+06 to 153+10. Due to a lack of informa-
tion on the exact location of the existing 8-inch pipe within the North Plant, Fox River Water
Reclamation District made the decision to terminate the 8-inch pipe at Station 147+06. This
results in the elimination of 604 linear feet of 8-inch pipe. The Contractor was intending to
install the 14-inch and 8-inch pipe in this area inside a single bore hole. As such, they had a
certain amount of fixed indirect and overhead costs tied into their unit price for the 8-inch
pipe. Due to this, the unit cost for the 604 linear feet of 8-inch pipe was negotiated down
from $166.00 per linear foot to $126.00 per linear foot. This will result in a deduction of
$76,104.00 from the original contract price.
CO2-11. Additional Welds for Shorter 30 Inch Diameter Steel Casing Pi Pe at IL Route 31. On Friday,
February 6, 2009, the Contractor began excavating for Launch Pit No. 1 on the west side of
the Union Pacific Railroad. While excavating, existing utilities were encountered on the
south side of the launch pit. The launch pit was then shifted north where the existing utilities
were then discovered on the west side of the launch pit. This resulted in the launch pit only
being 20 feet in length which made it necessary to cut the casing pipes in half and install
them in smaller sections. The smaller sections required 11 additional welds at a cost of
$880.00 per weld. This will result in an addition of$9,680.00 to the original contract price.
CO2-12. Jack and Bore at IL Route 31 Hand Mining. The Contract called for the installation of 210
linear feet of 30-inch diameter steel casing pipe beneath IL Route 31 and the Union Pacific
Railroad via jacking and boring. The Contractor was able to install 60 linear feet using the
specified method. However, at the 60 foot mark, the auger struck a large rock that could not
be broken up by the augers. As a result, the augers had to be removed and the rock hand
mined. Once the rock was removed, the augers were placed back inside the casing pipe and
jacking and boring continued. This same situation occurred at the 114 foot mark and the 160
foot mark. The hand mining was performed on a time and material basis. This will result in
an addition of$11,125.47 to the original contract price.
CO2-13. 14 Inch Ductile Iron Force Main by Open Cut The entire plan quantity was not used for this
item. Only 972 linear feet was used which results in the elimination of 28 feet of 14-inch
ductile iron force main at a unit cost of$140.00 per linear foot. This will result in a deduc-
tion of$3,920.00 from the original contract price.
REASONS FOR CHANGE:
• The circumstances necessitating the change in performance were not reasonably foreseeable at
the time the contract was signed.
• The change is germane to the original contract as signed.
• The change order is in the best interests of the City of Elgin and is authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The contract is being amended to increase
the original contract amount. However, the changes to the contract amount will not result in a change to
the contract provisions or contract times for work to be completed.

The original amount of the contract with Joel Kennedy Constructing Corp. is $2,861,200.00. This
Change Order No. 2 and Final totaling ($49,362.45) and previous change orders totaling ($18,116.00)
will decrease the original contract amount by a total of$67,478.45, that sum representing two point
thirty-six percent (2.36%) of the original contract amount. The new contract amount, inclusive of all
change orders is $2,793,721.55.
The City of Elgin's share of the original $2,861,200.00 contract with Joel Kennedy Constructing Corp.
is $2,402,895.00. This Change Order No. 2 and Final totaling ($49,362.45) and previous change orders
totaling ($18,116.00)will increase the City of Elgin's share of the original contract amount by a total of
$887.78, that sum representing zero point zero thirty-seven percent (0.037%) of the original share of the
original contract amount. The City of Elgin's new share of the new contract amount, inclusive of all
change orders is $2,403,782.78.
The Fox River Water Reclamation District's share of the original $2,861,200.00 contract with Joel Ken-
nedy Constructing Corp. is $458,305.00. This Change Order No. 2 and Final totaling ($49,362.45) and
previous change orders totaling ($18,116.00) will decrease the Fox River Water Reclamation District's
share of the original contract amount by a total of$68,366.23, that sum representing fourteen point
ninety-two percent(14.92%) of the original share of the original contract amount. The Fox River Water
Reclamation District's new share of the new contract amount, inclusive of all change orders is
$389,938.77.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.

SUBJECT: Change Order No. 2 for Phase II Joint Disposal Main
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider authorization of Change Order No. 2 with Joel Kennedy Construction for
Phase II of the Joint Disposal Force Main project.
RECOMMENDATION
It is recommended that the City Council authorize the execution of Change Order No. 2 with Joel
Kennedy Construction for Phase II of the Joint Disposal Force Main project for a contract
deduction in the amount of$49,362.
BACKGROUND
The project included the installation of approximately 4.3 miles of 14-inch and 2.7 miles of 8-
inch diameter of High Density Polyethylene (HDPE) force main by directional drilling, bore jack
and open cut; 4 ft and 6 ft diameter manholes with air relief valves; 4 ft and 6 ft diameter
manholes with cleanouts; launch pits, bituminous pavement, trench replacement, curb and gutter
removal and replacement; sidewalk removal and replacement;trench backfill and restoration.
The 14-inch HDPE forced main transfers sludge from City of Elgin Riverside Water Treatment
Plant to South McLean Lime Residue Facility (Sludge Lagoons). The 8-inch diameter HDPE
forced disposal main will transfer waste disposal materials from Fox River Water Reclamation
District (FRWRD) north plant to their main plant, rather than trucking the material as is done
now.
The forced mains were installed in two phases. The first phase was installed by H. Linden and
Sons and the second phase was installed by Joel Kennedy Construction. The Elgin 14-inch
diameter was placed in service on March 23, 2009. The contractor, Joel Kennedy Construction
is completing the punch list.

On May 25, 2008, the City Council awarded the agreement for Phase II of the Joint Disposal
Main to Joel Kennedy Construction. Change Order No. 1 for a deduction in the amount of
$18,116 was approved by the City Council on September 10, 2008.
Change Order No. 2 and Final includes thirteen(13) items:
• Jack and bore at U.S. Route 20 hand mining
• Elimination of 231 linear feet of 16-inch diameter steel casing pipe
• Elimination of 231 linear feet of 20-inch diameter steel casing pipe
• Installation of 30-inch diameter steel casing pipe
• Installation of 14-inch diameter HDPE force main by jack and bore at Metra Railroad

The original project cost with Joel Kennedy Construction for Phase II of the Waste Disposal
Main is $2,861,200. Change Order No. 2 will decrease the contract amount by $49,362. The
total contract decrease as a result of both change orders is $67,478 with FRWRD receiving a
credit of $68,366 and the City an increase of $888. The revised contract amount will be
$2,793,722. Funds for this project are budgeted ($6.45 million) and available ($1.65million) in
the Water Development Fund, account number 420-0000-771.92-41, "Capital Additions-
Buil ings/Structures, and project number 409691,"Waste Disposal Line".

the Union Pacific Railroad. While excavating,existing utilities were encountered on the
south side of the launch pit. The launch pit was then shifted north where the existing utilities
were then discovered on the west side of the launch pit. This resulted in the launch pit only
being 20 feet in length which made it necessary to cut the casing pipes in half and install
them in smaller sections. The smaller sections required I 1 additional welds at a cost of
$880.00 per weld. This will result in an addition of$9,680.00 to the original contract price.
CO2-12. Jack and Bore at IL Route 3I Hand Mining. The Contract called for the installation of 210
linear feet of 30-inch diameter steel casing pipe beneath IL Route 31 and the Union Pacific
Railroad via jacking and boring. The Contractor was able to install 60 linear feet using the
specified method. However,at the 60 foot mark,the auger struck a large rock that could not
be broken up by the augers. As a result,the augers had to be removed and the rock hand
mined. Once the rock was removed,the augers were placed back inside the casing pipe and
jacking and boring continued. This same situation occurred at the 114 foot mark and the 160
foot mark. The hand mining was perfonned on a time and material basis. This will result in
an addition of$11,125.47 to the original contract price.
CO2-13. 14 Inch Ductile Iron Force Main by pen Cut. The entire plan quantity was not used for this
item. Only 972 linear feet was used which results in the elimination of 28 feet of 14-inch
ductile iron force main at a unit cost of$140.00 per linear foot. This will result in a deduc-
tion of$3,920.00 from the original contract price.
REASONS FOR CHANGE:
• The circumstances necessitating the change in performance were not reasonably foreseeable at
the time the contract was signed.
• The change is germane to the original contract as signed.
• The change order is in the best interests of the City of Elgin and is authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The contract is being amended to increase
the original contract amount. However,the changes to the contract amount will not result in a change to
the contract provisions or contract times for work to be completed.

share of the original contract amount by a total of$68,366.23,that sum representing fourteen point
