HomeMy WebLinkAbout08-249 Resolution No. 08-249 RESOLUTION APPROVING CHANGE ORDER NO. 9 IN THE CONTRACT WITH CYBERDINE MASONRY FOR CONSTRUCTION ACTIVITIES AT FIRE STATION 7 WHEREAS,the City of Elgin has heretofore entered into a contract with Cyberdine Masonry for additional masonry services at Fire Station 7; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 9, attached hereto. After the main construction of the masonry work at Fire Station 7, the plumbing in the vehicle mainte- nance area was exposed. This is a potential strike area due to the movement of vehicles and equipment and the decision was made to protect the exposed plumbing by creating three additional plumbing chases. There was an additional charge for work that was created by another contractor (Hiatt/EB Inc.). The total cost of Change Order No. 9 with Cyberdine Masonry is $6,514 and a previous change order for $12,122.63 for a total contract price of$655,893.63. REASONS FOR CHANGE: Change Order No. 9 is in the best interest of the city and is authorized by law. The necessity for the change was unforeseen at the time the contract was originally executed. The changes contemplated in Change Order No. 9 are germane to the original agreement. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as to scope and costs to include the addition of the masonry work and additional work completed. ORIGINAL CONTRACT AMOUNT: $637,257 CHANGE ORDER No. 9 Increased masonry services $6,514 TOTAL FOR CHANGE ORDER NO. 9 ADD $6,514 PREVIOUS CHANGE ORDER(S): Change Order No. 3 $12,122.63 TOTAL OF PREVIOUS CHANGE ORDERS: ADD $12,122.63 TOTAL REVISED CONTRACT AMOUNT: $655,893.63 The original amount of the contract with Cyberdine Masonry is $637,257. Change Order No. 9 and pre- vious change orders totaling$12,122,63 will increase the original contract amount by a total of $18,636.63,that sum representing two and nine tenths percent(2.9 %)of the original contract amount. The new contract amount, inclusive of all change orders is $655,893.63. RECOMMENDATION It is recommended that the City Council authorize the execution of Change Order No. 9 to the contract with Cyberdine Masonry for the masonry services for Fire Station 7 in the amount of $6,514. The total budget for this project is $5,432,443 with $5,330,660 spent and/or encumbered to date. There are sufficient funds budgeted ($483,750) and available ($39,875) in the 2008 Riverboat Lease Fund, account number 276-0000-791.30-03, "Architectural and Engineering" project 289506, "Fire Station 7" for the change order. LEGAL IMPACT None ALTERNATIVES 1. The City Council may choose to approve Change Order No. 9 with Cyberdine Masonry in the amount of$6,514. 2.
