FOR CONSTRUCTION ACTIVITIES AT FIRE STATION 7 WHEREAS,the City of Elgin has heretofore entered into a contract with Elliott and Wood, Inc. for construction activities at Fire Station 7; and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 6, attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,be and is hereby authorized and directed to execute Change Order No. 6,a copy of which is attached hereto and made a part hereof by reference. s/Ed Schock Ed Schock, Mayor Presented: September 24, 2008 Adopted: September 24, 2008 Omnibus Vote: Yeas: 5 Nays: 0 Attest: s/Diane Robertson Diane Robertson, City Clerk Ci ty of Elgin Change Order ELGIN,ILLINOIS PROJECT 289506 CHANGE ORDER No. 6 CONTRACT: Construction of Fire Station 7 (Bid No. 06-053) SCOPE: Elliott and Wood, Inc. was awarded the bid for the excavation and site utilities for the con- struction of Fire Station 7. The original contract amount was $310,500 for site excavation and installa- tion of utilities. A previous change order in the amount of$57,208.15 was approved by City Council which increased the contract amount to $367,708.15. A change order in the amount of $16,429 was submitted by Elliott and Wood, Inc. for the increased costs associated with poor soil conditions and the removal of a stone median on Longcommon Parkway. This amount includes a credit for$765 for repair work performed by Landmark Contractors. REASONS FOR CHANGE: Change Order No. 6 is in the best interest of the city and is authorized by law. The necessity for the change was unforeseen at the time the contract was originally executed. The changes contemplated in Change Order No. 6 are germane to the original agreement. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as to scope and costs to include increased costs associated with poor soil conditions and the removal of a stone median on Longcommon Parkway. ORIGINAL CONTRACT AMOUNT: $310,500 CHANGE ORDER No. 6 Change in building scope and budget $16,429 TOTAL FOR CHANGE ORDER NO. 6 ADD $16,429 PREVIOUS CHANGE ORDER(S): Change Order No. 2 $57,208.15 TOTAL OF PREVIOUS CHANGE ORDERS: ADD $57,208.15 TOTAL REVISED CONTRACT AMOUNT: $384,137.15 The original amount of the contract with Elliot and Wood is$310,500. Change Order No 6 and Change Order No 2 totaling$57,208.15 will increase the original contract amount by a total of$73,637.15,that sum representing twenty three and seven tenth percent(23.7%)of the original contract amount.The new contract amount, inclusive of all change orders is$384,137.15. RECOMMENDATION It is recommended that the City Council authorize the execution of Change Order No. 6 to the contract with Elliott and Wood, Inc. for the increase in excavation and site utilities for the construction of Fire Station 7 in the amount of$16,429. The original contract amount was $310,500 for site excavation and installation of utilities. A previous change order in the amount of$57,208.15 was approved by City Council which increased the contract amount to $367,708.15. A change order in the amount of$16,429 was submitted by Elliott and Wood, Inc. for the increased costs associated with poor soil conditions and the removal of a stone median on Longcommon Parkway. The total budget for this project is $5,432,443 with $5,246,955 spent and/or encumbered to date. There are sufficient funds budgeted ($4,918,600) and available ($55,420) in the 2008 Riverboat Lease Fund, account number 276-0000-791.92-36, "Capital Additions/Buildings and Structures," project 289506, "Fire Station 7" for the change order. LEGAL IMPACT None ALTERNATIVES 1. The City Council may choose to approve Change Order No. 6 with Elliott and Wood, Inc. for the increase in excavation and site utilities for the construction of Fire Station 7 in the amount of$16,429. 2. The City Council may choose not to approve Change Order No. 6 with Elliott and Wood, Inc. for the increase in excavation and site utilities for the construction of Fire Station 7 in the amount of$16,429.
