FOR THE RIVERSIDE RESERVOIR PIPING REVISIONS PROJECT WHEREAS, the City of Elgin has heretofore entered into a contract with Marc Kresmery Construction, L.L.C. for the Riverside Reservoir Piping Revisions Project; and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1 and Final, attached hereto. Relocation of the Existing Electrical Duct Bank. The existing electrical line on the east side of the one million gallon tank turned out to be a three foot wide by two foot deep concrete electrical duct bank. This duct bank was in conflict with the proposed valve vault on the connection on the east side of the one million gallon tank as well as the two tee connection to the existing 36-inch water main pipe. As a result, the existing electrical duct bank must be relocated. 2. 6-Foot Diameter Valve Vaults. The proposed valve vaults are set up for the proposed 36- inch water main pipe to run through the center of the vaults. The proposed 36-inch butterfly valves do not fit inside the vaults in this format as the gear box hits the vault wall. As a re- sult, the three valve vaults must be switched from a 6-foot diameter valve vault to a 7-foot diameter valve vault. The size of the valve vaults were based on the technical drawings of the 36-inch butterfly valves provided by Val-matic. The dimensions on these drawings were not correct when compared to the 36-inch butterfly valves that were actually manufactured and delivered to the project site. 3. Existing 30-Inch Butterfly Valve. The existing 30-inch butterfly valve on the west side of the one million gallon tank had to be opened for the tank to be put in service for the construc- tion on the existing 36-inch water main to take place. When the valve was opened, the valve stem broke. The Contractor did not have a spare valve stem in their shop and had to order a new valve stem to replace the broken one. 4. Topsoil Furnish and Place 3". Due to the steep slopes around the one million gallon tank and tight working conditions resulting from the location of the parking lot and access roads, the Contractor has had to disturb a larger area than initially planned. 5. Sodding. Due to the steep slopes around the one million gallon tank and tight working con- ditions resulting from the location of the parking lot and access roads, the Contractor has had to disturb a larger area than initially planned. 6. Fence Removal and Restoration. Due to the tight working conditions resulting from the loca- tion of the parking lot and access roads, the Contractor had to remove more fencing that ini- tially planned. 7. 36 Inch Diameter Water Main. Due to changes in the proposed routing of the water main as a result of the existing 36-inch water main and the existing 42-inch water main, additional 36-inch water main pipe was necessary to complete the project. 8. Additional Compacted CA-6 Required to Address Unanticipated Conditions. This pay item was not needed to complete the project. 9. 36-Inch Hatch for Flow Meter Vault. Due to the location of the new 36-inch water main and the orientation of the flow meter within the vault, access to the structure itself was very diffi- cult through the normal 2-foot diameter opening in the flat top slab. To provide safer access to the structure, a 36-inch by 36-inch hatch was installed. REASONS FOR CHANGE: The reasons supporting the change order must demonstrate the change order is: • The circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed. • The change is germane to the original contract as signed. • The change order is in the best interests of the City of Elgin and is authorized by law. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The contract is being amended to increase the original contract amount. However, the changes to the contract amount will not result in a change to the contract provisions or contract times for work to be completed. Change Or- der No. 1 and Final and previous changer orders totaling $51,538.83 will increase the original contract amount by a total of$51,538.83, that sum representing thirteen point thirty-three percent (13.33%) of the original contract amount. Jacobsen, Water System Superintendent SUBJECT: Change Order No. 1 and Final for 5 MG Riverside Reservoir Piping Revisions PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider authorization of Change Order No. 1 and Final with Marc Kresmery Construction LLC for the 5 MG Riverside Reservoir Piping Revisions Project. RECOMMENDATION It is recommended that the City Council authorize the execution of Change Order No. 1 and Final with Marc Kresmery Construction LLC for the 5 MG Riverside Reservoir Piping Revisions Project for an amount of$51,539. BACKGROUND On November 28, 2007, the City Council awarded the construction of the five million gallon reservoir piping revisions to Marc Kresmery Construction LLC. The project included the installation of approximately 200 feet of 36-inch ductile iron pipe by open cut, an additional storage tank inlet and outlet, a 60-inch x 60-inch energy dissipater, 6-feet diameter manholes for the 36-inch butterfly valves and an insertion probe magmeter, trench backfill and restoration. Change Order No. 1 and Final includes nine (9) items, these items are: relocation of the existing electrical duct bank; replacement of the 6-foot diameter valve vaults with 7-foot diameter valve vaults; repair of existing 30-inch butterfly valve; furnishing additional topsoil; additional sodding; more fence removal and restoration; additional 36-inch diameter water main; additional compacted CA-6 to address unanticipated conditions; and installation of a 36-inch hatch. The main portion of this Change Order is due to the relocation of the electrical duct bank. It is a major route for all the electrical lines for the water plant. When the contractor began excavation for the piping revisions, the duct bank was not in the location as identified by the plant as-builts. The reservoir pipe could not be relocated, therefore, the duct bank needed re-routing. There are sufficient funds budgeted ($700,000) and available ($238,267) in the water portion of the 2007 General Obligation Bond Fund, account number 367-4000-795.92-41, "Capital Improvements,"project number 409690, 5 MG Riverside Reservoir to fund this Change Order. LEGAL IMPACT None ALTERNATIVES 1. The City Council may choose to authorize Change Order No. 1 and Final with Marc Kresmery in the amount of$51,539, as recommended. 2. The City Council may choose not to authorize Change Order No. 1 and Final with Marc Kresmery at this time. Respectfully submitted for Council consideration. KBJ Attachment
