FOR CONSTRUCTION MANAGEMENT SERVICES FOR FIRE STATION 7 WHEREAS, the City of Elgin has heretofore entered into a contract with Lamp, Inc. for construction management services for Fire Station 7; and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 4, attached hereto. At the time of the initial interview with Lamp Incorporated,Fire Station#7 square footage was 12,000 square feet. Fire Station#7 final construction square footage is 20,885 square feet, began construction in May 2007, and the current project budget is $5,432,443. Lamp Incorporated is requesting an increase in the Gen- eral Conditions services of$20,395.90 to cover the cost of increased wages based upon the revised pro- ject starting date from the original date of September 2006. The current construction cost of the additional has increased the Construction Fee by $34,489.84. REASONS FOR CHANGE: Change Order No. 4 is in the best interest of the city and is authorized by law. The necessity for the change was unforeseen at the time the contract was originally executed. The changes contemplated in Change Order No. 4 are germane to the original agreement. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as to scope and costs to include the additional masonry services associated with preparing the building for cold weather construction. RECOMMENDATION It is recommended that the City Council authorize the execution of Change Order No. 4 to the contract with Lamp, Inc. for construction management services for Fire Station 7 in the amount of$62,326. BACKGROUND On April 28, 2006, the City Council awarded a contract to Lamp Inc. for the construction management of Fire Station 7 totaling $360,550. At the time of the initial interview with Lamp Inc., Fire Station 7 square footage was 12,000 square feet. Project delays due to land acquisition changed the initial groundbreaking date from September 2006 to May 2007. This delay was outside of the agreement with Lamp, Inc. and resulted in an increase in labor costs as part of their General Conditions portion of the contract. During this time, the scope of the project changed to include the addition of a Vehicle Maintenance Division area which increased the scope of the project to the final 20,885 square feet. The construction management services contract is a three part contract which is based upon project schedule and construction cost. The first part of the contract is Pre-construction services which cover budgeting, planning, and bidding. The second part of the contract is the General Conditions services which covers the management of the construction project. The third part of the contract is the Construction Fee which covers Lamp Inc.'s office overhead. The current project budget is $5,432,443. Lamp Inc. is requesting an increase in the General Conditions services of$20,395.90 to cover the cost of increased wages as a result of the delayed Change Order No. 4 for Construction Management Services for Fire Station 7 July 3, 2008 Page 2 project starting date from the original date of September 2006 to May 2007. The current project construction cost has increased the Construction Fee by $34,489.84 due to the increased size of the building. Lamp Inc. is not requesting any additional fees for the Pre-construction phase of their contract. The remaining $7,440 of the change order is for services paid for by Lamp, Inc. The total amount of the request is $62,325.74. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None FINANCIAL IMPACT The total cost of Change Order No. 4 with Lamp, Inc. is $62,325.74. The total budget for this project is $5,432,443 with $5,198,129 spent and/or encumbered to date. There are sufficient funds budgeted ($4,918,600) and available ($85,541) in the 2008 Riverboat Lease Fund, account number 276-0000-791.92-36, "Capital Additions/Buildings and Structures," project 289506, "Fire Station 7" for the change order. LEGAL IMPACT None ALTERNATIVES 1. The Council may choose to approve Change Order No. 4 with Lamp, Inc. for construction management services for Fire Station 7 in the amount of$62,326. 2. The Council may choose not to approve Change Order No. 4 with Lamp, Inc. for construction management services for Fire Station 7 in the amount of$62,326.
