HomeMy WebLinkAbout08-167 Resolution No. 08-167 RESOLUTION APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH THE KENNETH COMPANY FOR GRANT SCHOOL PARK IMPROVEMENTS WHEREAS, the City of Elgin has heretofore entered into a contract with the Kenneth Company for Grant School Park improvements; and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. The demolition of the school and site clearing left this parcel devoid of any topsoil and therefore topsoil must be imported to the site in order to grow a good stand of grass. There is also an existing concrete retaining wall on the east property edge that is falling into the neighbor's garage and driveway. It is a hazardous situation and has to be rectified. This wall must be removed and replaced with a segmental retaining wall. Almost directly on top of the wall is a 10' tall chain link fence that is damaged, falling over and also must be removed. The original contract includes a new short fence to be erected in its place. A number of undesirable trees have grown up through the fence and the retaining wall and must be removed as a result. Finally, a fence enclosure is desired for the new skate park for public safety reasons. After recently re- searching how other park districts/departments secure skate parks, it became evident that such a fence was necessary for this location. Neighbors have voiced their support for this fence. The Kenneth Com- pany will he responsible to complete all of these items. REASONS FOR CHANGE: The work outlined above was omitted from the bid documents however the work is essential for the success of the project. The change order is in the best in- terests of the City of Elgin and authorized by law. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as to scope and costs to include the improvements outlined above ORIGINAL CONTRACT AMOUNT: $264,703.00 CHANGE ORDER No. I Remove 10' chain link fence $2,593.50 Remove trees along property edge $3,289 Remove concrete wall $7,468 Regrade area along fence line, remove asphalt $2,814 Install segmental retaining wall $12,800 Import 190 cu.yds. of topsoil and grade on-site, seed and blanket $11,877 Furnish and install 8' fence around perimeter of skate park $20,262 TOTAL FOR CHANGE ORDER NO.1: ADD $61,103.50 TOTAL REVISED CONTRACT AMOUNT: $325,806.50 The original amount of the contract with The Kenneth Company is $264.703. Change Order No. 1 will increase the original contract amount by a total of$61,103.50, which represents twenty-three percent (23%) of the original contract amount. June 19, 2008 4F t TO: Mayor and Members of the City Council FROM: Olufemi Folarin, City Manager Randy Reopelle, Director of Parks and Recreation SUBJECT: Change Order No. 1 to Bid#07-117 for Grant School Park Improvements PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to approve Change Order No. 1 to the contract with the Kenneth Company to address various items required to complete Grant School Park. RECOMMENDATION It is recommended that the City Council approve Change Order No. 1 with the Kenneth Company for Grant School Park Improvements in the amount of$61,103.50. BACKGROUND On November 14, 2007, the City Council awarded a contract to the Kenneth Company in the amount of$264,703 for improvements to Grant School Park. Work on the park has progressed well with the project about 90% complete. A ribbon cutting and park dedication event are tentatively planned for July 26 for this park. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Grant School Park Neighbors Association Change Order No. 1 to Bid#07-117 for Grant School Park Improvements June 19, 2008 Page 2 FINANCIAL IMPACT The cost of this change order with the Kenneth Company will total $61,103.50. To accommodate this change order, the total budget for this project must be increased by $33,608, from $372,387 to $405,995. There is currently $372,387 budgeted and $27,496 available in the Riverboat Fund, account number 275-0000-791.92-37, "Park Development and Acquisition," project number 509681. The additional amount required of$33,607.90 will be paid out of the Park Development Fund, account number 340-0000-795.92-32, "Land Improvements,"project number 509681 where $33,608 is budgeted and $33,608 remains available. LEGAL IMPACT None ALTERNATIVES 1. The City Council may choose to approve Change Order No. 1 with the Kenneth Company for Grant School Park Improvements in the amount of$61,103.50. 2. The Council may choose not to approve Change Order No. 1 with the Kenneth Company for Grant School Park Improvements in the amount of$61,103.50.
