RESOLUTION
AUTHORIZING EXECUTION OF INTERGOVERNMENTAL AGREEMENT
WITH THE COUNTY OF KANE REGARDING COST PARTICIPATION IN
A FEASIBILITY STUDY FOR THE RANDALL ROAD AND
U.S. ROUTE 20 INTERCHANGE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that
Ed Schock, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to
execute an Intergovernmental Agreement with the County of Kane regarding cost participation in a
feasibility study for the Randall Road and U.S. Route 20 interchange, a copy of which is attached
hereto and made a part hereof by reference.

INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF ELGIN AND THE COUNTY OF KANE
REGARDING COST PARTICIPATION OF A FEASIBILITY STUDY
FOR THE RANDALL ROAD AND U.S. ROUTE 20 INTERCHANGE
This Agreement is entered into this 10th day of April,2007 by and between the City of Elgin,
a municipal corporation of the County of Kane, State of Illinois, hereinafter referred to as "CITY",
and the County of Kane,a body corporate and politic of the State of Illinois,hereinafter referred to as
"COUNTY."
WITNESSETH
WHEREAS,the Illinois Constitution of 1970 Article VII,Section 10 and the Intergovernmental
Cooperation Act of the Illinois Compiled Statues, (5 ILCS 220/1 et seq.) authorizes the CITY and the
COUNTY to cooperate in the performance of their respective duties and responsibilities by contracts
and other agreements; and
WHEREAS, the CITY and the COUNTY, in order to facilitate the free flow of traffic and
insure safety to the motoring public, are desirous of improving the interchange at Randall Road
(County Highway # 34) and U.S. Route 20 (FAP Route 345), State Section: 2006-018I,
hereinafter referred to as the "PROJECT", by conducting a Feasibility Study; and
WHEREAS,the population of north central Kane County is expected to increase dramatically
over the next twenty years, diminishing safety and increasing congestion at and in the surrounding area
of the PROJECT; and
WHEREAS, the CITY and the COUNTY find that the health, welfare and safety of their
residents are best served by entering into this Agreement to participate in the cost of a Feasibility Study
for the purpose of determining a conceptual interchange design necessary for future improvements to
ensure they will function in a safe and efficient manner for the movement of vehicular traffic;and
WHEREAS,the Feasibility Study shall consist of the preparation of a bound report detailing
the feasibility of various interchange reconstruction alternatives, which shall include, but not be
limited to the Review of Existing Conditions,Determination of Future Traffic Demands,Interchange
Type Study, Preliminary Project Cost Estimates, and Meeting with Involved Agencies, Political
Bodies and the Public; and
NOW,THEREFORE,in consideration of the mutual covenants contain herein,the CITY and
the COUNTY mutually covenant, agree and bind them as follows, to wit:
1. The CITY and the COUNTY acknowledge and agree that the preambles as stated herein above
are incorporated into this Agreement.
2. The COUNTY agrees to obtain the services of a State of Illinois pre-qualified engineering
firm to provide the necessary documentation for the Feasibility Study.
3. The COUNTY agrees to pay for all costs associated with the Feasibility Study in its entirety,
subject to reimbursement by the CITY as hereinafter stipulated.
4. It is mutually agreed by both parties hereto that the estimated cost of the Feasibility Study is
$100,000.
5. The CITY agrees that upon execution of this Agreement by both parties, the COUNTY's
proof of acquiring a pre-qualified engineering firm, and receipt of an invoice from the
COUNTY, the CITY will pay to the COUNTY in a lump sum an amount equal to 100%of
its obligation incurred under this Agreement, an amount not to exceed $25,000.
6. The COUNTY shall provide the CITY with a copy of the Feasibility Study upon its
completion by the State of Illinois pre-qualified engineering firm.
This AGREEMENT and the covenants contained herein shall be null and void in the
event the contract covering the Feasibility Study contemplated herein is not awarded within the
three years subsequent to execution of the agreement.
This Agreement shall be binding upon and to the benefit of the parties hereto, their
successors and assigns.

SUBJECT: Intergovernmental Agreement with Kane County for Participation in Funding a
Feasibility Study for the Randall Road and U.S. Route 20 Interchange
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider executing an agreement with Kane County for cost participation in a
feasibility study for roadway improvements at the Randall Road/U.S. Route 20 interchange.
rk. RECOMMENDATION
It is recommended that the City Council authorize execution of the Intergovernmental
Agreement with Kane County for participation in funding of a feasibility study for improvements
at the Randall Road and U.S. Route 20 interchange in the amount of$25,000.
BACKGROUND
Kane County has recently contracted with a consultant to complete a feasibility study for
improvements to the Randall Road/U.S. Route 20 interchange. With the expected dramatic
increase in population in Kane County over the next twenty years, it is recognized that
diminishing safety and increasing congestion will become a major problem for this intersection.
The feasibility study will look at various intersection alternatives, determine future traffic
demands and provide preliminary project cost estimates.
Kane County is requesting that the City participate in the cost of the feasibility study. The
results of this study will have a major impact on the ability of traffic to move at an acceptable
level of service through the subject intersection. The not-to-exceed cost of the study is $100,000.
The City's share of the cost will be $25,000. A copy of the Intergovernmental Agreement is
attached as Exhibit A.

FINANCIAL IMPACT
The City's share of the cost for the feasibility study is $25,000. A budget transfer of$25,000
will be necessary to fund this initiative. A transfer from account number 275-0000-791.47-00
"Special Events Expense" where sufficient funds have been budgeted ($225,000) and are
available ($225,000) is recommended. This project will be established in the Riverboat Fund,
account number 275-0000-791.30-99, project number 039695, "U.S 20/Randall Feasibility
Study".

ALTERNATIVES
1. The City Council may choose to authorize execution of the Intergovernmental
Agreement as recommended.
r 2. The City Council may choose not to authorize execution of the Intergovernmental
Agreement.
