Beeter, Deputy Chief of Police �afc Cmlrnnrrrity SUBJECT: Acceptance of Department of Justice Edward Byrne Memorial Justice Assistance Grant PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider accepting a Department of Justice Edward Byrne Memorial Justice Assistance Grant. RECOMMENDATION It is recommended that the City Council approve the acceptance of the Department of Justice Grant in the amount of$146,120 and authorize the Chief of Police to sign the grant agreement. BACKGROUND The Edward Byrne Memorial Justice Assistance Grant (JAG) Program (42 U.S.C. 3751(a)) is the primary provider of federal criminal justice funding to state and local jurisdictions. JAG funds support all components of the criminal justice system, from multi-jurisdictional drug and gang task forces to crime prevention and domestic violence programs, courts, corrections, treatment, and justice information sharing initiatives. The JAG formula includes a state allocation consisting of a minimum base allocation with the remaining amount determined on population and Part 1 violent crime statistics and a direct allocation to units of local government. Once the state allocation is calculated, 60 percent of the funding is awarded to the state and 40 percent to eligible units of local government. A joint grant application was submitted including Kane County, City of Aurora and the Village of Carpentersville. The $146,120 grant award was allocated to the City of Elgin ($46,851), City of Aurora ($84,358) and the Village of Carpentersville ($14,911). Kane County has waived its right to the funds. The Elgin Police Department is proposing to expand our surveillance capabilities in an attempt to capture gang members as well as drug dealers involved in criminal activities. These efforts will greatly enhance our ability to successfully arrest and prosecute these individuals. The JAG i Department of Justice—Edward Byrne Memorial Justice Assistance Grant October 5, 2007 Page 2 Grant allocation would allow the purchase of additional covert cameras and recording systems primarily for use in vehicles to surreptitiously capture criminal activity. The systems will transmit video via the internet to the Elgin Police Department for remote viewing and will also allow for remote control of the systems functions. Additionally, we would purchase three DVR recorders for the capturing of covert video primarily from fixed sites; purchase a Beacon for covert operations that would benefit from a '`trip wire" style of silent notification of activity, as well as two GPS data loggers to covertly record vehicle movement. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None FINANCIAL IMPACT The Department of Justice grant award equals $146,120 with Elgin's share totaling $46,851. The grant requires, among other special conditions, compliance with the organizational audit requirements of OMB Circular A-133 which would entail additional audit fees up to $1,000. There are sufficient funds budgeted ($33,210) and available ($12,120) in the General Fund, Police Department, Misc. Professional Services, account number 010-2301-731.30-99 to pay for the additional audit services. For grant purposes, the City of Elgin is considered the sole grantee and therefore the Police Department will be responsible for coordination, administration and adherence of all grant requirements among the three participating police agencies. LEGAL IMPACT None ALTERNATIVES 1. The City may choose to accept the Grant. 2. The City may choose to not accept the grant and continue to explore additional funding sources.
