WHEREAS, the parties hereto have previously entered into an Agreement for certain professional engineering services, dated March 8th, 2002, attached hereto as Attachment"A" (hereinafter referred to as "ORIGINAL AGREEMENT"); as modified by Amendment Agreement No. 1, dated February 11, 2004, attached hereto as Attachment B (hereinafter referred to as the"First Amendment Agreement"), and as further modified by Amendment Agreement No. 2, dated December 21, 2005, attached hereto as Attachment C (hereinafter referred to as the"Second Amendment Agreement"); and WHEREAS, Paragraphs IV (A) and (B) of the Original Agreement, as modified by the First Amendment Agreement, and as further modified by the Second Amendment Agreement, provided for a maximum payment of$688,310.71; and WHEREAS, the parties hereto have each determined it to be in their best interest to amend Original Agreement; and WHEREAS, the CITY has determined that the proposed scope of the PROJECT should be modified to include an additive alternate site for onsite stockpiling, requiring additional professional engineering services; and WHEREAS, the CITY has determined that the proposed schedule of the PROJECT be modified to start in the fall of 2007 (rather than the previous date of Spring 2006)with a contract completion date of October 31, 2008, requiring additional professional engineering services; and WHEREAS, the parties have agreed to increase the maximum payment amount under the Original Agreement, as modified by the First Amendment Agreement and the Second Amendment Agreement, by$128,045.66 for such additional professional engineering services, as more fully described herein; and WHEREAS, the circumstances necessitating the change in performance contemplated by this amendment were not reasonably foreseeable at the time Original Agreement was signed; the change contemplated by this Amendment Agreement is germane to the original agreement as signed; and this Amendment Agreement is in the best interests of City and is authorized by law. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, and other good and valuable consideration, the sufficiency of which is hereby mutually acknowledges, the parties hereto hereby agree as follows: amendment 3_revised final_9-06-07.doc Page 1 of 2 02265-01 9/6/2007 1. Section I (B) of the Original Agreement is hereby amended by adding the following additional text to the end thereof which reads as follows: "ENGINEER shall also perform the additional services for the PROJECT to include an additive alternative site for the earthwork stockpile area and to provide additional construction phase services." 2. Section I (C) of the Original Agreement is hereby amended by adding the following additional text to the end thereof which reads as follows: "A detailed Scope of Services for the additional services provided by the Third Amendment Agreement is attached hereto as Attachment D ." 3. Paragraph IV (A) is hereby amended to read as follows: "For services provided by the ENGINEER as described in Attachment A of Original Agreement, as described in the First Amendment Agreement, as described in the Second Amendment Agreement and as described in the Third Amendment Agreement, ENGINEER shall be reimbursed at the rate of 3.0 times the direct hourly rate of personnel employed on this PROJECT as set forth in Attachment E of this Third Amendment Agreement, with the total fee not to exceed $816,356.37 regardless of the actual time expended or actual costs incurred by the ENGINEER unless substantial modifications to the Scope of Work are authorized in writing by the DIRECTOR." 4. Paragraph IV (B) is hereby amended to read as follows: "For outside services provided by other firms or subconsultants, the CITY shall pay the ENGINEER the invoiced fee to the ENGINEER, plus five percent (5%). Any such payment or payments to the ENGINEER for outside services are included in the total fee provided in subparagraph IV (A) above and shall not cause the total cost of the project to exceed $816,356.37." 5. Except as amended by the First Amendment Agreement, Second Amendment Agreement and this Third Amendment Agreement the Original Agreement between the parties shall remain full force and effect. (hereinafter referred to as'ENGINEER"). WHEREAS, the CITY desires to engage the ENGINEER to furnish certain professional services in connection with Design Services for the Spartan Drive Extension—Section 2 (hereinafter referred to as the'PROJECT"). AND WHEREAS,the ENGINEER represents that he is in compliance with Illinois Statutes relating to professional registration of individuals and has the necessary expertise and experience to furnish such services upon the terms and conditions set forth herein below. NOW,THEREFORE, it is hereby agreed by and between the CITY and the ENGINEER that the CITY does hereby retain the ENGINEER for and in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby acknowledged to act for and represent it in all engineering matters involved in the PROJECT,subject to the following terms and conditions and stipulations,to-wit: 1. SCOPE OF SERVICES A_ All work hereunder shall be performed under the direction of the Director of Public Works of the CITY, herein after referred to as the"DIRECTOR". B. In general,the ENGINEER's work shall include,but not limited to,the following major engineering activities, the ENGINEER will provide contract bid documents to the CITY for the Spartan Drive Extension—Section 2 project. The ENGINEER will also assist the CITY in applying for any necessary permits for the construction of the project. C. A detailed Scope of Services is attached hereto as Attachment A. II. PROGRESS REPORTS A. Estimated notice to proceed date is February 14, 2002 with completion on December 13, 2002. B. A project schedule for the Project is included as Attachment B, attached hereto. Progress will be recorded on the project schedule and submitted monthly as a component of the Status Report described in C below. C. The Engineer will submit to the Director monthly a Status Report keyed to the Project Schedule. A brief narrative will be provided identifying progress, findings and outstanding issues_ III. WORK PRODUCTS A. All work products prepared by the ENGINEER pursuant hereto including, but not limited to, reports, designs, calculations, work drawings, studies, Page 2 photographs, models and recommendations shall be the property of the CITY and shall be delivered to the CITY upon request of the DIRECTOR provided, however,that the ENGINEER may retain copies of such work products for its records. Such work products are not intended or represented to be suitable for reuse by the CITY on any extension to the PROJECT or on any other project, and such reuse shall be at the sole risk of the CITY without liability or legal exposure to the ENGINEER. IV. PAYMENTS TO THE ENGINEER(Not To Exceed Method) A. For services provided by the ENGINEER as described in Attachment A,he shall be reimbursed at the rate of 3_0 times the direct hourly rate of personnel employed on this PROJECT as set forth in Attachment C,with the total fee not to exceed $185,353.47 regardless of the actual time expended or actual costs incurred by the ENGINEER unless substantial modifications to the scope of the work are authorized in writing by the DIRECTOR. B. For outside services provided by other firms or subconsultants,the CITY shall pay the ENGINEER the invoiced fee to the ENGINEER, plus 5%. Any such payment or payments to the ENGINEER for outside services are included in the total fee and shall not cause the total cost of the project to exceed$185,353.47. C. The CITY shall make periodic payments to the ENGINEER based upon actual progress within 30 days after receipt and approval of invoice. V. INVOICES A. The ENGINEER shall submit invoices in a format approved by the CITY_ Progress reports(II. C above)will be included with all payment requests. B. The ENGINEER shall maintain records showing actual time devoted and cost incurred. The ENGINEER shall permit the authorized representative of the CITY to inspect and audit all data and records of the ENGINEER for work done under this Agreement. The ENGINEER shall make these records available at reasonable times during the Agreement period, and for a year after termination of this Agreement. VI. TERMINATION OF AGREEMENT Not withstanding any other provision hereof, the CITY may terminate this Agreement at any time upon fifteen (15)days prior written notice to the ENGINEER. In the event that this Agreement is so terminated, the ENGINEER shall be paid for services actually performed and reimbursable expenses actually incurred prior to termination, except that reimbursement shall not exceed the task amounts set forth under Paragraph IV above. Page 3 VII. TERM This Agreement shall become effective as of the date the ENGINEER is given a notice to proceed and, unless terminated for cause or pursuant to Article VI,shall be deemed concluded on the date the CITY determines that all of the ENGINEER's work under this agreement is completed. A determination of completion shall not constitute a waiver of any rights or claims which the CITY • may have or thereafter acquire with respect to any term of provision of the • Agreement VIII. NOTICE OF CLAIM If the ENGINEER wishes to make a claim for additional compensation as a result of action taken by the CITY, the ENGINEER shall give written notice of his claim within 15 days after occurrence of such action. No claim for additional compensation shall be valid unless so made. Any changes in the ENGINEER's fee shall be valid only to the extent that such changes are included in writing signed by the CITY and the ENGINEER. Regardless of the decision of the DIRECTOR relative to a claim submitted by the ENGINEER, all work required under this Agreement as determined by the DIRECTOR shall proceed without interruption. IX. BREACH OF CONTRACT If either party violates or breaches any term of this Agreement, such violation or breach shall be deemed to constitute a default, and the other party has the right to seek such administrative,contractual or legal remedies as may be suitable to the violation or breach; and, in addition, if either party, by reason of any default, fails within fifteen(15)days after notice thereof by the other party to comply with the conditions of the Agreement, the other party may terminate this Agreement X. INDEMNIFICATION To the fullest extent permitted by law, ENGINEER agrees to and shall indemnify, defend and hold harmless the CITY, its officers, employees, agents, boards and commissions from and against any and all claims,suits,judgments,costs, attorney's fees, damages or other relief, including but not limited to workers' compensation claims in any way resulting from or arising out of negligent actions or omissions of the ENGINEER in connection herewith, including negligence or omissions of employees or agents of the ENGINEER arising out of the performance of this Agreement. In the event of any action against the CITY, its officers, employees, agents, boards or commissions,covered by the foregoing duty to indemnify, defend and hold harmless such action shall be defended by legal counsel of the CITY's choosing. Xl. NO PERSONAL LIABILITY No official, director, officer, agent or employee of the CITY shall be charged personally or held contractually liable under any term or provision of this Agreement or because of their execution, approval or attempted execution of this Agreement. Page 4 XII. INSURANCE A. Comprehensive Liability. The ENGINEER shall provide, pay for and maintain in effect,during the term of this Agreement, a policy of comprehensive general liability insurance with limits of at least$1,000,000 aggregate for bodily injury and $1,000,000 aggregate for property damage. The ENGINEER shall deliver to the DIRECTOR a Certification of Insurance naming the CITY AS ADDITIONAL INSURED. The policy shall not be modified or terminated without thirty(30)days prior written notice to the DIRECTOR. The Certificate of Insurance which shall include Contractual obligation assumed by the ENGINEER under Article X entitled"Indemnification"shall be provided. This insurance shall apply as primary insurance with respect to any other insurance or self-insurance programs afforded to the CITY. There shall be no endorsement or modification of this insurance to make it excess over other available insurance, alternatively, if the insurance states that it is excess or prorate, it shall be endorsed to be primary with respect to the CITY. B. Comprehensive Automobile Liability. Comprehensive Automobile Liability Insurance covering all owned, non-owned and hired motor vehicles with limits of not less than$500,000 per occurrence for damage to property. C. Combined Single Limit Policy. The requirements for insurance coverage for the general liability and auto exposures may be met with a combined single limit of$1,000,000 per occurrence subject to a$1,000,000 aggregate. D. Professional Liability. The ENGINEER shall carry Engineer's Professional Liability Insurance Covering claims resulting from error, omissions or negligent acts with a combined single limit of not less than$1,000,000 per occurrence. A Certificate of Insurance shall be submitted to the DIRECTOR as evidence of insurance protection. The policy shall not be modified or terminated without thirty(30)days prior written notice to the DIRECTOR. XIII. CONSTRUCTION MEANS, METHODS,TECHNIQUES, SEQUENCES, PROCEDURES AND SAFETY The ENGINEER shall not have control over or charge of and shall not be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the construction, unless specifically identified in the Scope of Services. XIV. NONDISCRIMATION In all hiring or employment made possible or resulting from this Agreement, there shall be no discrimination against any employee or applicant for employment because of sex, age, race, color, creed, national origin, marital status, of the presence of any sensory, mental or physical handicap, unless based upon a bona fide occupational qualification, and this requirement shall apply to, but not be limited to, the following: employment advertising, layoff or termination, rates of pay or other forms of compensation and selection for training, including apprenticeship. Page 5 No person shall be denied or subjected to discrimination in receipt of the benefit of any services or activities made possible by or resulting from this Agreement on the grounds of sex, race,color,creed, national origin, age except minimum age and retirement provisions, marital status or the presence of any sensory, mental or physical handicap. Any violation of this provision shall be considered a violation of a material provision of this Agreement and shall be grounds for cancellation, termination or suspension, in whole or in part, of the Agreement by the CITY. XV. ASSIGNMENT AND SUCCESSORS This Agreement and each and every portion thereof shall be binding upon the successors and the assigns of the parties hereto; provided,however,that no assignment shall be made without the prior written consent of the CITY. XVI. DELEGATIONS AND SUBCONTRACTORS Any assignment, delegation or subcontracting shall be subject to all terms, conditions and other provisions of this Agreement and the ENGINEER shall remain liable to the CITY with respect to each and every item,condition and other provision hereof to the same extent that the ENGINEER would have been obligated if it had done the work itself and no assignment,delegation or subcontract had been made. Any proposed subcontractor shall require the CITY's advanced written approval. XVII. NO CO-PARTNERSHIP OR AGENCY This agreement shall not be construed so as to create a partnership,joint venture, employment or other agency relationship between the parties hereto. XVIII. SEVERABILITY The parties intend and agree that, if any paragraph, sub-paragraph, phrase, clause or other provision of this Agreement,or any portion thereof, shall be held to be void or otherwise unenforceable, all other portions of this Agreement shall remain in full force and effect. XIX. HEADINGS The headings of the several paragraphs of this Agreement are inserted only as a matter of convenience and for reference and in no way are they intended to define, limit or describe the scope of intent of any provision of this Agreement, nor shall they be construed to affect in any manner the terms and provisions hereof or the interpretation or construction thereof. XX. MODIFICATION OR AMENDMENT This Agreement and its attachments constitutes the entire Agreement of the parties on the subject matter hereof and may not be changed, modified, discharged or extended except by written amendment duly executed by the parties. Each party agrees that no representations or warranties shall be binding upon the other party unless expressed in writing herein or in a duly executed amendment hereof, or change order as herein provided. • Page 6 XXI. APPLICABLE LAW This Agreement shall be deemed to have been made in, and shall be construed in accordance with the laws of the State of Illinois. Venue for the resolution of any disputes or the enforcement of any rights pursuant to this agreement shall be in the Circuit Court of Kane County, Illinois. XXII. "-1`IEWS RELEASES The ENGINEER may not issue any news releases without prior approval from the DIRECTOR, nor will the ENGINEER make public proposals developed under this Agreement without prior written approval from the DIRECTOR prior to said documentation becoming matters of public record. XXIII. COOPERATION WITH OTHER CONSULTANTS The ENGINEER shall cooperate with any other consultants in the CITY's employ or any work associated with the PROJECT. XXIV. INTERFERENCE WITH PUBLIC CONTRACTING The ENGINEER certifies hereby that it is not barred from bidding on this contract as a result of a violation of 720 ILCS 5/33E et seq. Or any similar state or federal statute regarding bid rigging. XXV. SEXUAL HARASSMENT As a condition of this contract,the ENGINEER shall have written sexual harassment policies that include, at a minimum,the following information: A. the illegality of sexual harassment; B. the definition of sexual harassment under state law; C. a description of sexual harassment, utilizing examples; D. the vendor's internal complaint process including penalties; E. the legal recourse, investigative and complain process available through the Illinois Department of Human Rights, and the Illinois Human Rights Commission; F. directions on how to contact the department and commission; G. protection against retaliation as provided by Section 6-101 of the Human Rights Act. A copy of the policies must be provided to the Department of Human Rights upon request 775 ILCS 5/2-105. • Page 7 XXVI. WRITTEN COMMUNICATIONS All recommendations and other communications by the ENGINEER to the DIRECTOR and to other participants which may affect cost or time of completion, shall be made or confirmed in writing. The DIRECTOR may also require other recommendations and communications by the ENGINEER be made or confirmed in writing. XXVII. NOTICES All notices,reports and documents required under this Agreement shall be in writing and shall be mailed by First Class Mail, postage prepaid, addressed as follows: A. The project is anticipated to begin on February 14,2002 with final plans to be completed by end of 2002. B. Scope will include Plans,Specifications and Engineers Estimate of Probable Cost. C. Scope assumes two plan submittals. (Pre-final and Final submittals) D. R.O.W. plat preparation is not included in the scope. It is assumed that R.O.W. acquisition will not be required. E. Review of documents will include the following: 1. Project Development Report and Phase I files.(provided by City of Elgin) 2. Phase II files.(provided by City of Elgin) 3. Soil Reports that were completed by Testing Services Corporation.(provided by City of Elgin) 4. Environmental Report completed by Huff&Huff,Incorporated.(provided by City of Elgin) 5. Existing roadway plans(provided by City of Elgin) 6. Existing and proposed R.O.W.plans.(provided by City of Elgin) 7. Existing utility atlases. 8. Survey data and ground control(provided by City of Elgin) 9. Review of existing CADD files. (provided by City of Elgin) F. Wetlands are located within the project limits and will be impacted during construction. CMT's sub-consultant(Christopher B.Burke Engineering West,Ltd.) will assist in the coordination of wetland mitigation and will prepare permit application and required exhibits to be submitted to the United States Army Corp of Engineers. Data Collection and Review A. Document review: As identified in the"General" section above, item F. B. Field Checks: 1. A detailed field check of the existing survey will be performed to determine any additional survey needs. 2. A plan in hand field check will be conducted after the pre-final submittal. Spartan_Project Scope.doc Attachment A C. Photo Log: A photo log of existing conditions will be prepared for the project. We will assume 5 rolls of film will be incorporated into the log. II. Field Surveys (assume 2 person crew) The man-hour estimate assumes a complete survey will be required to create a Digital Terrain Model(DTM)for use in preparing cross sections. This scope assumes that control points have been set. A crew day will consist of a 2-person crew,which equates to 18 hours per crew day assuming 9-hour workdays. Hydraulic surveys are not included. CMT will perform the following survey work items: A. Preliminary Field Work: 1. Preliminary fieldwork to re-establish the project control. 2. Run level circuit between benchmarks to verify closure and set temporary benchmarks. 3. Download and incorporate survey information to create Digital Terrain Model. 4. CMT will layout the PI's,PC's and PT's for the proposed alignment. B. Topographic Surveys: CMT will conduct topographical surveys that will include 500' of existing Spartan Drive to the eastern tie-in point of proposed Spartan Drive. Width of the survey to extend 25' beyond proposed R.O.W. Topographic surveys will be approximately 3500' in length. C. Cross-Sections: Cross sections will be taken at 100'. III. Roadway Plans,Specs.,and Quantities A. The roadway construction limits will be approximately 2660' of Spartan Drive, approximately 266' of College Parking Lot Access Drive. (2926' total) B. Bike Path design is include in the project scope and man-hours. C. Estimate of MOT sheets has assumed 2 stages of traffic control for the project. The MOT sheets will be shown at a I"=20' scale. D. Plan and profile sheets will be shown at a 1"=20' scale with the proposed and existing plan shown in the same view. CMT will review the profile that was developed as part of the Project Development Report and make necessary changes. It is assumed that the alignment will be the same as the Project Development Report and it will not require any changes. (Estimated 6 Sheets) E. CMT will review the proposed pavement design for the permanent pavement based on the TSC soil report from 3/3/2000. The soil report indicated poor soil conditions and recommended additional borings for further investigation. TSC will perform any additional soil borings. F. The drainage and utility sheets will include the design of a proposed closed drainage system,proposed sanitary system and design of proposed watermain. Pavement marking and signing plans will be shown at 1"=20',with 2 views per sheet.(Estimated 4 sheets) H. Roadway Lighting Plans will be included as part of the scope of work. The lighting plans will be prepared at a 1'=20"scale,with 2 views per sheet(Estimated 4 sheets). Photometric calculations will also be conducted as part of this scope. CMT will coordinate with the City regarding the architectural design of the street light poles I. Erosion Control plans will be included as part of the scope of work. The erosion control plans will be prepared at a 1"=50' scale for each of the 2 traffic control stages. (Estimated 4 sheets) J. Detention pond plans and contours will be prepared at a 1"=50' scale. K. Cross sections will incorporate staged construction and earthwork computations per the January 1,2002 Standard Specifications for Road and Bridge Construction_ The cross sections will be spaced at 100' intervals. There will be an estimated total of 30 sections shown,with an average of 4 sections per sheet(Estimated 8 sheets). IV. Structural Plans for Open Detention Pond The Project Development Report and the Soil Boring Report discussed the possibility of a single- span or 2-span bridge structure over one of the existing open water ponds located on the golf course at approximately Sta.23+00. CMT will provide the following services for this task item: A. Re-evaluate the need for a bridge structure or box culvert. (Work to be completed by CMT's sub-consultant Christopher B.Burke Engineering West, Ltd.) B. Prepare bridge plans in conformance with IDOT and City of Elgin requirements.(If required) C. Prepare box culvert plans in conformance with IDOT and City of Elgin requirements. (If required) V. Permits A. Permits Application Preparation: CMT will be responsible for preparing the following permit applications. 1. IEPA—Water Pollution Control Permit(Sanitary Sewer Permit) 2. IEPA—Public Water Supplies Permit(Watermain) 3. IEPA—NPDES Permit(If required) 4. United States Army Corp of Engineers Permit 5. Wetland Permit 6. Kane County Stormwater Permit(If required) Spartan_Project_Scope.doc Attachment A VI. Meetings and Coordination A. Monthly Progress Meetings: Assume monthly progress meetings with the City of Elgin. Assume 6 man-hours for each meeting. (Assume 10 meetings—60 hours total) .B. Kick-off Meetings: 1. Project Kick-off meeting between CMT Project Team and City of Elgin. 2. No additional work required under this item. II. Field Surveys A. Additional Topographic Surveys: Provide additional topographic surveys for the location of the wetland detention pond for limits outside the current project limits for incorporation into the Spartan Drive Plans. B. Provide layout and staking of wetland and buffer limits when final determination of these limits has been established by the Corps of Engineers. C. Complete topographic surveys and partial cross-sections of the completed athletic fields (Baseball and Soccer Facilities)constructed by the Elgin Community College for incorporation into the Spartan Drive Plans. D. Down load and file additional surveys. E. Bike Path 1. Preliminary Field Work: a. Preliminary fieldwork to extend the project horizontal and vertical control. b. Run level circuit between benchmarks to verify closure and set temporary benchmarks. c. Download and incorporate survey information to create Digital Terrain Model. 2. Topographic Surveys: CMT will conduct topographical surveys for the northerly half of existing Spartan Drive(centerline to 25' beyond right-of-way)from the project limits at Lehr Drive to McLean Blvd. The width of the survey will extend 25' beyond existing R.O.W. Topographic surveys will be approximately 3000' in length. 3. Cross-Sections: Cross sections will be taken at 50' intervals for the same limit as the topographic survey(25' beyond the existing R.O.W.).The cross section will be used to create the working digital terrain model. J. Revise construction quantities to include changes due to the inclusion of the new wetland detention pond,Corps of Engineers buffer requirements. K. Revise Summary of Quantity Sheets. L. Revise contract documents and specification to include wetland buffer and plan revisions requirements. M. Revise Engineers Estimate of Probable Construction Cost. N. Bike Path 1. The bike path construction limits will be approximately 3000' on existing Spartan Drive from Lehr Drive to McLean Blvd(approximately sta.41+67 to 71+67).The bike path extension plan will only detail the northerly half of roadway. Traffic control for this work will consist of adding General Notes and IDOT Traffic Standard references to the previously completed MOT Plan Sheets. 3. It is estimated the two additional plan sheet will be required to show the bike path work.The plan sheets will be shown as a split panel sheet at a 1"=40' scale with the proposed and existing plan shown in the same view. Grades will be reviewed but not included in the plans sheets.Per direction from the City the bike path will be constructed to reasonably match the existing ground line.Therefore, a profile will not be included as part of this work. (Estimated 2 Sheet) 4. The pavement design for the bike path will be assumed to be the same as the current bike path design of 2"of bituminous surface course on a 6"of aggregate base course. There is no soils information for the proposed bike path extension area.It will be assumed that the soil conditions for this section of the project are adequate for the construction of the bike path.If poor soils conditions exist,they will be addressed during the construction phase.A typical section detailing the bike path will be developed and provided as part the new plan sheets. 5. Erosion Control and landscaping plans will be combined and added as separate sheets. The erosion control and landscaping plans will be prepared at a 1"=40' scale for each of the 2 plan sheets. (Estimated 2 sheets) 6. Working cross sections will be developed to aid in the design but will not be included in the contract plans. 7. Quantities for this section of work will be completed and included in the appropriate pay items established within the current roadway design contract documents. 8. Additional notes or special provisions for this work are anticipated to be added to the current plans or special provisions. IV. Watermain Design A. No additional work required under this item. V. Sanitary Sewer Design A. Revise Drainage and Utility Sheets and Sanitary Sewer Profile to include sanitary sewer system as original proposed by ECC. VI. Bridge Design For Open Detention Pond A. No additional work required under this item. VII. Permits A. Revise and re-submit IEPA—Water Pollution Control Permit(Sanitary Sewer Permit. B. Bike Path There is an existing detention pond and outlet structure on ECC property that the bike path will be adjacent to or cross over. Since the pond outlets to an unnamed tributary of Otter Creek,the pond and outlet will be under Corps of Engineers jurisdiction.If the bike path can be designed to maintain a 10'-15' buffer between the pond and the bike path and assuming that no modification is required to the outlet structure,a permit should not be required. The bike path work will be based on this assumption and will not include any work associated with mitigating,coordination or permitting for wetlands or Waters of the US for this section of the project. VIII. Meetings and Coordination A. Additional meetings and coordination with the City,Elgin Community College,and Corps to discuss and coordinate project issues involving the wetland,wetland buffers and ECC Athletic Field. B. Coordinate and attend the Public Information Meeting for project. Prepare exhibits as required for the Public Hearing Meeting(if required by Corps.). C. Coordinate and complete follow-up task as result of the Public Information Meeting. D. Bike Path 1. This project will require additional coordination with the City of Elgin, Elgin Community College. One(1)Meeting is anticipated. 2. This project will require continual verbal coordination through use of e-mail, correspondence or phone conversations with the City of Elgin,Elgin Community College. Elginscope spartan_combinedsuppl2 11_4 O5.doc Attachment C PHASE III ENGINEERING-CONSTRUCTION SERVICES The project schedule will be based on an anticipated construction period from May 30,2006 thru November 23,2006. We have assumed an additional three months of inspection beyond the substantial completion date of November 23,2006 for the punch list items,final and balancing pay request,and change orders. We propose to staff the project with a full time Resident Engineer,a part time inspector and a Project Manager to provide contract administration and agency coordination issues. C-I. Project Start Up A. Project kick-off meeting with all stakeholders associated with the project(City of Elgin, Elgin Community College, etc.). B. Attend and facilitate the pre-construction meeting,distribute notices to affected agencies, prepare and distribute minutes of the meeting. C. Photograph the project site and create an"existing conditions"photo log. D. Set up field file and records. C-II. Shop Drawing Reviews A. Develop shop drawing submittal requirements and assist Contractor in development of submittal schedules. Review and monitor compliance with submittal schedules. B. Record and maintain a shop drawing submittal and approval log and notify the Contractor whenever submittals are lacking or untimely. C. Review roadway lighting shop drawings. D. Review of structural shop drawings for headwalls,box culverts and pedestrian wall. E. Review of miscellaneous catalog cut submittals(i.e.: watermain,sanitary, storm, etc.). C-III. Initial Project Control and Layout Checking A. Establish the initial project vertical and horizontal control(base bid),the estimated effort included assumes the 5 control points identified on the plans are recoverable, and a line of sight can be established between at least 2 of the points. B. Periodic checking of contractor layout(assume 1 crew day every other week). C-IV. Construction Observation A. Provide liaison and contract control activities. B. Conduct continuous and full-time(considered 50 hrs/week)on-site observations of the work in progress to determine that the project is proceeding in accordance with the Construction Contract Documents and the completed work will confonn to the requirements of the Construction Contract Documents. Coordinate and conduct a pre-final inspection of substantial project completion on or about November 1,2006,to generate punch list. B. Coordinate and resolve all pre-final inspection issues expected in the previous task,upon completion of installation,to generate punch list. C. Conduct a final inspection upon completion of punch list items. D. Prepare final construction record,and material certification. E. Prepare and submit record drawings,hard copy,in addition to an electronic version on disk,prepared in Microstation format. F. Assemble,copy,and deliver final job box. C-VI. Project Administration A. Periodic review of the Construction schedule prepared by the contractor,to inform all stakeholders of any adverse impacts to the critical path,or final completion.Any reference to preparation of the schedule or use of scheduling type software is not included. B. Attend and facilitate weekly on-site project meetings to discuss project schedules and issues specific to upcoming construction activities. Prepare and distribute minutes to attendees. C. Maintain orderly project records of on-site activities and construction record. D. Prepare bi-weekly progress reports and submit with subsequent pay request. E. Prepare applications for payment in accordance with the payout schedule included in the contract documents. Assume 13 applications will be prepared for this project. F. Provide an initial evaluation and recommendation for change order issues. Assume 2 change orders,plus a final balancing change order for the entire project. We have assumed an additional two months of inspection beyond the substantial completion date of October 31,2008 for the punch list items,final and balancing pay request,and change orders. We propose to staff the project with a full time Resident Engineer,a part time inspector and a Project Manager to provide contract administration and agency coordination issues. C-I. Project Start Up A. Project kick-off meeting with all stakeholders associated with the project(City of Elgin, Elgin Community College,etc.). B. Attend and facilitate the pre-construction meeting,distribute notices to affected agencies, prepare and distribute minutes of the meeting. C. Photograph the project site and create an"existing conditions"photo log. D. Set up field file and records. C-H. Shop Drawing Reviews A. Develop shop drawing submittal requirements and assist Contractor in development of submittal schedules. Review and monitor compliance with submittal schedules. B. Record and maintain a shop drawing submittal and approval log and notify the Contractor whenever submittals are lacking or untimely. C. Review roadway lighting shop drawings. D. Review of structural shop drawings for headwalls,box culverts and pedestrian wall. E. Review of miscellaneous catalog cut submittals(i.e.: watermain,sanitary, storm,etc.). C-III. Initial Project Control and Layout Checking A. Establish the initial project vertical and horizontal control(base bid),the estimated effort included assumes the 5 control points identified on the plans are recoverable,and a line of sight can be established between at least 2 of the points. Verify that tests are conducted as required by the Construction Contract Documents and in the presence of the required personnel,and that Contractors maintain and submit adequate records thereof; observe,record,and report to the city appropriate details relative to the test procedures.QC/QA Testing Compliance and all subgrade testing to be performed by a sub-consultant to be selected with the concurrence of the City of Elgin. C-V. Project Closeout and Final Inspection A. Coordinate and conduct a pre-final inspection of substantial project completion on or about October 1,2008,to generate punch list. B. Coordinate and resolve all pre-final inspection issues expected in the previous task,upon completion of installation,to generate punch list. C. Conduct a final inspection upon completion of punch list items. D. Prepare fmal construction record,and material certification. E. Prepare and submit record drawings,hard copy,in addition to an electronic version on disk,prepared in Microstation format. F. Assemble,copy,and deliver final job box. C-VI. Project Administration A. Periodic review of the Construction schedule prepared by the contractor,to inform all stakeholders of any adverse impacts to the critical path,or final completion.Any reference to preparation of the schedule or use of scheduling type software is not included. B. Attend and facilitate weekly on-site project meetings to discuss project schedules and issues specific to upcoming construction activities. Prepare and distribute minutes to attendees. C.
