FOR CONSTRUCTION OF TEMPORARY AND PERMANENT ACCESS ROADS TO THE HIGHLAND AVENUE WATER TANK T-11 WHEREAS, the City of Elgin has heretofore entered into a contract with Sinnett Builders, Inc. for construction of temporary and permanent access roads to the Highland Avenue Water Tank T-11; and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. Additional 1,000 Feet of Temporary Access Road The contract drawings provided for the temporary access road for the Highland Avenue Tank T-11 construction to cross the Iowa, Chicago and Eastern Railroad and then run north along an old farm driveway to Highland Avenue. Due to problems obtaining a license agreement from the Railroad for this crossing, it was necessary to re-route the temporary access road through the Williams and Crown Parcels south of the railroad tracks. This resulted in a net increase of 1,000 feet to the length of the temporary access road. Refer to the Contractor letter dated September 22, 2006. REASONS FOR CHANGE: Change Order Number One (1) is necessary and proper due to the following: 1. The circumstances set to necessitate the change performance were not reasonably foreseeable at the time the contract was signed. 2. The change is germane to the original contract as signed. 3. The change order is in the best interests of the City and authorized by law. CHANGES IN CONTRACT AMOUNT Adjustments to the Contract Price resulting from the aforementioned items shall be the negotiated lump sum prices covering all compensation due for the work as shown in Table 1. CHANGE IN CONTRACT TIME The following adjustments to the Contract Times shall be given for Work completed under this change order: Original Adjusted Completion Date Completion Date Substantial Completion October 14, 2006 November 3, 2006 Final Completion October 29, 2006 November 20, 2006 CHANGE ORDER NO. 1 Table 1 Summary of Contract Price Change ITEM ADD DEDUCT 1. Jacobsen, Water System Superintendent SUBJECT: Change Order No. 1 for the Construction of the Temporary and Permanent Access Roads to the Highland Avenue Tank T-11. PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider authorization of Change Order No. 1 with Sinnett Builders Inc. for the construction of temporary and permanent access roads to the Highland Avenue Tank T-11 project. elk RECOMMENDATION It is recommended that the City Council authorize the execution of Change Order No. 1 with Sinnett Builders Inc. for the construction of temporary and permanent access roads to the Highland Avenue Tank T-11 project for a total of$12,000. BACKGROUND On March 22, 2006 the City Council awarded an engineering contract to Rezek, Henry, Meisenheimer, and Gende (RHMG) in the amount of $108,150 for bidding and construction services for the Highland Tank and site work improvements. On July 12, 2006 the City Council awarded the construction contract in the amount of$2,016,000 of the Highland Water Tank T-11 to CBI Constructors of Plainfield, Illinois. On August 9, 2006 the City Council awarded the construction of temporary and permanent access roads to the Highland Avenue Tank T-11 project to Sinnett Builders Inc. of Elgin, Illinois. Change Order No. 1 includes an additional 1,000 feet of temporary access road. The original location of the access road as bid was modified due to restricted access from Highland Avenue. The road that was installed is accessed from Coombs Road through the Highland Woods subdivision and adds an additional 1,000 feet of roadway. The cost of the original contract with Sinnett Builders Inc. for the construction of the temporary and permanent access road to Highland Water Tank (T-11)was $296,000. Change Order Water—Change Order No. 1 Sinnett January 5, 2007 Page 2 No.1 with Sinnett Builders is for $12,000, which will bring the revised contract total cost to $308,000. A copy of the Change Order is attached for your review. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None FINANCIAL IMPACT The cost of Change Order No. 1 with Sinnett Builders, Inc. totals $12,000. Funding is available in the water portion of the 2006 General Obligation Bond Fund, account number 365-4000-795.92-41, "Capital Additions/Distribution Systems", project number 409651, "Highland Water Tower T11", ($2,000,000 budgeted and $873,490 available) and account number 420-0000-771.92-41, "Capital Additions/Distribution Systems", also project number 490651, ($1,540,000 budgeted and $118,582 available) to fund Change Order No. 1. LEGAL IMPACT 4)1None ALTERNATIVES 1. Authorize Change Order No. 1 as recommended. 2. Do not authorize the Change Order No. 1 at this time. Respectfully submitted for Council consideration.
