With: The County of Kane and the City of Elgin Agreement Description The Kane County Division of Transportation in lieu of a letter of credit requires this Letter of Agreement to ensure compliance with all County regulations and standards and the project shall not be terminated by the Municipality before the County's concerns have been addressed. Agreement The Kane County Division of Transportation(already stated above) shall be notified before final acceptance and the performance bond is released to Shodeen,Inc.The Municipality shall submit a copy of the Bond/Guarantee prior to issuance of the permit.All concerns and punch list items of the Kane County Division of Transportation shall be addressed by the municipality and/or its contractor before final payment is released. Should any item or deficiency not be addressed to the full satisfaction of the County Engineer,the Municipality will be responsible to correct the deficiency in a proposed manner acceptable to the County Engineer within 10 calendar days from the date of notice.If the deficiency is not corrected,the County may at the Municipalities expense,correct the deficiency and bill the Municipality for the deficiency which must be paid within 30 days.In addition,future permit applications will forfeit the use of the Letter of Agreement and the Letter of Credit will be required. DESCRIPTION OF PERMITTED IMPROVEMENTS The work will include a forced main sanitary crossing Damisch Road,a water main crossing Highland Avenue and 3 temporary construction access points. Utility Modification or New Construction: Location 1:Sanitary Sewer crossing-Approximately 880'south of the center line of Highland Avenue,the crossing of Damisch Road shall be installed by bore and jacking method.There shall be an approximate 15'by 40'boring and jacking pit located outside of the eastern right of way of Damisch Road and an approximate 15'by 40'receiving pit located outside of the western right of way of Damisch Road.The crossing shall include a 70'long 28"steel casing for a 14 inch sewer main.The casing ends shall be bricked and mortared.A KDOT inspector must witness the casing ends prior to backfilling. Location 2:12"Water main crossing-Approximately 35'east of the center line of Damisch Road,the crossing of Highland Avenue shall be installed by open trench method.One open lane of Highland Avenue shall be maintained at all times.Traffic control shall be per IDOT standards. >>>>Note:The trench shall be backfilled and the pavement repair shall be per the attached detail.A KDOT inspector must be on site for fiowable fill and paving.«« A portion of the Shodeen Inc.Highway Bond held by the City of Elgin equal to 125%of the estimated cost of the crossing shall be held for a period of 5 years to assure the quality of the crossings.Repairs of any failures related to the crossing shall be the responsibility of the Permittee for a period of 5 years from the completion of the crossings. Temporary Construction Access: The following temporary construction access points shall be used.All accesses shall conform to KDOTs standard detail (attached)and include a minimum 15"by 30'culvert.At the completion of the work,the accesses shall be removed and the right of way restored to the satisfaction of KDOT. PRE-CONSTRUCTION REQUIREMENTS 1 The County receives and approves a progress schedule for the Improvements. 2 The County conducts a pre-construction meeting.with the attendance of the County's Consultant(if applicable), Permittee and Permittee's Contractor. 3 Certificates of Insurance from the Permittee,contractor,and sub-contractors naming the County of Kane and the County's Consultant(if applicable)as additionally named insured. 4 Advanced Warning Signage and/or message board shall be posted by the Permittee and Kane County will prepare the press release notice(s)which will be published at least 72 hours prior to the start of construction. Notifications shall communicate the date when construction will start and the duration of the project. 5 The County receives a list of 24-hour contact numbers for all contractors,sub-contractors and traffic control maintenance contractor. 6 The County Signal Maintenance Contractor shall be contacted for identification and location of traffic signal, interconnect and approach lighting items in the County right-of-way. TRAFFIC CONTROL REQUIREMENTS 1 The County approval is required for any lane closure.Advanced Warning Signage and/or message boards posted at least 3 days in advance of construction activities that will cause significant disruption(i.e.work changing from one side of street to the other,lane closures,etc.)to the motoring public. 2 The Permittee shall be responsible for provisions of traffic control during construction. Traffic control shall be in accordance with the Illinois Department of Transportation standards and the Manual of Uniform Traffic Control Devices for highway construction,and approved engineering plans. +Cane County Division of Transportation Highway Permit ;�...,� 41W011 Burlington Road,St Charles,IL 60175 '53r Phone(630)584-1171 Fax(630)584-5239 3 The flow of traffic shall not be hindered at any time, unless authorized by the County. 4 The County shall limit work activities in the highway right-of-way if it is determined that such limitations are necessary to ensure the safety and efficiency of the motoring public. 5 The Kane County Division of Transportation reserves the right to control the operation and traffic movements of this Permit including future changes in operation and traffic movements needed because of improvements to or changing conditions of the County Highway. REQUIREMENTS FOR CONSTRUCTION ACTIVITY 1 No equipment(i.e.trenchers,backhoes,etc.)is authorized to operate on the pavement of the roadway and shall be operated outside the shoulders of the roadway unless pre-approved by the County of Kane. 2 No excavated and/or backfill material shall be stockpiled on the roadway or the shoulder of the roadway. 3 All disturbed areas in or adjacent to the highway right-of-way shall be properly barricaded overnight,on weekends, and on days when no work is being performed.Barricades shall be up and in conformance of the Illinois Department of Transportation standards at all times. 4 Unprotected open trenches are not allowed. 5 The Permittee shall be responsible for any revisions needed to accommodate construction due to unforeseen field conditions,highway maintenance,or safety problems that become apparent during construction. 6 The Permittee shall receive approval from the County for field changes needed prior to their implementation. 7 Pavement saw cutting is required when there is damage resulting from work activities,along edge of pavement for widening,or as directed by the County. • 8 The Permittee is responsible during construction for maintenance and upkeep of the right-of-way,vicinity highway pavement,and Improvements,and other as deemed necessary by the County.This includes,but is not limited to, removal of mud and debris from highway surface,and the maintenance of drainage systems and turf areas. 9 The Permittee shall be responsible for the provision and maintenance of soil erosion and sedimentation control devices as provided in approved Improvement plans. 10 The Improvements and work activities required to construct such shall not interfere with natural drainage of the road and the right-of-way. 11 The Improvements and work activities required to construct such shall not interfere with other area highway construction or maintenance projects. 12 Trees or shrubbery shall not be removed,cut,trimmed,or disturbed within the highway right-of-way without the approval of the County. 13 All permanent road signage shall be erected before roadways and accesses are opened to the motoring public. The Permittee is responsible for any required signs associated with the safe travel of the motoring public through the construction improvement. 14 Work shall be done on one side of the roadway at a time. PAVING OPERATIONS 9 Pavement markings shall be placed on the level binder or surface coarse prior to opening to traffic. AUTHORIZATION FOR TEMPORARY CONSTRUCTION ACCESS 1 Temporary Construction Access is permitted at the locations described on page 1 of this permit. 3 Authorization is contingent upon the installation of a mud tracking system to prevent the spread of debris and sediments in the County highway right-of-way.Mud tracking shall be placed for a minimum of 150'to allow mud and debris to fall free of the tires before entering the County highway right-of-way. If mud tracking does not prevent the deposition of mud and debris,a tire wash shall be constructed to clean mud and debris from tires before entering the roadway. Highway Permit , 41W011 Burlington Road,St Charles,IL 60175 Phone(630)584-1171 Fax(630)584-5239 4 Use is for construction traffic only. 6 The County reserves the rights to reduce,relocate,or eliminate the temporary access if it is found to be a traffic hazard or consistent mud and debris are placed on the pavement. 7 Temporary construction access is permitted for a maximum of one year from the Issuance date of this permit. SPECIAL 3 The Permittee shall notify the Permit Department prior to the installation of theTemporary Construction Access culvert and after the installation of the access for inspections and approval. 5 The access shall be constructed perpendicular to the County Highway up to the right-of-way line. 9 Loading or unloading of equipment or supplies will not be allowed in the County Highway right-of-way. 10 No equipment will be allowed to park along the County Highway right-of-way that will block or hinder traffic or sight lines. 12 At the end of the project the County will require an"As Built"set of plans.These plans shall include all changes that have been done in the field to complete the project.The improvements shall be tied in to the State Plane Coordinating System-Zone IL.E and North American Datum 83(NAD83). The record drawings shall be submitted in the form of a burned CD,as follows:a)Drawing format shall be Micro Station(.dgn)and/or AutoCad(.dwg);b) Plan sheets shall be included as a collection of scanned files or images as Tagged Information File Format(.tif) files. 17 Failure to complete the construction of the access described in this permit within one year of permit issuance date will result in the Permittee to re-apply for the access request. ENFORCEMENT AND SECURITY 2 Reduction in the letter of credit will not be granted if any previous bills have not been paid. 3 Violation of any condition of this permit may result in the suspension or revocation of the Temporary Construction Access. 4 The County shall suspend this permit without notice if any conditions are not followed. 5 The County shall suspend this permit due to a lack of progress. 6 The County has the right to modify the letter of credit for this permit to cure defaults(i.e.engineering review costs, construction observation,work activity deficiencies,improvement deficiencies,claims for prime damage,etc.). 7 The Permittee shall not perform any work or participate in any activity that is beyond the scope of this permit. MAINTENANCE&RELOCATION RESPONSIBILITIES 1 After completion and acceptance of these Improvements,the County shall maintain,in accordance with its normal maintenance policies,the drainage system including ditches,pavement widening including turning lanes,pavement markings and traffic control devices,curb and/or gutters,shoulders and turf area located within the right-of-way of the County Highway. 4 The County does not allow without a permit,alteration work in the highway right-of-way after the acceptance of the Improvements. Phone(630)584-1171 Fax(630)584-5239 1 The Permittee,its successors,grantees and assigns, covenants and agrees that it will not let or permit or suffer any lien to be put,placed upon,arise or accrue against the right-of-way or funds of the County in favor of any person or persons,individual or corporate,furnishing labor or material in any work contemplated herein.Permittee, its successors,grantees and assigns,further covenants and agrees to hold said right-of-way and/or funds of the County free from any and all liens,or rights or claims of lien which might arise or accrue under or be based upon any Mechanic's Lien Law of the State of Illinois either now in force or to be enacted.All contracts and agreements that may be made by Permittee or Permittee's contractor relating to any work herein proposed shall expressly state that the interest and reversion of the County in and to said right-of-way or funds shall be wholly free from and not subject to any lien or claim of any contractor,subcontractor,mechanic,material man or laborer whether passed upon any law,regulation of the State of Illinois,or any other authority, now in force or hereafter to be enacted,and Permittee or Permittee's contractor also agrees and covenants that it will not enter into any contract for such work which shall not in express terms contain the aforesaid provisions.The County does not allow without a permit, alteration work in the highway right-of-way after the acceptance of the Improvements. 2 This permit is effective only insofar as the County has jurisdiction and does not presume to grant any consent or privilege over any right-of-way or any part of any road which may be under the control or ownership of some other entity,individual or jurisdictional body or to release Permittee from compliance with the provisions of any laws or statutes relating to such construction. 3 The Permittee and all persons involved in the construction and other related activities of this permit shall indemnify, defend and hold harmless the County,including their elected and duly appointed officials,employees and representatives from and against any and all claims,suits,actions,losses,expenses,damages,injuries,deaths, judgments,and demands arising from and relating to the construction and other related activities. 4 The Permittee and all persons involved in the construction and other related activities of this permit shall pay all damages,judgments,costs and expenses,including attorney fees and court costs in connection with or resulting from the construction and other related activities of this permit regardless of any limitations of insurance coverage. 5 The Permittee shall be responsible for the repair of any damage to highway facilities and/or facilities of others located within the County Highway right-of-way caused by the construction of this permit or Improvements to the property served by this Permit This includes,but is not limited to,the highway pavement,shoulders,ditch lines and signage. I LICENSE AGREEMENT 1 This permit is effective only insofar as the County has jurisdiction and does not presume to grant any consent or privilege over any part of any road which may be under the control of some other jurisdiction body or to release Applicant from compliance with the provisions of any laws or statutes relating to such construction. 2 It is understood that the construction work permitted hereunder shall commense within one year after the date this permit is approved,unless an extension of a shorter or longer time is granted by the County Engineer.Otherwise, this permit shall become null and void. 3 Pemiittee,its successors,grantees and assigns,in performing the work shall not interfere with or obstruct traffic on said road or roads,and,as soon as practical after laying and constructing said Improvements,shall restore the road or roads to the former condition,including not limited to regrading shoulder,shoulder slope,ditch,and back slope to its original cross section,fertilizing,reseeding and covering same with mulch and replacing the aggregate shoulder along pavement.In the event any costs are incurred by the County that are directly necessary and attributed to interim maintenance of the above in order to provide safe road conditions,the Permittee,it successors,grantees and assigns,agrees to reimburse the County in full for all costs upon submission of a proper invoice covering and explaining the same. 4 Damisch Road Crossing:Permittee,its successors,grantees and assigns,shall install road crossing or crossings, without disturbing the existing surface or base of the roadway,by augering.All boring,augering,or jacking pits shall be a minimum of ten(10)feet from the closest edge of pavement or traveled portion of the road. 5 Damisch Road Crossing:Permittee,its successors,grantees and assigns,shall not carry on construction activity between the shoulder points of any of the County roads covered in this permit.All equipment,including trenchers, backhoes,and the like,shall at all times be operated outside the shoulder point limits.All excavated and backfill material shall be stockpiled or placed outside the shoulder point limits. 6 Permittee,its successors,grantees and assigns,shall lay,construct,operate,and maintain said Improvements so as not to interfere with the natural drainage of the road and so as not to interfere with the construction or maintenance of said road,and said Improvements shall be placed below the surface so as not to interfere with public travel as shown on the attached 60175 '}„a--nowu- Phone(630)584-1171 Fax(630)584-5239 7 Permittee,its successors,grantees and assigns,shall lay,construct,and erect said Improvements in such a manner as not to interfere with private entrances or subsurface drainage of properties now abutting on the highways or roads associated with this permit.If private entrances are disturbed,they shall be replaced by regrading,replacing aggregate and bituminous cover and fertilizing,seeding and mulching and replacing aggregate shoulders.If subsurface drainage tile is disturbed,it shall be properly repaired or replaced.The County shall not be liable for any damages,including crop damage,due to any act or failure to act of the Permittee associated with the requirements of this paragraph and the Permittee further hereby indemnifies and holds the County harmless regarding the same. 8 Permittee,its successors,grantees and assigns,shall not trim,cut or in any way disturb any trees or shrubbery along said highway without the approval of the County Engineer or his duly authorized representatives. 9 Permittee,its successors,grantees and assigns,shall assume all risks and liabilities and forever hold the County harmless for any and all accidents and damages that may accrue to persons or property that are in ANY WAY associated with or relating to the construction,laying, maintenance,and/or operation of said Improvements. 10 Permittee,its successors,grantees and assigns,shall notify the County Engineer not less than 48 hours in advance of the starting date of any work on the road or roads listed herein. 11 Permission for future maintenance work required on said Improvements is not granted by this permit.Individual work orders or permits will be granted by the County Engineer for future maintenance work on said Improvements that will disturb the road right-of-way. 12 The Permittee acknowledges that this permit does not grant an easement to the County right-of-way.Should the County's construction,operation,maintenance and/or future expansion of any highway or roadway associated with this permit require any alteration or change of location of the Improvement provided for in this permit,said requested alteration shall be made by the Permittee without expense to the County,upon a written request of the County Engineer. 13 All obligations,agreements,representations,warranties and indemnifications made hereunder shall survive the one(1)year construction period set forth in Paragraph 2 above. UTILITY PERMIT PROVISIONS 1 Traffic control shall meet or exceed IDOT Standards. 2 48 hours notice to KDOT before beginning work.630-584-1171 Monday thru Friday 8-4. 3 NO OPENCUT of any County Highway or other paved surface within the right of way without written permission from KDOT. 4 ANY discrepancies from approved plans will need KDOT approval in writing. 5 Upon completion of the project all disturbed areas within the County right-of-way shall receive a Minimum-Seeding Class 2A Salt Tolerant Roadside Mixture,fertilizer nutrients and erosion control blanket(North American Brand or equivalent)or salt tolerant sod with fertilizer nutrients. RECOMMENDATION It is recommended that the City Council authorize the City Manager to execute the highway permit and the letter of agreement with Kane County. BACKGROUND The development of the proposed subdivision by Shodeen, Inc. near Pingree Grove necessitates the extension of public sanitary sewer and water main. To extend these utilities to the property, sanitary sewer will be augured under Damisch Road and water main will be installed across Highland Avenue by an open cut method. These utilities are being constructed in accordance with City ordinance, Shodeen annexation agreements and the City's agreement with Shodeen and Crown to extend sanitary and water main to their developments. Kane County requires a highway permit due to the occupation of their rights-of-way for Damisch Road and Highland Avenue. The County permit requires a bond from the developers for the two crossings. However, the developers have asked the County to consider the letters of credit they already have on record with the City as sufficient bonding. In order to consider this method of bonding, the County requires a letter of agreement between the City and the County assuring the County that the City will not release the bonding until restoration work meets with the County's approval.
