RESOLUTION
APPROVING CHANGE ORDER NO. 1 AND FINAL IN THE CONTRACT
WITH SHALES MC NUTT CONSTRUCTION FOR THE
BOWES ROAD BOOSTER PUMP STATION
WHEREAS,the City of Elgin has heretofore entered into a contract with Shales McNutt for
the Bowes Road Booster Pump Station; and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 and Final, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,be and is hereby authorized and directed to
execute Change Order No. 1 and Final, a copy of which is attached hereto and made a part hereof by
reference.

BOWES ROAD BOOSTER PUMP STATION
CHANGE ORDER NO. 1 - FINAL
SCOPE
This Change Order No. 1 adjusts the Contract Price to account for additions and
modifications as indicated below.
BASIS FOR CHANGE
1. Bituminous Paving. Bituminous paving of the gravel access road around the
Bowes Road Booster Station is proposed to be included in the project to minimize
future maintenance.
2. Water Main and Fittings. The existing water main that was installed by others is
at a deeper elevation than anticipated requiring additional water main and fittings.
3. Shaft Sleeve and Impeller Wear Rings. Stainless steel shaft sleeve and impeller
wear rings have been requested in lieu of a bronze shaft sleeve and wear rings.
Change Order No. I is necessary and proper due to the following:
• The above changes were not anticipated for the reasons listed, at the time the
contract with Shales McNutt Construction was authorized.
• It is in the best interest of the Owner to approve the above changes.
• These changes are germane to the intent and scope of the original contract.
CHANGES IN CONTRACT AMOUNT
Adjustments to the Contract Price for Item 1 is based on an estimated quantity of 627
square yards of bituminous paving at $25.15 per square yard. Adjustments to the
Contract Price resulting from Item 2 and Item 3 shall be the negotiated lump sum prices
covering all compensation due for the work as shown in Table 1.
CHANGE IN CONTRACT TIME
No adjustments to the Contract Times shall be given for Work completed under this
change order.
NOTE: Asphalt work will take place in spring when asphalt
plants open.

SUBJECT: Change Order No. 1 for the Bowes Road Booster Pump Station
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider authorization of Change Order No. 1 and Final with Shales McNutt
Construction for the Bowes Road Booster Pump Station Project.
RECOMMENDATION
It is recommended that the City Council authorize the execution of Change Order No. 1 and
Final with Shales McNutt Construction for Bowes Road Booster Pump Station project for a total
of$23,231.
BACKGROUND
On March 22, 2006, the City Council awarded a contract for the construction of the Bowes Road
Booster Pump Station to Shales McNutt Construction, Inc. of Elgin, Illinois. The scope of the
work included the construction of a new cement masonry unit building with a brick facade,
furnishing and installation of two booster pumps with piping, valves, and appurtenances,
furnishing and installation of yard piping, valves, motor control center, electric and
instrumentation, security and radio telemetry, and construction of a gravel access road, fencing
and landscaping.
Change Order No. 1 and Final includes three work items that Shales McNutt will perform and
are listed as follows:
1. Bituminous Paving - of the gravel access road around the Bowes Road Booster Station to
minimize future maintenance.
2. Water Main and Fittings — the existing water main that was installed by previous
contractors is at a deeper elevation than anticipated and requires additional water main
and fittings.
3. Shaft Sleeve and Impeller Wear Rings — stainless steel shaft sleeve and impeller wear

ANCIAL IMPACT
The cost of Change Order No. 1 with Shales McNutt Construction totals $23,231. To date all
budgeted funds have been spent/encumbered on the $750,000 project (number 409647, Bowes
Road Booster Pump Station). There are sufficient funds available in account number 365-4000-
795.92-36, 2005 Bond Fund, Buildings/Structures, project number 409597, Water Department
Security Improvements (budget = $1,065,000; available = $373,960) to pay for the change
order.

ALTERNATIVES
r. 1. Approve the change order as recommended.
2. Do not approve the change order as recommended. This is not recommended and will
likely result in legal action by the contractor.
