SUBJECT: Amendment No. 2 to an Agreement with Crawford, Murphy & Tilly (CMT) for
Additional Design Engineering Services and Construction Engineering Services
for the Spartan Drive Extension-Section 2 Project
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider Amendment No. 2 to the engineering services agreement with CMT for
additional design engineering services and construction engineering services for the Spartan Dr.
Extension-Section 2 Project.
RECOMMENDATION
It is recommended that City Council authorize Amendment No. 2 with CMT in the amount of
$367,957.24 and authorize staff to execute the necessary documents.
BACKGROUND
The original agreement with CMT ($185,353.47) for design engineering services for the subject
project was authorized by City Council on February 13, 2002. Amendment No. 1 ($135,000) for
additional design engineering related to further soils investigations, alternate roadway alignment
study and more extensive wetland permitting efforts was authorized by City Council on January
28, 2004. Amendment No. 2 ($367,957.24) will provide for additional design engineering and
construction phase engineering services.
As part of Amendment No. 1, the City directed CMT to cease permitting efforts on the chosen
Spartan Drive alignment and examine an alternate alignment that could result in lower
construction costs and substantially less impact to the wetlands. Any proposed new alignment
had to be approved by ECC as the City's partner in this project. Although an alternate alignment
was identified that met the objective of lower construction costs and minimal wetland impacts,
the impact on buildable property proposed for future expansion of its campus was too great for
ECC to concur with the alignment change. Therefore, staff has directed CMT to reapply for the
needed Corps of Engineers permit, complete the plans and specifications and bid the project
using the original proposed roadway alignment.

Page 2
Amendment No. 2 will provide additional compensation to CMT to relocate and redesign the
detention pond required on part of this project, resubmit the permit application to the Army
Corps of Engineers for construction in wetlands, additional bike path design and provide
construction phase engineering services.
Design engineering of the bike path from McLean Blvd to Lehr Dr. is also included in this
amendment. This will provide for the connection of the existing path on McLean Boulevard to
the new path being installed as part of the Spartan Drive extension. In addition, construction
phase engineering for the entire project is included in this amendment. This will allow CMT to
immediately begin construction engineering upon award of the contract for the roadway
extension. It is anticipated that construction will begin in late Spring or early Summer of 2006,
if all required permits are obtained. A copy of Amendment No. 2 is attached as Exhibit A.

Spartan Drive Extension—Section 2
Kane County
Amendment No. I
To The
Agreement Of Consultant's Services
This Amendment No. 1 entered into this aro day of r.e 4, , 2004,by and between the City
of Elgin,an Illinois Municipal Corporation(hereinafter referred to as"CITY")and Crawford,Murphy,
and Tilly,Inc.,a Delaware corporation, (hereinafter referred to as"ENGINEER"),shall modify that
Agreement dated March 8`h, 2002,whereby the ENGINEER was engaged by the CITY to perform certain
professional services in connection with Spartan Drive Extension-Section 2(hereinafter referred to as
"ORIGINAL AGREEMENT"and"PROJECT",respectively).
WHEREAS,ORIGINAL AGREEMENT(at paragraphs IV(A)and(B))provided for a maximum
payment of$185,353.47,
WHEREAS,a wetland investigation had previously been prepared(in.October 1998 by others)as part of
a Project Development Report(PDR)for this PROJECT.By U.S.Army Corps of Engineers(USCOE)
and Illinois Department of Natural Resources(IDNR)requirements, the original report had expired and
the wetlands needed to be re-delineated. The original scope of service was based on the ability to utilize
the previous wetland investigation and only provided the effort required for development of a mitigation
plan for the wetlands as delineated therein, and
WHEREAS,a soils investigation had also previously been completed for this PROJECT(on March 3,
2000 by others)and the scope of services contained within the executed Agreement provided only for
three additional soil borings per the recommendation of the previous soils investigation. The estimated
effort for this task was based on the assumption that the recommendations in the original report were
adequate to use for design and that the only necessary work would be completion of the original three soil
borings. After design refinement and further analysis of soil conditions, it was determined that due to the
subgrade materials encountered, additional testing beyond the three borings contained within our original
scope would be required.Testing Service Corporation, the ENGINEER'S materials sub-consultant, also
advised that there had been changes to the Illinois Department of Transportation design criteria utilized in
the preparation of the Project Development Report requiring additional Geotechnical testing and
evaluation,and
WHEREAS,changes in 2003 to the USCOE jurisdiction and regulations regarding waters of the United
States required that the PROJECT be permitted as an Individual Permit(IP) rather than a Regional Permit
(RP)as identified in the Project Development Report and the scope of service contained within the
original Agreement requiring additional services,and
WHEREAS,during the permitting process the USCOE has requested that a Phase I and potentially a
Phase II Archaeological Survey be completed as part of the permit requirements for this PROJECT.No
provisions were included in the original scope of services for archaeological related services, and

WHEREAS, the CITY has determined that it is appropriate to re-evaluate the PROJECT and requested
ENGINEER to evaluate alternate roadway alignments, construction cost and permitting requirements, and
WHEREAS,the CITY has requested ENGINEER to coordinate a soil investigation and boring program
for the alternate alignments selected to be evaluated by the CITY, and
WHEREAS,the CITY has requested ENGINEER provide engineering services to coordinate and assist
in the preliminary re-evaluation of the PROJECT,and
WHEREAS,the circumstances, which necessitated this amendment, were not reasonably foreseeable nor
were they within the contemplation of the Agreement as executed, and
NOW THEREFORE BE IT RESOLVED, that paragraphs IV (A) and (B) of the ORIGINAL
AGREEMENT be revised to provide a not to exceed payment of$320,353.47.Further, that the Scope of
Services contained within the ORIGINAL AGREEMENT be amended to include before mentioned
additional services requested by the CITY and provided by the ENGINEER, and
FURTHER BE IT RESOLVED, that the remainder of the ORIGINAL AGREEMENT shall remain in
full force and effect except as Specifically modified herein.

Spartan Drive from Lehr Drive to McLean Blvd(approximately sta.41+67 to
71+67).The bike path extension plan will only detail the northerly half of
roadway.
Elginscope spartan combinedsuppl2 11_4 OS.doc Attachment C
2. Traffic control for this work will consist of adding General Notes and IDOT
Traffic Standard references to the previously completed MOT Plan Sheets.
3. It is estimated the two additional plan sheet will be required to show the bike
path work. The plan sheets will be shown as a split panel sheet at a l"=40' scale
with the proposed and existing plan shown in the same view. Grades will be
reviewed but not included in the plans sheets.Per direction from the City the bike
path will be constructed to reasonably match the existing ground line. Therefore,
a profile will not be included as part of this work. (Estimated 2 Sheet)
4. The pavement design for the bike path will be assumed to be the same as the
current bike path design of 2"of bituminous surface course on a 6"of aggregate
base course. There is no soils information for the proposed bike path extension
area. It will be assumed that the soil conditions for this section of the project are
adequate for the construction of the bike path. If poor soils conditions exist, they
will be addressed during the construction phase. A typical section detailing the
bike path will be developed and provided as part the new plan sheets.
5. Erosion Control and landscaping plans will be combined and added as separate
sheets. The erosion control and landscaping plans will be prepared at a 1"=40'
scale for each of the 2 plan sheets. (Estimated 2 sheets)
6. Working cross sections will be developed to aid in the design but will not be
included in the contract plans.
7. Quantities for this section of work will be completed and included in the
appropriate pay items established within the current roadway design contract
documents.
8. Additional notes or special provisions for this work are anticipated to be added to
the current plans or special provisions.
IV. Watermain Design
A. No additional work required under this item.

D. Kane County Stormwater Permit.
E. Prepare additional exhibits required for the Corps Engineers Individual Permit(as
directed by Corps.)
F. Bike Path
There is an existing detention pond and outlet structure on ECC property that the bike
path will be adjacent to or cross over. Since the pond outlets to an unnamed tributary
of Otter Creek, the pond and outlet will be under Corps of Engineers jurisdiction. If
the bike path can be designed to maintain a 10'-15' buffer between the pond and the
bike path and assuming that no modification is required to the outlet structure, a
permit should not be required. The bike path work will be based on this assumption
and will not include any work associated with mitigating, coordination or permitting
for wetlands or Waters of the US for this section of the project.
VIII. Meetings and Coordination
A. Additional meetings and coordination with the City,Elgin Community College, and
Corps to discuss and coordinate project issues involving the wetland, wetland buffers
