RESOLUTION
AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT WITH
ALVORD, BURDICK& HOWSON, L.L.C. FOR THE LAWRENCE AVENUE TO
AIRLITE WATER TREATMENT PLANT WATER MAIN PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,that
David M.Dorgan,City Manager,and Dolonna Mecum,City Clerk,be and are hereby authorized and
directed to execute Amendment No. 1 to an Agreement for Engineering Services on behalf of the
City of Elgin with Alvord, Burdick & Howson, L.L.C. for the Lawrence Avenue to Airlite Water
Treatment Plant Water Main Project, a copy of which is attached hereto and made a part hereof by
reference.

AMENDMENT NO. 1 AND FINAL
TO
AGREEMENT FOR ENGINEERING SERVICES
This contract amendment is hereby made and entered into this I 2.T1 day of
TA/VOA-R y , 2000; by and between the City of Elgin, Illinois, a municipal
corporation (hereinafter referred to as "CITY"), and Alvord, Burdick & Howson, L.L. C.,
an Illinois Limited Liability Company (hereinafter referred to as "ENGINEER").
WHEREAS, the parties hereto have previously entered into an agreement, dated May
28, 2002 (hereinafter referred to as "AGREEMENT"), a copy of which is attached
hereto and made a part hereof as Attachment "A" by which CITY has engaged
ENGINEER to perform certain engineering services related to various water main
project; and
WHEREAS, the parties hereto have each determined it to be in their best interests to
amend and modify AGREEMENT pursuant to the terms and provisions of this contract
amendment.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein, the sufficiency of which is hereby acknowledged, the parties hereto hereby
agree to amend AGREEMENT as follows:
SECTION I - SCOPE OF SERVICES
In accordance with Paragraph I of the AGREEMENT, the following Services are
hereby authorized. The scope of services under the original AGREEMENT is
amended to include the following additional services. The additional services provided
under this amendment are the result of 1) cost savings to be realized by the City for
having the fiber optic conduit designed and installed with the water main contract from
State Street and Frazier Avenue to Airlite Water Treatment Plant and 2)
recommendations from the City's outside consultant Black & Veatch to install a remote
operated control valve and meter vault at the Airlite Water Treatment Plant.
The additional engineering services consist of the following:
1. Preparation of plans and specifications for the fiber optic conduit and
handholes from State Street and Frazier Avenue to Airlite Water Treatment Plant to
be included with the Contract Documents for the Lawrence Avenue Watermain
Project.
2. Preparation of plans and specifications for a remote operated control valve and
meter vault along with rerouting the 20" watermain from the northside of the Airlite
Water Treatment Plant to the southside of the plant.

SECTION IV - PAYMENTS TO THE ENGINEER
Paragraph IV-A.1 of the AGREEMENT is amended as follows:
In consideration for the additional services to be performed by ENGINEER under
this Amendment, the billing limit is herby increased by Twenty Four Thousand and
Thirty Eight Dollars ($24,038). The total combined maximum amount to be invoiced
for all services under the AGREEMENT, as amended herein, shall not exceed Five
Hundred and Forty Seven Thousand Eight Hundred and Ninety Eight Dollars
($547,898) without further authorization in writing from the City Council.
The circumstances necessitating the change in performance provided for by this
amendment were not reasonably foreseeable at the time agreement was signed; the
changes provided for by this agreement are germane to the Agreement as signed; and
the amendment is in the best interests of the City and is authorized by law.
All other terms and conditions of the AGREEMENT remain in effect.
IN WITNESS WHEREOF, the undersigned have placed their hands and seal upon and
executed this Amendment No. 1 in triplicate as though each copy hereof was an original
and that there are no other oral agreements that have not been reduced to writing in
this statement.

SUBJECT: Amendment No.1 to the Agreement for Engineering Services with Alvord,
Burdick& Howson.
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider Amendment No. 1 to the agreement with Alvord, Burdick & Howson to
provide additional engineering services for the Lawrence Avenue to Airlite Water Treatment
Plant water main.
RECOMMENDATION
It is recommended that the City Council authorize the execution of Amendment No. 1 to the
Engineering Services Contract with Alvord, Burdick and Howson for a total amount of$24,038.
BACKGROUND
On May 22, 2002, the City Council authorized execution of a contract with Alvord, Burdick &
Howson to provide engineering plans and specification and construction phase services for the
water main projects that included the design and construction services for Fox Lane Water Main
Project, Riverside to State Street Water Main Project, the State Street Water Main Project and
Lawrence Avenue to Airlite Water Treatment Plant (WTP) Transfer Main.
In order to reduce data communication problems in the SCADA (Supervisory Control and Data
Acquisition) between Riverside and Airlite Water Treatment Plants (WTP), Water Department
staff with consultation with MIS staff proposed that a fiber optic line be installed in the path of
the water main. This line could also be used by the City in the future.
The 1992 Water Master Plan proposed that a 16-inch water main be constructed from Riverside
to Airlite WTP, to transfer approximately 4 million gallon of finished water. The 2004 Water
Master Plan indicates that approximately 8 MGD is needed to be transferred to Airlite WTP. To
rachieve this goal, the size of the main was increased to 20-inch diameter and the water main
relocated in the vicinity of the Airlite WTP due to elevation and soil conditions.

The additional services consist of preparation of plans and specifications for the fiber optic
conduit and handholes from Riverside WTP to Airlite WTP, rerouting the section of 20-inch
water main in the vicinity of the Airlite WTP and for a remotely operated control valve identified
during the current Water Master Plan study.

JThe cost for proposed Amendment No. 1 with Alvord, Burdick & Howson is $24,038. The
project budget totals $1,397,800. This amendment will be charged to project number 409583
(Riverside to State Street Water Main), account number 420-0000-771.92-41, Water
Development / Capital Additions. The remaining funds available for this project are $83,378.
There are sufficient funds available to fund this amendment.
