RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
TECNICA ENVIRONMENTAL, INC.
FOR ENVIRONMENTAL REMEDIATION
AT 464 McBRIDE STREET
WHEREAS, the City of Elgin has heretofore entered into a contract with Technica
Environmental, Inc. for environmental remediation at 464 McBride Street; and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,be and is hereby authorized and directed to
execute Change Order No. 1 with Technica Environmental,Inc.,a copy of which is attached hereto
and made a part hereof by reference.

CHANGE ORDER No. 1
CONTRACT: 464 McBride Street Site
SCOPE: Change Order No. 1 will increase the quantities of some items as set forth
in Attachment A hereto.
The Contractor for this project is Tecnica Environmental Services, Inc. of Chicago, Illinois,
(TES)
REASON FOR CHANGE: Change Order No. 1 is in the best interests of the City of Elgin and
authorized by law; the changes necessitating this change order
were unforeseeable at the time of the original agreement; and the
changes provided for by this change order is germane to the
original agreement.
SUMMARY OF CHANGES IN CONTRACT AMOUNT:

The original contract amount with Tecnica Environmental Services, Inc. (TES). is $1,696,700.
By reason of Change Order No. 1, the contract for the Remediation Services for 464 McBride
Street will increase the amount of the original contract. The contract amount, inclusive of
Change Order No. 1 is Two Million Two Hundred Seventy-Eight Thousand Seven Hundred
Fifteen and 55/100 Dollars ($2,278,715.55).
The total amount of the increase of the amounts originally scheduled to be paid resulting from
the Change Order is $582,015.55.

SUBJECT: Change Order No. 1 with Tecnica Environmental Inc. for Environmental

PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider Change Order No. 1 with Tecnica Environmental Inc. in the amount of
$582,027.57.
RECOMMENDATION
It is recommended that the City Council authorize Change Order No. 1 with Tecnica
Environmental Inc. in the amount of$582,027.57.
BACKGROUND
The City of Elgin is the owner of property located at 464 McBride Street (former Elgin Salvage
Yard site). The buildings on the seven acre site must be demolished and the soils remediated in
order to include this parcel in the larger twenty acre residential redevelopment project that is
envisioned for the area. The initial bid for the environmental remediation of the site was awarded
to Tecnica Environmental Inc. on March 23, 2005 in the amount of$1,696,700.
The clean up effort at the site began during the first week in May of 2005. The attached aerial
photograph shows the extent of which buildings and other elements were present on the site.
The presence of structures, old building foundations and machinery related to the salvage process
limited the ability of Terracon Inc. (Environmental Consultant) to obtain a complete and accurate
assessment of the totality of the contamination present on the site.

Minor increases in clean-up costs are due to the discovery of additional underground fuel tanks,
asbestos abatement and concrete disposal. The major factor impacting the increase in the costs is
the disposal of over 28 tons of additional contaminated soil. This additional material was
discovered under building foundations and machinery structures following the removal of said
items. The additional soils are classified as Special Waste and can be disposed of at a local land
fill. If the additional contaminated soil had been classified as Hazardous Waste, such
contaminated soils would have been shipped to a special landfill not located in Illinois.
It should be noted that with the removal of the additional 28 tons of Special Waste contaminated
soil, the onsite clean up oversight services provided by Terracon Inc. must be increased. An
amendment to the services provided by Terracon will be processed under a separate contract
amendment.

FINANCIAL IMPACT
The proposed Change Order with Tecnica Environment Inc. totals $582,027.57. There is
currently $4,850,000 budgeted and $776,796 is available in the Riverboat Fund, Elgin Salvage
Redevelopment project (account number 275-0000-791.92-35, project number 039565) to enter
into the proposed contract with Tecnica Environmental Inc.

slabs were left in place and new floor slabs constructed on top. Contract Impact is +
$30,058.
7. Additional USTs
Although the contract plans called for the removal of two known underground storage
tanks (USTs), three additional tanks were discovered during the course of the project.
One of these tanks appears to be a former railroad tank car that was buried under the
Material Storage Building. Terracon's review of documentation did not reveal the
presence of these unregistered tanks. The cost of removal of these tanks is claimed by
the Contractor and is a relatively small cost. The removal of these additional leaking
USTs, however, also contributed to the increased soil removal quantities that are
addressed above under Item No. 4. Contract impact is + $2,679.
Terracon has reviewed the contractor's cost submittal for the extra work. We find that the costs
are appropriate based on the contract and that the contract unit prices have been applied
appropriately for both contract additions and deductions. In the instances where no contract
unit price was available for the extra work item, the Contractor has applied reasonable time and
material rates to determine the cost of the work. The Contractor has also provided satisfactory
documentation to support the quantities of work performed and estimated. Based on Terracon's
field oversight of the work we agree with the quantities represented in the submittal.
Accordingly, Terracon concurs with the costs reflected in the proposed Change Order.
The extra work necessary at the Elgin Salvage Yard will impact the project schedule. Assuming
work resumes at the site shortly following approval of the Contractor's Change Order on August
11, 2005, Terracon believes that the remaining work at the site should be completed within
approximately four weeks. Therefore we suggest that the contract time be extended until
September 15, 2005.
