HomeMy WebLinkAbout05-184 Resolution No.05-184 RESOLUTION AUTHORIZING EXECUTION OF A PROMOTIONAL AGREEMENT WITH THE ELGIN COURIER NEWS (Performing Arts for Young People Season) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that Olufemi Folarin,City Manager,and Dolonna Mecum,City Clerk,be and are hereby authorized and directed to execute a promotional agreement on behalf of the City of Elgin with the Elgin Courier News for the Hemmens 2005-2006 Performing Arts for Young People Season, a copy of which is attached hereto and made a part hereof by reference. s/ Ed Schock Ed Schock, Mayor Presented: June 8, 2005 Adopted: June 8, 2005 Omnibus Vote: Yeas: 7 Nays: 0 Attest: s/Dolonna Mecum Dolonna Mecum, City Clerk Elgin Courier News Hemmens Cultural Center 2005-2006 Performing Arts for Young People PROMOTIONAL AGREEMENT IS AGREEMENT is hereby made and entered into this 0 day of J4V\?, 2005, by and between the CITY OF ELGIN, ILLINOIS, a municipal corporation (hereinafter referred to as "City") and Suburban Chicago Newspapers, the parent company of The Elgin Courier News, an Illinois Corporation, (hereinafter referred to as "The Courier") . WHEREAS, City owns and operates a theater commonly known as the Hemmens Cultural Center; and WHEREAS, the parties hereto have each determined it to be in their best interests to enter into an agreement by which The Courier provide sponsorship for the aforementioned Hemmens Cultural Center. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby mutually acknowledged, the parties hereto hereby agree as follows: 1 . The Courier shall provide the City with $15, 000 worth of advertising and/or promotional support between the dates of May 12, 2005 and March 17, 2006, for the purpose of promoting the 2005-2006 Performing Arts for Young People Season. 2 . City shall provide The Courier with prominent logo placement in 250, 000 editions of City' s season brochure in the Performing Arts for Young People Series section. 3 . City shall provide The Courier with a half page ad in City' s Adult/Family program for the applicable season. 4 . City shall provide space to The Courier at all Performing Arts for Young People shows for banner display. The Courier shall provide banner (s) . 5 . City shall provide The Courier with forty (40) tickets per show (not performance) for each of the Performing Arts for Young People shows . 6. City shall provide The Courier with logo placement and hyperlink on the Hemmens' Performing Arts for Young People website for the length of the applicable season. 7 . City shall include The Courier in the Performing Arts for Young People ad in City' s Adult/Family program for the applicable season. 8 . City shall credit The Courier as a season sponsor on Elgin' s Government Access TV Channels on Comcast and Wide Open West . 9 . This agreement shall be subject to and governed by the laws of the State of Illinois . Venue for the resolution of any disputes and the enforcement of any rights arising out of or in connection with this agreement shall be in the Circuit Court of Kane County, Illinois . 10 . The terms of this agreement shall be severable. In the event any of the terms or conditions of this agreement are deemed to be void or otherwise unenforceable for any reason, the remainder of this agreement shall remain in full force and effect. 11 . This agreement shall not be construed so as to create a joint venture, partnership, employment, or other agency relationship between the parties hereto except as specifically provided herein. 12 . Marth,Marketing fficer SUBJECT: The Courier News Sponsorship of The Hemmens Cultural Center Performing Arts for Young People Season PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider a co-sponsorship agreement with The Courier News for The Hemmens 2005-2006 Performing Arts for Young People Season. RECOMMENDATION rIt is recommended that the City Council approve the promotional agreement with The Courier News as presented. BACKGROUND The staff of The Hemmens Cultural Center has developed a sponsorship program for City sponsored shows. The goal of the new sponsorship program is to enable the Hemmens to bring in different acts, reduce ticket prices, and broaden the theatre's exposure in the community and beyond. To this end, an effort was made to target local and regional businesses for sponsorship opportunities. The Courier News expressed interest in participating by sponsoring The Hemmens 2005-2006 Performing Arts for Young People Season. The main items of the sponsorship agreement are as follows: 2005-2006 Performing Arts for Young People Season Sponsor The Hemmens Cultural Center will provide: 1. Prominent placement of The Courier News' logo in 250,000 brochures for the sponsored season distributed through the Daily Herald, Courier News, Kane County Chronicle, subscriber mailing list and around town. 2. A half page Courier News ad in program book for the season valued at$500. 3. The Courier News' logo on all print advertising and tagline for all radio advertising for each show. p . • The Courier News Co-Sponsorship of The Hemmens Cultural Center May 20, 2005 Page 2 4. Forty(40) tickets for The Courier News to use to each production of the sponsored shows valued at $2,800. 5. Logo and link (if applicable) on Hemmens' Performing Arts Season webpage for 2005- 2006 Performing Arts for Young People Season. 6. Credit as a season sponsor on Elgin's government access Cable TV channels. 7. Space for signage in lobby of the Hemmens Center during each show. The Courier News will provide their own signage for display. The Courier News will provide: 1. Advertising &promotions in The Courier News valued at $15,000. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED r None FINANCIAL IMPACT The sponsorship agreement with The Courier News stipulates that the City will provide tickets and program advertising valued at $3,300 to The Courier News. There are sufficient funds budgeted ($425,000) and available ($264,000) in the Recreation Fund-Hemmens, account number 296-5402-765.47-00 to pay for this expense. For their promotional efforts, The Courier News will provide $15,000 of advertising and promotions. g ,____ AL IMPACT None ALTERNATIVES, 1. Approve the promotional agreement as presented. 2.
