HomeMy WebLinkAbout05-121 Resolution No. 05-121 RESOLUTION ACCEPTING A PLAT OF DEDICATION FOR PUBLIC.RIGHT-OF-WAY (Owasco Avenue) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that it hereby accepts a certain plat of dedication for public right-of-way prepared by Survey Systems of America,Inc.,an Illinois Land Surveyor,and dated May 10,2004, for the property legally described as follows: That part of Lot 10 in Block XIII of Sadler's Addition to Elgin, Illinois, being a subdivision of part of the North ''/2 of Section 11, Township 41 North, Range 8 East of the Third Principal Meridian,bounded by a line described as follows: Beginning at a point 13.20 feet North of the Southwest corner of said Lot 10; thence Southerly along the West line of said Lot 10,a distance of 13.20 feet to the Southwest corner of said Lot 10; thence Easterly along the South line of said Lot 10, a distance of 12.90 feet;thence Northwesterly to a point 13.20 feet North of the Southwest corner of said Lot 10, said point being the Point of Beginning, in the City of Elgin, Kane County, Illinois. Loete, Public Works D ector SUBJECT: Dedication of Right-of-Way and Easement Agreement for Public Utilities with Habitat for Humanity of Northern Fox Valley along Owasco Avenue in Elgin PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the acceptance of a dedication of right-of-way and an easement agreement with Habitat for Humanity of Northern Fox Valley for public utilities serving • proposed residential property located along the north side of Owasco Avenue in Elgin. RECOMMENDATION It is recommended that the City Council accept the dedication of right-of-way and easement agreement and authorize staff to execute and record the documents. BACKGROUND Habitat for Humanity of Northern Fox Valley is proposing to extend the sanitary sewer along Owasco Avenue to service five (5) buildable lots on the north side of the roadway. An easement is needed along north edge of the right-of-way for Owasco Avenue to allow for the installation and maintenance of the sanitary sewer. The easement area encompasses a rectangular area 10' in width, across lots 10, 11 and 12 of Sadler's Addition to Elgin Illinois. Recording of the easement is a condition for approval of the site development. A dedication of right-of-way is being provided in order to incorporate existing street area in the Owasco Avenue and Steel Street intersection into the public right-of-way. The dedication area is a triangular shaped area with sides along Owasco Avenue and Steel Street being 12.90 feet and 13.20 feet respectively. The dedication and easement are depicted on the attached location map. Upon approval by the City Council, the dedication and easement agreement will be recorded by the City at Kane County. • • Dedication of ROW and Easement Agreement for Public Utilities March 4, 2005 Page 2 COMMUNITY GROUPSANTERESTED PERSONS CONTACTED None FI ANCIAL IMPACT There are no costs to the City for acquiring the right-of-way dedication or easement. A cost for recording the documents of $100 will be paid by the City and reimbursed by Habitat for Humanity of Northern Fox Valley. The expense will be charged to the General Fund, Engineering Division, account number 010-3311-752.32-05, "Legal Recording Fees" where 7 th re is $500.00 budgeted and $424.00 available. EGALIMPACT None. ALTERNATIVES I • 1. The City Council may approve the dedication and agreement. 2. The City Council may reject the dedication and easement agreement. This will make maintenance of public utilities very difficult and existing pavement of a public street will encroach into-lot 10 without proper authorization.
