WITNESSETH WHEREAS, the City and the County are public agencies within the meaning of the Intergovernmental Cooperation Act; and WHEREAS,the City and the County are also units of local government within the meaning of Section 10 of Article 7 of the Constitution of the State of Illinois; and WHEREAS, the City and the County are authorized to contract among themselves to obtain or share services, or exercise, combine, or transfer any power or function in any manner not prohibited by law; and WHEREAS,the City has contracted with Curbside, Inc., a subsidiary of the Safety-Kleen Corporation, to provide certain household hazardous waste services for the residents of the City; and WHEREAS,the collection and proper management of household hazardous waste so as to protect the environment is a matter within the government and affairs of the parties; and WHEREAS, the collection of household hazardous waste from residents of the City will also benefit citizens of the County. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein,the City and County agree as follows: 1. That the foregoing recitals are hereby incorporated into this agreement in their entirety. 2. That the City agrees to indemnify and hold the County harmless from any and all claims, damages or causes of action which may result from said services. 3. The County agrees to pay the City one-half of the total expenses incurred for providing this service to residents of the City for a twelve-month period from October 1, 2003 to September 30, 2004. The County's expense shall not exceed $25,000. The County's expense shall be payable to the City upon receipt of an invoice detailing total program expenses for the above stated period. 1 ' The terms of this agreement shall be severable. In the event any of the terms or provisions of this agreement are deemed to be void or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. This agreement shall not be construed so as to create a partnership, employment,joint venture, or other agency relationship between the parties hereto. Loete, Public Works Director SUBJECT: Agreement with Kane County Accepting a Grant to Fund Household Hazardous Waste Collection Services PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to execute an agreement with Kane County to accept a grant of up to $25,000 to help fund the City's Household Hazardous Waste Collection Program. RECOMMENDATION It is recommended that the City Council approve the agreement with Kane County to accept a grant of up to $25,000 for the City's Household Hazardous Waste Collection Program and authorize the City Manager to execute the agreement. BACKGROUND The City has contracted with Curbside, Inc., a former subsidiary of Safety-Kleen, since 1999 to provide household hazardous waste disposal services to Elgin residents. These services include home pick-up of hazardous waste materials, local used motor oil collection centers and a mail-in program for medical syringes. There is no charge to residents to utilize these services. Since the inception of the program, Elgin residents have safely disposed of over 273,000 pounds of hazardous materials. Kane County has provided the City with an annual grant in the amount $25,000 since 1999 in order to help fund the City's Household Hazardous Waste Collection Program. This new agreement would remain in effect for a three year period and would reimburse the City for half of the actual Household Hazardous Waste Program costs,not to exceed $25,000 annually. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None s Kane County Household Hazardous Waste Grant Agreement October 29, 2004 Page 2 glA__ FINANCIAL IMPACT A total of $50,000 has been budgeted in the 2004 Public Works/Refuse Services Budget, Account Number 010-3331-754.33-05 for Hazardous Waste Services, of which, approximately $25,000 has been spent on the residential household hazardous waste program thus far this year. The grant from Kane County reimburses the City for half of our total program expenditures, up to $25,000 annually. As part of the City's solid waste contract, the City also receives $25,000 annually from Waste Management in order to help offset household hazardous waste program costs. ,,// 11 LEGAL IMPACT 1vJ\� 'None ALTERNATIVES 1. Approve the agreement with Kane County and accept the grant. 2. Not approve the agreement with Kane County and refuse the grant.
