Dorgan, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute a Peer Jury Agreement on behalf of the City of Elgin with Kane County for the implementation of a Peer Jury Program, a copy of which is attached hereto and made a part hereof by reference . s/ Ed Schock Ed Schock, Mayor Presented: October 22 , 2003 Adopted: October 22 , 2003 Omnibus Vote : Yeas : 6 Nays : 0 Recorded: October 23 , 2003 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk PEER JURY AGREEMENT THIS AGREEMENT is hereby made and entered into this 2ZN0 day of Qctvi56f 2003, by and between the CITY OF ELGIN, an Illinois municipal corporation (hereinafter referred to as the "City" ) and KANE COUNTY, Illinois, a body corporate and politic of the State of Illinois, hereinafter referred to as the "County" ) . WHEREAS, County and City have each determined it to be in the best interests of the citizens of Kane County and the City of Elgin, Illinois to implement a Peer Jury Program; and WHEREAS, County intends to provide funding for the aforementioned Peer Jury Program (hereinafter referred to as "Program") , and it is City' s intention to provide for the administration of Program; NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby mutually acknowledged, the parties hereto hereby agree as follows: 1 . The term of this agreement shall commence on July 1, 2003, and shall terminate July 1, 2004, Kane County shall provide city the sum of $27, 949 on or before October 15, 2003 . 2 . City shall provide the services , described herein per Attachment A, which is attached hereto and made a part hereof. 3 . To the extent permitted by law, City shall provide County with a reasonable accounting of City' s expenditures of the funds provided to City by County pursuant to this agreement . 4 . County shall comply with all applicable state and federal wage and labor laws . 5 . This agreement shall not be construed so as to create a partnership, joint venture, employment or other agency relationship between the parties hereto except as expressly provided for herein. City shall, in its sole discretion, determine the manner and method of delivering the services provided for pursuant to this agreement. 6. City shall provide County with billing statements, audit reports, and progress reports as may reasonably and legally be deemed necessary by the County by the 10th of each month. 7 . City shall comply with any and all applicable federal and state labor laws . 8 . The parties hereto hereby agree that no person shall, on the grounds of race, color, national original, sex, age, handicap status, or religion, be excluded from participating in, or be denied the benefits of, or be subjected to discrimination under any service, program, or activities funded with any portion of the funds received by the County pursuant to this agreement . 9 . Either party may terminate this agreement at any time upon thirty (30) days written notice for any reason. In the event , + this agreement is so terminated, any unused funds in the possession of City shall be refunded to County within thirty (30) days, and any services provided by City which have not been paid for by County shall be paid for on a pro quantum meruit basis . Such a proration shall constitute the sole recourse for either party herein. 10 . All notices required or permitted hereunder shall be deemed served when deposited in the U. S . Mail, certified or registered, postage prepaid and return receipt requested, addressed if intended for County to it at Kane County Sheriff' s Office, 777 E. Fabyan Parkway, Geneva, Illinois 60134 and Chairman of the County Board at 719 S . Batavia Av. , Geneva, IL. 60134; or if intended for City, at the Elgin Police Department, Attn: James Burns, 151 Douglas Avenue, Elgin, Illinois 60120-5555 . 11 . An estimated cost is attached hereto and made a part hereof as Attachment B. This Attachment B is attached hereto for explanatory and estimate purposes only, and shall not constitute an enforceable provision of this agreement . 12 . The terms and provisions of this agreement shall be severable. In the event any of the terms or provisions of this agreement are deemed to be void or otherwise unenforceable for any reason, the remainder of this agreement shall remain in full force and effect . 13 . This agreement shall be subject to and governed by the laws of the State of Illinois . Venue for the enforcement of any rights or the adjudication of any disputes arising out of or in connection with this agreement shall be in the Circuit Court of Kane County, Illinois . IN WITNESS WHEREOF, the County has caused this Contract to be signed and attested by Kane County, and the City has caused this Contract to be signed and attested pursuant to a lawful authorization for its execution. This coordinator will be paid $20/hour for 15 hours per month, totalling $300/month, or$3600.00/year.This staff will be responsible for all organizational tasks involved with scheduling jurors and offenders into the program, as well as keeping statistics. EQUIPMENT The Elgin peer jury plans to purchase a desktop computer and a laptop computerand software on which the coordinator can organize and track program attendees,jurors, and and activities of the offenders. Forms needed for the program can be produced on these computers. It is estimated that the computers and software licenses will cost $4,000.00 The Elgin Peer Jury plans to purchase a locking file cabinet($300)and a paper shredder($70.00)to enhance confidentiality of the records of the peer jury participants. Elgin Grand Total--P2 In order to provide ongoing training to peer jurors, the coordinator plans to purchase training tapes ($2000)as well as a VCR/DVD player($375). Finally, to help with organization and planning, a dry erase board will be purchased. ($150) COMMODITIES (1) Office supplies will be utilized by the program staff and peer jurors and will consist of paper and envelopes, staplers, staples, pens, and binders for peer court materials, as well as business cards for staff($1000). (2) Program supplies include recognition certificates for jurors, as well as food and drink for peer jury orientations and meetings($1500). TRAVEL Two staff and peer jurors will be attending the National Youth Conference. This is an excellent opportunity to network with other Peer Jury programs from around the country and receive training regarding "What Works" programming. Conference costs are as follows: $200 air fare for 2 people $400 Hotel--2 nights lodging $476 $32.00 per diem for 2 people-2 days $128 Registration Fee--$150/person $300 Total $1,304 CONTRACTUAL The Program Coordinator will be provided with a cellular phone costing $40 per month, for a total of$480. The Elgin Peer Jury plans to contract with the Juvenile Offender Restitution Program, a long-standing Elgin social service program specializing in community service, restitution collection, and counseling. Proposed costs are as follows: Anger Management Counseling It is estimated that 27 minors, including some referrals from the Dundee program, will be required to attend this program. It will consist of 12 sessions of 2 1/2 hours each, and will cost$175/offender, for a total of$4725. Community Service Each minor attending anger management counseling will be required to work 30 hours of community service to"pay back"for receipt of the service. The cost is $75/offender,with an anticipated 27 offenders, for a total of$2025. The JORP program will provide transportation and supervision for this service. Elgin Grand Total--P3 An additional 24 minors who are not referred to anger management counseling will be required to perform up to 20 hours of community service at a cost of$60/offender. The JORP program will provide transportation and supervision for this program. The total cost will be$1440. Counseling Up to 10 minors/families per year will be referreed to 6 sessions of counseling at$30/session. Total cost will be $1800. OTHER COSTS No expenses are listed under this category. Dorgan, City Manager tI James Burns, Deputy Chief SUBJECT: Agreement with Kane County for Peer Jury PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider approval of a grant agreement with Kane County under the Juvenile Accountability Incentive Block Grant and an agreement with the Young Men' s Christian Association (YMCA) of Greater Elgin to operate the Juvenile Offender Restitution Program (JORP) . BACKGROUND The City has been asked to act as a sub-contractor for a grant from the Illinois Criminal Justice Information Authority (ICJIA) . Under the terms of the agreement the City will receive $3 , 600 as funding for one of the current police employees, to act as a paid coordinator of the Peer Jury Program. The peer jury is a trained group of high school peers that hear cases and sets consequences for middle and high school offenders eligible for diversion. The consequences set by the jury are similar to those that would be seen in a juvenile court . The coordinator will be paid a regular overtime rate to administer the program, up to $3 , 600 . The grant will also fund various equipment costs, travel and commodities to facilitate the program totaling $13 , 879 . The grant also contains $10 , 470 to enter into a contract with the YMCA for the Juvenile Offender Restitution Program (JORP) . The total grant is in the amount of $27, 949 and will run from July 1 , 2003 through July 1 , 2004 . JORP will provide a structured, supervised work program for offenders, family counseling, job training and restitution to the victims of their crimes . . ... emk Agreement with Kane County and YMCA September 19, 2003 Page 2 A contract with Kane County, authorizing this agreement in the amount of $27, 949 and an agreement with the YMCA for JORP is attached. This entire program is funded by this grant and there is no match required of the City of Elgin. The Peer Jury Program is designed to provide a meaningful and remedial method of dealing with selected juvenile (Under age 17) offenders without reference to the Juvenile Court and it has been operating in a limited fashion for many years using volunteers and on-duty personnel . This grant will allow more time to be dedicated by staff and provide an alternative for violators through the JORP program. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Kane County Juvenile Justice and the YMCA have participated in the submission of this grant application. FINANCIAL IMPACT There is no cost to the City of Elgin for this program. The City is in receipt of a check from Kane County (#60578 attached) for $27, 949 to fund this program if accepted. Existing account numbers will be used to account for this program. A budget transfer will be required. On/(EGAL IMPACT None. ALTERNATIVES 1 . The City may choose to reject this check and fund the program through local funds . 2 .
