HomeMy WebLinkAbout03-104 Resolution No. 03-104 RESOLUTION AUTHORIZING EXECUTION OF A SPECIAL EV' NT CO-SPONSORSHIP AGREEMENT WITH PREMIER SPO' S CAMPS BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Dolanna Mecum, City Clerk, be and are hereby authorized and directe. to execute a Special Event Co-Sponsorship Agreement on behalf of the City of Elgin with Premier Sports Camps for the Nike Gids USA Cup on July 25, 26 and 27 at The Centre, a copy of which is attached hereto and made a part hereof by reference. s/ Ed Schock Ed Schack, Mayor Presented: April 23, 2003 Adopted: April 23, 2003 Omnibus Vote: Yeas : 6 Nays : 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk SPECIAL EVENT CO-SPONSORSHIP A 1i REEMENT THIS AGREEMENT made and entered into this 9th day of A.ril, 2003, by and between the CITY OF ELGIN, an Illinois municipal corporation (hereinafter referred to as the "City") and Premier Sports Camps, a California corporation(hereinafter ref-. ed to as "Premier Sports"), WITNESSETH WHEREAS, Premier Sports, operates at 5078 San Gonza o, Santa Barbara, California, 93111; and WHEREAS,Premier Sports Camps has proposed a special e ent in the form of a Nike Girls USA Cup event for July 25, 26 and 27 2003, to be conducted at The Centre Fieldhouse at 100 Symphony Way,Elgin,Illinois, 60120(hereinafter referred to as he"subject special event");and WHEREAS, Elgin Municipal Code Section 13.25.020A requires special events to be sponsored and conducted by not-for-profit corporations or also o'ations or by public bodies;and WHEREAS, Premier Sports has requested that the City I o-sponsor the subject special event; and WHEREAS, the City has determined that the subject spec al event will attract additional interest in the center city area and will assist in promoting furth-r redevelopment of the center city area; and WHEREAS,the City Council has further determined that it is in the best interests ofthe City to co-sponsor the subject special event with Premier Sports in .ccordance with the terms and conditions of this Co-sponsorship Agreement; and WHEREAS,the City of Elgin is a home rule municipality a. defined in Article VII, Section 6a of the 1970 Constitution of the State of Illinois and is autho 'zed to exercise any power and perform any function relating to its government and affairs; an WHEREAS, the co-sponsorship of the subject special e ent and promoting the further 1 r interest in redevelopment of the City's center city area pertains to he government and affairs of the City of Elgin. NOW, THEREFORE, for and in consideration of the mutu. promises and undertakings contained in this Agreement, and for other good and valuable .onsideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto .gree as follows: 1. The foregoing recitals are hereby incorporated into t 's Agreement in their entirety. 2. The City and Premier Sports hereby agree to co-spa nsor the proposed Nike Girls USA Cup event on July 25, 26 and 27, 2003. The subject spec'al event will be located at the Centre Fieldhouse and shall be conducted between 9:00 a.m. to :00 p.m. each day. 3. Premier Sports, notwithstanding the City's co-spo sorship of the subject special event, agrees that pursuant to this Agreement and pursuant to th; provisions of Elgin Municipal Code Section 13.25.090, Premier Sports shall be strictly liable for the acts of its volunteers, officers and employees. Additionally,Premier Sports shall to the fullest extent permitted by law indemnify, defend, and hold harmless the City, its officers, e ployees, agents, boards and commissions from and against any and all claims, suits, jud„ ents, costs, attorney's fees, damages or other relief arising out of or in any way connected ith the subject special event or any acts or omissions of Premier Sports, its agents, volunteers sr employees. Nothing herein affects Premier Sports' duty to defend the City. In the event of y action against the City or its officers,employees, agents,boards or commissions covered by t e foregoing duty to indemnify, defend and hold harmless, such action shall be defended by legal counsel of the City's choosing. The provisions of this paragraph shall survive any termina ion and/or expiration of this Agreement. 4. Premier Sports shall also provide, without cost to t e City, the insurance written in occurrence form required pursuant to Elgin Municipal Code Section 13.25.070 naming the City as a primary, non-contributory coinsured with limits of not les' than $500,000 per occurrence 2 and excess coverage of not less than $5,000,000 covering gene .1 liability including personal injury and property damage. This insurance shall apply as primary insurance with respect to any other insurance or self-insurance programs afforded to the City. here shall be no endorsement or modification of this insurance to make it excess over other avai able insurance,alternatively,if the insurance states that it is excess or pro rata, it shall be endorse o to be primary with respect to the City. 5. In consideration of Premier Sports being solely r;sponsible for conducting the subject special event and for all costs associated with the subj-ct special event as provided herein,the parties understand and agree that Premier Sports shall i►a entitled to retain any income received from the subject special event. 6. Premier Sports will pay to the City $1,000 per day 1$3,000 total) for the rental of The Centre Fieldhouse and $1 from each admission ticket purc ased to benefit the Parks and Recreation Youth Scholarship Fund. 7. The City shall allow the sale of tickets at The Centre ieldhouse door for admission into the event as well as the sale of event merchandise during th- event. 8. The City shall be recognized as a sponsor of the Nike Girls USA Cup event and shall receive the benefits of sponsorship consistent with the level of s pport provided. At minimum, the City's support shall be acknowledged in print materials prom,I ting the organization or event, radio advertising, "web page" information and event pro: ams. Three samples of this acknowledgment shall be provided to the City. A logo provided ►y the City shall be used for this purpose. 9. Nothing contained in this Agreement shall be const ed to relieve Premier Sports,its officers, agents or employees, as well as any other participants i the subject special event from complying with all applicable laws and regulations of the Cit , State and the United States, including but not limited to obtaining any other permits or app ovals as required by law. 3 10. This Agreement shall not be deemed or construed to create any employment,joint venture, partnership or other agency relationship between the parties hereto. Dorgan, City Manager I0 V r SUBJECT: Co-Sponsorship Agreement with P emier Sports Camps PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with inform.tion to consider a co- sponsorship Agreement with Premier Spor s Camps for the Nike Girls USA Cup event at The Centre. BACKGROUND Premier Sports Camps has requested tie use of The Centre Fieldhouse to host the Nike Girls USA Cu. on July 25, 26 and 27, 2003, from 9 : 00 a.m. until 9 : 00 p.m. .aily. Premier Sports Camps is a for profit, event coordin.ting agency based in California. Nike is providing the f ' nancial support to be listed as the title sponsor of the event . The event is a three day basketball tournament hosted for college scouts and coaches to view 13 to 17 year old girls' bas •etball players for the purpose of college basketball recruitment. Approximately 200 to 300 college scouts, 95 to 120 basketball teams and more than 1, 000 spectators ar- anticipated to attend over the three day event. The Elg ' n Area Convention and Visitors Bureau estimated that the ev-nt could provide over $400, 000 in local economic development .ollars from hotel stays and restaurant purchases . Premier Sports Camps will provi.e insurance naming the City as a primary, non-contriouting co-insured with excess coverage of not less t an $5, 000, 000 covering general liability, including personal injury and property E damage. With the combination of direct rental ees of $3, 000, the $1 from each ticket sold, the potential fo concession revenue via the food/beverage contract with Cuisine America as well as the local economic development impact, sta f is recommending the City co-sponsor the Nike Girls USA Cip with Premier Sports Camps . • In comparison, the rate for a nonresident group to use the Fieldhouse for this event would cost $2 700 per day or a total of $8, 100 . Premier Sports Camps assuming the current Centre Field ouse rental charges of $8, 100 for a nonresident group to hold the Nike Girls USA Cup as well as allow the sale o tickets for admission and event merchandise. 3 . To not enter into a co-sponsorship agreement with Premier Sports Camps for the event an. Premier Sports Camps assuming the current Centre Fiel.house rental charges of $8, 100 for a nonresident group to hold the Nike Girls USA Cup as well as not approve th- sale of tickets for admission nor event merchandise, ' hereby not allowing the event to proceed. RECOMMENDATION It is recommended that the City Cou cil enter into a co- sponsorship agreement with Premier Spots Camps for the Nike Girls USA Cup to be held at The Centre ' ieldhouse at no cost to the City, but allowing reduced rental r.tes as well as the sale of tickets for admission and event merchandise.
