RESOLUTION
AUTHORIZING EXECUTION OF THE DEDICATION OF AN ADDITION TO THE
TROUT PARK NATURE PRESERVE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk,
be and are hereby authorized and directed to execute a Dedication
of an Addition to the Trout Park Nature Preserve for 530 Glenwood
Trail , Elgin, Illinois, a copy of which is attached hereto and
made a part hereof by reference .

SUBJECT: Dedication of 530 Glenwood Trail as an Addition to the
Trout Park Nature Preserve
PURPOSE
To submit for City Council consideration the proposed dedication of
530 Glenwood Trail as an addition to the Trout Park Nature
Preserve .
BACKGROUND
The City recently completed the acquisition of 530 Glenwood Trial .
The City' s purchase of this property included an agreement with
CorLands and the Fox Valley Land Foundation which included the Fox
Valley Land Foundation providing the City $23 , 310 and CorLands
providing the City $15, 000 to be utilized by the City for the
purchase of the subject property. The City' s agreement with the
Fox Valley Land Foundation and CorLands also provided for the City
to pursue the proposed dedication of the subject property as an
addition to the existing Trout Park Nature Preserve .
Attached is a draft document which would provide for the dedication
of 530 Glenwood Trail as an addition to the Trout Park Nature
Preserve . The Fox Valley Land Foundation is processing the
proposed dedication with the Illinois Nature Preserve Commission.
The next meeting of the Illinois Nature Preserve Commission is on
February 5, 2002 .

T�he City' s previous agreement with the Fox Valley Land Foundation
and CorLands requires the City to pursue the proposed dedication of
530 Glenwood Trail as an addition to the existing Trout Park Nature
Preserve. The dedication of the subject property as an addition to
the existing Trout Park Nature Preserve will subject the subject
property to the Rules for Management of Illinois Nature Preserves
and any approved master plan.
ALTERNATIVES
None . The City has an existing contractual obligation to pursue
the proposed dedication.
RECOMMENDATION
It is recommended that the City Council approve the proposed
dedication of 530 Glenwood Trail as an addition to the Trout Park
Nature Preserve .

DEDICATION OF AN ADDITION TO
TROUT PARK NATURE PRESERVE
KNOW ALL PEOPLE BY THESE PRESENTS, that the City of Elgin, a
municipal corporation, being the owner thereof, does hereby dedicate
as nature preserve buffer to Trout Park Nature Preserve the following
described real property lying adjacent to said preserve :
That part of Lot 1 of Glenwood Subdivision, Elgin,
described as follows : Beginning at the northeasterly
corner of said lot; thence south along the east line of
said lot 135 . 6 feet to the northerly line of Glenwood
Trail; thence westerly along said northerly line 88 . 5 feet;
thence northerly 132 . 9 feet to a point on the north line of
said lot 88 . 5 feet west of the northeast corner thereof;
thence east along said north line 88 . 5 feet to the point of
beginning, in the City of Elgin, Kane County, Illinois, and
containing 11, 811 feet more or less (Permanent Index No.
06-01-452-007-0000)
The property hereinabove described is dedicated for the
purposes, and shall be held, maintained, and used, as provided for
nature preserve buffer in the Illinois Natural Areas Preservation Act
(525 ILLS 30) . The Property is further dedicated for the purposes
and shall be held, maintained, and used, as provided for nature
preserve buffer in any amendment to said Act enacted hereafter, but
no such amendment shall alter the exclusive commitment of said
property for the purposes specified in said Act as of the date of
this dedication.
Said buffer area may be developed, managed, or used for
conservation, recreation, or service purposes as may be jointly
approved by the Illinois Nature Preserves Commission and the owner
and shall be managed as if it were part of the adjacent nature
preserve.
The City of Elgin, its successors or assigns, shall have custody
and management of the property herein dedicated, subject to the Rules
for Management of Illinois Nature Preserves, as amended, and any
approved master plan.
The dedication provided for herein is not intended nor shall be
construed as a conveyance of any title interest to the property
hereinabove described and the City of Elgin hereby expressly retains
title to the property.
