(hereinafter referred to as "ENGINEER"), shall modify that Agreement dated March 20, 2001,Amendment No.1 dated August 10, 2001 and Amendment No.2 dated July 22, 2001, whereby the ENGINEER was engaged to perform professional services in connection with the preparation of final design plans, specifications and quantities as needed for contract bid and construction of the 2001 Sewer Rehabilitation (hereinafter referred to as the PROJECT). WHEREAS, the services did not include professional design services for drainage improvements in the Highview Hills Subdivision as part of the PROJECT, AND WHEREAS, the CITY desires the ENGINEER to provide design services for this part of the PROJECT, AND WHEREAS, the CITY desires to include the payments to the ENGINEER under the AGREEMENT in connection with the professional services with the PROJECT. In response to these additional services, certain revisions and additions must be made to the AGREEMENT. In compliance, therefore, the terms and conditions of the AGREEMENT are modified as specifically set out below. All other parts of the AGREEMENT remain unchanged. SECTION I of the AGREEMENT is hereby amended to include PARAGRAPHS H. and I.: H. An outline of the design services to be provided by the ENGINEER includes development of preliminary design concepts to be selected for implementation by the CITY; preparation of final design plans,specifications and quantities as needed for contractor bid and construction for the Highview Hills Drainage Improvements. I. A detailed Scope of Design Services is attached hereto as attachment A-4. 1754 North Washington Street Suite 120 Naperville, Illinois 60563-1334 SECTION IV, PARAGRAPH A. of the AGREEMENT is hereby deleted and replaced with the following: A. For services provided, the Engineer shall be reimbursed at hourly rates as given in Attachment B-2 for the personnel employed on this PROJECT,with the total fee not to exceed $144,000 regardless of the actual costs incurred by the ENGINEER unless substantial modifications to the scope of the work and authorized in writing by the DIRECTOR. SECTION IV, PARAGRAPH C. of the AGREEMENT is hereby deleted and replaced with the following: C. Reimbursable expenses will include mileage for vehicles used,printing costs for plans and specifications as needed for review by the CITY, permit applications, and review by utility companies. Additionally included are one set of reproducible plans and specifications for use by the CITY in making sets for the bid and construction phases of the PROJECT. The total for these expenses is given in E, F, G and H. Fees required by other agencies for permit application will be paid directly by the CITY. SECTION IV of the AGREEMENT is hereby amended to include PARAGRAPH H: H. The schedule of Fees and Expenses for the design services to be performed by the ENGINEER as described in Paragraphs I.H. and I.I. is attached hereto as Attachment C-4. Any such fees are included in the above-referenced figure of$144,000.00. Make or cause to be made such drainage studies as may be required to furnish sufficient data for the design of the proposed improvement. 2. Prepare detailed plans which will include the following as required: - Cover Sheet - Index of sheets - Existing and proposed typical sections - General Notes - Summary of Quantities - Existing topography within right of way as necessary to cover improvements. - Proposed Geometrics - Proposed drainage - Existing easements and right of way - Proposed easement and right of way - Construction Staging - Existing and Proposed cross sections - Standards and Special Details 3. Make complete specifications special provisions, proposals and Estimate of Cost. 4. Attend progress meetings at any reasonable time when required to do so by representatives of the city. 5. Other consultant services (if required) will only be used with prior authorization and will be specifically itemized in the Consulting Agreement. 5. Hourly Billing Rates normally change on January 1st of each year. (CDG) for design services related to drainage improvements in the Allen Drive/Bruce Drive neighborhood. BACKGROUND The agreement with CDG ($75, 000) for the preparation of final plans, specifications, cost estimates and bidding assistance for the 2001 Sewer Rehabilitation Projects was authorized by the City Council on February 28, 2001 . The project included a combination of both sanitary sewer and storm sewer repairs/extensions that required conventional construction techniques to implement . It was a counterpart to the "trenchless" sewer lining contract and was funded by both the 2001 Neighborhood Storm Sewer Program and the 2001 Neighborhood Sewer Repair Program. Amendment No. 1 ($13 , 000) for construction engineering services for the 2001 Sewer Rehabilitation Projects was authorized by City Council on August 25, 2001 . Amendment No. 2 ($28, 000) for construction engineering services for the Country Knoll Relief Sewer Project was authorized by City Council on June 26, 2002 . r • . telk Allen Dr. /Bruce Dr Drainage Improvements October 4 , 2002 Page 2 The drainage improvements on Allen Drive and Bruce Drive were chosen as the project to be completed under the 2002 Neighborhood Storm Sewer Program. The City received numerous complaints from residents in the neighborhood about storm water and ground water drainage problems . The problems include standing water in the ditches, which makes them very difficult to mow and properly maintain, and very shallow or non-existent ditches, which causes the drainage to run onto the street pavement and create icing problems in the winter. Due to the similarity of the work and the lateness of the season, it is recommended that CDG' s agreement be amended to include this work rather than do a consultant selection process for the project . The approval of the amendment will require an exception to the procurement ordinance . Amendment No. 3 ($28, 000) will add design engineering, preparation of final plans, specifications and cost estimates and bidding assistance for the project which will regrade and sod all the drainage ditches after installing an under drain system and re-establishing the culvert pipes under the driveway entrances . The under drain will keep the ditches dry and mowable, even in the areas of high groundwater. A copy of Amendment No. 3 is attached as Exhibit A. A project location map is attached as Exhibit B. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None . FINANCIAL IMPACT Amendment No. 3 totals $28 , 000 and covers design related engineering services for the Allen Drive/Bruce Drive Drainage Improvement Project . Funding is available in the amount of $250, 400, account no. 276-0000-791 . 93-80, project no. 339657, 2002 Neighborhood Storm Sewer Rehabilitation. RECOMMENDATION It is recommended that the City Council authorize Amendment No. 3 with Civil Design Group, Inc . in the amount of $28, 000 and authorize staff to execute the necessary documents .
