RESOLUTION
ESTABLISHING PREVAILING WAGE RATES ON PUBLIC WORKS CONTRACTS
WHEREAS, 820 ILCS 130/0 . 01 et seq. entitled "AN ACT regulating
wages of laborers, mechanics, and other workers employed in any
public works by the State, county, city or. any public body or any
political subdivision or by any one uniler contract for public
works . " requires that any public body awarding any contract for
public work, or otherwise undertaking any public works as defined
herein, shall ascertain the general prevailing hourly rate of wages
for employees engaged in such work; and
WHEREAS, said Act further provides Ithat if the public body
desires that the Department of Labor ascertain the prevailing rate
of wages, it shall notify the Department of Labor to ascertain the
general prevailing wage rate; and
WHEREAS, at the request of the City o'f Elgin the Department of
Labor has determined the prevailing rate of wages for construction
work in Cook and Kane Counties in the State of Illinois .
NOW, THEREFORE, BE IT RESOLVED BY THE, CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that the determination of the prevailing wages
as made by the Department of Labor, copies of which are attached
hereto and made a part hereof by reference, are adopted by the City
of Elgin.
BE IT FURTHER RESOLVED that all contracts for public work of
the City of Elgin shall include a stipultion to the effect that
not less than the prevailing rate of wages as found by the
Department of Labor shall be paid to all laborers, workers and
mechanics performing work under the contract .
BE IT FURTHER RESOLVED that all contract bonds for public
works shall include a provision to 'guarantee the faithful
performance of the prevailing wage clause as provided by contract .
BE IT FURTHER RESOLVED that a copy of the prevailing wage rate
as established by the Department of Laborfi shall be publicly posted
and kept available for inspection by anyj_nterested party.
BE IT FURTHER RESOLVED that nothing herein contained shall be
construed to apply to the prevailing houily rate of wages in the
locality for employment other than public works construction as
defined in the Act, and that the City Clerk be and is hereby
authorized to file a certified copy of this resolution with the
Secretary of State Index Division and the Department of Labor of
the State of Illinois .

Explanations
COOK COUNTY
TRUCK DRIVERS (WEST) - That part of the county West of Barrington
Road.
The following list is considered as those days for wich holiday rates
of wages for work performed apply: New Years Day, MeHorial/Decoration
Day, Fourth of July, Labor Day, Veterans Day, Thanks.iving Day,
Christmas Day. Generally, any of these holidays whici fall on a Sunday
is celebrated on the following Monday. This then makes work
performed on that Monday payable at the appropriate overtime rate for
holiday pay. Common practice in a given local may a ter certain days
of celebration such as the day after Thanksgiving for Veterans Day.
If in doubt, please check with IDOL.
EXPLANATION OF CLASSES
ASBESTOS - GENERAL - removal of asbestos material from any place in a
building, including mechanical systems where those echanical systems
are to be removed. This includes the removal of asbestos materials
from ductwork or pipes in a building when the building is to be
demolished at the time or at some close future date
ASBESTOS - MECHANICAL - removal of asbestos material from mechanical
systems, such as pipes, ducts, and boilers, where tie mechanical
systems are to remain.
COMMUNICATIONS ELECTRICIAN - Installation, operation inspection,
maintenance, repair and service of radio, television recording, voice
sound vision production and reproduction, telephone .:nd telephone
interconnect, facsimile, data apparatus, coaxial, fi.re optic and
wireless equipment, appliances and systems used for he transmission
and reception of signals of any nature, business, do estic,
commercial, education, entertainment, and residential purposes,
including but not limited to, communication and telephone, electronic
and sound equipment, fibre optic and data communicaton systems, and
the performance of any task directly related to such installation or
service whether at new or existing sites, such tasks to include the
placing of wire and cable and electrical power conduit or other
raceway work within the equipment room and pulling w;re and/or cable
through conduit and the installation of any incident:1 conduit, such
that the employees covered hereby can complete any job in full.
TRAFFIC SAFETY - work associated with barricades, ho ses and drums
used to reduce lane usage on highway work, the inst:llation and
removal of temporary lane markings, and the installa ion and removal
of temporary road signs.

Other Classifications of Work:
For definitions of classifications not otherwise setout, the
Department generally has on file such definitions which are
available. If there is no such definition on file, the Bureau of
Labor Statistics SIC list will be used. If a task to be performed is
not subject to one of the classifications of pay set out, the
Department will upon being contacted state which neighboring county
has such a classification and provide such rate, such rate being
deemed to exist by reference in this document. Further, if no such
neighboring county rate applies to the task, the De artment shall
undertake a special determination, such special dete mination being
then deemed to have existed under this determinatio . If a project
requires these, or any classification not listed, p ease contact IDOL
at 618/993-7271 for wage rates or clarifications.
LANDSCAPING
Landscaping work falls under the existing classifications for laborer,
operating engineer and truck driver. The work perf rmed by landscape
plantsman and landscape laborer is covered by the existing
classification of laborer. The work performed by 1 ndscape operators

SUBJECT: Prevailing Wage Rates
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information in establishing prevailing
wages for public works contracts.
BACKGROUND
By law, Illinois municipalities are required to annually establish
the prevailing rate of wages for employees engaged in work on
public works projects . Contractors entering into public works
projects are required to pay employees not less than the prevailing
wage established.
Municipalities may hold public hearings to determine prevailing
wages or may rely upon the Illinois Department of Labor to
ascertain them. Historically, the City Council has elected to
accept the Illinois Department of Labor' s prevailing rate
determination. The Illinois Department of Labor has forwarded a
schedule of prevailing wages, which is an exhibit to the attached
resolution submitted for council action.

FINANCIAL IMPACT
In the event the City elects to independenly establish wage rates,
the City will incur the costs of conducing the public hearing
required to ascertain such ranges, and wili be required to bear the

LEGAL IMPACT
The Prevailing Wage Act (820 ILCS 130/3 . 01 et seq. ) requires any
public body not intending to adopt the findings of the Illinois
Department of Labor as to wage rates to investigate and ascertain
the prevailing rate of wages during thellmonth of June . In the
event the city wishes to independently scertain wage rates, it
must immediately authorize and direct th scheduling of a public
hearing to investigate and ascertain such rates .
ALTERNATIVES
The City may adopt the wage rates certified by the Illinois
Department of Labor or it may conduct an independent public hearing
to establish wage rates .
