RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
GETDOWN UNDERGROUND, INC. FOR THE BRANDT DRIVE WATER MAIN
WHEREAS, the City of Elgin has heretofore entered into a
contract with Getdown Underground, Inc. for water distribution
system improvements for Brandt Drive water main connection; and
WHEREAS, it is necessary and desirable to modify the terms of
the contract as is described in Change Order No. 1, attached
hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that Olufemi Folarin, Interim City Manager, be
and is hereby authorized and directed to execute Change Order
No. 1, a copy of which is attached hereto and made a part hereof by
reference.

I . A. REASON FOR CHANGE:
As a direct result of an on-site inspection of the soil
conditions at the jacking pit by The Illinois State
Toll Highway Authority. Per the March 12, 2002 letter
from The Illinois State Toll Highway Authority, it was
the judgment of The Illinois State Toll Highway
Authority that the inspected soil was found to contain
a large number of cobbles (rocks larger than three
inches) that will create voids under the pavement and
jeopardize the structural integrity of the roadway. As
a result, the Authority will not allow this underground
crossing to be bored using the conventional Machine
Driven Auger method. Instead, the City of Elgin may use
an approved alternate method, that being the
Impact-Driven Casing with a Soil Plug. NICOR will not
allow the Impact-Driven Casing with a Soil Plug method
because of potential vibration. They will however,
allow the open-cut method.
The following Change Order will be for substituting the
contracted Machine Driven Auger method with the Impact-
Driven Casing with a Soil Plug method underneath The
Illinois Stat Toll Highway property and the open-cut
method under NICOR property, as described in Exhibit A,
attached.

II. CHANGE ORDER CONDITIONS:
1. The Contract completion date established in the
original Contract is hereby changed by extended
calendar days, changing the final completion date from
May 25, 2002 to July 25, 2002 .
2 . Any additional work to be performed under this Change
Order shall be carried out under the provisions of the
Original Contract, including compliance with applicable
Equipment Specifications, General Specifications, and
Project Specifications for the same type of work.
3 . This Change Order unless otherwise provided herein does
not relieve the Contractor from strict compliance with
the guarantee provisions of the Original Contract,
particularly those pertaining to performance and
operation of equipment.
4 . The Contractor expressly agrees that he will place
under coverage of his Performance and Payment Bonds and
Contractor' s Insurance all work covered by this Change
Order. The Contractor will furnish to the Owner
evidence of increased coverage of his Performance and
Payment Bonds for the accrued value of all Change
Orders.
5 . All terms of the original Contract not specifically
amended here by remain in full force and effect.
III. ADJUSTMENTS IN AMOUNT OF CONTRACT:

IV. STATUTORY BASIS FOR CHANGE ORDER
1. The above changes were not anticipated, for the reasons
listed, at the time the contract with Getdown
Underground, Inc. was authorized.
2 . It is in the best interest of the City to approve the
above listed changes.
3 . The above listed changes are germane to the intent and
scope of the original contract.

SUBJECT: Authorization for Change Order No. 1
for Brandt Drive Water Main, with Getdown
Underground Construction Inc.
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider authorization of
Change Order No. 1 for Brandt Drive Water Main, with Getdown
Underground Construction, Inc .
BACKGROUND
On October 10, 2001 the Mayor and the City Council awarded a
contract for water distribution system improvements for the Brandt
Drive Water Main connection to Getdown Underground Company,
Batavia, Illinois . Permanent and temporary easements were acquired
from Jewel/Osco Stores, Inc . , Max McGraw Wildlife Foundation,
Kimball Hill, and NICOR Gas. The Illinois Environmental Protection
Agency (IEPA) issued a construction permit on October 31, 2001, and
the Illinois State Toll Highway Authority permit was issued on
December 20, 2001 .
On March 4, 2002, the contractor attempted machine auguring at the
south end of NICOR' s property under the observation of the Illinois
State Toll Highway Authority. The contractor ceased operation due
to unstable soil conditions, and the Illinois State Toll Highway
Authority required hand mining.
Due to the high cost of hand mining, the staff and project engineer
Alvord, Burdick & Howson (AB&H) , explored various alternatives for
the tollway crossing They included hand mining, auguring through
the NICOR Gas property and using the impact-driven auger method
with a soil plug, also called "pipe ramming" , through the tollway
property (from south to north) , and driving the pipe casing from
north of the tollway using the pipe ramming method, then open-cut
through NICOR Gas property. City staff and the Engineer AB&H

recommended pipe ramming from the north, then open cut through
Nicor Gas property, for its being the most economical method to
install the casing beneath 1-90 and the gas lines without damaging
the tollway or the gas lines. The pipe ramming was not anticipated
at the time the contract with Getdown Underground was authorized,
and it is in the best interest of the City to approve the Change
Order. A copy of Change Order No. 1 is attached.

I The total project budget is $815, 000 . The original contract with
Getdown Underground was $498, 124 . The total cost of Change Order
No. 1 is $137, 675 .40 . This can be funded from account number 381-
4000-795 . 92-41, project number 409545, where sufficient monies
($263 , 153) are available. With the addition of this change order
rib. the amended contract totals $635, 800 .

ALTERNATIVES
1. Do not approve the change order at this time.
RECOMMENDATION
It is recommended that the City Council authorize execution of
Change Order No. 1 in the amount of $137, 675 .40 with Getdown
Underground, Inc.
