HomeMy WebLinkAbout02-184 r Resolution No. 02-184 RESOLUTION AUTHORIZING EXECUTION OF AN AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH ENSR CORPORATION FOR ENVIRONMENTAL TESTING SERVICES FOR SOUTH GROVE AVENUE SITES BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5 . 02 . 020B (9) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interests of the city; and BE IT FURTHER RESOLVED that Olufemi Folarin, Interim City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an Amendment to Professional Services Agreement on behalf of the City of Elgin with ENSR Corporation for environmental services at Festival Park, Crocker Theatre and South Grove Avenue sites, a copy of which is attached hereto and made a part hereof by reference . s/ Ed Schock Ed Schock, Mayor Presented: May 22 , 2002 Adopted: May 22 , 2002 Omnibus Vote : Yeas : 7 Nays : 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk City of Elgin Agenda Item No. p _ April 19, 2002 TO: Mayor and Members of the City Council FROM: Olufemi Folarin, Interim City Manager ECONOMIC GROWTH SUBJECT: Proposal for Environmental Testing at Festival Park, the Crocker Theater and the South Grove Townhome Site PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information on a proposal from ENSR International for environmental testing and oversight services at Festival Park, the Crocker Theater site, and the South Grove Townhome site . BACKGROUND On February 13 , 2002 , the City Council authorized an agreement with ENSR International in the amount of $8 , 160 . ENSR' s scope of work included the completion of a site investigation and remediation objectives evaluation to determine the extent of remedial activities that may be necessary to achieve site clean-up objectives that are consistent with the planned residential development . ENSR has completed the Site Remediation Plan Application and submitted the Site Investigation Work Plan to the IEPA on March 15, 2002 . The plan was enrolled in the voluntary site remediation program on March 19, 2002 . An IEPA project manager has been assigned to the sites . The IEPA has advised ENSR that it may take 60 days to complete the review of the submittals . The work plan submitted to IEPA called for eight soil borings and nine monitoring wells . The development agreement with PAR states that the City is to obtain a No Further Remediation Letter (s) for the property for residential standard prior to closing. The closing (s) is/are anticipated to be approximately 300 days from Februarys 13 , 2002 . The site review by the City will be completed by mid June. Given this timing, ENSR suggests that the City begin the site investigation without waiting for the IEPA review of the Work Plan. Proceeding now would allow the City to meet the time line identified in the PAR Development Agreement . ENSR Environmental Testing Proposal April 19, 2002 Page 2 ENSR has proposed a very traditional approach for investigating the three sites . The proposed procedure involves a series of soil borings and groundwater testing wells . The down side of proceeding prior to IEPA approval of the work plan would be that IEPA may require that additional soil borings or groundwater monitoring wells be installed. Staff is proposing that the following tasks be authorized at this time : 1 . Soil Investigation - eight borings 2 . Groundwater assessment - nine wells 3 . Site Investigation Reports 4 . Remediation Objective Report 5 . Project Coordination and Management Services If the City contracts directly with ENSR for all elements of the scope of work, the cost would be $55, 418 (see table 1) . ENSR would subcontract for soil investigation, well placement and laboratory analysis . If the City was to contract directly for the drilling services and laboratory testing, and if ENSR was to provide oversight for the soil boring and groundwater well placement and review and analysis of test results, the total project cost would be $56, 709 . Proposals were solicited from three drilling companies and laboratories to determine direct cost quotes to the City. Contracting directly with ENSR is cheaper than contracting with private drillers and labs due to the significant discounts that a firm of ENSR' s size is able to obtain. Staff is recommending that ENSR be authorized to proceed with the identified scope of services at a cost of $55, 418 due to the press of time relating to the PAR Development Agreement and the expectation of beginning construction at Festival Park in July of 2002 . The award of a contract to ENSR will require an exception to the procurement ordinance. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. ENSR Environmental Testing Proposal April 19, 2002 Page 3 IMPACT DV_FINANCIAL The cost of this contract with ENSR will total $55, 418 for site investigation, project management and report preparation. Costs associated with this project will be charged to the Riverboat Fund, Riverfront/Center City Improvements, account number 275-0000- 791 . 92-35, project number 039520 . The City Council has previously approved $1, 870, 000 for Festival Park from the Riverboat Fund and $600, 000 from the South Grove TIF fund, for a total of $2 .47 million. ALTERNATIVES 1 . Proceed with an agreement with ENSR for environmental services in the amount of $55, 418 . 2 . Choose not to enter into an agreement with ENSR. RECOMMENDATION Staff recommends that an agreement in the amount of $55, 418 be entered into with ENSR for environmental services related to the South Grove Avenue residential project . Moller Director of Economic Development and Business Services City of Elgin 150 Dexter Court Elgin, IL 60120 SUBJECT: Request for Authorization Festival Park Redevelopment Sites Site Investigation Tasks Dear Ray: Pursuant to our telephone conversations, ENSR has submitted the Work Plans for the site investigation activity for the three Festival Park sites to the Illinois EPA. In conversation with our assigned Illinois EPA Project Manager, it looks as though we will not receive Agency comments on the Work Plans for approximately 60 days. In order to comply with the schedule outlined in the Development Agreement for the Crocker Theater Site and Townhome Redevelopment Site, ENSR recommends proceeding with the investigation work as soon as practicable. Illinois EPA approval of the Work Plans is not a requirement of the Site Remediation Program. The work plans must be completed and submitted at some point in time, but the City may proceed with the site investigation work at its discretion. The advantage of allowing the Illinois EPA to review and comment on the plans is to obtain early concurrence with the proposed site investigation strategy and avoid any problems or duplication of efforts if the Agency has differing views on the investigation work. To proceed at this point will ensure our ability to meet the project schedule in that we will be able to have the majority of the site characterization data available during the 120- day investigation period. At a minimum we would then be able to provide a general assessment of the environmental conditions and be in a position to provide recommendations and conclusions regarding the sites. With reference to ENSR's December 26, 2001 proposal, the first two tasks that were proposed, SRP Application/Regulatory Coordination (Task 100) and Site Investigation Work Plans (Task 200), were authorized by the City on February 18, 2002 in the amount of$8,160.00. With the completion and submittal of the Work Plans, these tasks are now essentially complete. ENSR requests authorization in the amount of $55,418.00 to undertake the remaining tasks outlined in our proposal dated December 26, 2001. Changes in the proposed costs between our original costs and the enclosed revised cost proposal are as follows: ® Over 30 Years of Excellence in Environmental Services - ULM. City Mr. Ray Moller of Elgin April 2, 2002 Page 2 • Additional Well Sampling- During the development of the work plans we identified two groundwater wells that are adjacent to the Townhome Redevelopment site. We added additional labor (4 hours) and laboratory costs to sample these wells during the site investigation; • Additional Soil Borings — We modified the number of soil borings on the Townhome site from 7 to 8 and on the Festival Park site from 8 to 9. These changes were considered based on the additional area of the Townhome Site once Wellington Avenue was vacated and the portion of the former railroad right-of-way was added to the site. These changes affect the laboratory costs but do not substantially increase the estimated labor effort; and • We have obtained slightly more favorable pricing from the laboratory to perform the analytical work. Table 1, attached, shows the original proposed costs and current estimated costs for the work. The cost differential between the 12/26/01 proposal and the current estimate is $405.00. These cost estimates are both based on ENSR being responsible for subcontracting the laboratory and drilling services as part of its entire scope of work for the City of Elgin. ENSR has obtained three quotations from potential drilling firms and laboratories to perform the subcontracted services. These quotes are attached for your reference. A separate table, Table2, is also provided to compare the cost of the City directly contracting the laboratory and drilling services with ENSR providing the field oversight and professional services. While this method of contracting eliminates ENSR's handling fee of 10 % on the subcontracted services, it is less advantageous overall to the City. ENSR has negotiated discounts on laboratory services from our preferred vendor, ENCHEM, in consideration of the volume of work placed by ENSR. This discount would not be available to the City of Elgin if contracted directly. Further, our experience is that we have better control over these services if it is subcontracted through ENSR and we can therefore provide greater assurance of meeting the critical project schedule. Accordingly, ENSR recommends the authorization of the total scope of work, including drilling and laboratory services in the amount of$55,418.00. Please notify our office in the event that any of the terms below is unacceptable, and we shall provide you with a revised price quotation. 1. Site ReFresentative — A representative from the client's firm shall be on site at all times to provide direction to the drilling staff. 2. Personal Protective Equipment and Site Contamination — Personal protective equipment ("PPE") shall consist of hard hat, eye protection, hearing protection, gloves and steel-toe boots. In the event that additional PPE is required, client shall determine required level. In case of a contaminated site, client shall continuously monitor contamination levels and suggest upgraded PPE, if appropriate. 3. Work Day and "Drillin Services' — Crews shall not wort: more than eight hours on site per day unless otherwise indicated on quotation. 'Drilling services" time includes all time on site and includes, but is not limited to, time spent drilling, constructing wells/pads and standby time not caused by Rock& Soil. 4. Limited Knowledge — Quotation is based solely on information known at the time of quotation. Normal conditions and standard operating procedures are assumed. Unusual or difficult circumstances or a change in scope of work may create additional cost. Quantities are estimates and ac ual quantities used will appear on the final invoice. Standby time shall apply to those delays that are not caused by Rock & Soil staff. Mobilization charge is based on one mobilization and remobilization shall be billed additionally. S. Utilitv Clearances and Site Access— Client shall provide utility clearances, traffic control and permits. Client shall provide access and route of access to a site that is unobstructed with fuim terrain. At least 15 feet of space shall exist between drill rig mast and standard overhead lines; high voltage lines require additional space. If the project involves rock drilling or coring, a sufficient amount of potable water is assumed to be present at the site. 6_ Broken or Damaged Equipment — In the event that equipment and tools are broken or damaged beyond ordinary wear and tear, client agrees to reimburse for the actual cost of repair plus a 15% restocking fee. 7, Payment Terms — Payment terms are net 30 days, past due charges of 1.5% per month, unless otherwise agreed to in a subcontract agreement_ 8, Industry Assumptions — Typical industry practice shall apply secondarily to the attached quotation. Please note that Rock&Soil is committed to long-term relationships with its clients; therefore, a cost estimate is most typically an accurate representation of actual cost. These properties include Festival Park, a site to the east slated for a new townhome redevelopment, and the Crocker Theatre site. Securing an NFR for these parcels will assure the developer, as well as future residents of the sites, that the Illinois Environmental Protection Agency has reviewed and approved of the investigation and remediation steps undertaken by ENSR on behalf of the City. Our 70-person Chicago area client service center (CSC) is located in the western suburb of Warrenville, Illinois, approximately 20 miles from the Festival Park Redevelopment sites. The Warrenville CSC has approximately 40 staff capable of performing geologic and hydrogeologic assessments,assisting with the selection of a remedial method, and designing and implementing remedial actions once a course of action is selected. The sites are identified and described as follows: Festival Park Site —This site occupies approximately 4.2 acres and is a landscaped parcel • bordered by Prairie Street to the north, South Grove Avenue to the east, a bicycle path along the Fox River to the west, and Lake Street to the south_ We understand the City intends to further develop this property as park space with the construction of a pavilion, additional public park features,and compensatory storage for storm water. Tnwnhome Redeveloament Site — This site comprises a 5.0-acre area located east of the Festival Park site. The site is currently a parking lot and landscaped space. Development plans call for the construction of townhomes on this property. Crocker Theatre Site—The Crocker Theatre is located to the north of the Festival Park Site and is approximately 1.5 acres. The Site currently has two structures:the Crocker for resident i ding and the Coin Shop_ The City is interested in redevelopment of this property with the construction of a condominium building. To address the environmental issues associated with redevelopment of the three sites, ENSR has made a preliminary review of the Phase 1 Environmental Site Assessment Reports prepared by others for these sites. A listing of the prior reports upon which ENSR relied to develop this proposal is provided in Attachment A Our proposal has been organized into five sections. This section, the Introduction, presents an overview of the proposal document. ENSR's proposed approach and scope of work are discussed in Section 2.0. Section 3.0 provides a summary of the Illinois Environmental Protection Agency's Site Remediation Program and the steps typically required to obtain a No Further Remediation letter_ ENS Project Team and management approach are presented in Section 4.0. The City also intends to make improvements to the Festival Park Site to enhance the space with the construction of a band shell/pavilion. Part of these improvements also call for the excavation of soils to provide compensatory storage volume for storm water. Based on the site development plans, the City is interested in pursuing remediation to residential standards for all three properties. The goal of ENSR's work will be to provide environmental services and consultation to allow the three sites to be investigated in accordance with the Illinois Environmental Protection Agency's (IEPA's)Site Remediation Program(SRP). The first major milestone will be the completion of a site investigation and remediation objectives evaluation to determine the scope of remedial activities necessary to achieve site clean up objectives that are consistent with the planned residential redevelopment. The evaluation of environmental contaminants will be conducted in accordance with Tier 1 residential clean up objectives as set forth under the Title 35 Part 742—Tiered Approach to Corrective Action Objectives(TACO)regulations. This first phase of the project will be conducted during the developer's 120 day feasibility review period so that identified environmental issues can be taken into consideration prior to the finalization of the redevelopment agreement between the City and the developer. ENSR will also serve to coordinate the environmental regulatory review of the three sites in an effort to expedite the project toward the eventual issuance of No Further Remediation(NFR)letters by the IEPA. Task 100 SRP Application/Regulatory Coordination As the environmental consultant serving the City on this redevelopment program, ENSR will initiate contact with the Illinois EPA's Site Remediation Program and coordinate the technical aspects of the program during the course of the project_. The process will start with the completion of a SRP application form(DRM-1)for each of the three sites._ Based on the December 17''meeting, ENSR believes that enrolling the three properties into the SRP as discrete sites will benefit the program. For example, in the.event different remedial activities are identified for different sites; separate ` applications will allow each site to proceed independently towards a No Further Remediation letter. i Also, ENSR foresees the potential for different ownership of the three parcels at a later point in time. Separate applications will ensure that.any property use conditions required by the NFR will apply only to the specific site and not to all three properties. The SRP requires the submittal of a $500 partial payment check made payable to the State of Illinois upon enrollment.of each site. The City will also be responsible for IEPA costs associated with review of the project deliverables and oversight activities performed by the Agency. ENSR has not included the costs for these fees in our proposal. Since the City has possession of current Phase I Environmental Assessment Reports for each site, ENSR will submit these reports to the Illinois EPA with the initial SRP application. Providing the available information to the IEPA at the earliest date is expected to help expedite EEPA's review effort. The SRP application is also the preferred decision point where the applicant indicates its choice to pursue a focused or comprehensive NFR letter. A comprehensive NFR is based on an investigation program aimed at identifying all recognized environmental conditions and related contaminants of concern at a site. A focused NFR is intended to address specified and limited number of environmental conditions or contaminants of concern. Based on ENSITs knowledge of the sites"and the intended redevelopment efforts, ENSR is of the understanding that a comprehensive NFR is desired. This meeting is assumed to take place in Springfield, Illinois. • Regular phone contacts with the SRP Project Manager to track Agency review, and expedites response to any IEPA questions or comments. • Participate in one on-site meeting with the SRP Project Manager to inspect the sites. Task 200-Site Investigation Work Plan As part of this task, ENSR will prepare a Site Investigation Work Plan (SIWP) describing supplemental investigation activities including drilling and monitoring well installation details and soil and groundwater sampling protocols.The SIWP will include a site-speck Health and Safety Plan(HASP)to ensure the safety of all drilling and sampling personnel. The HASP will be used by field personnel, along with the investigation approach presented in this proposal,to guide drilling and sampling activities. The HASP will provide a list of emergency telephone numbers and directions to the nearest medical facility. The SIWP will be issued in draft to the City for review prior to submittal to the IEPA SRP Project Manager. The SIWP will be developed based on available information, further discussion with the City, and/or refinement of the project objectives. The SIWP will reflect the findings of the Phase I Environmental Site Assessment reports and input from City personnel who may have direct knowledge of past and present facility operations at the three sites. SRP procedures do not require the submittal of a separate SIWP document to obtain IEPA approval. However, ENSR has recognized the benefit of doing so, particularly in instances where a comprehensive NFR is sought. The Agency's review of the work plan helps to achieve buy-in with respect to the planned investigation work. If the schedule constraints will allow, ENSR will take this approach. Task 300—Soil Investigation As part of mobilization activities for this task, ENSR will secure contracts with a drilling subcontractor, and analytical laboratory to perform the work activities described in this section. In conjunction with the subcontractor mobilization activities, ENSR will notify the Joint Utility Locating Information for Excavators (JULIE) service (the subsurface utility clearance service for the state of 2-3 December.zoo, j_Vg*0SelsW100110049-City of ElOffes6wl PukPMAM ENM. Illinois) to arrange utility clearance for the site prior to initiating drilling and sampling activities. ENSR will also request available site surveys and utility layout drawings from.City personnel so that unmarked utility lines and other infrastructure features can be located. As part of Task 300 sampling activities, ENSR will advance soil borings to depths of 12 feet below grade using direct push technology. Two soil samples will be collected from each boring, based on photoionization detector (PID), olfactory, and visual screening, to delineate the vertical and horizontal extent of impacted soils. One soil sample from each borehole will target the upper 3-foot interval of the soils, while the second sample will assess subsurface conditions below 3 feet. Soil samples will be selected for laboratory analysis based on field screening results and geologic characterization. Soil boring locations will be finalized in the field once the utility and infrastructure layouts are evaluated. Soils generated during drilling activities will be returned to the boreholes. If the borehole collapses or if the soil cannot be returned for other reasons, the soil will be placed in a 55-gallon DOT approved steel drum and labeled with the contents. The costs to characterize,contain,and dispose of the containerized soil are not included in this proposal. Task 400—Area-wide Groundwater Assessment Based on ENSR's preliminary review of the Phase 1 ESA reports and preliminary Phase II study conducted at the redevelopment sites,an area-wide groundwater assessment is recommended. To ENSR's knowledge, none of the previous investigation efforts have addressed groundwater to determine if it is impacted above applicable standards. ENSR believes that this is a necessary step considering the documented environmental conditions cited in the Phase I reports, the known historical groundwater issues at the Riverboat complex adjacent to the sites, and the relatively shallow groundwater depth identified by the Preliminary Phase Il Environmental Investigation (Patrick Engineering, 10/4/01). Since all three of the redevelopment sites are contiguous (excluding the public right of ways for. streets), ENSR recommends an area-wide groundwater assessment that will encompass all three parcels as a single study area. Provided groundwater conditions are found to be generally similar for all three sites,this area-wide groundwater approach will reduce the cost of the initial assessment activity. If individual parcels are shown to have unique groundwater issues (i.e. different contaminants of concern)then additional groundwater characterization efforts may be required. To characterize groundwater quality and flow direction, ENSR will construct seven groundwater monitoring wells, obtain water level measurements and collect groundwater samples- In addition, groundwater field measurements (pH,dissolved oxygen, redox potential and specific conductance) will be measured down-well using a calibrated field probe to help evaluate the geochemistry of the groundwater. Task 500—Site Investigation Reports ENSR will prepare individual Site Investigation Reports(SIRs)to address recognized environmental conditions and constituents of concern (COCs) identified during the site investigation activities described in Tasks 300 and 400. The SIRs will describe field methods and procedures implemented along with analytical results from soil and groundwater samples collected at each site in order to characterize the lateral and horizontal extent of COCs at each site. The SIRs will be prepared in a manner consistent with the SRP regulations(35 III.Adm.Code Part 740) and will include sections applicable to each site. As noted previously, ENSR anticipates that each SIR will rely upon the results of the area-wide groundwater assessment to address the characterization of groundwater. As required by the SRP regulations, the site investigation reports will be prepared under the direction of and signed by a licensed professional engineer. Task 600—Remediation Obiectives Report Based on the results of the site investigation activities, ENSR will determine applicable remediation objectives(ROs)for the three sites. The development of ROs will be based on the Tiered Approach to Corrective Action Objectives(TACO) regulations(35 III. Adm. Code Part 742). As the residential clean up objectives are the most stringent standards, ENSR will also consider and evaluate the potential to apply other provisions of TACO that permit exclusion of exposure pathways as a means of reducing remedial activities. Based on information known about the sites, these considerations may include the following: • Use of engineered barriers to prevent exposure to impacted soils through the soil ingestion and soil inhalation exposure pathways. Engineered barriers that may be applicable to the sites include asphalt parking lots,building foundation slabs,or the pavilion structure. • Use of area background concentrations as screening tools or as remediation objectives. • Use of institutional controls to restrict groundwater use on the property as a means of excluding the groundwater ingestion exposure pathway. For the purpose of this proposal, evaluation of remediation objectives using Tier 2 or Tier 3 methods is not anticipated and not included in the estimated level of effort and cost. Task 700—Proiect Management/Meetings To facilitate and expedite the work, ENSR will need to be in regular communication with City personnel and the developer to ensure that the environmental aspects of the project are coordinated with other development plans. ENSR will attend two meetings with the City and/or the developer during the course of the project to facilitate such communication. Task 700 activities also include time allocation for the ENSR Project Manager and Cost Analyst to review project costs, schedule, and personnel requirements. The SRP is a voluntary program that was developed to provide persons performing investigation or corrective action activities, at sites where there was a release of hazardous substances,the opportunity to demonstrate that environmental conditions do not present I a significant risk to human health or the environment. An overview of the SRP process is provided j` below. A summary of ENSR's SRP project experience is presented on Table 3-1. Site closure within the Illinois Environmental Protection Agency(IEPA) Site Remediation Program (SRP) requires performing investigation and remedial action tasks in accordance with specific SRP technical protocols,.conformance.with data quality objectives,and preparation of project documents in specific formats. Regulations pertaining to the SRP are found in 35 Illinois Administrative Code } (IAC)Part 740. Site Remediation Program Process Under the SRP,the remedial applicant can pursue either a 'Comprehensive' or 'Focused' No Further . Application Remediation (NFR) letter. A comprehensive NFR . Site Investigation Report letter is issued when the applicant has successfully . A focused NFR letter, as the name implies, is based on demonstrating that specific contaminants from the 35 IAC Part 740 target compound list, or those related to a specific source, have been remediated to a level that is protective of human health and the environment. An NFR letter signifies a release from further responsibility under 'the Illinois Environmental Protection Act and is considered prima facie evidence that the site does not constitute a significant risk to human health and the environment provided the site is used in accordance with the terms of the NFR letter. The NFR letter does not become effective until it has been recorded with the > County Office of the Recorder of Deeds so that it forms a permanent part of the chain of title and serves as notification to future owners of the terms of the NFR letter. SRP Form DRM-1 is used for this purpose. 3.2 Site Investigation Report The Site Investigation Report (SIR) will address recognized environmental conditions and contaminants of concern identified during site investigation activities conducted at each site. Existing data along with data obtained in the supplemental investigation proposed in Section 2.0 will be used to identify risk to human health and the environment, determine site-specific remediation objectives, select cost effective and technically feasible remedial altematives and to develop/implement a Remedial Action Plan. A Phase I Environmental Site Assessment(ESA) is a general requirement of the SRP whenever a l comprehensive NFR is being sought. The existing Phase I ESA reports, as listed in Appendix A, Will be used to provide this information to the Agency. 3.3 Remediation Objectives Report A Remediation Objectives Report (ROR) is required by an applicant to the SRP to address recognized environmental conditions and related contaminants of concern identified during the comprehensive site investigation. The ROR presents project remediation objectives developed in accordance with 35 IAC Part 742,Tiered Approach to Corrective action Objectives(TACO). The RAP generally includes a statement of remediation objectives, provides a description of remedial technologies selected, and includes a confirmation sampling program to document the t performance of the remedial action method(s)selected. f ENSR has not included costs for development of a RAP at this point in time. Development of a technically feasible and.cost effective RAP will be contingent on results of the site investigation program described in Section 2.0 and subsequent development of site-specific ROs. The RAP will also need to consider other constraints and site limitations that may be imposed by the City based } on development schemes planned for the two redevelopment sites. Based on the scope of work described in this proposal and the request for experience within the Illinois SRP, ENSR has selected a Project Team comprised of experienced project management and senior technical staff to lead the investigation and remediation of the Festival Park sites. Each member of the project team has specific, project- related experience conducting site investigation and remediation under Illinois EPA's SRP. These projects have made extensive and creative use of the TACO regulations to achieve cost-effective site closure. A summary of qualifications for key individuals and their anticipated role on the project is provided in the section below. Additional experience information and technical qualifications in the form of professional resumes is available upon request Principal in Charge/Senior Program Manager—John M.Nardozzi,P.E. Mr. Nardozzi will serve as Principal in Charge and Senior Program Manger with overall responsibility for project direction and quality control. Mr. Nardozzi has over 22 years of professional service in the environmental field and has managed numerous site remediation projects in Illinois. Mr. Nardozzi is a registered professional engineer in Illinois and has extensive experience working with regulators at.the Illinois EPA. Mr. Nardozzi has managed a variety of remediation projects including assessment and closure of petroleum and solvent impacted sites. This experience includes directing a large-scale investigation and remediation program for a 45- acre electronics manufacturing facility in Montgomery, Illinois. Working through the Illinois Site Remediation Program, source area soil and groundwater remediation was accomplished on a fast track basis. In addition, Mr. Nardozzi has assisted the City of Elgin with site closure at several underground storage tank sites that have been issued a NFR letters by the Illinois EPA. As Program Manager for the City of Elgin,Mr. Nardozzi will be responsible for management of both the technical and financial aspects of the project He will provide direction to staff members that are implementing the various tasks and monitor the completion of those tasks with respect to the project schedule and budget Mr. Nardozzi will be the primary contact between the City, the site developer,the Illinois EPA and the ENSR project team. Site Investigation Manager—Eric R.Powley Mr. Powley has 11 years of professional experience on a wide variety of environmental projects. I QA/QC Manager/Senior Geologist-John Hyder,PG ` Mr. Hyder is a licensed Professional Geologist with 11 years of multi-disciplinary environmental experience. Mr. Hyder has managed and conducted many site investigations to determine the nature and extent of contamination as well as feasibility studies and remediation activities at industrial manufacturing facilities and municipal and industrial waste disposal facilities. Mr. Hyder has also assisted clients in receiving NFR letters from both the Illinois Site Remediation Program and Illinois Underground Storage Tank Program. t Mr.Hyder will be responsible for reviewing project deliverables and ensuring that all work is performed with appropriate levels of quality control review. Regulatory Specialist—Dennis Sopcich, P.E. Mr. Sopcich has been selected to serve.as the Task Manager for data evaluation based on the i Illinois Tiered Approach to Corrective Action Objectives(TACO) regulations. Mr. Sopcich has more than 20 years experience in conducting and managing a"wide range of Civil Engineering and '. environmental projects. These projects included voluntary cleanup actions, due diligence i assessments of industrial facilities, wastewater permitting, and RCRA closure. Technical areas of expertise include the application of risk-based corrective action methods for closure of leaking ± underground storage tank (LUST) sites, RCRA Closure, and voluntary cleanup sites. Risk-based protocols used include Superfund Soil Screening Levels (SSLs), ASTM E 1739-95 Risk-Based Corrective Action for Petroleum Sites (RBCA), and Illinois Tiered Approach to Cleanup Objectives (TACO)regulations. i Field and Project Support Staff 6 i In addition to the above senior staff,specific project tasks will be implemented by field and support staff under the supervision and direction of the Program Manager. The estimated base cost to execute the work described in Section 2.0 is $63,173. A summary of estimated project costs by task is presented in Table 5-1. Table 5-2 presents the proposed hourly billing rates for ENSR personnel and mark ups applicable to Other Direct Costs. 5.2 Cost Assumptions ENSR's cost estimate presented in Table 5-1 was developed using the following assumptions. • All borings and monitoring wells will be advanced on property owned by the City. ENSR has not included costs to obtain permits to drill in utility right-of-ways or privately owned properties. • The proposed costs assume three 8-hour days on site with the drilling contractor for the advancement of soil borings and monitoring we11 construction and sampling. • Neither ENSR nor its subcontractors are responsible for the replacement of utilities that are unknown or that are not marked by the local utility clearance service (JULIE) or the City unless such utilities are damaged as a result of ENSR or its subcontractor's negligence or willful misconduct • . Fieldwork will be performed under reasonable weather conditions and without major weather delays. No costs have been included for unusually severe weather conditions or access difficulties. • Work will occur during normal business hours, Monday through Friday, based on 8-hour workdays. ENSR has also assumed that we will have access to all drilling locations. • Investigation Derived Wastes (IDW) generated as a result of onsite work will be containerized by ENSR and its subcontractors. Costs for character¢ation and disposal are not included in this proposal • ENSR's estimated cost to prepare the SRP project deliverables is based on our experience on similar projects. Site investigation and report costs are dependent on the type and extent of contamination that is identified at the sites. However, ENSR will not be responsible for damage to landscape materials or turf, unless caused by our negligence or lack of reasonable care while conducting field activities. • The City will provide adequate.property boundary surreys with legal descriptions for the three sites to properly record the NFR letters. • All laboratory analytical work will be performed at standard(five to seven day)turnaround times. 5.3 Authorization ENSR believes our project team has the experience, depth of resources, and management approach to successfully achieve the City of Elgin's objectives. ENSR understands the City's desire to expedite work on this assignment to meet deadlines associated with the development agreement being contemplated by the City and a development firm. Based on these understandings, ENSR will provide services as follows: Task 100—SRP Application/Regulatory Consultation ENSR will prepare for City review and approval a Site Remediation Program Application (Form DRM-1)within 30 days. Regulatory consultation will be on-going through the course of the project in response to (EPA questions and comments.
