RESOLUTION
AUTHORIZING EXECUTION OF A PURCHASE OF .ERVICE AGREEMENT WITH
THE RENZ ADDICTION COUNSELING CENTER
BE IT RESOLVED BY THE CITY COUNCI OF THE CITY OF ELGIN,
ILLINOIS, that Olufemi Folarin, Interim City Manager, and Dolonna
Mecum, City Clerk, be and are hereby au.horized and directed to
execute a Purchase of Service Agreement •n behalf of the City of
Elgin with the Renz Addiction Counselin• Center for a community
based gambling addiction treatment and pr-vention program, a copy
of which is attached hereto and made a pa. t hereof by reference .

PURCHASE OF SERVICE AGR=EMENT
HIS AGREEMENT is made and entered i Ito on this /s-Th day of
fl14 , 2002 , by and between the City of Elgin, Illinois, a
muni ipal corporation, (hereinafter referred to as "City" ) , and the
Renz Addiction Counseling Center, and Illinois not-for-profit
corporation (hereinafter referred to as "P ovider" ) for services fo
the Problem and Compulsive Gambling Progr-m.
WHEREAS, City has determined that compulsive gambling is a
serious social problem which is destru, tive not only to the
individuals directly affected by such beh.vior, but which is also
generally detrimental to the general safety and welfare of the
citizens of City; and
WHEREAS, Provider provides prevention, outreach and treatment
services for compulsive gambling;
NOW, THEREFORE, in consideration of the mutual promises and
covenants contained herein, the sufficie cy of which is hereby
acknowledged, the parties hereto hereby a•ree as follows :
1 . Provider shall furnish City reasonably competent
professional treatment and educational services for a period
beginning on the date of the agreement and -nding December 31, 2002
which is attached hereto and made a part ereof .
2 . City shall pay to Provider the s m of $24 , 900 . 00 for the
term of this contract in two installment•. of $12 , 450 . 00 payable
within thirty (30) days of execution of this agreement and July 1,
2002 . Payments shall be made upon wr tten request from the
Provider. Provider shall not be entitled lo any payment in excess
of said $24, 900 pursuant to this Agreemen. .
3 . Provider shall maintain detailed records and receipts of
all services and other expenditures provi.ed directly and solely
pursuant to City' s fulfillment of the term•. of this Agreement, and
shall make such records and receipts .vailable to City for
inspection and copying upon reasonable novice .
4 . The Provider shall provide two written reports of
programs activities to the extent possibl- without violating the
confidentiality of the clients . This r-port shall detail the
disbursement of $24 , 900 and shall be prov' ded of the City Council
by May 31, 2002 and December 31, 2002 , and shall include all
program activity. These reports shall b: submitted to the City
Manager' s Office, 150 Dexter Court, Elgin, IL 60120 .
5 . Provider shall provide City wi h financial statements
relative to the organization' s total opera ions . These statements
shall be provided on or before July 31, 2002 and December 31, 2002 .
6 . The Provider shall provide appr.priate case management
services including but not limited to the • ontinuous evaluation of
client progress which leads to re-assessme t and the development of
new service plans, coordination of service. , or other disposition.
7 . The Provider shall comply with any and all applicable
labor standards imposed by all Local , State, and Federal regulatory
authorities .
8 . Provider agrees that no person -hall , on the grounds of
race, color, national origin, sex, age, di..ability, or handicapped
status or religion be excluded from participating in, or be denied
the benefits of, or be subjected to d ' scrimination under any
service, program, or activities funded ith any portion of the
funds received by the Provider under this Agreement .
9 . City shall have the right to cancel this Agreement by
written notice to the Provider, at any t me, in City' s sole and
absolute judgement that the Provider has failed to perform, in
City' s sole judgment, in a timely fashion, any obligation of the
Provider under this agreement . Such writ en notice from City to
the Provider shall be effective on the First day of the month
immediately following the mailing of the written notice as provided
hereafter, as of which first of the mon h, in such event, City
shall have no further obligation under thi•. Agreement, whether for
the payment of money or otherwise . Provi.er shall have the same
right to cancel this Contract by the giving of such written notice,
to be effective in the same fashion, on th first day of the month
immediately following the mailing of the otice .
In the event this agreement is termin:ted or in the event the
program for which the City funds provided Herein are to be applied
is discontinued or Provider ceases operati.ns prior to December 31,
2002 . Provider shall refund to the City a y unexpended funds paid
by the City hereunder.
10 . This Agreement shall terminate on December 31, 2002 ,
unless otherwise terminated as provided herein.
11 . To the fullest extent permitted by law, Provider agrees
to indemnify, defend and hold harmless he City, its officers,
employees, boards and commissions from al d against any and all
claims, suits, judgments, costs, attorney' . fees, damages or other
relief arising out of or resulting from o' through or alleged to
arise out of any reckless or negligent acts or omissions of
j Provider' s officers, employees or agents i the performance of this
110 agreement . In the event of any action against the City, its
officers, employees, agents, boards or co missions covered by the
foregoing duty to indemnify, defend and ho d harmless, such action
shall be defended by legal counsel of the City' s choosing.
7 4. The Provider shall promptly ref nd to the Purchaser:
a. Any payments received by the Provider as a result of
any material misrepresentation or raud contained in any
statements, written or oral, made by the Provider or any of
its agents, employees, or subcontrac ors to City. Provider
acknowledges that payment is mad: under this Contract
dependent also upon the proper qualifications of Provider' s
staff and employees . Material isrepresentation shall
include, but not be limited to, the qualifications of
Provider, employees, staff, and thei agents . In addition,
material misrepresentation shall als. include the failure by
Provider to perform reasonable qual ' ty of service which is
determined subsequent to payment of 'Provider' s fee .
b. If at any time, pursuant to this paragraph,
Provider owes a refund to City, City ay set off same from any
monies otherwise due from City to Provider hereunder, in
City' s sole judgment .
c . City shall be entitled to all other remedies which
may be available by law.
1 . The terms of this agreement shall be severable. In the
event any of the terms or provisions of thi_ agreement are found to
be void or otherwise unenforceable, the remainder of this agreement
shall remain in full force and effect .f1 This agreement shall not be deeme. or construed to create
an employment, joint venture, partner.hip or other agency
relationship between the parties hereto.

SUBJECT: Purchase of Service Agreement with Renz Addiction
Counseling Center for a Commu ity Based Gambling
Addiction Treatment and Prevention Program
PURPOSE
The purpose of this memorandum is to provide information to
the Mayor and members of the City Coui cil to consider a
Purchase of Service Agreement with ' he Renz Addiction
Counseling Center for support of the Comm nity Based Gambling
Addiction Treatment and Prevention Progra .
BACKGROUND
Since 1996, the City has sponsored the Gambling Addiction
Treatment and Prevention Program admini-tered by the Renz
Addiction Counseling Center. The progra seeks to address
gambling problems in three primary ways : 1) Provide assessment
and early intervention of compulsive gambling; 2) Treatment of
compulsive gamblers with individual and g oup counseling; and
3) Outreach efforts to educate the g=neral public about
compulsive and problem gambling.
As a part of the 2002 budget, the Renz 'ddiction Counseling
Center has requested $24 , 900 to support he program. Funds
expended through the 2001 program ye.:r provided direct
clinical treatment to 50 individuals In addition 16
unregistered clients were treated. Treat ent hours rose from
479 in 2000, to over 1300 in 2001 . This w.s due to serving 18
more patients and increased severity of ases treated. The
program also provided educational and prevention services to
over 18 community organizations reaching .:n audience of about
500 people.
The attached draft agreement provides or support of the
program at the requested $24 , 900 amou t . Treatment and
"' prevention/outreach efforts would continue as implemented over
the previous five years . Renz would report program activity
and results twice during the year.

the Riverboat Fund account number 275-0000-791 . 80-05

ALTERNATIVES
The City Council could approve the agreement as drafted, edit
the agreement or decline to provide support to the Gambling
Addiction Treatment and Prevention Program.
RECOMMENDATION
ells‘ It is recommended that the City Council .approve the Purchase
of Service Agreement in the amount of $24, 900 with the Renz
Center to support the Community Based Gambling Addiction
Treatment and Prevention Program.
