RESOLUTION
AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT WITH
THE COUNTY OF KANE FOR THE ELGIN FAR WEST TRAFFIC PLAN
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Olufemi Folarin, Interim City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed to
execute an Intergovernmental Agreement on behalf of the City of
Elgin with the County of Kane for the Elgin Far West Traffic
Plan, a copy of which is attached hereto and made a part hereof
by reference .

This Agreement entered into this 2 day of 2b01 by and between the
County of Kane (hereinafter the "County") a body co porate and politic of the State of
Illinois and the City of Elgin (hereinafter the "City") a municipal corporation of the
State of Illinois.
WITNESSETH
WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et
seq. authorizes the County and the City to cooperate in the performance of their respec-
tive duties and responsibilities by contract and other agreements; and,
WHEREAS, the City and the County desire develop a coordinated transportation plan
(hereinafter the "Plan") for County and City roadways in the Elgin Far West Planning
Area; and,
WHEREAS, the County and the City desire to develop the Plan to provide a guide for
development and for appropriate contributions for identified roadway improvements;
and
WHEREAS, the Plan shall be of benefit to the citizens of the County of Kane and the
City of Elgin in that it shall facilitate the safe and efficient movement of traffic.
NOW,THEREFORE,in consideration of the above preambles and the mutual promises
and covenants as contained herein and for other good and valuable consideration the
sufficiency of which is agreed to by the parties hereto, both the County and the City
covenant, agree and bind themselves as follows:
A. The Plan shall encompass the Elgin Far West Planning Area (See Attachment A),
approximately bounded by Highland Avenue on the north; Muirhead Road on
the west; Hopps Road on the south; and Randall Road on the east.
B. The Plan shall analyze the impact that proposed development in the Elgin Far
West Planning Area will have on both existing and proposed roads. The Plan
shall identify the expected increases in traffic density as a result of such devel-
opment and shall make recommendations regarding road widening and other
similar improvements to streets and highways in order to accommodate the
identified increases in traffic density.
C. The Plan shall identify intersection improvements that will be necessary due to
the identified increases in traffic density resulting from the proposed develop-
ment in the Elgin Far West Planning Area. When intersection improvements are
identified under the Plan, the Plan shall provide recommendations for the de-
sign, construction (including signalization and channelization) and inspection of
the proposed intersection improvements. The Plan shall also identify property
necessary to be acquired for the public right-of-way in connection with identified
intersection improvements and shall provide the estimated cost for all identified
improvements.
D. The Plan shall identify the specific level of improvement for both existing and
proposed roads necessary to accommodate the expected impact from the pro-
posed development in the Elgin Far West Planning Area, including the number
of lanes to be added to existing roads or constructed on new roads, the location
of the identified improvements and the estimated cost of all identified improve-
ments.
E. The County shall execute a professional services agreement with the consulting
design engineering firm of CH2M-Hill Engineers for the completion of the Plan.
F. CH2M-Hill Engineers shall submit copies of the completed Plan to the County
and City not later than 3 June 2002.
G. The City and County shall share in payment of the cost for the respective Plan,
provided that the City shall not be required to pay more than $40,000.00 in such
costs.
H. The County shall pay CH2M-Hill Engineers the entire balance of the costs to
complete the Plan. The City shall reimburse the County within 30 days from the
County's receipt of a final invoice for the Plan from CH2M-Hill Engineers.
I. Nothing in the Plan or this Agreement shall obligate the City to proceed in ac-
cordance with the Plan's recommendations nor shall the City be otherwise obli-
gated to provide funding for road or intersection improvements as identified in
the Plan, it being agreed and understood that the Plan is intended as being advi-
sory only.
J. This agreement shall be effective upon approval by the respective legislative
bodies of the County and the City.
K. The failure of either party hereto, at any time, to insist upon performance or ob-
servation of any term, covenant, agreement, or condition contained herein shall
not in any manner be construed as waiver of any right to enforce any term, cove-
nant, agreement, or condition herein contained.
L. This agreement shall inure to the benefit of the parties hereto successors and as-
signs.

SUBJECT: Proposed Intergovernmental Agreement with
Kane County - Cost Sharing of Traffic Study
for Far West Area
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider the proposed
intergovernmental agreement with Kane County with respect to a Far
West Traffic Study.
BACKGROUND
rKane County hired a consulting firm, CH2M-Hill, to provide a
county- wide traffic study. Because of the near future development
potential in the Far West area, City staff felt it was prudent to
work with the County to develop an understanding of what roadway
and intersection improvements will be needed. The execution of the
intergovernmental agreement (attached as Exhibit A) will allow the
County to expand their county-wide traffic study and provide the
City staff with an understanding of the needed improvements .
With an understanding of necessary improvements and their related
costs, staff will be able to determine each developer' s financial
responsibility in a fair manner. By expanding the County' s
traffic study, the City saves not only costs but the time it would
take to enter into its own engineering services agreement . Also,
because Kane County controls most of the roadways that will need
improving, the combined effort will lead to a consistent plan for
both City and County.

FINANCIAL IMPACT
The City' s share of the study is $40, 000 , which will be paid to the
County once the intergovernmental agreement is executed by Kane
County and returned to the City. This share was determined by the
County' s consultant after discussing with City staff the level of
effort and information desired. Once the attached agreement is
executed by both parties it is staffs intention to process a single
payment within sixty days or less .
The City budgeted $100, 000 in the Riverboat Fund for a City Wide
Traffic Study (Account No. 275-0000-791 . 93-80 Project No. 030030)
which can be used to fund this project .

None .
ALTERNATIVES
The information this study will provide staff is essential for
determining improvements and collecting fees from the developers in
the Far West Area. An alternative includes rejecting the
agreement but doing so will limit staff' s ability to assess a
developer' s financial responsibility for essential transportation
improvements . The City could employ its own consultant but the
delays in selecting, negotiating, awarding and completing a study
would hamper staffs ability to expedite several Far West
development projects .
RECOMMENDATION
It is recommended that the City Council authorize the execution of
the intergovernmental agreement with Kane County.
