RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
PATRICK ENGINEERING FOR THE SPORTS COMPLEX BLASTING STUDY
WHEREAS, the City of Elgin has heretofore entered into a
contract with Patrick Engineering for the Sports Complex Blasting
Study; and
WHEREAS, it is necessary and desirable to modify the terms of
the contract as is described in Change Order No. 1 and Final,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed to
execute Change Order No. 1 and Final, a copy of which is attached
hereto and made a part hereof by reference .

Change Order No. 1 and Final
ORIGINAL CONTRACT: The original contract with Patrick Engineering dated March 14, 2001
for the Sports Complex Blasting Study totaling $67,825.
SCOPE: This Change Order#1 will compensate Patrick Engineering for work related to
performance improvements unforeseen at the time the original contract was signed.
REASONS FOR CHANGE: The circumstances necessitating the change in performance were not
reasonably foreseeable at the time the contract was signed. The additional issues are as follows:
$6,825 43 additional home inspections, as authorized by the City, were conducted
in addition to the 20 estimated in the City's required Scope of Services.
$6,825 Total Change Order#1.
SUMMARY OF CHANGES AND CONTRACT AMOUNT: The Patrick Engineering Contract
will be revised as follows:
Original Contract: $67,825
Change Order#1 6,825
New and Final Total Contract Amount $74,650
OTHER CONTRACT PROVISIONS: All other contract provisions shall remain the same.

SUBJECT: Change Order No. 1 with Patrick Engineering
for the Sports Complex Blasting Study
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider the first and
final change order to the Patrick Engineering Contract for the
Sports Complex Blasting Study.
BACKGROUND
In March 2001, the City Council awarded a contract to Patrick
Engineering to conduct a study to evaluate the blasting being
conducted by Prairie Materials, Inc. at the Sports Complex in the
amount of $67, 825 . Change Order No. 1 was approved during the data
collection phase of the study. Residents were asked to participate
in home inspections by Patrick Engineering to evaluate the
possibility of home damage as a result of the blasting. The
original Scope of Services as outlined in the contract agreement
included 20 home inspections . Resident requests for home
inspections totaled 63 . To insure that all possible residential
data was collected, the additional 43 home visits were approved.
The new contract amount is as follows :
Original Contract Amount $67, 825
Total 1st and Final Change Order 6 , 825
New Total Contract Amount $74, 650
Patrick Engineering completed the study in August concluding that
no structural damage could have been caused to any residential
property as a result of the blasting at the Sports Complex.
Additionally, Patrick Engineering presented the findings to the
community and City Council in August . Patrick Engineering has
returned all of the data to the City as well as their report which

rThe recommendation is to approve the first and final change order

Enclosed is PEI's final invoice for City of Elgin's Project at the Sports Complex, Patrick
Engineering Project No. 9177.00. I hereby certify that the following services have been provided
during the period starting May 26, 2001 and ending July 25, 2001. The enclosed invoice in the
amount of$9,881.00 for the completion of the project including all incurred costs for the work
completed with the FAA, printing of the multiple copies of the report, and the additional charges
for the increased number of homeowner interviews.The costs are summarized below:

Change Order 1
Sixty three homeowner interviews within the Sunset Park Neighborhood were completed. PEI
had originally established appointments with residents of Sunset Park and the adjacent
neighborhoods who previous recorded their complaints regarding concerns over the blasting
conducted at the Elgin quarry (Prairie Materials Yard #93). The initial scope of work resident
listing of approximately twenty homeowners expanded after PEI and the City of Elgin attended a
Public meeting held at the Wesley Methodist Church on March 13, 2001. At that meeting, an
additional 40 residents indicated that they had blasting related damage concerns that required
special consideration and documentation. The cited change order is a result of the additional
homeowner interviews, location monitoring, and associated reporting.

• FAA supplemental analysis and meetings,and Homeowner Oversight reporting.
• Preparation of Presentation materials for City Council and Homeowner meetings.

For the final record,the analysis of Prairie historical blasting data and information established about
the physical and condition assessment of Prairie Materials blasting operations and its impact at the
Sunset Park Neighborhood Association homes is reported in a manner which defines the
conditions for each home on a separate basis and the conclusions remain unchanged. The Prairie
Materials blasting operations has not adversely impacted the homes of the SUNSET park
Association
Separately PEI has returned the available Blasting Operator Logs for the years of 1997 through the
first half of 2001 filed in binders and tabbed in monthly intervals for ready reference. For those
months of mining equipment, overall or relocation the months are tabbed but logs may be
conspicuous by their absence. In addition, included with the transmittal is a complete three volume
set of the Sports Complex Blasting Study for the Illinois DNR use and file, should the city elect to
transmit a copy to the State of Illinois,DNR.
As City of Elgin's blasting consultant, Patrick Engineering Inc. (PEI) and Vibra-Tech Engineers
wish thank you and the City of Elgin for the opportunity to assist in the development of responses to
the residents concerns related to the Prairie Materials Blasting operations. Should you require
further assistance during the next and final phase of the blasting work in the South Mining Area
we are prepared to assist with the following work items:
• Finalization of the final seismic model and with respect to the FAA building;
• Conceptualization of the final mine excavation procedure by recommending size and
ribk configuration of blast charge loadings, and
• Validation of rock blasting input parameters.
