RESOLUTION
AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT WITH
BLACK & VEATCH FOR THE SOUTH MCLEAN LIME RESIDUE FACILITY
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, be and is hereby
authorized and directed to execute Amendment No. 1 to an
Agreement on behalf of the City of Elgin with Black & Veatch for
design and construction phase services for the South McLean Lime
Residue Facility, a copy of which is attached hereto and made a
part hereof by reference .

Facilities —pH Adjustment to Facility Discharge
Amendment No. 1: Supplemental Engineering Services - Design and
Construction Phases
This Amendment No. 1 modifies and amends the Agreement Between Owner and
Engineer dated February 22, 2001 (Agreement) to provide supplemental engineering
services related to the design and construction of the pH control channel at the South
McLean Lime Residue Lagoon site.
SCOPE OF SERVICES
The Scope of Services in Paragraph I of the Agreement shall be modified to include the
Supplemental Services indicated below. The approach for these services will be based on
an accelerated schedule, using design/construction management techniques. The project
includes design and construction management of a diversion channel to reroute the
discharge from the lime residue lagoon decant pond through the extended treatment
channel to the adjacent golf development, ultimately discharging to an existing stream
which discharges into the Fox River.
1. Coordinate a topographic survey of the site and review a topographic drawing of
existing conditions. The topographic survey will be conducted by others under a
change order to a current contract with the Owner, at no expense to the Engineer.
2. Coordinate with the IEPA, and prepare, submit and obtain the construction and
operating permit. The basic design of the channel submitted previously to the IEPA
for the construction permit application will be used. However, later modify the
length and location of the channel to increase the length from approximately 800
lineal feet to approximately 1400 lineal feet; and change the discharge location from
the v-notch weir structure to a location on the golf course development. Delete
meeting with the Illinois Pollution Control Board, which was included in the original
Scope of Services.
3. Prepare drawings or sketches indicating the scope of the proposed construction of
the diversion channel, including the channel, the inlet and outlet structures, and
grading of the surrounding area. Provide outline specifications of the technical
requirements of the work in order to obtain construction bids.
4. Meet with representatives of the Owner and the golf course developer/contractor.

Assist in negotiating change orders with the golf course developer and contractor(s)
to construct the diversion channel, the inlet and outlet structures, site grading,
landscaping, and other required work. Change orders may also be negotiated for
topographic survey, staking and grading, and landscaping. Engineer will not hold
these contracts.
5. Provide up to 40 hours of field observation during construction of the diversion
channel, the inlet and outlet structures, grading, landscaping, and final site
development related to the pH control channel. Answer questions regarding
materials of construction.
6. Coordinate final topographic survey of the channel and prepare record drawings.
7. Attend up to 6 construction progress meetings to coordinate with the Owner and golf
course developer and contractor.
8. Assist in review of partial and final change orders or construction pay applications.
9. Perform inspection of construction and prepare punch list; perform final inspection
and acceptance letter.
10. Coordinate with IEPA regarding final acceptance and start-up of the pH control
channel.
COMPENSATION
The Owner agrees to pay the Engineer for the Supplemental Services described above as
outlined in Paragraph III of the Agreement.
The contract amount shall be increased as follows:
Original Contract Amount $ 22,000
This Amendment No. 1 $ 31,500
Adjusted Contract Amount $ 53,500
The contract amount for the Supplemental Services to be provided pursuant to this
Amendment No. 1 shall not exceed $31,500 without further authorization by a written
amendment to this Agreement approved by both parties.
The Engineer shall start the performance of these Supplemental Services upon receipt of
notice to proceed. If, through no fault of the Engineer, the Supplemental Services cannot
be considered complete by November 30, 2001, then the maximum billing limit may be
adjusted accordingly by an amendment to this Agreement, if so requested by the Engineer
and approved by Owner.

SUBJECT: Amendment to the Agreement for Engineering Services
With Black & Veatch for Design & Construction Phase
Services for the South McLean Lime Residue Facility
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider awarding an
amendment to the Black & Veatch Engineering Contract to provide for
Supplemental Engineering Services - Design and Construction Phase
Services, to the South McLean Decant Pond Improvements .
BACKGROUND
On January 24, 2001, the City Council awarded a contract to Black
& Veatch for evaluation and preliminary design of modifications to
the South McLean lime residue facility discharge stream in
preparation for an appearance before the Illinois Pollution Control
Board. This appearance was to present design modifications to the
effluent discharge to enable us to meet water quality standards.
Since then, we have reached an agreement with the Illinois
Environmental Protection Agency as to the treatment technique to be
employed to reduce the discharge pH from this facility. As a
result thereof, the appearance before the Illinois Pollution
Control Board has been declared unnecessary.
This proposal will allow the City to design and construct a ditch
through the new Highlands of Elgin Golf Course which are expected
to lower pH values prior to discharge to waters of the state. This
amendment with Black & Veatch allows for an accelerated schedule,
using design build or construction management techniques, thereby
allowing the City to meet the timetable established in a settlement
proposal forwarded to the Kane Country State' s Attorney and the
Illinois Attorney General .

Construction of the new spillway and the treatment ditch grading
will be incorporated by change order into the Ryan Construction
contract . Ryan Construction is presently performing the work on
the new Highlands of Elgin Golf Course for the City.

This project (409557) has been funded for under account number 381-
4000-795 . 92-36, in the amount of $200, 000, of which $22, 000 has
been spent to-date, leaving a balance of $178, 000 .

RECOMMENDATION
It is recommended that the City Council approve this contract
amendment for engineering services to the firm of Black & Veatch
for a negotiated cost not-to-exceed $31, 500 .
