HomeMy WebLinkAbout01-211 Resolution No. 01-211 RESOLUTION APPROVING CHANGE ORDER NO. 4 IN THE CONTRACT WITH WHITTAKER EXCAVATING FOR THE WING PARK FAMILY AQUATIC CENTER WHEREAS, the City of Elgin has heretofore entered into a contract with Whittaker Excavating for the Wing Park Family Aquatic Center; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 4 , attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Joyce A. SCOPE : This 4th and Final Change Order will compensate Whittaker Excavating for work related to performance improvements and Illinois Department of Health requirements unforeseen at the time of the original bid. REASONS FOR AND AMOUNT OF CHANGES : The circumstances necessitating the changes as set forth in this Change Order #4 and Final were not reasonably foreseeable at the time the contract was signed. The additional issues are detailed in the February 14, 2001 Memorandum of Burbach Aquatics LLC, attached hereto as Exhibit A, and may be summarized as follows : $ 2 , 581 . 54 Sign and Plumbing Changes-Requested by Illinois Department of Health following contract award. $23 , 348 . 92 Performance Improvements-These entail contractor overtime for expediting July 2000 opening and general design improvements noted during pre-opening walk-through (add fence changes, add privacy screens, add pool heater electric, add counter tops, and add bridge scour) . $25 , 930 . 46 Total Amount of 4th and Final Change Order SUMMARY OF CHANGES AND CONTRACT AMOUNTS : Original Contract Amount : $ 4 , 653 , 170 . 00 Change Order No. 1* 0 Change Order No. 2 87, 998 . 02 Change Order No . 3 89, 852 . 78 This Change Order #4 and Final : 25 , 930 .46 New Total and Final Contract Amount : $4 , 856, 951 . 26 *Change Order #1 was to extend the completion date by 30 days and was approved at the time of contract . This memo is a summarization of the proposals presented by the contractor since Change Order #3. These proposals are first listed according to the contractors submittal sequence. Parker, City Manager SUBJECT: Change Order No. 4 with Whittaker Excavating for the Wing Park Family Aquatic Center PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the final change order to the Whittaker Excavating contract for the Wing Park Family Aquatic Center. BACKGROUND In August 1999, the City Council awarded a contract to Whittaker Excavating for the construction of the Wing Park Family Aquatic Center in the amount of $4, 653 , 170 . Included within the project funding was $50, 000 for utility work and $144, 000 in contingency. Change Order No. 1 was approved at the time the contract was approved and provided for an extension to the project completion date due to the floodway mapping and permit approval processing. The fourth and final change order involves capital improvements and Illinois Department of Health requirements . The change order cost breakdown is as follows : IDOH Requirements $ 2, 581 . 54 add sign frame add sand play plumbing Performance Improvements 823 , 348 . 92 contractor overtime add fence changes add privacy screens add pool heater electric add counter tops (11116'' add bridge scour Total 4th and Final Change Order $25, 930 .46 Change Order No. 4 with Whittaker/Wing Park July 20, 2001 Page 2 Hey and Associates was contracted after the initial budget was established, and prior to the bidding phase, for a cost of $21, 500 to acquire permits due to the floodway issues of the site . The additional Illinois Department of Health requirements, contractor premium costs to fast track work on evenings and weekends for a July 2000 opening, and performance improvements were elements of the contract where contingency funds were used. Since the grand opening of the Wing Park Family Aquatic Center on July 3 , 2000, Whittaker Excavating continues to complete minor punch list and warranty items at the facility. Final completion is scheduled by the end of 2001 . Additionally, the mechanical contractor trained staff on proper winterization procedures following the 2000 season as well as start-up procedures for the 2001 season and will again perform and refresh staff on winterization procedures following the 2001 season.
