Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute Amendment No. 2 to an Engineering Services Agreement on behalf of the City of Elgin with Clark Dietz, Inc . for the Spartan Drive extension, a copy of which is attached hereto and made a part hereof by reference. s/ Ed Schock Ed Schock, Mayor Presented: May 9, 2001 Adopted: May 9, 2001 Omnibus Vote : Yeas 6 Nays : 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk CITY OF ELGIN,ILLINOIS SPARTAN DRIVE EXTENSION ENGINEERING SERVICES AGREEMENT AMENDMENT NO. 2 THIS AMENDMENT NO. 2 entered into this jaZday of fit C 2001, by and between the City of Elgin, an Illinois municipal corporation (herein r referred to as "CITY"), and Clark Dietz, Inc., an Illinois Business Corporation (hereinafter referred to as "ENGINEER"), shall modify the Agreement dated the 21st day of January, 1998 (hereinafter referred to as "Original Agreement") as well as Amendment No. 1 dated the 20th day of May, 1999, whereby the ENGINEER was engaged by the CITY to perform certain professional services in connection with the completion of Phase I - Preliminary Engineering and Phase II - Final Engineering Design for the extension of Spartan Drive (hereinafter referred to as "PROJECT"). This change is germane to the original contract as signed. Whereas, the ENGINEER completed the Phase I - Preliminary Engineering for the PROJECT which presented the preferred alignment for the extension of College Green Drive and the proposed intersection improvements with Randall Road and College Green Drive. AND Whereas, the ENGINEER completed the Phase II - Final Engineering Design for the preferred alignment for the extension of Spartan Drive. AND Whereas, the ENGINEER was required to provide additional engineering and surveying service associated with changes in the SCOPE of SERVICES caused by requirements of Kane County, increases in the project length, and development activities adjacent to the project. In response to these changes, certain revisions must be made to the Original Agreement and Amendment No 1. In compliance, therefore, the terms and conditions of the Original Agreement are modified as specifically set out below. SECTION I of the original agreement is hereby amended to add the Scope of Services included in Attachment A. SECTION IV of the original Agreement is hereby amended by adding the following to Paragraph A thereof: For additional services provided in Attachment A of Amendment 2 the ENGINEER shall be reimbursed a total additional fee of$41,589, including outside services and job related expenses, regardless of the actual time expended or actual costs incurred by the ENGINEER. This will increase the total and final amount of the fee and expenses to be paid to the ENGINEER for the project to $281,748. All other provisions of the ORIGINAL AGREEMENT shall remain in full force and effect. IN WITNESS whereof,the undersigned have placed their hands and seals upon and executed AMENDMENT NO. 2 in triplicate as though each copy hereof was an original and that there are no other oral agreements that have not been reduced to writing in this statement. Additional survey performed by Baird& Company along Randall Road. 2. Additional traffic projections for new development adjacent to the project. 3. Additional geometrics and IDS revisions for alternate traffic projections and adjacent development. 4. Revisions to the Intersection Design Study based upon changes in development. Phase II -Final Engineering Design 1. Additional plat of roadway by Baird & Company for revised roadway alignment. 2. Additional survey along Randall Road for further lengthening of project. 3. Modification of project limits due to Kane County requirements. 4. Revision to construction limits for alternate construction bid packages. 5. Final geometric revisions to incorporate Kane County requirements. 6. Addition of approach lighting as required by Kane County. Parker, City Manager SUBJECT: Amendment No. 2 to an Agreement with Clark Dietz, Inc. (CDI) for Design Engineering Services for the Spartan Drive Extension Project PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider Amendment No. 2 to an Agreement with CDI for additional design services for the Spartan Drive Extension Project . BACKGROUND The original agreement with CDI ($111, 109) for preliminary engineering and roadway location purposes was authorized by the City Council at its December 17, 1997 meeting. Amendment No. 1 ($129, 050) to the agreement with CDI for the preparation of plans, specifications, bid documents and bidding assistance was authorized by the City Council at its April 28, 1999 meeting. Amendment No. 2 ($41, 589) will provide compensation to CDI for additional design work required in order to obtain a permit from Kane County for modifications to the College Green Drive/Randall Road intersection. Kane County required more significant modification to Randall Road than was initially anticipated. This included the addition of dual left turn lanes from southbound Randall Road to eastbound College Green Drive, additional widening on Randall Road to accommodate a barrier median and right turn lanes and the complete resurfacing of Randall Road within the project limits . This resulted in the need for additional survey work and redesign of nearly complete plans . The significant increase in the design work scope obviously warranted additional fees but staff felt that CDI ' s initial request for $96, 840 was excessive. Multiple meetings over several months were held to review the documentation/justification. The mutually acceptable total fee for Section I (the western half of Spartan Spartan Drive Extension Project rw April 20, 2001 Page 2 Drive plus the College Green/Randall Road intersection improvements) was based on 12 . 6% of the actual construction cost for that section/project ($1, 458, 457) . The originally established engineering fees for Sections 1 and 2 ($240, 159) were 12 . 6% of the original construction estimate for both sections ($1, 958, 436) . Since it has already been decided not to have CDI complete the design engineering for Section 2 , fees for that section were limited to billings to date at the time that work was halted. Upon final payment for this Amendment No. 2 , the agreement with CDI will be terminated. Because the final design for Section II (Spartan Drive through Spartan Meadows Golf Course) is only 50% complete, the City will need to hire a new consultant to complete the design. It is anticipated that a new firm will be selected in late 2001 with completion of final design in 2002 . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. FINANCIAL IMPACT 12(iti\-- Amendment No. 2 is in the amount of $41, 589 . The final contract amount with CDI will be $281 , 748 . Sufficient funds are available in account number 270-0000-791 . 93-80, project number 339514, to fund this amendment . This project is 50% reimbursable from Elgin Community College. EGAL IMPACT None . ALTERNATIVES None. RECOMMENDATION It is recommended that City Council approve Amendment No. 2 with Clark Dietz, Inc. in the amount of $41, 589, leaving a total final fee with CDI of $281, 748, and authorize staff to execute the amendment .
