Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Cone/Kalb/Wonderlick for architectural services under the Facade Improvement Program for the property located at 51 S . Spring Street, a copy of which is attached hereto and made a part hereof by reference. s/ Ed Schock Ed Schock, Mayor Presented: October 25, 2000 Adopted: October 25, 2000 Omnibus Vote : Yeas 6 Nays 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk AGREEMENT This Agreement, made and entered into this /S 7— day of October, 2000, by and between the CITY OF ELGIN, an Illinois municipal corporation (hereinafter referred to as the "City" ) and Cone, Kalb and Wonderlick Architects (hereinafter referred to as "Architect" ) . WITNESSETH WHEREAS, the City has agreed as part of its Facade Improvement Program to assist in improvements to the exterior of the facade of the building at 51 South Grove Avenue, Elgin, Illinois; and WHEREAS, Architect has submitted a proposal for the requested improvements to the exterior facade of the building at 51 South Grove Avenue to include tuckpointing, brick cleaning, painting and the restoration of other architectural features, all as set forth in the Standard Form of Agreement Between Owner and Architect attached hereto as Exhibit 1 . NOW, THEREFORE, for and in consideration of the mutual agreements set forth herein and in the attached Standard Form of Agreement Between Owner and Architect, attached hereto as Exhibit 1, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows : 1 . That the foregoing recitals are incorporated into this agreement in their entirety. 2 . That the Architect is hereby retained by the City of Elgin to perform architectural services consisting of improvements to the exterior facades of the building at 51 South Grove Avenue to include tuckpointing, brick cleaning, painting and the restoration of other architectural features . The terms and scope of work for the architect services shall be as set forth in Exhibit 1 attached hereto . For services provided by the Architect pursuant to this Agreement the City shall pay the Architect the Jump sum of $3, 460, inclusive of all fees and expenses, regardless of actual time expended or actual costs incurred by the Architect . 3 . That Article 7 as set forth in the attached Exhibit 1 entitled "Arbitration" is hereby deleted in its entirety. 4 . That in the event of a conflict between this form agreement and Exhibit 1 attached hereto the terms of this form agreement shall control . 5 . That this agreement constitutes the entire agreement between the parties hereto and may not be amended without the express written agreement executed by the parties hereto .
