Anderson and Associates, Inc., a Delaware corporation (hereinafter referred to as "ENGINEER"), shall modify that Agreement dated July 29, 1999 (hereinafter referred to as "AGREEMENT"), whereby the ENGINEER was engaged by CITY to perform certain professional services in connection with Phase I(preliminary)Engineering of the Wing Street/State Street (Il Rte 31) improvements (hereinafter referred to as "PROJECT"). A copy of Agreement is attached hereto and incorporated by reference as Attachment A. Whereas the CITY has requested Federal Participation with Transportation TEA 21 funding to complete the Phase I Project Report for improvements to the Illinois Route 31 intersection with Wing Street (Section#96-00159-00-CH, Project#M-0336, Job#P91- -99, Funding STU, Existing Str. #N/A) in the City of Elgin, County of Kane, State of Illinois; and Whereas the Illinois Department of Transportation(hereinafter referred to as the"STATE") will be administrating Federal-aid Funds known as Transportation TEA 21 for this project and has requested changes to the AGREEMENT between the City of Elgin and Robert H. Anderson to rincorporate all provisions as stated in the STATE's"Preliminary Engineering Services Agreement for Federal Participation" (BLR 4351 rev. 11/89); and Whereas the CITY and the ENGINEER mutually agree to expand the scope of services to include all of provisions of the"Preliminary Engineering Services Agreement for Federal Participation" and reduce costs to the existing agreement. Now, therefore, in consideration of the mutualpromises and covenants contained herein, the sufficiency of which are hereby acknowledge,the parties hereto hereby agree as follows: In response to these additional services, certain revisions must be made to the Agreement. In compliance, therefore, the terms and conditions of the agreement are modified as specifically set out below. All other parts of the Agreement remain unchanged. 1. Section I Scope of Services, subsection B. is hereby amended to create the following subparagraphs: i. The ENGINEER agrees to perform or be responsible for the performance of the following engineering services for the CITY in connection with the proposed improvement in addition to those already described under Section I, subsection B under the AGREEMENT. The engineering services are as follows: a. Make such detailed surveys as are necessary for the planning and design of roadways and/or bridges and for the preparation of the Phase 1 Project Report. b. Make or cause to be made such soil surveys or subsurface investigations including borings and soil profiles as may be required to furnish sufficient data for • the design of the proposed improvement. Such investigations to be made in accordance with the current requirements of the STATE. c. Analyze and evaluate the soil surveys and structure borings to determine the roadway structural design and bridge foundation. d. Prepare the Phase 1 Project Report and meet with representatives of the LA and STATE at the site of the improvement for review of plans prior to the establishment of final vertical and horizontal alignment location and size of drainage structures and compliance with applicable design requirements and policies. • e. Make or cause to be made such traffic studies and counts and special intersection studies as may be required to furnish sufficient data for the Phase 1 Project Report. f. Prepare the necessary environmental documents in accordance with the guidelines contained in the Federal-Aid Procedures for Local Highway Improvements manual. (Environmental Survey Request Form). ii. To attend conferences to be held at the request of the CITY and visit the site of work at any reasonable time when requested to do so by the CITY or representatives of the STATE. iii. To commence the work within 10 calendar days, and to complete the services provided for herein within 300 calendar days, from the date of the Notice to Proceed, excluding from consideration periods of delay caused by circumstances beyond the control of the ENGINEER. iv. That should the CITY require changes in any of the Bridge Design and Hydraulic Report,ROW, Plats Easements, environmental documents, detailed construction plans, specifications or estimates after they have been approved in writing by the CITY, the • CITY shall pay the ENGINEER, in addition to the Fees set forth in Section IV of the AGREEMENT, hourly rates in amounts equal to the entire value to the ENGINEER for the actual time spent in making such changes but in no case shall the CITY be billed at rates in excess of those listed below nor shall the total compensation for changes under the provisions of this SECTION exceed $5000.00 without renegotiation of the agreement and concurrence of the STATE. Section DI Work Products is hereby amended to add the following paragraphs: i. The CITY agrees to furnish the ENGINEER with all presently available survey data and information including instructions for scales to be used, standard details and Standard Specifications adopted by the STATE and other available data useful to the work to be done by the ENGINEER ii. That all plans, specifications, estimates, plats, and other documents furnished to the CITY by the ENGINEER in accordance with this AGREEMENT shall be endorsed by him and shall show his professional seal where such is required by law. iii. That tracings, plans, specifications, estimates, maps and other documents prepared by the ENGINEER in accordance with this AGREEMENT shall be delivered to and become the property of the CITY and that basic survey notes, sketches, charts, and other data prepared or obtained in accordance with this AGREEMENT shall be made available, upon request, to the CITY, or to the STATE,without restriction of limitation as to their use. • iv. That all reports, plans, plats, estimates, and special provisions to be furnished by the ENGINEER in accordance with Section 1 of this amendment inclusive, of THE ENGINEER AGREES shall be in accordance with the current standard specifications and policies of the STATE, it being understood that all such furnished documents shall be approved by the CITY and the STATE before final acceptance. During the performance of the engineering services herein provided for, the.ENGINEER shall be responsible for any loss or damage to the documents herein enumerated while they are in the ENGINEER's possession and any such loss or damage shall be restored at the ENGINEER's expense. v. That the ENGINEER and his subcontractors will maintain all books, documents, papers, accounting records and other evidence pertaining to cost incurred and to make such materials available at their respective offices at all reasonable times during the AGREEMENT period and for three years from the date of the final payment under this AGREEMENT, for inspection by the STATE, Federal Highway Administration, or any authorized representatives of the Federal Government and copies thereof shall be furnished if requested. 3. Section XVI Delegations and Subcontractors shall hereby be amended to include the following paragraph: That none of the services to be furnished by the ENGINEER shall be sublet, assigned, or transferred to any other party or parties without written consent of the CITY, except as'+ o3f 5ro11!' L prrj& -stated in Sections 1.i.b. and 1.i.c. of this Amendment. The consent to sublet, assign or otherwise transfer any portion of the services to be furnished by the ENGINEER shall not be construed to relieve the ENGINEER of any responsibility for the fulfillment of this AGREEMENT. 4. Section XXVII Notices shall hereby be amended to include the following paragraph: No work shall be commenced by the ENGINEER prior to issuance by the CITY of a written Notice to Proceed. 5. The AGREEMENT shall hereby be amended to include the following documents attached to this amendment: CERTIFICATE OF ENGINEER(1 page) ii STATE OF ILLINOIS DRUG FREE WORKPLACE CERTIFICATION(1 page) iii EXHIBIT A(a revised PHASE I ENGINEERING cost spread sheet) (1 page) . iv SUPPLEMENT TO EXHIBIT A(5 pages) v UPDATE SCOPE OF WORK&IN-HOUSE DIRECT COST(7 pages) vi EXHIBIT 13 (HOURLY RATE RANGE) (2 pages) vii UPDATE SOILS CONSULTANT(2 pages) 6. The AGREEMENT shall hereby be amended to include all provisions of the STATE's standard "Preliminary Engineering Services Agreement for Federal Participation" a copy of which is attached as Attachment B. All other provisions of the AGREEMENT shall remain in full force and effect. Parker, City Manager NEIGHBORHOOD HOOD VITALITY SUBJECT: Amendment to Engineering Services Agreement with R.H. Anderson, Inc. for Illinois Route 31 and Wing Street Intersection Improvements PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the authorization of an amendment to the engineering services agreement for the preliminary engineering of the Wing Street/State Street intersection improvements . BACKGROUND rft. Upon the City' s abandonment of the North End Bridge project, the City set about a program of improving the existing transportation routes used in place of the bridge. These routes include Big Timber Road, State Street, Kimball Street, Dundee Avenue and Summit Street. Besides the Wing Street/State Street intersection the City has also initiated engineering for improvements to the Dundee/Summit and Waverly/Summit intersections . In July of 1999 the City of Elgin entered into an agreement with Robert H. Anderson and Associates for the preliminary engineering of the subject intersection. The City was accepted into the Surface Transportation Program for Federal cost participation at the one half of the total preliminary engineer cost. This Federal program is administrated by the Illinois Department of Transportation (IDOT) and therefore the engineering services agreement between the City and R.H. Anderson required IDOT' s approval. In the near future, the City will apply for Federal participation in final engineering, right-of-way acquisition, construction engineering (inspection) and construction. Except for construction, all Federal participation is at fifty percent. Federal participation in construction is at seventy-five percent . IDOT reviewed the 1999 Agreement with R.H. Anderson and they (eft requested additional provisions be added and a resolution be signed committing City funds to the project . The provisions the State requested required several reviews by both the City and the State until a final draft of the amendment could be completed. The reb- Route 31/Wing Street Improvements June 14, 2000 Page 2 final draft of the amendment is attached for your consideration. The State also required a "joint agreement" , otherwise known as a "Local Agency Agreement for Federal Participation" , which provides the rules and regulations for the Federal Governments financial participation in the engineering. This agreement is being submitted to City Council under separate cover. Both the amendment and the joint agreement must be executed simultaneously. Future agreements will be required for the final and construction engineering as well as the right-of-way acquisition. The provisions that IDOT had requested be added to the 1999 Agreement with R. H. Anderson included the following. The original scope of engineering services was revised to add detailed surveying, a Phase One Project Report (a report that is typical to IDOT projects but not to City projects) , a soils survey and report of sufficient detail to design pavements, several project meetings and conferences with IDOT, detail traffic studies and the preparation of environmental documents to the satisfaction of Federal policy. The amendment also includes provisions for engineering charges if work completed falls outside the scope of rk services, provisions for preliminary engineering products typically associated with final engineering such as estimates, maps, plans and environmental documents, Federal subcontracting rules and specific attachments (for example, a Drug Free Workplace Certification) required by the Federal Government . The Wing Street/State Street intersection improvement project is expected to improve traffic volume capacity via widening (to accommodate left turn bays) and a new signal system. The right- of-way acquisition and final engineering have been programmed in the City' s budget and the Council of Mayors program over the next two years . The programmed funds between the City and the Council of Mayors is $950, 000 shared equally between the City and Federal Government. The construction and the construction engineering have yet to be programmed. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED R.H. Anderson Illinois Department of Transportation 9 '(FINANCIAL IMPACT r The City has committed $74, 056 to this project via the July 29, 1999 engineering services agreement. The attached amendment adheres to the original cost although additional work is required per the IDOT added provisions . The City will pay the consultant, R. H. Anderson, as the consultant completes the preliminary Amendment to Engineering Services Agreement - Wing/State June 14, 2000 Page 3 engineering and request a lump sum reimbursement from the State upon the completion and State' s approval of the preliminary engineering. Account number 275-0000-791 . 93-80, project number 339590 will be charged. There is $205, 000 currently budgeted for the preliminary and final engineering facets of the project . The reimbursement is provided for in the " joint agreement" with the State and not the attached amendment. The City will receive a reimbursement of $37, 000 from the State. LEGAL IMPACT None. ALTERNATIVES A) The City could simply pay 100% of the preliminary engineering. RECOMMENDATION rm. It is recommended that City Council authorize staff to execute the amendment for engineering services agreement with Robert H. For the Wing Street/State Street project the scope of work for the Phase I Project Development Report is outlined as follows: Data Collection: 1. Obtain peak hour turning movement vehicle counts at the intersection. 2 Obtain automatic (road tube) 24-hour vehicle counts on each approach. 3. Make a topographic survey within the right-of-way to obtain information to supplement the planimetric information on the City of Elgin aerial mapping base to locate significant physical features and to obtain cross-section information. 4. Collect background information including "as built" plans, accident data, underground utility maps (sewer, water, storm sewer, gas, electric, telephone and cable TV), land use maps, comprehensive plan and zoning maps, and flood insurance study maps. 5. Obtain pavement cores and soil borings. 6. Obtain IDOT "Condition Rating Survey" information. 7. Prepare an environmental survey request form and submit to IDOT. Traffic and Accident Analysis: 1. Summarize and tabulate traffic count data. 2. Prepare a request for traffic projections by CATS. 3. Prepare a capacity analysis based on existing conditions. 4. Review accident data for high accident locations and wet pavement cluster sites, and define remedial measures. 5. Using CATS projected ADT's, project peak hour volumes and prepare a capacity analysis for projected traffic conditions. a__t 1 Scope of Work 6. Prepare a report on traffic and capacity. 7. Prepare a report on accident history. Alternative Development and Evaluation: 1. Define scope of required improvements and design options. 2. Perform capacity analyses for various alternatives. 3. Estimate construction & right-of-way costs for various alternatives. 4. Choose recommended alternative. Drainage Studies: 1. Obtain information from City staff on existing drainage and flooding problems, if any., 2. Prepare maps showing the drainage areas that contribute flow to the Project and compute the impact of the resulting flows on the Project facilities, including storm sewers, culverts and overland flow routes. 3. Determine the need for drainage improvements in the existing storm sewer system, and the need for storm water detention to be constructed as part of the Project to mitigate flooding problems. Prepare the Location Drainage Study. Preliminary Design: 1. Plot topographic and planimetric information and plot cross sections. 2. Identify design deviations from standard design parameters. 3. Draw the proposed design on the base maps. 4. Prepare existing and proposed typical sections. 5. Identify preliminary Right-Of-Way requirements. Intersection Design Studies: 1. Wing Street and State Street P,:s-2 Scope of Work Preliminary Project Development Report: 1. Include information on the proposed design, as well as the required documentation of alternative development and evaluation, environmental analysis, coordination with review agencies and community involvement. 2. Submit the draft document to the City of Elgin for review. 3. Transmit the draft document to IDOT for review. Coordination: 1. Meet regularly with the City Staff and schedule periodic meetings to keep them advised of the progress of the Project and of the options being studied. 2. Review with and obtain clearance from Cultural Review agencies. 3. Attend an IHPA coordination meeting, if required. 4. Meet with IDOT Local Roads. /FHWA. Community Involvement Program: 1. Conduct public informational meetings to facilitate public approval of the Project and anticipate concerns of area residents. 2. Address improvements in the residential area that are likely to be sensitive issues such as tree removal, parking, sidewalks and safety. 3. Schedule informal meetings with area residents at the beginning of the Phase I work, prior to the public hearing to obtain public input during the report process and to insure that the selected alternatives are responsive to the public concerns. Public Hearing: 1. Anderson & Associates, Inc. 220 West River Drive St. Charles, Illinois 60174 Re: Pavement Investigation Wing Street/Route 31 Improvements Elgin, Illinois Dear Mr. Breunlin: We are submitting for your consideration our proposal to provide the requested pavement investigation and subsurface soil condition analysis for the proposed improvements at the intersection of Wing Street and Route 31 in the City of Elgin, • Illinois. Scooe of the investigation The soil survey will be completed in accordance with IDOT guidelines established for road improvements. Boring locations will be established at the 13 requested locations. Existing pavement materials at the 9 pavement locations will be cored to determine• material types and thicknesses. The soils at all locations will be auger drilled to establish the soil profile within 10.0 feet of existing surface elevations or shallower if refusal is encountered. A soil sample will be obtained immediately below the base or other surface conditions present using a split barrel sampler. Soil samples will be obtained from the auger at 2.0 foot intervals for the remaining depth of the boring. A pocket penetrometer reading will be performed on each sample of cohesive soil. Soil samples will be returned to our laboratory for testing including determination of moisture content. Cohesive soils will be tested for determination of dry unit weight and unconfined compressive strength. Selected soil samples will be tested for determination of grain-size distribution, Atterberg limits, maximum density-optimum moisture relationship, Illinois Bearing Ratio value and other pertinent testing. Enaineerina Evaluation. Report The field investigation and laboratory testing will be completed under the direction of a Registered Professional Engineer.
