RESOLUTION
AUTHORIZING EXECUTION OF AN ENGINEERING CONSTRUCTION SERVICES
AGREEMENT AMENDMENT NO. 1 WITH
WALKER PARKING CONSULTANTS/ENGINEERS, INC . FOR THE
SPRING STREET PARKING DECK REHABILITATION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute an Engineering Construction Services Agreement on
behalf of the City of Elgin with Walker Parking
Consultants/Engineers, Inc . for the Spring Street parking deck
rehabilitation, a copy of which is attached hereto and made a
part hereof by reference .

ENGINEERING CONSTRUCTION SERVICES AGREEMENT
AMENDMENT No. 1
This Agreement Amendment No. 1 entered into this'S71iday of zig, 2000, by and between the
City of Elgin, an Illinois municipal corporation (hereinafter referred to as "City" and Walker
Parking Consultants/Engineers, Inc. (hereinafter referred to as "ENGINEER").
Whereas, the City and Engineer previously entered into an Agreement dated April 2,
1998, for engineering services in connection with the condition assessment and
rehabilitation/safety recommendations for the Spring Street Parking Facility (hereinafter referred
to as the "Agreement"); and
Whereas, the Agreement did not include construction related services and payments
therefore for the Spring Street Parking Deck rehabilitation; and
Whereas, the City desires to expand the scope of service to have the Engineer provide
construction administration, construction observation and quality control of the construction
phase for the Spring Street Parking Deck rehabilitation and to provide payments to the Engineer
for such construction services.
Now, therefore, for and in consideration of the mutual understandings as set forth in the
Agreement, and in consideration of the additional construction phase services to be provided by
the Engineer as set forth in this Amendment No. 1, and other good and valuable consideration,
the receipt and sufficiency or which are hereby acknowledged, the parties hereto agree as
follows:
1. That the Agreement between the City and Engineer dated April 2, 1998, is hereby
amended as follows:
2. SECTION I of the Agreement is hereby modified to add Paragraph C to include
the following construction administration activities.
A. Direct a preconstruction conference at the site to review each work item,
quality control and scheduling of the repair work to be done.
B. Meet with the City of Elgin staff or representatives on a bi-weekly basis.
C. Assist in the preparation of an Owner/Contractor Agreement for signature
as set forth in the construction documents (if requested).
D. Prepare change orders and assist the City in negotiation of a reasonable
price for changes in the project scope of services to be performed by the
Contractor. Also, prepare any clarification drawings and details
considered necessary to impalement the repairs.
E. Review shop drawings and material submittals for conformance with the
construction documents.
F. Review pay requests submitted by the Contractor for work completed to
date of pay request.

G. Provide an experienced part-time project representative on-site
observation of repair work while work is in progress. This can be adjusted
if desired by the City.
H. Furnish progress reports to the City, indicating the status of work
completed.
I. Furnish a final punch list upon completion of the specified work.
J. Assemble all warrantees for the work and materials installed.
K. Visit the project approximately 12 months after final acceptance of the
completed repair work to review performance of warrantee work items
prior to expiration of the warrantee period.
3. SECTION IV of the Agreement is hereby amended by adding an additional
Paragraph C thereto to read as follows:
C. The City shall reimburse the Engineer for construction administrative
services as provided in Section I C of this Agreement in a lump sum of
$12,342.61, regardless of actual costs incurred by the Engineer.
4. All other provisions of the AGREEMENT shall remain in full force and effect.

SUBJECT: Engineering Contract Amendment
Spring Street Deck Parking Facility
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to authorize amending an
agreement for professional services to prepare a Condition
Agreement relating to construction observation services for the
Spring Street Parking Deck Facility Rehabilitation.
BACKGROUND
The City of Elgin awarded a contract to Walker Parking Consultants
of Elgin, Illinois on April 2, 1998 for professional services to
prepare a Condition Assessment and Rehabilitation/Safety
Recommendations of the Spring Street Parking Facility. The
original scope of work for the Spring Street Parking Deck Facility
project was intended to address preservation and safety issues such
as replacing interior lighting, modifying exterior lighting,
repainting the interior ceiling and walls, placing concrete sealer
on all parking decks, and performing other miscellaneous
rehabilitative and maintenance measures . Amendment No. 1 in the
not-to-exceed amount of $12, 400 is for construction observation
services performed during the actual contract activities. The main
intent of these services is to provide a part-time experienced
project representative during construction. Additionally, it is
intended to have the Engineer conduct a preconstruction conference,
prepare construction documents for execution, review shop drawings
and material submittals, process payment requests and conduct a
one-year project inspection to verify that all warranty conditions
are met. A copy of Amendment No. 1 is attached as Exhibit A.

The project was completed in the fall of 1999 and these services
were provided as specified. In order to proceed with payment, an
amendment to the agreement with Walker is necessary.

A total of $299, 200 was budgeted for this phase of project number
079502, Spring Street Parking Deck Improvement. The 1999 budget
provided $210, 000 in account number 270-0000-791. 93-80. The
additional $89, 200 utilizes remaining available funds originally
budgeted in 1998 for project number 079502, $55, 300 in account
number 270-0000-791. 93-80 and $33, 900 in account number 275-0000-
791. 92-52. Sufficient funds are available for payment of Amendment
No. 1.

None.
RECOMMENDATION
It is recommended that the City Council approve Contract Amendment
No. 1 with Walker Parking Consultants for a not-to-exceed amount of
$12, 400 for additional professional construction observation
services relating to the Spring Street Parking Facility
Rehabilitation. Further, it is recommended that the City Council
authorize staff to execute the amendment.
