RESOLUTION
AUTHORIZING EXECUTION OF A FIRST AMENDMENT TO
ARCHITECTURAL SERVICES AGREEMENT WITH GREG BERNA
(19 S . Spring Street)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute a First Amendment to Architectural Services
Agreement on behalf of the City of Elgin with Greg Berna for
architectural services under the Facade Improvement Program
for the property located at 19 S . Spring Street, a copy of
which is attached hereto and made a part hereof by reference.

FIRST AMENDMENT TO ARCHITECTURAL SERVICES AGREEMENT
This Agreement made and entered into this 4JX day
of November, 1999 , by and between the City of Elgin, an
Illinois municipal corporation (hereinafter referred to as the
"City" ) and Greg Berna, (hereinafter referred to as
"Architect" ) .
WITNESSETH
WHEREAS, the City and Architect entered into an
agreement dated November 6 , 1998 wherein Architect was to
provide certain architectural services for improvements to the
exterior of the facade of the building at 19 S . Spring Street,
Elgin, Illinois (hereinafter referred to as the "Subject
Agreement" ) ; and
WHEREAS, the compensation to be paid for the
architectural services in the Subject Agreement was an amount
not to exceed $4 , 275; and
WHEREAS, the time and monies allocated for the
architectural services under the Subject Agreement were to be
focused on the west facade on the building at 19 S . Spring
Street ; and
WHEREAS, during the course of the design development
process for the west facade the owner of the property became
interested in developing design alternatives for the east
facade of the property as well and the City and the Architect
desire to amend subject agreement to provide for additional
architectural services relating to the east facade and to
provide additional compensation to the Architect for such
services .
NOW, THEREFORE, for and in consideration of the
mutual agreements set forth herein, and the mutual agreements
set forth in the original subject agreement, and for other
good and valuable consideration, the receipt and sufficiency
of which is hereby acknowledged, the parties hereto agree as
follows :
1 . That the Subject Agreement between the City and
the Architect is hereby amended to expand the terms and scope
of work for the architectural services to include design
services for the east facade of the building at 19 S . Spring
Street to include door and window replacement, tuckpointing,
brick cleaning and exterior lighting. Compensation for the
Architect ' s services originally in the amount of $4 , 275 shall
be increased by an additional $4 , 275 to a total amount not to
exceed $8 , 550 .
2 . That except as amended herein the original
Subject Agreement between the City and the Architect dated
November 6, 1998 shall remain in full force and effect .
IN WITNESS WHEREOF, the parties have executed and
entered into this agreement on the date and year first written
above .

SUBJECT: Amendment to the Architectural Services Agreement for
a Facade Improvement Project at 19 South Spring Street
PURPOSE
The purpose of this memorandum is to present to the Mayor and
members of the City Council an amendment to the Architectural
Services Agreement with Greg Berna Architects for the facade
improvement project at 19 South Spring Street .
BACKGROUND
On November 6 , 1998, Greg Berna Architects and the City of Elgin
entered into a Professional Services Agreement for architectural
services under the Facade Improvement Program for property located
at 19 South Spring Street . The authorized expenditures for
architectural services was $4, 275 . Time allocated for professional
services was focused on the west facade . During the design
development process for the west facade, Mr. Jones became
interested in developing design alternatives for the east facade of
the building as well. Mr. Berna did develop design options for the
east (rear) facade of the building. In order to compensate for the
additional services, the current agreement should be amended. The
additional changes for Mr. Berna' s work for the east facade are
$4, 275 .

I?rANCIAL IMPACT
The additional fixed fee for providing the architectural services
associated with the east facade project at 19 South Spring Street
is $4, 275 . There are no available funds remaining in the Downtown
Redevelopment Fund. It is proposed that unencumbered dollars
within the Riverboat fund be utilized to fund this project and be
replenished from the Downtown Redevelopment Fund after approval of
the 2000 budget . A budget transfer will be required. Account
number 350-0000-795 .78-99, project number 179543 , will be charged.

A contract amendment will need to be prepared.
ALTERNATIVES
1 . Approve the proposal by Berna Architects to provide additional
architectural services for a facade improvement project at 19
South Spring Street .
2 . Reject the proposal by Berna Architects to provide
architectural services for a facade improvement project at 19
South Spring Street .
RECOMMENDATION
It is recommended that the proposal by Berna Architects for
additional architectural services, at a fixed rate fee of $4 , 275,
be approved.
