RESOLUTION
AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT
WITH KANE COUNTY
(Randall Road at Holmes Road)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City
Clerk, be and are hereby authorized and directed to execute an
intergovernmental agreement on behalf of the City of Elgin
with Kane County for access and improvements to Randall Road
at Holmes Road, a copy of which is attached hereto and made a
part hereof by reference .
BE IT FUTHER RESOLVED that Resolution No. 99-231 adopted
August 25 , 1999 authorizing an earlier version of this
intergovernmental agreement be and is hereby repealed.

INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF ELGIN AND THE
COUNTY OF KANE REGARDING ACCESS AND IMPROVEMENTS
TO RANDALL ROAD AT HOLMES ROAD
This Agreement entered into this /� day of h r , 1999,
by and between the COUNTY OF KANE (hereinafter referred to as the
"County" ) , a body corporate and politic of the State of Illinois,
and the CITY OF ELGIN (hereinafter the "City" ) , a municipal
corporation of the State of Illinois .
WITNESSETH
WHEREAS, the Illinois Constitution of 1970 Article VII, Section
10 and 5 ILCS 220/1 et seq. authorizes the County and the City to
cooperate in the performance of their respective duties and
responsibilities by contracts and other agreements; and,
WHEREAS, it is deemed necessary and appropriate to allow access
to Randall Road at Holmes Road and to thereafter provide for
certain intersections improvements (hereinafter the
"Improvements" ) ; and,
WHEREAS, it is deemed necessary in order to facilitate and assure
the proper flow of traffic and to ensure safety to the motoring
public to improve Randall Road at Holmes Road; and,
WHEREAS, the City and the County are desirous of making said
improvement in that the same will be of immediate benefit to
their residents and permanent in nature .
NOW, THEREFORE, in consideration of the mutual covenants
contained herein, the receipt and sufficiency of which are hereby
acknowledged, the parties hereto agree as follows :
1 . The County hereby agrees to allow a full intersection access
to Randall Road at Holmes Road and upon proper application
therefor, to issue all necessary permits and other approvals
authorizing the full intersection access to Randall Road at
Holmes Road subject to all relevant County access and
permitting reg1irements .

2 . At such time as the County determines that the channelizing,
signalizing, interconnection, and lighting of the Randall
Road and Holmes Road intersection is required to assure the
proper flow of traffic and insure safety to the motoring
public the City agrees to let or cause to be let the
contract for such improvements and to have said improvements
constructed under the City and County supervision in
accordance with plans approved by the County. All plans for
the design and construction of such improvements shall be
subject to the review and approval of the County. Such
plans and improvements shall include provisions for the
signal timing and interconnects with the intersection of Big
Timber and Randall Road and the intersection of Fox Lane and
Randall Road. The City shall cause to be paid or pay the
cost of any channelizing, signalizing, lighting and related
improvements at Randall Road and Holmes Road.
3 . The County shall own, operate and pay the cost to maintain
any traffic signals at Randall Road and Holmes Road and
related signal interconnect improvements .
4 . The City shall pay the cost to energize any traffic signals
at Randall Road and Holmes Road.
5 . The City agrees to cause to be paid or pay for the
installation of the Randall Road intersection approach
lighting when traffic signals are warranted at Randall Road
and Holmes Road.
6 . The County shall own and operate the Randall Road
intersection and approach lighting at Randall Road and
Holmes Road.
7 . The City shall pay the cost to maintain the Randall Road
intersection and approach lighting at Randall Road and
Holmes Road. Maintenance shall include, but is not limited
to, the lamps, brackets, poles, cable and special equipment
upon installation of the permanent signalization and approach
lighting. The City shall reimburse the County within forty-
five (45) days of the receipt of an invoice for all costs
incurred by the County in relation to the maintenance of the
lighting.

8 . The City shall pay the energy costs for the Randall Road
intersection and approach lighting at Randall Road and
Holmes Road.
9 . To the extent that they may lawfully do so, the City and the
County shall cause to be conveyed to the County additional
right-of-way within the municipal limits along Randall Road
between Big Timber and Fox Lane so as to make the Randall
Road right-of-way width generally one hundred and fifty
(150) feet . The City and County shall acquire such right-of-
way to the extent to which they may lawfully do so and at no
expense to the City and County. The County shall specify
the amount and location of property.
10 . To the extent that they may lawfully do so, the City and
County shall cause to be conveyed to the County, additional
triangular right-of-way areas (generally 25 feet x 25 feet)
at each intersection to Randall Road between Big Timber Road
and Fox Lane within the City' s municipal limits for
intersection radius and signal equipment areas . The City
and County shall acquire such right-of-way to the extent to
which it may lawfully do so and at no expense to the City
and the County. The amount and location of property shall be
as specified by the County.
11 . The City agrees to locate any municipal utilities relating
to the improvements along Randall Road in consultation with
the County to avoid potential roadway/utility conflicts in
future widening projects .
12 . The City agrees to provide or cause to be provided any
additional stormwater detention required by the subject
improvements and, to the extent they may lawfully do so,
shall require at no expense to the City or County the
property owner (s) /developer (s) of adjacent properties to
Randall Road between Fox Lane and Big Timber Road to provide
for stormwater detention for auxiliary lane and capacity
improvements to Randall Road projected in Kane County' s 2020
Transportation Plan.
13 . All of the proposed improvements to Randall Road and Holmes
Road intersection shall be subject to the review and
approval of the County.

14 . This agreement shall be binding upon and shall inure to the
benefit of the parties hereto and their respective
successors and assigns .
15 . No oral modification, amendment or change shall be allowed
to this agreement . Any modification, amendment or change
hereto shall be in writing and signed by the County and the
City.

THE COUNTY OF KANE AND THE CITY OF ELGIN
FOR ACCESS AND IMPROVEMENTS TO RANDALL ROAD AT HOLMES ROAD
WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et
seq. authorizes the County and the City of Elgin to cooperate in the performance of their
respective duties and responsibilities by contract and other agreements; and,
WHEREAS, it is deemed necessary and appropriate to allow access to Randall Road at

WHEREAS, it will be necessary to enter into a joint agreement embodying such provisions
between the City of Elgin and the County of Kane; and,
WHEREAS,an intergovernmental agreement with the City of Elgin to designate access and
improvements to Randall Road at Holmes Road is deemed by the County and the City of Elgin
to be of immediate benefit to the residents of the County of Kane in that it shall facilitate the safe
and efficient movement of traffic and shall provide for the safety of the motoring public.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman
thereof is hereby authorized to execute the intergovernmental agreement (a copy of which is on
file with the County Clerk's Office) with the City of Elgin to designate access and improvements
to Randall Road at Holmes Road.

SUBJECT: Proposed Intergovernmental Agreements
with Kane County - Randall/Holmes Road
Intersection
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider the proposed
intergovernmental agreement with Kane County with respect to the
Randall Road and Holmes Road intersection.
BACKGROUND
The execution of the intergovernmental agreement (attached as
Exhibit A) will permit the City to construct the new intersection
of Randall Road and Holmes Road. The success of developments north
of Big Timber and west of Randall Road are dependent on the
construction of this intersection. In actuality, a developer has
agreed to construct the intersection pavement improvements with the
understanding that he will be reimbursed next year. The City will
install permanent signals, approach lighting and interconnect
between Big Timber Road and Fox Lane at a later date when the
intersection warrants the signals .
If the developer does not proceed with the construction of the
intersection as proposed, the City is under no obligation to
complete the intersection at any given time. However, the City may
wish to complete the intersection as soon as possible so as to
encourage development in this area.

FINANCIAL IMPACT
OnThe ultimate intersection improvement costs identified with the
intergovernmental agreement for Holmes Road are estimated at
$500, 000 and will include pavement widening, signals, interconnects
and approach lighting. Once the intersection is fully improved, the
City will be required to pay the energy costs for the approach
lighting. These costs are estimated at $600/year. Staff does not
expect the purchase of right-of-way to be necessary.

The City will reimburse a portion of the ultimate cost ($500, 000)
to the developer in 2000 . The developer' s cost is anticipated to be
$125, 000 . Sufficient funds are available in the Capital Drive
construction project account .

Attached is a new and final draft of the Holmes Road/Randall Road Intergovernmental
Agreement. You may recall that this agreement was approved at the August 25, 1999 Council
meeting. The approved agreement was signed by the Mayor and returned to the County. Once
the County received the signed agreement they indicated that I had neglected to revise two
portions of the agreement that they felt strongly about. The two changes to the signed agreement
are as follows:
ADDED: "....subject to all relevant County access and permitting requirements."to the
end of paragraph 1.
ADDED "...and, to the extent to they may lawfully do so, shall require at no expense to
the City or County the property owner(s)/developer(s) of adjacent properties
to Randall Road between Fox Lane and Big Timber Road to provide for
stormwater detention for auxiliary lane and capacity improvements to
Randall Road projected in Kane County's 2020 Transportation Plan."to the
end of paragraph 12.
I have discussed this issue with Bill Cogley and the changes are not significant but he felt it best to
have the new agreements placed on the consent agenda. Please consider placing on the next
