RESOLUTION
AUTHORIZING EXECUTION OF AN AGREEMENT WITH
ENVIRONMENTAL MONITORING AND TECHNOLOGIES, INC. FOR
COMPOST TESTING SERVICES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute an agreement on behalf of the City of Elgin with
Environmental Monitoring and Technologies, Inc . for composting
testing services for the period August 1, 1999 through
July 31, 2000, a copy of which is attached hereto and made a
part hereof by reference .

SUBJECT: Leaf Compost Testing Services
PURPOSE
This memorandum will provide the Mayor and members of the City
Council with information to consider an agreement with
Environmental Monitoring and Technologies, Inc . (EMT) for leaf
compost testing at the City' s compost facility.
BACKGROUND
The City of Elgin was granted a supplemental permit for our compost
facility on February 15, 1996 . This permit allows the City to
em. operate a landscape waste composting facility for leaves .
This permit was granted with several modifications to our previous
permit . Those modifications require much more detailed
documentation which includes weekly testing for oxygen, temperature
and moisture content on our windrowed leaves . Also, an End-Product
Test of composted leaves is required before they can be removed
from the site for use.
All of the tests require either field or laboratory testing and all
necessary supporting documentation for the yearly IEPA Report .
Public Works is not capable of performing these tests in-house
because it does not have the necessary equipment or the expertise
to perform them. EMT has provided these testing services at the
site for the last three years, but their contract expires in
August, 1999 .
Public Works solicited quotes from three firms to provide all
necessary testing per the City' s IEPA permit . Of those vendors,
Environmental Monitoring & Technologies was the only firm to
provide a responsive bid. The remaining firms were either
unresponsive to the bid or did not meet the required
specifications .

FINANCIAL IMPACT
• The total cost of the contract is $8, 195 . 00 and would be effective
for one year beginning August 1999 . Sufficient funds are budgeted
in account number 010-3331-754 . 30-71, Composting-Professional
Services/Environmental to cover the cost of this testing service .

A contract will need to be prepared.
ALTERNATIVES
The testing that is required by the IEPA as part of the City' s
compost facility permit must be performed.
RECOMMENDATION
It is recommended that the City Council approve the proposal from
Environmental Monitoring and Technologies, Inc . in the amount of
$8, 195 . 00 for testing services at the Compost Facility.

AGREEMENT
THIS AGREEMENT made and entered into this tc2 day of
September, 1999, by and between the CITY OF ELGIN, an Illinois
municipal corporation (hereinafter referred to as the "City" )
and ENVIRONMENTAL MONITORING AND TECHNOLOGIES, INC . , an
Illinois corporation (hereinafter referred to as "EMT" ) .
WHEREAS, the City desires to engage EMT to conduct
compost testing services for the period of August 1 , 1999
through July 31, 2000 .
NOW, THEREFORE, for and in consideration of the
mutual undertakings as contained herein, and other good and
valuable consideration, the receipt and sufficiency of which
is hereby acknowledged, the parties hereto agree as follows :
1 . That EMT shall provide all materials, labor,
equipment and all work incidental thereto for the compost
testing services for the City of Elgin in accordance with the
July 14 , 1999 City of Elgin Department of Public Works Request
for Proposals attached hereto as Exhibit 1 and the EMT
correspondence of July 20 , 1999 attached hereto as Exhibits 2
and 3 . All work performed by EMT shall be in compliance with
the requirements of the Illinois Environmental Protection Act
and other applicable legal requirements .
2 . That for and in consideration of such services
to be provided by EMT the City shall pay to EMT the total
amount not to exceed $8, 195 . Payment may be made in
installments for the percentage of work completed by EMT upon
invoice from EMT for same .
3 . That EMT does and shall indemnify and hold
harmless the City, its officers, agents and employees, against
liability, losses and damage of whatever nature, including
workman' s compensation claims, and including legal expenses,
in any way resulting from or arising out of negligent actions
or omissions of EMT in connection herewith, including
negligent acts or omissions of employees or agents of EMT
arising out of the performance of the services to be provided
hereunder.
4 . That the term of this agreement shall be from
August 1, 1999 through July 31, 2000 .
5 . That this agreement and each and every portion
thereof shall be binding upon the successors and the assigns
of the parties hereto, provided, however, that no assignment
of this agreement shall be made without the prior written
consent of the City.
6 . That this agreement shall not be deemed or
construed to create an employment, joint venture, partnership,
or other agency relationship between the parties hereto.
7 . That this agreement and its attachments
constitutes the entire agreement of the parties on the subject
matter hereof and may not be changed, modified, discharged or
extended except by written amendment duly executed by the
parties . Each party agrees that no representations or
warranties shall be binding upon the other party unless
expressed in writing herein or in a duly executed amendment
hereof . In the event of any conflict between the terms of
this form agreement and the attachments hereto the terms of
this form agreement shall control .
8 . That this agreement shall be deemed to have been
made in, and shall be construed in accordance with the laws of
the State of Illinois .
9 . That EMT shall not discriminate against any
employee or applicant from employment because of race, color,
religion, sex, ancestry, national origin, place of birth or
physical handicap which would not interfere with the efficient
performance of the job in question. EMT will take affirmative
action to comply with the provisions of Elgin Municipal Code,
Section 3 . 12 . 100 , as amended, and will require any
subcontractor to submit to the City a written commitment to
comply with those provisions . EMT will distribute copies of
this commitment to all persons who participate in recruiting,
screening, or selection of job applicants and prospective
subcontractors . EMT shall complete and return the
certification forms attached hereto and made a part hereof by
this reference as Exhibit 4 .
IN WITNESS WHEREOF, the parties hereto have entered
into and executed this agreement on the date and year first
written above .

REQUEST FOR PROPOSALS
Compost Testing Services
August 1, 1999 -July 31, 2000

INTRODUCTION _
The City of Elgin is seeking proposals from qualified testing firms to complete compost testing as
required by our compost facility permit with the State of Illinois Environmental Protection Agency.
SCOPE OF SERVICES
I. Pu rpose
The following is a description of the work to be included in this proposal. Proposals submitted shall
include all services necessary to complete the testing requirements as outlined herein.
II. Services Required
All testing shall be performed in accordance with Section 39(a) of the Illinois Environmental
Protection Act as follows:
A. Testing for oxygen level within each windrow to promote aerobic composting. The oxygen
level of each windrow of compost material shall be monitored on a weekly basis using an
oxygen probe (field measurement).
B. Testing the moisture levels of the compost material. The moisture level of each windrow shall
be monitored once every two weeks using EPA 160.3 (laboratory method).
C. Testing the temperature of each windrow of compost shall be monitored on a weekly basis
using a temperature probe (field measurement).
D. All testing and records required for compost material that has reached the end-product state
as verified by the required testing. (See Attachment A) General-Use Compost must meet the
following criteria:
1. Must be free of any materials which pose a definite hazard to human health due to
physical characteristics, such as glass or metal shards;
2. Must not contain man-made materials larger than four millimeters in size exceeding
one percent of the end-product compost, on a dry weight basis;
3. Must have a pH between 6.5 and 8.5;
4. Must have reached stability, as demonstrated by one of the methods prescribed in 35
Ill. Adm. Code 830 Appendix B;
5. Must not exceed, on a dry weight basis, the inorganic concentrations set forth in 35
Ill. Adm. Code 830 Table A;
6. Must not contain fecal coliform populations that exceed 1000 MPN per gram of total
solids (dry weight basis), or Salmonella species populations that exceed 3 MPN per
four grams of total solids (dry weight basis).
III. Reporting& Record Keeping Requirements
Lab reports shall be submitted to the City of Elgin Solid Waste Coordinator, or his/her designee, upon
completion. In addition to the analysis outlined above, the following information shall be included
in each report:
• Location where sample was obtained (i.e., windrow#1)
• Number of samples taken
• Volume of samples taken
• Date and time of samples taken
• Name and signature of individual taking sample
• Name and address of laboratory receiving samples
• Signature of person responsible for sample analysis
AWARD
It is the intent of the City of Elgin to award this service based on experience, cost and ability to
perform the required services.
Written proposals must be received no later than 4:00 p.m. on July 21, 1999. Proposals may

Testing Frequency
The City will conduct sampling of end-product compost when the compost becomes dark-brown
and soil-like in appearance and periodic monitoring for temperature, oxygen, and moisture level
indicate that the composting process is complete. Based on the average expected volume of end-
product compost at the facility (approximately 12,000 cubic yards), the City is anticipating three
sampling events based on the requirement to sample once every 5,000 cubic yards of end-product
compost transported off site. Due to the nature of the operations of the Elgin Composting Facility,
the quantity of compost collected during one,fall is typically ready for off-site use the following
August; therefore, sampling for all compost may occur during the same sampling event.
Sampling Methods
Sample collection, preservation, and analysis will be completed by trained City employees or
laboratory personnel, as applicable for the sampling being conducted. The sampling technician will
obtain 12 discrete samples from the end-product compost at the facility. The location, volume, and
quantity of samples obtained will be determined based on the following criteria:
• Twelve grab samples, each 550 milliliters in size, must be taken from the end-
product compost at the facility in the following manner:
1) Four grab samples from points both equidistant throughout the length and at
the center of the windrow or other pile, at a depth not less than 1 meter from
the surface of the windrow or other pile.
2) Four grab samples from points both equidistant throughout the length and
one-queer the width of windrow or other pile, at a depth not less than half
the distance between the surface and the bottom of the windrow or other
pile.

3) Four grab samples from points both equidistant throughout the length and
one-eighth the width of the windrow or other pile, at a depth not less than
half the distance between the surface and the bottom of the windrow or other
pile.
4) The 12 grab samples must be mixed thoroughly to form a homogeneous
composite sample. Analyses must be of a representative subsample. The
parameters for analyses, sample holding times, sample container types, and
minimum collection volumes are listed in Table A-1.
Sampling methods may be adjusted based on the configuration of compost material at the time of
sampling (i.e., windrows, stockpiles, etc.). The analytical procedures are presented in Table A-2.

A) MAN-MADE MATERIALS
1) Take four 250 gram samples.
2) Dry samples at 70°C for 24 hours. Let sample cool to room temperature (20 to 25 °C).
3) Weigh each sample and pass through a four millimeter screen. Inspect material remaining on
the screen, and separate and weigh man-made materials. Calculate percent man-made materials
relative to the total dry weight of the sample prior to screening.
B) gll
The following protocol must be used to determine the pH of the compost: North Central Regional
Publication 221, Method 14; or EPA Method 9045 in Test Methods for Evaluating Solid Waste,
Physical/Chemical Methods (SW-846).
C) METALS
The end-product compost must not exceed the metal concentrations listed in Table A-3. The test
methods for metal analyses are also listed in Table A-3. -

D) STABILITY
The operator shall demonstrate that the composite sample has reached stability by showing either:
1) Self-Heating Test : That the compost does not reheat, upon standing, to greater than 200°C
above room temperature (20 to 25°C). The degree of reheating must be measured using the
following method:
A) Take 4 liters of composite sample and adjust the moisture of the end-product compost so it falls
within the range of 45 to 55%water on a dry weight basis;
B) Fill a 2 liter Dewar flask (100 millimeters, inside diameter) loosely with sample within the
acceptable moisture range and gently tap to simulate natural settling. Keep at room temperature (20
to 25°C).
C) Insert thermometer into Dewar flask to a point 5 centimeters from bottom of flask. Do not push
thermometer against bottom of flask.
D) Record time and temperature each day for 15 days to determine when the highest point is
reached. After each reading, shake down the thermometer, or
2) Seed Germination Test: That the end-product compost supports a germination rate of 70% for
annual ryegrass and radish using the following protocol;
A) Mix 4 liters vermiculite with 4 grams of air-dried soil.
B) Take 1 liter of the composite sample with a moisture level within the range of 45 to 55 percent,
on a dry weight basis; if necessary, adjust the moisture level until within such range.
C) In three 2-liter containers, combine the vermiculite-soil mix with the compost sample at the
following ratios:

D) Break up lumps of compost with a spatula or trowel. Moisten the blend with water.
E) Cover each container with plastic wrap and mix well by inverting each container 20 times.
F) Transfer each blend into four 4-inch pots. Fill the pots to the brim and firm the surface by
pressing down with the bottom of another 4-inch pot. Leave about 2 to 5 centimeters of space
between surface of the blend and the top of the pot.
G) Add approximately 50 milliliters of water soluble fertilizer (e.g., 20-20-20 NPK, fish emulsion)
diluted to half-strength to each pot.
H) Place 10 seeds of annual ryegrass and 10 radish seeds onto the surface of the moistened blend.
Cover the seeds with about 1 centimeter dry vermiculite.
I) Set the pots in a tray of warm water and let them remain there until capillary action has drawn
water up and moistened the surface of the blend. Remove the pots from the tray when moisture
from the bottom-watering is observed.
J) Put pots in an environment suitable for plant growth (e.g., 8 to 12 hours of light daily, 30 to
60% humidity, 20 to 25°C). Check pots daily to determine if watering is needed. Blends should be

kept evenly moist. If necessary, cover each pot with plastic wrap until the seedlings emerge.
Remove plastic wrap at the first sign of emergence.
K) Seven days after planting the seeds, count emergent seedlings in each pot and record visual
observations of relative plant conditions identified in Table A-4.
L) Calculate the percent germination of plants in each blend relative to the control pot, using the
formula set forth in Table A-4.

Written Commitment Guideline
The written commitment required in Item #4 of the Bidder's Employee Utilization Form shall:
1. Set out the name and phone number of the bidder's Equal Employment Officer.
2. Clearly identify the bidder's recruitment area and the percentage of minorities and
females in the area's population and labor force.
3. Set out what the bidder has done and has set as a goal to ensure the recruitment of
minority and female employees.
4. Set out the bidder's specific goals to recruit minorities and females for training programs
or other similar opportunities available through the bidder's organization.
5. Indicate bidder's consent to submit to the City of Elgin, upon request, statistical data
concerning its employee composition and recruitment efforts anytime during the term of
the contract.
6. Show bidder's consent to distribute copies of the written commitment to all persons who
participate in recruitment, screening, referral, and selection and hiring of job applicants
for the bidder.
7. Clearly show that the bidder shall require all subcontractors, if any, to submit a written

Effective July 1, 1993, every party to any contract with the City of Elgin and every eligible bidder is
required to have written sexual harassment policies that include, at a minimum, the following
information:
(1) the illegality of sexual harassment
(ii) the definition of sexual harassment under state law
(iii) a description of sexual harassment, utilizing examples
(iv) the vendor's internal complaint process including penalties
(v) the legal recourse, investigative and complaint process available through the
Illinois Department of Human Rights, and the Illinois Human Rights
Commission
(vi) directions on how to contact the depaiLntent and commission
(vii) protection against retaliation as provided by Section 6-101 of the Human Rights
Act
