WITNESSETH WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et seq. authorizes the County and the City to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and, WHEREAS, it is deemed necessary and appropriate to provide for the channelization and signalization, of the intersection of Kane County Highway No. 34, also commonly known as Randall Road, and College Green Drive, a street under the jurisdiction of the City, hereinafter referred to as the "improvements") ; and, WHEREAS, the County and the City desire to make the improvements as contemplated in that it will be of immediate benefit to the citizens of the County of Kane in that it shall facilitate the safe and efficient movement of traffic and shall provide for the safety of the motoring public and shall be permanent in nature; and, WHEREAS, the permanent installation of the channelization and traffic control signals, along with any other appurtenance deemed necessary by the County including but not limited to, the installation of signal actuators, approach lighting, signal interconnects, etc. , is anticipated to be installed by the City in conjunction with the Spartan Drive extension programmed for Fiscal Year 2000; and, WHEREAS, the permanent installation of the traffic control signals, along with any other appurtenance deemed necessary by the County including but not limited to, the installation of signal actuators, approach lighting, signal interconnects, etc. , shall be installed by the City no later than fiscal year 2002; and, • r WHEREAS, the County and the City have determined a mutually satisfactory distribution of all costs and responsibilities for said improvement to Randall Road as set forth in this Agreement. NOW, THEREFORE, in consideration of the above preambles and the mutual promises and covenants as contained herein both the County and the City agree as follows: 1 . The County shall, prior to construction, approve all plans for the design and construction of the improvements . In no event shall bids be let or construction commenced for the improvements until the County has given its written approval therefor. 2 . The City agrees to let the contract for the improvement and to have said improvement constructed under its supervision and contract in accordance with plans approved by the County and the Illinois Department of Transportation. 3. The City agrees to pay or cause to be paid one hundred percent (100%) of the actual cost of the design and construction of the improvements . 4 . The City agrees that the County shall own, operate, and maintain the electronic traffic control signals that are part of the improvements. 5 . The County agrees to pay one hundred percent (100%) of the cost of the maintenance of the traffic control signals . 6. The City agrees to pay one hundred percent (100%) of the cost of the maintenance of the approach lighting improvements including, but not limited to, the lamps, brackets, poles, cable and special equipment upon installation of the permanent signalization and approach lighting. The City shall reimburse the County within forty five (45) days of the receipt of an invoice for all costs incurred by the County in relation to the maintenance of the approach lighting. 7 . The City agrees to pay one hundred percent (100%) of the cost of electrical energy for the permanent traffic signals and approach lighting that are a part of the improvement and to have the supplier of the electrical energy bill said costs directly to the City. 8 . In order to facilitate the free flow of traffic through the intersection of Randall Road and College Green Drive, the City agrees to interconnect the permanent traffic control signals at College Green Drive to the Randall Road signals at South Street and Bowes Road. 9. The City has passed or will pass resolutions appropriating sufficient funds to pay the costs of the improvements and will in the future pass any supplemental resolution to provide any additional funding in the event amounts previously appropriated are insufficient . 10 . The County and the City agree to exercise their franchise rights to cause public or private utilities to be relocated when necessary from their respective right-of- ways or jurisdictions . 11 . The City acknowledges that the County shall control the sequence and timing of the traffic signals . 12 . The City agrees to provide any additional stormwater detention required by the improvement. 13 . The City shall acquire and convey or cause to be conveyed to the County any additional right-of-way needed along Randall Road as a result of the improvement. 14 . The County shall, upon completion of the improvements, retain jurisdiction of all portions of Randall Road at College Green Drive and all additional right-of-way acquired therefor. 15 . The City agrees to locate any municipal utilities along Randall Road for the improvement only upon prior consultation with the County to avoid potential roadway/utility conflicts in future projects . 16. This Agreement shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and assigns . 17 . In the event a dispute arises regarding the terms of this Agreement the copy in the possession of the County shall control . 18 . No oral modification, amendment or change shall be allowed to this Agreement . Any modification, amendment or change hereto shall be in writing and signed by the County and the City. 19. In the event that any provision of this Agreement shall be found by a court of competent jurisdiction to be void or unenforceable, such finding shall not invalidate the remaining provisions hereof. RESOLUTION NO 99-22 4 APPROVING INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF KANE AND THE CITY OF ELGIN (Randall Road and College Green Drive) WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et seq. authorizes the County and the City of Elgin to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and, WHEREAS,the County and the City of Elgin desire to undertake a project to improve Kane County Highway No. 34, also known as Randall Road (hereinafter "Randall Road"), at the intersection of College Green Drive; and, WHEREAS, the County and City of Elgin desire to install turn lanes, signals and related improvements at the intersection of Randall Road and College Green Drive; and, WHEREAS, the County and the City of Elgin desire to cooperate among themselves to accomplish the improvement at the Randall Road and College Green Drive intersection; and, WHEREAS, the improvement is deemed by the County and the City of Elgin to be of immediate benefit to the residents of the County of Kane in that it shall facilitate the safe and efficient movement of traffic and shall provide for the safety of the motoring public; and, WHEREAS, on October 14, 1997 and February 10, 1998, the Kane County Board authorized the County Board Chairman to execute an intergovernmental agreement associated with the installation of signals at the Randall Road and College Green Drive intersection; and, WHEREAS,thereafter,the County and the City of Elgin did not reach agreement on certain elements of the agreement and the City of Elgin refused to execute the agreement; and, WHEREAS,the County and the City of Elgin have now determined a mutually satisfactory allocation of all responsibilities, obligations and costs for said improvement as set forth in the amended intergovernmental agreement(a copy of which is on file with the County Clerk's Office). NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof is hereby authorized to execute an intergovernmental agreement associated with the installation of signals and turn lanes at the Randall Road and College Green Drive intersection. Parker, City Manager SUBJECT: Proposed Intergovernmental Agreements with Kane County - Randall Road Access and Randall/College Green Intersection PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the proposed intergovernmental agreements with Kane County with respect to Randall Road access and the College Green intersec- tion. BACKGROUND In 1991, the City and the County entered into an intergovernmental agreement to set the locations of various access points along Randall Road. Upon the review of the Meijer development, the County suggested an amendment (includ- ed as Exhibit A) to permit two more access points to the Meijer property. Due to the proposed Spartan Drive construc- tion, the access to the Meijer property is limited to two points of full access, one on College Green Drive and another on Bowes Road. City and County staff felt that the limited access could be offset by allowing a second right-in/right- out access onto Randall Road. This second right-in/right-out access is unique in the fact that the right-in will be sepa- rated from the right-out . The second intergovernmental agreement (attached as Exhibit B) will permit the City to construct the intersection of Randall Road and College Green in conjunction with the Spar- tan Drive construction. The success of the Spartan Drive and Meijer projects are dependent on the construction of this intersection. The City will widen Randall Road to allow for dual left-turn lanes and a right-turn lane for the west leg of the intersection. The City will also construct permanent signals, approach lighting and interconnect between Bowes Road and South Street . Proposed Intergovernmenal Agreements w/Kane County June 11, 1999 Page 2 rak FINANCIAL IMPACT The financial impact associated with amending the existing N- intergovernmental agreement for the additional access points (right-in/right-out) will be borne by the developer. Intersection improvement costs identified with the intergovernmental agreement for College Green are estimated at $500, 000 and will include pavement widening, signals, interconnects and approach lighting. Once the intersection is improved, the City will be required to pay the energy costs for the signals and approach lighting and maintenance costs for the approach lighting. These costs are estimated at $600/year. Staff does not expect the purchase of right-of- way to be necessary. There is $670, 000 budgeted for both the intersection improvements and the construction of the west leg of the extension to Spartan Drive (project number 339514 , account numbers 270-0000-791 . 93-80 and 276-0000-791 . 93-80) . Additionally, our intergovernmental agreement with Elgin Community College indicates that they will share (50%) in intersection and construction costs of Randall Road and Spartan Drive. LEGAL IMPACT None. ALTERNATIVES None.
