RESOLUTION
AUTHORIZING EXECUTION OF A RESIDENCE LEASE
(1215 Amanda Circle)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, be and is hereby
authorized and directed to execute a residence lease with
Evergreen Real Estate Services, LLC for the premises commonly
known as 1215 Amanda Circle, Elgin, Illinois, a copy of which
is attached hereto and made a part hereof by reference .

FLAMMABLES 9. Naphtha, benzine benzole, gasoline, benzine-varnish,•geopewier, fireworks, nitroglycerine, phos-
phorus, saltpeter, nitrate o' soda, camphene, spirit-gas, or any flammable fluid or oil, shall not be allowed
or used on the Premises wi hout the written permission of the Lessor.
TAXES AND 10. Lessee shall pay (in addition to the rent above specified) all gas, electricity
UTILITIES and power bills, levied or .harged on or in respect of the Premises, for and during the term of this lease,
and in case no water taxes are levied specifically on or in respect of the Premises, to pay the no

rules and orders of the health officers thereof, with the •rders and requirements of the police department,
and with the rules and orhrs of the fire department in respect to any matters

RESIDENT OFFICER LEASE
ADDENDUM
This addendum is for the purpose of establishing the use and intent of the City of Elgin, a
municipal corporation, and the Elgin Police Department in leasing the premises known as 1215
Amanda Circle.
The town home 1215 Amanda Circle shall be a residence for an Elgin Police Officer and
his family. The Elgin Police Department shall notify managemiint as to the name of the
participating officer, prior to establishing of residence.
The City of Elgin shall provide lessor with no less than thirty days notice of its intent to
terminate this agreement.
The City of Elgin holds harmless Evergreen Real Estat I Services, LLC from any liability
for injuries or damage to property occurring as a direct result f any negligent act or omission of
the ROPE officer residing on the subject premises during the c nduct of official police business by
such ROPE officer inside the rental premises at 1215 Amandaircle. This agreement shall not be
construed so as to constitute a special duty to provide police services ces to lessor or any other third
party nor a requirement that the City of Elgin shall pay any attorney's fees.

LEASE ADDENDUM FOR DRUG-FREE HOUSING
In consideration of the execution or renewal of a lease
of the dwelling unit identified in the lease, Owner and Tenant
agree as follows :
1 . Tenant, any member of the tena t ' s household, or a
guest or other person under the tenant ' control shall not
engage in criminal activity, including dug-related criminal
activity, on or near project premises . "Drug-related criminal
activity" means the illegal manufacture, sale, distribution,
use or possession with intent to manufacture, sell ,
distribute, or use of a controlled substance (as defined in
section 102 of the Controlled Substances Act (21 U. S . C. 802) ) .
2 . Tenant , any member of the tenant ' s household, or a
guest or other person under the tenant ' s control shall not
engage in any act intended to facilitat6 criminal activity,
including drug-related criminal activity, regardless of
whether the individual engaging in such activity is a member
of the household or a guest .
3 . Tenant or members of the tenant ' s household will not
permit the dwelling unit to be used for, or to facilitate,
criminal activity, including drug-related criminal activity,
regardless of whether the individual engaing in such activity
is a member of the household or a guest .
4 . Tenant or members of the tenants household will not
engage in the manufacture, sale or distribution of illegal
drugs at any location, whether on or nea project premises or
otherwise .
5 . Tenant , any member of the tenant ' s household, or a
guest or other persons under the tenants control shall not
engage in acts of violence or threats of violence, including,
but not limited to, the unlawful discharge of firearms, on or
near project premises .
6 . VIOLATION OF THE ABOVE PROVISIONS SHALL BE A
MATERIAL VIOLATION OF THE LEASE AND GOOD CAUSE FOR TERMINATION
OF TENANCY. A single violation of any f the provisions of
this addendum shall be deemed a serious violation and a
material noncompliance with the lease . It is understood and
agreed that a single violation shall be good cause for
termination of the lease . Unless otherwlise provided by law,
proof of violation shall not require criminal conviction, but
shall be a preponderance of the evidence .
7 . In case of conflict between the provisions of this
addendum and any other provisions of the lease, the provisions
of the addendum shall govern.

8 . This Lease Addendum is incorporated into the lease
executed or renewed this day between Owner and Tenant .

SMOKE DETECTOR AGREEMENT
This Agreement entered into this / day of , S ,
1999, by and between TOWNHOMES OF THE MILL ( "P-OFE'TY" ) and
CITY OF ELGIN, Illinois, a municipal corporation ( "RESIDENT" ) ,
concerning the premises known as 1215 Amanda Circle, Elgin,
Illinois ( "PREMISES" ) .
The PREMISES is equipped with obe smoke detector.
RESIDENT agrees to test the smoke alarm weekly by pushing the
"TEST" button on the smoke detector for five seconds . The
alarm should sound when the button is pushed. If there is no
sound, RESIDENT will inform PROPERTY or authorized agent
immediately in writing.
OVBy initialing as provided, each RESIDENT understands
that it is the RESIDENT' S responsibility to insure that the
smoke detector is in operating condition at all times (which
includes replacing the battery as needed, if applicable) . If
the smoke detector will not operate, RESIDENT will inform
PROPERTY or authorized agent immediately.
RESIDENT acknowledges by signing this Agreement that they
have read and underst this Agreement . '

RULES AND REGULATIONd
These rules are for the benefit of all tenants and are a part
of the lease . Violations may cause termination of your lease .
1 . No pets are allowed in or around th building under any
circumstances without written conse t of the OWNER or
OWNER' S AGENT.
2 . All personal possession must be kept in the apartment .
Nothing is to be left outside the unit. overnight .
3 . Harassment of other tenants or any ctivity or behavior
which is disruptive to the securit or quiet of other
tenants is expressly prohibited.
4 . Parking is restricted to marked spaces in the parking
lots provided. At no time may any Ivehicle be parked on
the lawn or in marked "No Parking" areas, or blocking
throughways or fire exits, or it will be towed at the
owner ' s expense . Tenants should park their vehicles in
the lot that is directly in front of their buildings .
5 . Maintenance work on any motor driven vehicles and washing
on the premises is prohibited.
6 . Window dressing must be installed within 30 days of move
in. No sheets, blankets, flags or t4pestries may be used
after 30 days of move in.
7 . No noise, music or other sounds sh 11 be permitted any
any time in such a manner as to di turb or annoy other
occupants in the building.
8 . Laundry and drying apparatus shall be used in such a
manner and at such times as the OWNER or OWNER' S agent
may direct . Washers and dryers cainot be kept in the
apartments .
9 . No sign, illuminations, advertiserrent, notice or any
other lettering, or equipment shall be exhibited,
inscribed, painted, affixed or exosed in or at any
window or on any part of the outside or inside of the
apartment or the building without Prior written consent
of the OWNER or OWNER' S AGENT.
10 . The tenant shall not alter any lock or install a new
lock, or knocker or peephole, or ny other attachment
without the written consent of t e OWNER or OWNER' S
AGENT. A key must be provided to OWNER' S AGENT.
11 . No awnings or other projectiOns including air
conditioners, television or radio antennas, or wiring

shall be attached to or extend from the outside walls of
the building.
12 . Running extension cord wiring for electrical appliances
or fixtures in violation of the Municipal Code is
prohibited.
13 . No spikes, hooks, nails or two-way tape hangers shall be
driven into or affixed onto any woodork in the apartment
without first obtaining the written 6onsent of the OWNER
or OWNER' S AGENT.
14 . No furniture filled with liquor or semi-liquid substance
shall be brought in or used in the apartment .
15 . Children under the age of 13 iust be under the
supervision of a parent or a responsible individual over
the age of 14 whether indoors or outdoors .
16 . The cost of repairing damage to property which includes
non-approved painting and wallpaperirig, etc . traceable to
a member of the lease tenant will ipe deducted from the
damage deposit, or charged at the t 'me of the incident,
as is applicable .
17 . Guests of the lessee shall not be Snowed to reside in
the apartment longer than one (1) week (7) days without
written consent of the OWNER or OWNER' S AGENT.
18 . During winter months, the heat shall not be turned off in
the apartment unless an emergency exists were it is
necessary.
19 . Carpeting shall not be installed over existing carpet or
tile, nor shall it be removed or exchanged without
written consent of OWNER or OWNER' S AIGENT.
20 . Garbage must be placed inside the outdoor dumpsters
provided in parking lots . It should be wrapped in sealed
plastic bags . Littering in or 4round the building,
placing refuse in any common areas of the buildings or
storage lockers is expressly prohibited.
21 . Appliances furnished with the apartment may only be
replaced or exchanged by the OWNER or OWNER' S AGENT.
Damage to these appliances caused py misuse or neglect
will be charged to tenant . Also, mildew and
deterioriation caused by turning off refrigerators for
substantial length of time could result in replacement of
the appliance at the less expense .
22 . Rules and regulations regarding the swimming pool will be
issued prior to the summer season. Failure to comply

with set rules and regulations will result in the
revocation of privileges to use those amenities .
23 . Lockouts occurring between the hours of 5 : 00 p.m. and
8 : 00 a.m. , Monday through Friday, Saturday, Sunday,
Holidays, or when the office is clos d, will result in a
$20 . 00 charge to the tenant . Lockou s occurring between
the hours of 9 : 00 a.m. and 4 : 55 p.m. , will result in a
$10 . 00 charge to the tenant .
24 . (BARRED) Management has the right to bar individuals from
the property. You must inform guest (s) of all The Mill
Apartments rules and regulations . If rules and
regulations are broken by your guest they may be barred
and/or arrested for criminal trespa sing. If the rules
and regulations are broken by a res dent , it is grounds
for termination of tenancy.
25 . No trespassing or loitering is allowed on any common
areas of the property including (lput not limited to)
parking lots, streets, hallways and stairway.
26 . The electricity must be on at all times to prevent damage
to appliances .
27 . The toilet basins, and other plumbin fixtures shall not
be used for any other purpose other than for those which
they were designed. No diapers, sweepings, rubbish,
rags, or any other improper articles shall be thrown into
them. Any damage resulting from misuse of such
facilities shall be paid for by the tenant .
28 . Residents are required to allow OWNER or OWNER' S AGENT
access to their unit with proper notice, for the purpose
of exterminating. Residents are required to properly
prepare their apartments for such exterminations at OWNER
or OWNER' S AGENT' S request .
29 . Residents, residents ' children and residents ' guests may
be required to show identification when on the property.
All guests not accompanied by a resldent are required to
have identification available upon request by OWNER or
OWNER' S AGENT.
30 . Open alcoholic beverages are prohibited on any of the
common areas of the property includAng, but not limited
to the parking lots, streets, hallway , st irwells and

SUBJECT: ROPE Lease Agreement, 1215 Amanda Circle
PURPOSE
The purpose of this memorandum is to prov'de information for the
Mayor and City Council to consider entering into a lease agreement
with Evergreen Real Estate Services, LLC at The Mill apartment
complex for a ROPE site at 1215 Amanda Circle.
BACKGROUND
A new Resident Officer has been appointed to The Mill . Since this
officer has need for less space than the previous officer,
rk management has offered a two-bedroom t+house located at 1215
Amanda Circle . As has been past practice, this residence will be
provided rent-free to the City of Elgin. The lease period is August
1, 1999, through July 31, 2000 .
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
The Evergreen Real Estate Services, LLC concurs with the new ROPE
location at 1215 Amanda Circle.
ALFINANCIAL IMPACT
None . There will be no charge to the CitST for monthly rent .
LEGAL IMPACT
None .
ALTERNATIVES
The City could direct staff to look for alternative housing.

RECOMMENDATION
It is recommended that City Council apprve the lease agreement
between the City of Elgin and the Evergreen Real Estate Services,
Inc, LLC at The Mill .

Dear Council Members,
Please be advised that enclosed are the petitions for the purpose
of requesting a Resident Officer (ie. R.O.P.E. Officer).
We are before you this evening to request that you budget funds
to establish a resident officer, for the Grant Park Neighborhood,
in the coming year.
Violence has become all to familiar on many of our streets. Along with
intimidation,vandalism,prostitution and highly visible and constant gang and
drug activity.We have also experienced on a continual basis drunk drivers,hit
and run drivers , burglaries, assaults, domestic violence,abandoned vehicles,
transients loitering, urinating and deficating on many of our home owners lawns
or passed out due to drunkeness.
Currently we have been unsuccessful in receiving proper response times
to our calls from the police department, the average is 25-30 minutes.
The Elgin Police Department has failed to enforce loitering, speeding,
illegal parking, red taging abandoned vehicles in a timely manner,
littering, and noise disturbances, nor ticketing vehicles over the 73,000
pounds limit driving and parking on residential side streets.
Highland Avenue Liquors also known as Nick's Liquors was moved
to our neighborhood from Grove Ave. by the City. And since it has opened it has
become a constant lure for undesirables, frequent traffic congestion,
loud noise disturbances, fights, robberies, prostitution, drug sales, drunken
drivers,excessive litter and trash, broken bottles and glass .
We have 54% low to moderate income families and a large number of
EHA housing units within our boundaries. Many of the people residing
here do not supervise their children and lacking any park or play space these
children are playing in the street ,they have no positive role models
or structured activites.Thus, many of the children are at risk. These
are our kids,that are being conditioned to accept this type of inadequate and
unsafe enviroment. The placement of a rope officer would ease and lend
aid in providing a solution to these ills and aid us in better helping ourselves.

Petition for a R.O.P.E. Officer
The undersigned hereby are making it known to the City of Elgin (and its
representative government officials), the City of Elgin Police Department, and the
Chief of Police, that we request to have a R.O.P.E. officer assigned to live and
work within the boundaries of the neighborhood represented by the Grant Park
Neighborhood Association. All persons who have signed below are either members
of the Grant Park Neighborhood Association, or residents of the area represented by
the Association in this matter.
