FOR THE TYLER CREEK INTERCEPTOR SEWER PHASE V WHEREAS, the City of Elgin has heretofore entered into a contract with Kenny Construction Co. for the Tyler Creek Interceptor Sewer Phase V project; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Joyce A. ENGINEER's Project No. 980193/970068 You are directed to make the following changes in the Contract Documents: Description: 1. a)Add a 8-inch drop connection at invert elevation 837.50' to SA-MH 37 for $3,288.00. b)Add a 8-inch drop connection at invert elevation 841.50' to SA-MH 35 for $4,038.00. 2. Refer to Plan Sheet 8 of 8 dated 10/14/98 previously forwarded. The 36-inch interceptor sewer will be lowered 4-6 feet between SA-MH 40 to SA-MH 42. This will also change the depths of the shafts and SA-MH's 40, 41, and 42. The 24-inch drop connection in SA-MH 40 will be deleted. This change amounts to $ 78,550.74. 3. A 29 day time extension for Substantial Completion for Items 1 and 2 above. Purpose of Change Order: 1. IDI requested these changes to serve Elgin Corporate Center. 2. At the City's and Developer's request to provide future sanitary service to property owners in Phase VI. 3. See above. Subject: Elgin—Sanitary Sewer System Improvements Tyler Creek Interceptor Sewer Phase V Dear Mr. Pertzbom: Enclosed for your review and acceptance is Change Order No. 1 that has resulted on the referenced project and was not foreseeable prior to the project starting. Below we offer a discussion and our recommendation on the Contractor's requests: Change Order No.1 Item No.! In April of 1998,IDI's engineer notified us of their desire for us to include two 8-inch drop connections into sanitary manhole nos. 35 and 37. We anticipate IDI will propose to connect to these two stubs in the development of their property. This request was received at the same time the bids were due so we could not incorporate these changes into the original contract. We discussed this change with the contractor at the Pre- construction conference and they have since provided us with a cost proposal for the additional work. We have reviewed their proposal and documentation for this additional work and we find their costs to be reasonable. We recommend the City of Elgin approve $7,326.00 for this additional work. Change Order No. 1 Item No.2 At the request of the property owners in Phase VI,the City asked us to pursue with the Contractor the costs to lower the western most sections of the interceptor sewer in Phase V. This change may appear to be rather expensive at first glance,but the value of the original work between Manhole 40 —42 is $284,500. The proposed change amounts to an increase of 27% in total cost ($363,050.74) for this section of the interceptor sewer. The average depth of the interceptor in this area was to be 16 feet and we propose to lower it to almost 22 feet. WOODMAN May 27, 1999 Consulting Engineers Page 2 reasonable when one considers the complexity, safety concerns, and difficulty in working at these depths. The Contractor has provided clear and concise documentation for their costs and we recommend the City approve their proposal. We have included a table to help explain the changes in the unit prices and bid quantities to reflect the revised work. We recommend the City of Elgin approve$78,550.74 for this additional work. Change Order No. 1 Item No. 3 The Contractor has requested a time extension for Substantial Completion as a result of Item Nos. 1 and 2 impact on their project. They have worked diligently to meet the original deadline,but will not quite finish in time. Therefore,we recommend a 29-day time extension be granted to the Substantial Completion date making the date the Substantial Completion and Completion date of June 30, 1999. Summary We have combined these items into a single change order. We recommend the City of Elgin approve Change Order No. 1 in the amount of$85,876.84 for this additional work and grant a 29 day time extension to the Substantial Completion date. Application for temporary electrical service handed out by CorEd.;2)August 15, 1998,Baxter& Woodman contacts Kenny Construction Company with the award of Tyler Creek Phase V;3)August 17, 1998,application for temporary power mailed into ComEd for review;4) September 7, 1998,I contacted John Ardente about the status of temporary power and it was still being engineered,but should be ready in a week;5)September 14, 1998,Kenny Construction company receives Notice to Proceed;6) September 15,1998,approved application and invoice received by Kenny;7)September 16, 1998,Kenny Construction hand delivers check to ComEd with request for power in two weeks;8) September 30, 1998,no action from ComEd,but we should see action within the next two weeks.Kenny Construction sets temporary power pole and 400 AMP mini-sub;9)October 15& 16, 1998,ComEd out to install transformers and stretch cables; 10)October 19, 1998 meter is installed; 11)October 23, 1998,fuses are finally turned on.During all this waiting for ComEd we continued to mobilize and set up yards and roads.Throw in numerous phone calls during this period and I believe it shows that we were on the ball as far as staying in touch with ComEd. Delay number two is the excavation of MH-26. The shaft was layed out at its present location due to the close proximity of an 16"watermain and a 12-bank ComEd duct that were not indicated on any drawings (I found out after a joint meet with J-U-L-I-E to mark the entire project). The locationof the shaft was such that the east walers were resting on the existing manhole so we had to bust out as we advanced down. After the base of the manhole was busted out it was discovered that there was a 30"high base under the manhole base(pictures were taken of the obstruction).Total lost production three days. Delay number three was again caused by the 16"watermain and ComEd duct crossing over the top of our 60"jacked pipe tail tunnel.We jacked the first sixteen feet in two days. The second sixteen feet took three and one half days(encountered a lot of ground water in the pipe backfill that kept washing out and caving in).Due to the excessive ground water encountered pouring bulkheads and grouting took longer than anticipated.Total lost production two days. We are a little behind schedule,with better ground to sink shafts,production mining and open cut to start after the first of the year,I believe the delays in the schedule will be bridged. Parker, City Manager SUBJECT: Tyler Creek Interceptor Sewer - Phase V (TCIS-V) Change Order No. 1 PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider Change Order No. 1 for Tyler Creek Interceptor Sewer-Phase V. BACKGROUND At its August 12, 1998 meeting, the City Council approved the contract with Kenny Construction Company for the construction of the TCIS-V project . The TCIS will provide sewer to serve the Industrial Developments International (IDI) property as well as the City' s northwest planning area. Change Order No. 1 will add two additional contract items and extend the substantial contract completion date from June 1, 1999 to June 30, 1999 . Item No. 1 will provide two .8-inch lateral sewer connections to the 36-inch interceptor sewer. As part of the annexation agreement with IDI, the City agreed to provide these connections . However, because IDI did not provide any information regarding the proposed location of the connections until after construction began, they could not be included in the original contract documents. Item No. 1 is in the amount of $7, 326 . 00 . Item No. 2 will provide additional compensation to Kenny Construction to lower a 400-foot section of sewer from a proposed depth of 16 feet to 22 feet . Subsequent to the completion of the sewer design and start of construction, Chicago White Metal approached the City regarding development of property north of Big Timber Road and the IDI Development . In order to provide sewer service through the TCIS to the property Chicago White Metal proposes to develop, it is necessary to lower this section of the interceptor sewer. Item No. 2 is in the amount of $78, 550 . 74 . Due to the addition of the above two items, Kenny Construc- tion will not be able to meet the substantial completion date of June 1, 1999 . This change order will revise the substan- tial completion date to June 30, 1999 . In 1999, bonds were sold totalling $2 . 2 million for Phase VI of the Tyler Creek Interceptor Sewer project . These dollars could be used to fund this change order. The revised contract amount with Kenny Construction will be $3 , 481, 001 . 74 . Account number 399-4200-795 . 92-41, project number 399558, would be charged. . LEGAL IMPACT 11411/ None . ALTERNATIVES None. Below we offer a discussion and our recommendation on the Contractor's requests: Change Order No.! Item No.! rik In April of 1998,IDI's engineer notified us of their desire for us to include two 8-inch drop connections into sanitary manhole nos. 35 and 37. We anticipate IDI will propose to connect to these two stubs in the development of their property. This request was received at the same time the bids were due so we could not incorporate these changes into the original contract. We discussed this change with the contractor at the Pre- construction conference and they have since provided us with a cost proposal for the additional work. We have reviewed their proposal and documentation for this additional work and we find their costs to be reasonable. We recommend the City of Elgin approve $7,326.00 for this additional work. Change Order No. 1 Item No. 2 At the request of the property owners in Phase VI,the City asked us to pursue with the Contractor the costs to lower the western most sections of the interceptor sewer in Phase V. This change may appear to be rather expensive at first glance,but the value of the original work between Manhole 40 — 42 is $284,500. The proposed change amounts to an increase of 27% in total cost ($363,050.74) for this section of the interceptor sewer. The average depth of the interceptor in this area was to be 16 feet and we propose to lower it to almost 22 feet. The Contractor has provided clear and concise documentation for their costs and we recommend the City approve their proposal. We have included a table to help explain the changes in the unit prices and bid quantities to reflect the revised work. We recommend the City of Elgin approve$78,550.74 for this additional work. Change Order No. 1 Item No. 3 The Contractor has requested a time extension for Substantial Completion as a result of Item Nos. 1 and 2 impact on their project. They have worked diligently to meet the original deadline,but will not quite finish in time. Therefore,we recommend a 29-day time extension be granted to the Substantial Completion date making the date the Substantial Completion and Completion date of June 30, 1999. Summary We have combined these items into a single change order. We recommend the City of Elgin approve Change Order No. 1 in the amount of$85,8767)(4 for this additional work and grant a 29 day time extension to the Substantial Completion date.
