HomeMy WebLinkAbout99-121 Resolution No. 99-121 RESOLUTION APPROVING CHANGE ORDER NO. 4 IN THE CONTRACT WITH DRIESSEN CONSTRUCTION COMPANY FOR YWCA BUILDING REHABILITATION WHEREAS, the City of Elgin has heretofore entered into a contract with Driessen Construction Company for YWCA building rehabilitation; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 4, attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Joyce A. Parker, City Manager SUBJECT: Proposed Change Order No. 4 for Driessen Construction-YWCA of Elgin CDBG Project PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider Change Order No. 4 for Driessen Construction on the YWCA facility improvement project . BACKGROUND On September 23, 1998, the City Council awarded Driessen Construction Company a contract in the amount of $159, 860 to complete building improvements to the YWCA facility. A major portion of the project involves repair and replacement of deteriorated pool tunnel piping, decking, and conduit sys- tems . Work was initiated on November 16, 1998 . To date, the project is 95% complete . Replacement of the supply and return circulating lines for the pool was included in the project bid. However, during construction it was discovered that the underground drain line piping for the pool was leaking, which would require additional repairs, and that the check valve on the existing pump would require replacement (reference attached letter from Driessen Construction) . The YWCA of Elgin is extremely pleased with the contractor' s workmanship and the improvements completed. The budget for the 1998 YWCA CDBG project totals $182 , 621 . 67 . The project total includes previous administra- tive transfer of surplus funds from two completed YWCA CDBG projects : 1996 YWCA Building Rehabilitation ($1, 421 . 67) , project number 154206 , and 1997 YWCA Architectural Services, ($6200 . 00) , project number 154306 . If the proposed change order is approved, the total amended contract amount with Driessen Construction will be as follows : Original Contract : $159, 860 Change Order #1 : 208 * Change Order #2 : 11, 367 ** Change Order #3 : 1, 823 *** Change Order #4 : 8 , 944 Total $182, 202 * Removal of rusted door frame and closure of opening with concrete masonry. ** Replace deteriorated drain piping. *** Tie domestic water/pool fill line directly into 4 inch circulating line . 0 LEGAL IMPACT ���/ The City Council may authorize change orders to a contract as appropriate to complete project work. ALTERNATIVES None . RECOMMENDATION It is recommended that the City Council authorize execution of Change Order No. 4 in the amount of $8, 944 . 00 and request staff to execute the required change order document . This improvement is associated with building rehabilitation improvements at the YWCA of Elgin located at 220 E . Chicago Street . BASIS FOR CHANGE: During construction it was discovered that a section of drain line piping for the pool was leaking and requires repair. The check valve on the existing pump also requires replacement . FINDINGS: The pool renovations commenced on November 16, 1998 . The pool was closed, drained and work began on the pool systems within the pool tunnel . During construction the leaking drain line piping was discovered and requires repair in order to re-fill the pool and make the system safe . The repair of the drain piping line and the check valve was not reasonably foreseeable at the time the contract was signed. The change order is germane to the original contract signed and is in the best interest of the City and authorized by law. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of the contract will be revised as follows : Repair of 6 inch main drain line piping. $8 , 203 . 00 Replace check valve on existing pump . 741 . 00 $8 , 944 . 00 The original contract with Driessen Construction Company was for $159, 860 . Previous Change Order #1 added $208, Change Order #2 , added $11, 367, Change Order #3 added $1, 823 totaling $173 , 258 . Change Order #4 will increase the contract amount by $8 , 944 for a total of $182 , 202 . CHANGE IN CONTRACT TIME: No further adjustments to the Contract Times shall be given for work completed under this and previous change orders . r ACCEPTANCE: The changes and conditions set forth in this Change Order No. 4 are hereby accepted. All other provisions of the Contract remain unchanged.
